<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 3040</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211021">October 21, 2021</action-date><action-desc><sponsor name-id="S351">Mr. Toomey</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Fannie Mae and Freddie Mac from purchasing or otherwise acquiring investor property loans, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No GSE Subsidies for Investor Properties Act</short-title></quote>.</text></section><section id="id68F3AC2D4A7E45CEB141DF6812EC35BE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idBF7475CCB0234EBF975B93371B442A47"><enum>(1)</enum><header>Conventional mortgage</header><text>The term <term>conventional mortgage</term> has the meaning given the term in section 302(i) of the Federal Home Loan Mortgage Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1451">12 U.S.C. 1451(i)</external-xref>).</text></paragraph><paragraph id="idA5C8CA419F0446B3B7774C0900B9AFC3"><enum>(2)</enum><header>Enterprise</header><text>The term <term>enterprise</term> has the meaning given the term in section 1303 of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4502">12 U.S.C. 4502</external-xref>).</text></paragraph><paragraph id="id58F1701E44B34FE0B57D8A225D26EDE0"><enum>(3)</enum><header>Investor property loan</header><text>The term <term>investor property loan</term> means a conventional mortgage secured by a property comprising 1-to-4 family dwelling units that is not the principal residence or a second home of the borrower.</text></paragraph></section><section id="id82d627e59188415da75dae20e50a75f0"><enum>3.</enum><header>Prohibition on purchase or acquisition of investor property loans</header><subsection id="id862740f526f24e6fbf15b6f2ef0c32f9"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, including the Federal National Mortgage Association Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1716">12 U.S.C. 1716 et seq.</external-xref>) or the Federal Home Loan Mortgage Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1451">42 U.S.C. 1451 et seq.</external-xref>), on and after the date that is 18 months after the date of enactment of this Act, an enterprise may not purchase or otherwise acquire an investor property loan.</text></subsection><subsection id="ida15a15ddd4dc438a9f33e21d06a1bea1"><enum>(b)</enum><header>Transition plans</header><text>The Federal Housing Finance Agency shall require each enterprise to develop and implement a plan to gradually reduce the purchase and acquisition of investor property loans by the enterprise to achieve compliance with subsection (a) while mitigating the risk of disruption to the housing finance market in the United States.</text></subsection></section></legis-body></bill>
