which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to modify certain allotments under that Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Water Allotment Modernization Act of 2021</short-title></quote>.</text></section><section id="idC5E60C9AC4DE48AABC8F9F66D16DFED3"><enum>2.</enum><header>Modification to allotments under the Federal Water Pollution Control Act</header><text display-inline="no-display-inline">Section 205 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1285">33 U.S.C. 1285</external-xref>) is amended by striking the section designation and heading and all that follows through the end of subsection (a) and inserting the following:</text><quoted-block id="id3A1C3D450C254F6AABAB371C22734D03" style="OLC" act-name=""><section id="idFE4BAA7B5A7F4F788EEDC05BD7A84090" section-type="subsequent-section"><enum>205.</enum><header>Allotments</header><subsection id="id98A9446B98D64723BC64DADC252DBBD3"><enum>(a)</enum><header>In general</header><paragraph id="id8B791B73F40347E7BD89C2DDD4CFA7B2"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id60AA593ED485438EA1CC71A1354E2F7D"><enum>(A)</enum><header>Buy American oversight</header><text>The term <term>Buy American oversight</term> means any activity carried out by the Administrator for the purposes of management or oversight with respect to section 608.</text></subparagraph><subparagraph id="idE8696FC964FD407E9836E6913B4C0621"><enum>(B)</enum><header>Clean watersheds needs survey</header><text>The term <term>clean watersheds needs survey</term> means the detailed estimate prepared by the Administrator under section 516(b)(1)(B).</text></subparagraph><subparagraph id="id5B0FD18911224766B99F17BC23D10060" commented="no"><enum>(C)</enum><header>State</header><text>The term <term>State</term> means—</text><clause commented="no" id="idE7AC994A766D411297F66D93DBD3CF1A"><enum>(i)</enum><text>each of the 50 States;</text></clause><clause commented="no" id="id279E0AC92C1745CF978508DD7F9AD273"><enum>(ii)</enum><text>the District of Columbia; and</text></clause><clause commented="no" id="idE63B3FF21C3A40898E5AD7BE4B7B6CBA"><enum>(iii)</enum><text>the Commonwealth of Puerto Rico.</text></clause></subparagraph><subparagraph id="id144709500A6E4F85BD76DD6CC3A3DBCA"><enum>(D)</enum><header>United States territory</header><text>The term <term>United States territory</term> means—</text><clause id="id02F83041C21446FA8CD20DCBFECC6914"><enum>(i)</enum><text>American Samoa;</text></clause><clause id="idD2D65B5003B94919979CF0A75B417965"><enum>(ii)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></clause><clause id="id96EEBFD458574E1EA3DDB875C2A137F6"><enum>(iii)</enum><text>the United States Virgin Islands; and</text></clause><clause id="idE5F32376455F436A97A59BD18C389EBA"><enum>(iv)</enum><text>Guam.</text></clause></subparagraph></paragraph><paragraph id="idFC0E77310E1040ED832F8197EC5F1AA4"><enum>(2)</enum><header>Fiscal years 2022 through 2026</header><subparagraph id="idAD888BF2F27B45A4996AD4CC36969D56"><enum>(A)</enum><header>Buy American oversight</header><text>For each of fiscal years 2022 through 2026, of the amounts made available to carry out this section for a fiscal year, the Administrator shall provide an allotment of not less than 0.1 percent for Buy American oversight.</text></subparagraph><subparagraph id="idC5615A9709DE4A05A50BF7CFB1B2CA07"><enum>(B)</enum><header>Initial allotments to States</header><text>For each of fiscal years 2022 through 2026, of the amounts made available to carry out this section for a fiscal year, the Administrator shall provide an allotment to each State in an amount that is not less than the amount received by the State under this section in fiscal year 2021.</text></subparagraph><subparagraph id="id44AA9D709F9D4E1EBA06425B924AD8AF"><enum>(C)</enum><header>Additional allotments to States</header><text>Notwithstanding any other provision of this section, for each of fiscal years 2022 through 2026, of the amounts made available to carry out this section for a fiscal year that remain available after application of subparagraph (B), the Administrator shall provide an additional allotment to each State in an amount that is based on the proportion that, as determined using the most recently published annual estimate of the Bureau of the Census—</text><clause id="id1FC133F7A3CD4B6C9DBCB26196234F03"><enum>(i)</enum><text>the population of the State; bears to</text></clause><clause id="id9F89C475FB5F40C39E30F6342757EBC0"><enum>(ii)</enum><text>the total population of all States.</text></clause></subparagraph><subparagraph id="id8C54825D05964296B5610ED66CF98C3A"><enum>(D)</enum><header>Allotments to Indian tribes</header><text>For each of fiscal years 2022 through 2026, of the amounts made available to carry out this section for a fiscal year, the Administrator shall provide an allotment of 2 percent to Indian tribes.</text></subparagraph><subparagraph id="idBF52199CAB9744218034F692E74FEC3E"><enum>(E)</enum><header>Allotments to United States territories</header><text>For each of fiscal years 2022 through 2026, of the amounts made available to carry out this section for a fiscal year, the Administrator shall provide an allotment of 1.5 percent to United States territories.</text></subparagraph></paragraph><paragraph id="idBDA431A3385D40CFB7B7B5735F757046"><enum>(3)</enum><header>Subsequent fiscal years</header><subparagraph id="id4F95452C181D487AA5F2B2E79D9564E8"><enum>(A)</enum><header>In general</header><text>For fiscal year 2027 and each fiscal year thereafter, in allotting amounts made available to carry out this section for a fiscal year, the Administrator shall use an updated allotment formula consistent with subparagraph (B).</text></subparagraph><subparagraph id="id431A5402C1D04F67963F9EC738F248DB"><enum>(B)</enum><header>Formula</header><clause id="idE829ACC980444361971B704EA9E22F72"><enum>(i)</enum><header>Development</header><text>The Administrator shall, by regulation, develop a formula—</text><subclause id="id79BB192FD1FB4B6E981F5E2EBF750D9C"><enum>(I)</enum><text>for the calculation of allotments of amounts made available to carry out this section for a fiscal year to States in accordance with clause (ii); and</text></subclause><subclause id="id0B18C6C786E541C9945DE2B02896C8BE"><enum>(II)</enum><text>that includes allotments of amounts made available to carry out this section for a fiscal year—</text><item id="id08201A0F3DC84024803ACA94C2265F61"><enum>(aa)</enum><text>to provide to Indian tribes in accordance with clause (iii);</text></item><item id="id605097526FD24265BC1018177904A6EF"><enum>(bb)</enum><text>to provide to United States territories in accordance with clause (iv); and</text></item><item id="id6230F83F41074A9896F29781E3C9F92F"><enum>(cc)</enum><text>for Buy American oversight in accordance with clause (v).</text></item></subclause></clause><clause id="id35CDBBEF46B4470ABBF0B53E030F9734"><enum>(ii)</enum><header>Allotments for States</header><text>In developing the formula required under subparagraph (A) for the allotments described in clause (i)(I), the Administrator shall—</text><subclause id="id7BD5345867D5469BAEAB9CD4DF7B2CA0"><enum>(I)</enum><text>base the formula on the needs of the States, as identified in the most recently available clean watersheds needs survey; and</text></subclause><subclause id="idB610A22FF48D486791AD7D759508FDBF"><enum>(II)</enum><text>ensure that each State receives not less than 1 percent of the amounts made available to carry out this section for a fiscal year.</text></subclause></clause><clause id="id51FDEA9C11614FB0BF664AD9D259494D"><enum>(iii)</enum><header>Allotments for Indian tribes</header><text>In developing the formula required under subparagraph (A) for the allotments described in clause (i)(II)(aa), the Administrator shall provide 2 percent of the amounts made available to carry out this section for a fiscal year to Indian tribes.</text></clause><clause id="id3108C6ADC61C45E5816CF4E77F6A9698"><enum>(iv)</enum><header>Allotments for United States territories</header><text>In developing the formula required under subparagraph (A) for the allotments described in clause (i)(II)(bb), the Administrator shall provide 1.5 percent of the amounts made available to carry out this section for a fiscal year to United States territories.</text></clause><clause id="id496776040FC14B388F139B3E2662459A"><enum>(v)</enum><header>Buy American oversight</header><text>In developing the formula required under subparagraph (A) for the allotments described in clause (i)(II)(cc), the Administrator shall ensure that 0.1 percent of the amounts made available to carry out this section for a fiscal year are used for Buy American oversight.</text></clause></subparagraph><subparagraph id="id838E2C5D31964805992C724530BA64CC"><enum>(C)</enum><header>Timeline</header><clause id="id7506FE1623554939B8ED3B2DC3B02E41"><enum>(i)</enum><header>Initial formula</header><text>The Administrator shall develop the initial formula required under subparagraph (A) by not later than September 30, 2026, to ensure that the formula is in effect for fiscal year 2027.</text></clause><clause id="id83733EE18ABE4AE29B2280A904070DBC"><enum>(ii)</enum><header>Updates required</header><text>After developing the formula required under subparagraph (A) by the date described in clause (i), the Administrator shall update that formula by not later than the date that is 1 year after the date on which the Administrator submits a new clean watersheds needs survey to Congress.</text></clause></subparagraph></paragraph><paragraph id="id02E9C31C1BE1407FBC679E64AEDD9284"><enum>(4)</enum><header>Savings provision</header><text>To the extent practicable, the Administrator shall continue developing the allotment formula under paragraph (2) until the date on which the Administrator submits to Congress a new clean watersheds needs survey for purposes of the formula required under paragraph (3)(A).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id48CDA5CA428A4F078FE34F35D03D5B4A"><enum>3.</enum><header>Clean watersheds needs survey</header><text display-inline="no-display-inline">Section 516(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1375">33 U.S.C. 1375(b)</external-xref>) is amended—</text><paragraph id="id100669F633224EBBAF6EF687B6A7EAD8"><enum>(1)</enum><text>by striking paragraph (2);</text></paragraph><paragraph id="id25DAE91808AB43A9B4EFF266E46782E7"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="id8CEFC9C42DE54AEBA09E654F9FD6EF8C"><enum>(A)</enum><text display-inline="yes-display-inline">in the third sentence, by striking <quote>Whenever the Administrator,</quote> and inserting the following:</text><quoted-block id="idFB98D0D7335B41A998B5078126265DB9" style="OLC" act-name=""><paragraph id="id2B45E038F3074BF8AF431DD52BA0A748"><enum>(3)</enum><header>Submission to Congress</header><text>Whenever the Administrator,</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id42656B15E62C4F3E9DB135A452CF77C0"><enum>(B)</enum><text>in the second sentence, by striking <quote>The Administrator shall</quote> and inserting the following:</text><quoted-block id="id14DAB6C31F144ECA86904EE06AD99213" style="OLC" act-name=""><paragraph id="id6BE20E6DE86E4ABEB18817F7E34C09B2"><enum>(2)</enum><header>Deadline</header><text>The Administrator shall</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id6EAC8155F9F54A5FACB1765B7B0F6B40"><enum>(3)</enum><text>by striking the subsection designation and all that follows through <quote>The Administrator,</quote> in paragraph (1) and inserting the following:</text><quoted-block id="idACA3AC93AF2F42AF98E491A12FD50F8D" style="OLC" act-name=""><subsection id="id367ED422636841E28BCE4FB0D0544219"><enum>(b)</enum><header>Estimates; studies; analyses</header><paragraph id="id581E632E3ADF4897BA93368B77D8C580"><enum>(1)</enum><header>In general</header><text>The Administrator,</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id4D4E0978DD974FF5A119A2667E5A2321"><enum>(4)</enum><text>in paragraph (1) (as so amended)—</text><subparagraph id="idB9B8AC1CF51D47C3B79A5D09CF54B31E"><enum>(A)</enum><text>by striking <quote>; and (D) a comprehensive</quote> and inserting the following: </text><quoted-block id="id3F0F885470534B2DBA2364C60468E00E" style="OLC" act-name="" display-inline="yes-display-inline"><text>; and</text><subparagraph id="idF7E686C481044A829E582FF2FCBB5E36"><enum>(D)</enum><text>a comprehensive</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id0DBD792B0D514F87A35D43BC9F049BAA"><enum>(B)</enum><text>by striking <quote>(C) a comprehensive</quote> and inserting the following:</text><quoted-block id="idA30F8E3ACC76490BA863BA1FD83580EA" style="OLC" act-name=""><subparagraph id="idCB0650E25E134F00BB05B7B79D23D6CD"><enum>(C)</enum><text>a comprehensive</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idDC99503C27674B6283B1BEC130E688F0"><enum>(C)</enum><text>by striking <quote>(B) a detailed estimate</quote> and all that follows through <quote>in each of the States;</quote> and inserting the following:</text><quoted-block id="id5A288746273744D8A89F133B31C896AD" style="OLC" act-name=""><subparagraph id="idD12B6944578546509AE1DDBC31C7BAA3"><enum>(B)</enum><text>a detailed estimate, biennially revised, of the cost of construction of all planned publicly owned treatment works in each State, and all needed publicly owned treatment works in each State, which shall include a detailed estimate of—</text><clause id="idE03487C1DA46433FBB4AA76EC5382875"><enum>(i)</enum><text>the cost of construction for rehabilitating or upgrading all existing publicly owned treatment works (excluding any pipe or other device or system for the conveyance of wastewater) every 20 years, including the cost of implementing measures necessary to address the resilience and sustainability of publicly owned treatment works to manmade or natural disasters; and</text></clause><clause id="idB18E55907B7848818AA2140BA8DFB8C7"><enum>(ii)</enum><text>the cost of construction for replacing 10 percent of existing publicly owned pipes and other devices and systems for the conveyance of wastewater to publicly owned treatment works over the 20-year period following the date of the estimate;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idA97A7663FC1643B0B7F2D441CB731B0F"><enum>(D)</enum><text>by striking <quote>shall make (A) a detailed estimate</quote> and inserting the following: </text><quoted-block id="id8912F6CDA3A34F9B8C4A89FFA4060077" style="OLC" act-name="" display-inline="yes-display-inline"><text>shall make—</text><subparagraph id="id878FB6FA32DD413B9E70C901390D3A0B"><enum>(A)</enum><text>a detailed estimate</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id748F7C57BD13470BAE8005D192EAD836"><enum>4.</enum><header>Additional eligible use of allotted funds</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id8A26A1BCC37A47E4B420D96EDE41BA70" style="OLC" act-name=""><subsection id="id1E144F7605B04EAEA954109451207403"><enum>(k)</enum><header>Additional eligible use of allotted funds</header><text>Notwithstanding any other provision of this section, each fiscal year, a State may reserve up to 0.5 percent of the amounts allotted to the State under this title and section 205(m) for that fiscal year to carry out activities necessary to create the detailed estimate under section 516(b)(1)(B).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
