STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title VI of the Social Security Act to allow States and local governments to use coronavirus relief funds provided under the American Rescue Plan Act for infrastructure projects, improve the Local Assistance and Tribal Consistency Fund, provide Tribal governments with more time to use Coronavirus Relief Fund payments, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="id9AAD6EE8A3764EA8BA2E8589B2A3969A" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State, Local, Tribal, and Territorial Fiscal Recovery, Infrastructure, and Disaster Relief Flexibility Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id0EC7F32A1C5C46A9BADA62191B1A835D" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Authority to use coronavirus relief funds for infrastructure projects</header><subsection id="id67FEE0C941EC41569A61D86441A89E36" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801 et seq.</external-xref>), as amended by section 40909 of the Infrastructure Investment and Jobs Act, is amended—</text><paragraph id="id3C68EEE946AA4B8BA56C368A2CEC2211" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in section 602—</text><subparagraph id="id2A36230C2FEB4A68B1B45185C63C7888" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by inserting <quote>(except as provided in subsection (c)(5))</quote> after <quote>December 31, 2024</quote>; and</text></subparagraph><subparagraph id="idFF5E2B06F31E442AA05184AD55443C53" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><clause id="id6FC051D348EE4D2FA0CF4478EEB8706C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subclause id="id9C7633EB15664C9A93B42E1792B39190" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>paragraph (3)</quote> and inserting <quote>paragraphs (3), (4), and (5)</quote>;</text></subclause><subclause id="idD95D2B79E80944088C35057131F6F486" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">by amending subparagraph (C) to read as follows:</text><quoted-block id="id60C4D248983849DD864B51BAE255E4D3" style="OLC" act-name="" display-inline="no-display-inline"><subparagraph id="id096C29ADA5C44E89B0D85364719393BF" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">for the provision of government services up to an amount equal to the greater of—</text><clause id="idEFD5FF70EE4941379EE9EE6B4A264804" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of the reduction in revenue of such State, territory, or Tribal government due to the COVID–19 public health emergency relative to revenues collected in the most recent full fiscal year of the State, territory, or Tribal government prior to the emergency; or</text></clause><clause id="id4B3734367FF64FCA8368CEEA9C7B752D" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">$10,000,000;</text></clause></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subclause><subclause id="id6847A941ACFA4947900A5196168BE041" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></subclause><subclause id="id4A2CA47B9D5441F29703744715FB5951" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id656FF7E2CE5D49C0A0CE0DB91E3789F7"><subparagraph id="id8A706D94F5284436B7056AA2EDDF1EEA" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">to provide emergency relief from natural disasters or the negative economic impacts of natural disasters, including temporary emergency housing, food assistance, financial assistance for lost wages, or other immediate needs.</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subclause></clause><clause id="id5331B0AE57504608BB3767D514707CB2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph: </text><quoted-block id="idE79673F0AD25465C8ABED22EBA277CBB" style="OLC" act-name="" display-inline="no-display-inline"><paragraph id="id585CF9B311AE4DA2976A283506D80710" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Authority to use funds for certain infrastructure projects</header><subparagraph id="id1D909579B677493084043C9AFAE6627D" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (C), notwithstanding any other provision of law, a State, territory, or Tribal government receiving a payment under this section may use funds provided under such payment for projects described in subparagraph (B), including, to the extent consistent with guidance or rules issued by the Secretary or the head of a Federal agency to which the Secretary has delegated authority pursuant to subparagraph (C)(iv)—</text><clause id="idCA9E4EFDCC284DC3BAC748847013E073" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a project eligible under section 117 of title 23, United States Code, or section 5309 or 6701 of title 49, United States Code, to satisfy a non-Federal share requirement applicable to such a project; and</text></clause><clause id="id6DBEB563BD524C7D8BA530DAD9793CDF" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a project eligible for credit assistance under the TIFIA program under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23, United States Code—</text><subclause id="idEFD41186982F44D9BB6BAC58AC46ABDC" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">to satisfy a non-Federal share requirement applicable to such a project; and</text></subclause><subclause id="idEC4C58AB386A404BA4421BE39CE35094" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">to repay a loan provided under such program.</text></subclause></clause></subparagraph><subparagraph id="id21EE32CF4B854561A860408447492388" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Projects described</header><text display-inline="yes-display-inline">A project referred to in subparagraph (A) is any of the following:</text><clause id="id7CAA3C0DD33C4BE88207F83A8DD6B8BF" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">A project eligible under section 117 of title 23, United States Code. </text></clause><clause id="id9AA96EFD74A849CFB61F12B5B7717821" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">A project eligible under section 119 of title 23, United States Code.</text></clause><clause id="idA42E06523D544A4199299AA70591D80E" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">A project eligible under section 124 of title 23, United States Code, as added by the Infrastructure Investment and Jobs Act.</text></clause><clause id="idC7F353FE5B47460BB8F8EB329A9E6A8A" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">A project eligible under section 133 of title 23, United States Code. </text></clause><clause id="idD61D3E8670E84C1F958B762C25259582" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">An activity to carry out section 134 of title 23, United States Code. </text></clause><clause id="idC12E9604B2EE4601A5DBB4223289607A" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">A project eligible under section 148 of title 23, United States Code. </text></clause><clause id="id04861AC87FD840FBAD98C3B5D03EC92A" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">A project eligible under section 149 of title 23, United States Code.</text></clause><clause id="idB8DE8384D2924A89B4C5FB5E897241B5" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">A project eligible under section 151(f) of title 23, United States Code, as added by the Infrastructure United States Code, as added by the Infrastructure Investment and Jobs Act. </text></clause><clause id="id33A40DEC73CC416986C40DE127F4B83C" commented="no" display-inline="no-display-inline"><enum>(xii)</enum><text display-inline="yes-display-inline">A project eligible under section 175 of title 23, United States Code, as added by the Infrastructure display-inline="yes-display-inline">A project eligible under section 176 of title 23, United States Code, as added by the Infrastructure Investment and Jobs Act. </text></clause><clause id="id0AA576E8F4044A6FB9FBD60EC0E65AB2" commented="no" display-inline="no-display-inline"><enum>(xiv)</enum><text display-inline="yes-display-inline">A project eligible under section 202 of title 23, United States Code. </text></clause><clause id="idFED179903D344ED9B59D085F2DBBA34A" commented="no" display-inline="no-display-inline"><enum>(xv)</enum><text display-inline="yes-display-inline">A project eligible under section 203 of title 23, United States Code.</text></clause><clause id="idDABA63C4EE7B4725A0ED1614E4131DC8" commented="no" display-inline="no-display-inline"><enum>(xvi)</enum><text display-inline="yes-display-inline">A project eligible under section 204 of title 23, United States Code. </text></clause><clause id="idD5022F9192A54500BC10C080FB7F452E" commented="no" display-inline="no-display-inline"><enum>(xvii)</enum><text display-inline="yes-display-inline">A project eligible under the program for national infrastructure investments (commonly known as the <quote>Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grant program</quote>). </text></clause><clause id="id96E584072DC44FA6920FE14C2B4B6677" commented="no" display-inline="no-display-inline"><enum>(xviii)</enum><text display-inline="yes-display-inline">A project eligible for credit assistance under the TIFIA program under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23, United States Code.</text></clause><clause id="id379AB201088143B9BA9E78EDCF9B3496" commented="no" display-inline="no-display-inline"><enum>(xix)</enum><text display-inline="yes-display-inline">A project that furthers the completion of a designated route of the Appalachian Development Highway System under section 14501 of title 40, United States Code.</text></clause><clause id="idDA5F3F64C3704F96BB0FE7DD4C092DE5" commented="no" display-inline="no-display-inline"><enum>(xx)</enum><text display-inline="yes-display-inline">A project eligible under section 5307 of title 49, United States Code. </text></clause><clause id="idAC3E856AD60949B4A5E1FE5B07244CC2" commented="no" display-inline="no-display-inline"><enum>(xxi)</enum><text display-inline="yes-display-inline">A project eligible under section 5309 of title 49, United States Code.</text></clause><clause id="idA6EF478677FB41B882F8A96A59934230" commented="no" display-inline="no-display-inline"><enum>(xxii)</enum><text display-inline="yes-display-inline">A project eligible under section 5311 of title 49, United States Code. </text></clause><clause id="idCBC35C8B8092465387DAAFC2D1323C2B" commented="no" display-inline="no-display-inline"><enum>(xxiii)</enum><text display-inline="yes-display-inline">A project eligible under section 5337 of title 49, United States Code.</text></clause><clause commented="no" display-inline="no-display-inline"><enum>(xxvi)</enum><text display-inline="yes-display-inline">A project eligible under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>). </text></clause><clause id="id1BE8232B444848F98B4F05F1A2B2845B" commented="no" display-inline="no-display-inline"><enum>(xxvii)</enum><text display-inline="yes-display-inline">A project eligible under the bridge replacement, rehabilitation, preservation, protection, and construction program under paragraph (1) under the heading <quote><header-in-text style="appropriations" level="appropriations-small">highway infrastructure program</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-intermediate">Federal highway administration</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-major">Department of Transportation</header-in-text></quote> under title VIII of division J of the Infrastructure Investment and Jobs Act.</text></clause></subparagraph><subparagraph id="id2CA7A744411642DDAECFF94277435EEA" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Limitations; application of requirements</header><clause id="idA252850E5698454EBBCFEF9CE7D213E1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Limitation on amounts to be used for infrastructure projects</header><subclause id="id4FC25C24F4814BD68E3D9B30BDDFC328" commented="no" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The total amount that a State, territory, or Tribal government may use from a payment made under this section for uses described in subparagraph (A) shall not exceed the greater of—</text><item id="id48623D0917A645EDB66F66E6E2A336E8" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">$10,000,000; and</text></item><item id="idF82552F373C34732BE754B1B50069D54" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">30 percent of such payment.</text></item></subclause><subclause id="id1EBB393F20F940F58E5C8EB4EAAEA5FE" commented="no" display-inline="no-display-inline"><enum>(II)</enum><header display-inline="yes-display-inline">Rule of application</header><text display-inline="yes-display-inline">The spending limitation under subclause (I) shall not apply to any use of funds permitted under paragraph (1), and any such use of funds shall be disregarded for purposes of applying such spending limitation. </text></subclause></clause><clause id="id51E85CE51B77477E8B4B9F1DB9E3E090" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Limitation on operating expenses</header><text display-inline="yes-display-inline">Funds provided under a payment made under this section shall not be used for operating expenses of a project described in clauses (xx) through (xxiv) of subparagraph (B).</text></clause><clause id="idE0CD146E8CA1490C9294B2B829748FB3" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Application of requirements</header><text display-inline="yes-display-inline">Except as otherwise determined by the Secretary or the head of a Federal agency to which the Secretary has delegated authority pursuant to clause (iv) or provided in this section—</text><subclause id="id5BA8494853D745C09EBA0EA4A04BB89F" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the requirements of section 60102 of the Infrastructure Investment and Jobs Act shall apply to funds provided under a payment made under this section that are used pursuant to subparagraph (A) for a project described in clause (xxvi) of subparagraph (B) that relates to broadband infrastructure;</text></subclause><subclause id="ide9dfaf8755924322b6611c0baea1b7d6" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the requirements of titles 23, 40, and 49 of the United States Code, title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), and the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et. seq) shall apply to funds provided under a payment made under this section that are used for projects described in subparagraph (B); and</text></subclause><subclause id="id793169c9119648288b8100c25a3405de" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">a State government receiving a payment under this section may use funds provided under such payment for projects described in clauses (i) through (xxvii) of subparagraph (B), as applicable, that—</text><item id="idafc494bc60624a35858415e26b3c59b5" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">demonstrate progress in achieving a state of good repair as required by the State’s asset management plan under section 119(e) of title 23, United States Code; and</text></item><item id="idf521399279684643855d2c26b296f073" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">support the achievement of 1 or more performance targets of the State established under section 150 of title 23, United States Code.</text></item></subclause></clause><clause id="id21A35841B262413A9B713DD325C9EFF2" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Oversight</header><text display-inline="yes-display-inline">The Secretary may delegate oversight and administration of the requirements described in clause (iii) to the appropriate Federal agency.</text></clause><clause id="id34A29A96607443BFB8BA4C9CAA342ACC" commented="no" display-inline="no-display-inline"><enum>(v)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Amounts from a payment made under this section that are used by a State, territory, or Tribal government for uses described in subparagraph (A) shall supplement, and not supplant, other Federal, State, territorial, Tribal, and local government funds (as applicable) otherwise available for such uses.</text></clause></subparagraph><subparagraph id="id083D85B47E5947A9ADA6627665F1045E" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Transportation, shall provide periodic reports on the use of funds by States, territories, and Tribal governments under subparagraph (A).</text></subparagraph><subparagraph id="id7DE6106BAECD4C9186476DD13FA9C47F" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Funds provided under a payment made under this section to a State, territory, or Tribal government shall remain available for obligation for a use described in subparagraph (A) through December 31, 2024, except that no amount of such funds may be expended after September 30, 2026.</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id2EBB3BD242F8462586CF598A605F2E1E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection 603—</text><subparagraph id="idF0B361ABCA3045B4B817732E3184EE52" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by inserting <quote>(except as provided in subsection (c)(6))</quote> after <quote>December 31, 2024</quote>; and</text></subparagraph><subparagraph id="id31324A3291794F008F85BB7D082A43CA" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><clause id="idB0CB2CC82EEB4CE08E3C75E300F1C282" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subclause id="id1C0A3D2C6FD94227BC3CAB3FC29EEC24" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>paragraphs (3) and (4)</quote> and inserting <quote>paragraphs (3), (4), (5), and (6)</quote>;</text></subclause><subclause id="id844D00E73C5F427081E24EFFB4E53FC3" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">by amending subparagraph (C) to read as follows:</text><quoted-block id="id4AD46862E4C748EBA2B08A4488BFDDE8" style="OLC" act-name="" display-inline="no-display-inline"><subparagraph id="id016C1792290D444FA7A06A2CAD42B405" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">for the provision of government services up to an amount equal to the greater of—</text><clause id="id23C6D735D1124BBFB2037608D0A7B37C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of the reduction in revenue of such metropolitan city, nonentitlement unit of local government, or county due to the COVID–19 public health emergency relative to revenues collected in the most recent full fiscal year of the metropolitan city, nonentitlement unit of local government, or county to the emergency; or</text></clause><clause id="id4CD07930D0954D5BB3252C944B3442DF" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">$10,000,000;</text></clause></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subclause><subclause id="id9B05AFDCA99245A59EC4437067AEEDD9" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></subclause><subclause id="id17DBE59480C6432E88D01EDFE378C274" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA4C6BA38B9EA4660A47245473AB6D847"><subparagraph id="idFCD55BD257BF4F3A9E6F654EF415C0D6" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">to provide emergency relief from natural disasters or the negative economic impacts of natural disasters, including temporary emergency housing, food assistance, financial assistance for lost wages, or other immediate needs.</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subclause></clause><clause id="id3BFB64A99B874C9BA90F09B9151DFDD0" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id660DA4825E274300B72623DED8814B78"><paragraph id="idC2E36052FE884103B6453CDAE0B12CEC" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Authority to use funds for certain infrastructure projects</header><subparagraph id="id60F99335832F477CBE6E31888C5DF9A9" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), notwithstanding any other provision of law, a metropolitan city, nonentitlement unit of local government, or county receiving a payment under this section may use funds provided under such payment for projects described in subparagraph (B) of section 602(c)(5), including, to the extent consistent with guidance or rules issued by the Secretary or the head of a Federal agency to which the Secretary has delegated authority pursuant to subparagraph (B)(iv)— </text><clause id="id221BB40609944902BCEF98600E8F8AF1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a project eligible under section 117 of title 23, United States Code, or section 5309 or 6701 of title 49, United States Code, to satisfy a non-Federal share requirement applicable to such a project; and</text></clause><clause id="idEE9D41986DD94019A750C40033E3A37E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a project eligible for credit assistance under the TIFIA program under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/6">chapter 6</external-xref> of title 23, United States Code—</text><subclause id="idFD3C1455C2A94460B70EFB9094163430" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">to satisfy a non-Federal share requirement applicable to such a project; and</text></subclause><subclause id="idEEC53B832BAF47ADBF64DC767751C865" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">to repay a loan provided under such program.</text></subclause></clause></subparagraph><subparagraph id="id3DEA87A47B35499C93D4009BD41A972D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Limitations; application of requirements</header><clause id="id0C78DA02AE1A419DA845F8342117A0A1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Limitation on amounts to be used for infrastructure projects</header><subclause id="id3C19839E818F4EB5881998DD91AA3C3C" commented="no" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The total amount that a metropolitan city, nonentitlement unit of local government, or county may use from a payment made under this section for uses described in subparagraph (A) shall not exceed the greater of—</text><item id="idDEFB7EB978AF4022AD8A359D561771D9" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">$10,000,000; and</text></item><item id="id59A793871F00466F8449DBA1A7E212EB" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">30 percent of such payment.</text></item></subclause><subclause id="id30B9061C0E484C319DAB9F6B6D6D22DA" commented="no" display-inline="no-display-inline"><enum>(II)</enum><header display-inline="yes-display-inline">Rule of application</header><text display-inline="yes-display-inline">The spending limitation under subclause (I) shall not apply to any use of funds permitted under paragraph (1), and any such use of funds shall be disregarded for purposes of applying such spending limitation. </text></subclause></clause><clause id="idFB166AA8BCC44569AAACBB3C32827750" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Limitation on operating expenses</header><text display-inline="yes-display-inline">Funds provided under a payment made under this section shall not be used for operating expenses of a project described in clauses (xx) through (xxiv) of section 602(c)(5)(B).</text></clause><clause id="id274EDA22EBA746CAB76AE96064065B62" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Application of requirements</header><text display-inline="yes-display-inline">Except as otherwise determined by the Secretary or the head of a Federal agency to which the Secretary has delegated authority pursuant to clause (iv) or provided in this section—</text><subclause id="id861A3F8DAFF8434A94D050B4D4C13796" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the requirements of section 60102 of the Infrastructure Investment and Jobs Act shall apply to funds provided under a payment made under this section that are used pursuant to subparagraph (A) for a project described in clause (xxvi) of section 602(c)(5)(B) that relates to broadband infrastructure; and</text></subclause><subclause id="idef58561256d04c3399cf059048b5066a" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the requirements of titles 23, 40, and 49 of the United States Code, title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>), and the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et. seq) shall apply to funds provided under a payment made under this section that are used for projects described in section 602(c)(5)(B). </text></subclause></clause><clause id="id19E631E7DFFE477FA6E7A09C9A331BD2" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Oversight</header><text display-inline="yes-display-inline">The Secretary may delegate oversight and administration of the requirements described in clause (iii) to the appropriate Federal agency. </text></clause><clause id="id850ED8CD220C4CD88CE070ABD2D6009C" commented="no" display-inline="no-display-inline"><enum>(v)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Amounts from a payment made under this section that are used by a metropolitan city, nonentitlement unit of local government, or county for uses described in subparagraph (A) shall supplement, and not supplant, other Federal, State, territorial, Tribal, and local government funds (as applicable) otherwise available for such uses.</text></clause></subparagraph><subparagraph id="id449BF8AEAC504736B1BB8050E87DB206" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Transportation, shall provide periodic reports on the use of funds by metropolitan cities, nonentitlement units of local government, or counties under subparagraph (A). </text></subparagraph><subparagraph id="id4E20C001C214476698CFBCCAD4457C89" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Funds provided under a payment made under this section to a metropolitan city, nonentitlement unit of local government, or county shall remain available for obligation for a use described in subparagraph (A) through December 31, 2024, except that no amount of such funds may be expended after September 30, 2026.</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="id8aba4b50bf9c4a398549b8779f523197" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Technical amendments</header><text display-inline="yes-display-inline">Sections 602(c)(3) and 603(c)(3) of title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/802">42 U.S.C. 802(c)(3)</external-xref>, 803(c)(3)) are each amended by striking <quote>paragraph (17) of</quote>.</text></subsection><subsection id="id6841fb840fe5447a986d3d82b79c9bb4" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Guidance and effective date</header><paragraph id="idE23A207CA4D44669B6A3194B8A3DA89F" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Guidance or rule</header><text display-inline="yes-display-inline">Within 60 days of the date of enactment of this Act, the Secretary of the Treasury, in consultation with the Secretary of Transportation, shall issue guidance or promulgate a rule to carry out the amendments made by this section, including updating reporting requirements on the use of funds under this section. </text></paragraph><paragraph id="id001f78948232416ea668a207eeda305f" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect upon the issuance of guidance or the promulgation of a rule described in paragraph (1). </text></paragraph></subsection><subsection id="idDE654DC7E5704E97A061DE9B3B6E71D3" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Department of the Treasury administrative expenses</header><paragraph id="idFCB48843F8DE4F4D961F941D5116D41D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the unobligated balances from amounts made available to the Secretary of the Treasury (referred to in this subsection as the <term>Secretary</term>) for administrative expenses pursuant to the provisions specified in paragraph (2) shall be available to the Secretary (in addition to any other appropriations provided for such purpose) for any administrative expenses of the Department of the Treasury determined by the Secretary to be necessary to respond to the coronavirus emergency, including any expenses necessary to implement any provision of—</text><subparagraph id="id08605D15DD9744519F18909F764D0AF5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>);</text></subparagraph><subparagraph id="id8DEA360D68904CF78A35B2AF74ABB4E5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>);</text></subparagraph><subparagraph id="idF61B975FCABE4304A25030882A16BE1D" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the American Rescue Plan Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>); or</text></subparagraph><subparagraph id="idDD096C65097B48229CA82C8E736C6FE5" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="idD1A3268F12AC459BA31B5971AAA205A6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Provisions specified</header><text display-inline="yes-display-inline">The provisions specified in this paragraph are the following: </text><subparagraph and Tribal Consistency Fund</header><text display-inline="no-display-inline">Section 605 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/805">42 U.S.C. 805</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDF280645E8AF4F7ABF3F560FDD08FD38"><section id="id9a63b52f457f4c41b21051b95c66ccb9" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>605.</enum><header display-inline="yes-display-inline">Local Assistance and Tribal Consistency Fund</header><subsection id="id53b9a8d03189413f8d5fb55582197b1a" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Appropriation</header><text display-inline="yes-display-inline">In addition to amounts otherwise available, there is appropriated for fiscal year 2021, out of any money in the Treasury not otherwise appropriated, $2,000,000,000 to remain available until September 30, 2023, with amounts to be obligated for each of fiscal years 2022 and 2023 in accordance with subsection (b), for making payments under this section to eligible revenue sharing recipients, eligible Tribal governments, and territories.</text></subsection><subsection id="idbd9f157feca640d89de5100f2554c91d" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Authority to make payments</header><paragraph id="id895623754e6b4d02952fada22d80b2b7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Allocations and payments to eligible revenue sharing recipients</header><subparagraph id="id6cfb078c05774b619c362ae4fda06c41" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Allocations to revenue sharing counties</header><text display-inline="yes-display-inline">For each of fiscal years 2022 and 2023, the Secretary shall reserve $742,500,000 of the total amount appropriated under subsection (a) to allocate to each revenue sharing county and, except as provided in subparagraph (B), pay to each revenue sharing county that is an eligible revenue sharing county amounts that are determined by the Secretary taking into account the amount of entitlement land in each revenue sharing county and the economic conditions of each revenue sharing county, using such measurements of poverty, household income, and unemployment over the most recent 20-year period as of September 30, 2021, to the extent data are available, as well as other economic indicators the Secretary determines appropriate.</text></subparagraph><subparagraph id="id4828017f505a4a7196973d2491ad7d6e" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Special allocation rules</header><clause id="id95183a2251b24b6896073a5b118e702a" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Revenue sharing counties with limited government functions</header><text display-inline="yes-display-inline">In the case of an amount allocated to a revenue sharing county under subparagraph (A) that is a county with limited government functions, the Secretary shall allocate and pay such amount to each eligible revenue sharing local government within such county with limited government functions in an amount determined by the Secretary taking into account the amount of entitlement land in each eligible revenue sharing local government and the population of such eligible revenue sharing local government relative to the total population of such county with limited government functions.</text></clause><clause id="id8af00f4a328d42c0b8a8eff87c457012" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Eligible revenue sharing county in Alaska</header><text display-inline="yes-display-inline">In the case of the eligible revenue sharing county described in subparagraph (f)(3)(C), the Secretary shall pay the amount allocated to such eligible revenue sharing county to the State of Alaska. The State of Alaska shall distribute such payment to home rule cities and general law cities (as such cities are defined by the State) located within the boundaries of the eligible revenue sharing county for which the payment was received.</text></clause></subparagraph><subparagraph id="id88888298931947efbbee70a380f857b5" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Pro rata adjustment authority</header><text display-inline="yes-display-inline">The amounts otherwise determined for allocation and payment under subparagraphs (A) and (B) may be adjusted by the Secretary on a pro rata basis to the extent necessary to ensure that all available funds are allocated and paid to eligible revenue sharing recipients in accordance with the requirements specified in each such subparagraph.</text></subparagraph></paragraph><paragraph id="idd4e68417e93c4309a2bd2e11dfd17bc8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Allocations and payments to eligible Tribal governments</header><text display-inline="yes-display-inline">For each of fiscal years 2022 and 2023, the Secretary shall reserve $250,000,000 of the total amount appropriated under subsection (a) to allocate and pay to eligible Tribal governments in amounts that are determined by the Secretary taking into account economic conditions of each eligible Tribe.</text></paragraph><paragraph id="id94f23b879bec44a4ab1f88db926b18f8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Allocations and payments to territories</header><text display-inline="yes-display-inline">For each of fiscal years 2022 and 2023, the Secretary shall reserve $7,500,000 of the total amount appropriated under subsection (a) to allocate and pay to each territory an amount which bears the same proportion to the amount reserved in this paragraph as the population of such territory bears to the total population of all such territories.</text></paragraph></subsection><subsection id="id1ab697075919442ead8a1b711f7a545b" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Use of payments</header><text display-inline="yes-display-inline">An eligible revenue sharing recipient, an eligible Tribal government, or a territory may use funds provided under a payment made under this section for any governmental purpose other than a lobbying activity.</text></subsection><subsection id="idefc6e5a8622645418653a9fd6ee365a7" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Reporting requirement</header><text display-inline="yes-display-inline">Any eligible revenue sharing recipient and any territory receiving a payment under this section shall provide to the Secretary periodic reports providing a detailed accounting of the uses of fund by such eligible revenue sharing recipient or territory, as applicable, and such other information as the Secretary may require for the administration of this section.</text></subsection><subsection id="idfc7b496370bf405b915958064e194e68" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Recoupment</header><text display-inline="yes-display-inline">Any eligible revenue sharing recipient or any territory that has failed to submit a report required under subsection (d) or failed to comply with subsection (c), shall be required to repay to the Secretary an amount equal to—</text><paragraph id="id0ab8cdf579a246c4b81cf51117d4e8fe" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of a failure to comply with subsection (c), the amount of funds used in violation of such subsection; and</text></paragraph><paragraph id="id875a764590b94ddf85c031109b3bcc0a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a failure to submit a report required under subsection (d), such amount as the Secretary determines appropriate, but not to exceed 5 percent of the amount paid to the eligible revenue sharing recipient or the territory under this section for all fiscal years.</text></paragraph></subsection><subsection id="id8b0393424e9449b4a5a95cb2091476ef" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idae7bccef2ca64ff7b985a72b4d6cdb05" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">County</header><text display-inline="yes-display-inline">The term <term>county</term> means a county, parish, or other equivalent county division (as defined by the Bureau of the Census) in 1 of the 50 States.</text></paragraph><paragraph id="id08387a1e54954dda8199d6eabb1663f8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">County with limited government functions</header><text display-inline="yes-display-inline">The term <term>county with limited government functions</term> means a county in which entitlement land is located that is not an eligible revenue sharing county.</text></paragraph><paragraph id="idfdc608814349468f9978d642e04d28d2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible revenue sharing county</header><text display-inline="yes-display-inline">The term <term>eligible revenue sharing county</term> means—</text><subparagraph id="id276fc568386946559e8321fba67f767f" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a unit of general local government (as defined in section 6901(2) of title 31, United States Code) that is a county in which entitlement land is located and which is eligible for a payment under section 6902(a) of title 31, United States Code;</text></subparagraph><subparagraph id="idfc1e8bca57c84e45a71719770f1daeb6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia; or</text></subparagraph><subparagraph id="id4cf7665f08594e00a3dd377a78b82067" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the combined area in Alaska that is within the boundaries of a census area used by the Secretary of Commerce in the decennial census, but that is not included within the boundary of a unit of general local government described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idf065a5d348fd4391b5c3c1bd9d883520" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible revenue sharing local government</header><text display-inline="yes-display-inline">The term <term>eligible revenue sharing local government</term> means a unit of general local government (as defined in section 6901(2) of title 31, United States Code) in which entitlement land is located that is not a county or territory and which is eligible for a payment under section 6902(a) of title 31, United States Code.</text></paragraph><paragraph id="id8e1cd4547f3e4c198122cc31cc71d858" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Eligible revenue sharing recipients</header><text display-inline="yes-display-inline">The term <term>eligible revenue sharing recipients</term> means, collectively, eligible revenue sharing counties and eligible revenue sharing local governments.</text></paragraph><paragraph id="id2f8e5943f7f14709974535574db171f6" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Eligible tribal government</header><text display-inline="yes-display-inline">The term <term>eligible Tribal government</term> means the recognized governing body of an eligible Tribe.</text></paragraph><paragraph id="idcb91a9e44ccd493d85f4279912fe4d48" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Eligible tribe</header><text display-inline="yes-display-inline">The term <term>eligible Tribe</term> means any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of March 11, 2021, pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="idc8b66a2a264541ec8125514407d64e23" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Entitlement land</header><text display-inline="yes-display-inline">The term <term>entitlement land</term> has the meaning given to such term in section 6901(1) of title 31, United States Code.</text></paragraph><paragraph id="idba0049aa6c3f4279b3c9909ab95c6110" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Revenue sharing county</header><text display-inline="yes-display-inline">The term <term>revenue sharing county</term> means—</text><subparagraph id="ide6392bec4df14f6c9eb28b56806ea839" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an eligible revenue sharing county; or</text></subparagraph><subparagraph id="id8623a561443947b5b99aff58a4938456" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a county with limited government functions.</text></subparagraph></paragraph><paragraph id="ida87726d0d2c349bcae8494dc6d570611" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Treasury.</text></paragraph><paragraph id="ide7b66b028f0a4840a0dd640071bf565b" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Territory</header><text display-inline="yes-display-inline">The term <term>territory</term> means—</text><subparagraph id="id88f7db3e0d814dbcb144dd2b1162e584" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="idf03dd77d95d349d1b29e3677a46cfdca" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the United States Virgin Islands;</text></subparagraph><subparagraph id="id799a593fe6ac474382f817c91d4362b2" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Guam;</text></subparagraph><subparagraph id="id43404bd87ea64ba7be023169fb37cf4d" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Commonwealth of the Northern Mariana Islands; or</text></subparagraph><subparagraph id="id59c2b52082e2458383e13a6003e3429a" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">American Samoa.</text></subparagraph></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id14085EB2F0EF42E7943852607C71BDDC" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Extension of availability of coronavirus relief fund payments to Tribal governments</header><text display-inline="no-display-inline">Section 601(d)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801(d)(3)</external-xref>) is amended by inserting <quote>(or, in the case of costs incurred by a Tribal government, during the period that begins on March 1, 2020, and ends on December 31, 2022)</quote> before the period. </text></section><section id="id4C3EC113315E4C8583F1D362D9A66286" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Rescission of coronavirus relief and recovery funds declined by States, territories, or other governmental entities</header><text display-inline="no-display-inline">Title VI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/801">42 U.S.C. 801 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0060D5433A6D444391A9914BC4197639"><section section-type="subsequent-section" id="idF1ECC44B5FA1453F8908DF75602AE1D1" commented="no" display-inline="no-display-inline"><enum>606.</enum><header display-inline="yes-display-inline">Rescission of funds declined by States, territories, or other governmental entities</header><subsection id="id27580D37FF0949E49B0D7FD2D078AEC5" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Rescission</header><paragraph commented="no" id="id7F98D0559D5B4E6B8BF05C8D9797D429" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), if a State, territory, or other governmental entity provides notice to the Secretary of the Treasury in the manner provided by the Secretary of the Treasury that the State, territory, or other governmental entity intends to decline all or a portion of the amounts that are to be awarded to the State, territory, or other governmental entity from funds appropriated under this title, an amount equal to the unaccepted amounts or portion of such amounts allocated by the Secretary of the Treasury as of the date of such notice that would have been awarded to the State, territory, or other governmental entity shall be rescinded from the applicable appropriation account. </text></paragraph><paragraph commented="no" id="idC70C49F5A5CF4A33A5CC499B1279941F" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to funds that are to be paid to a State under section 603 for distribution to nonentitlement units of local government.</text></paragraph><paragraph commented="no" id="idE7DF2FEFE5404212992CB3BB40DA9118" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Rules of construction</header><text display-inline="yes-display-inline">Paragraph (1) shall not be construed as—</text><subparagraph commented="no" id="idBD1FD51E44424D99B1CA662D5984B2D6" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">preventing a sub-State governmental entity, including a nonentitlement unit of local government, from notifying the Secretary of the Treasury that the sub-State governmental entity intends to decline all or a portion of the amounts that a State may distribute to the entity from funds appropriated under this title; or</text></subparagraph><subparagraph commented="no" id="id56CFD1602FF0410AB1827D3ECDD26887" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">allowing a State to prohibit or otherwise prevent a sub-State governmental entity from providing such a notice.</text></subparagraph></paragraph></subsection><subsection id="id790EBA5B4029430BB986FAE51ED6A2CD" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Use for deficit reduction</header><text display-inline="yes-display-inline">Amounts rescinded under subsection (a) shall be deposited in the general fund of the Treasury for the sole purpose of deficit reduction.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="id233E547B1DAF4D58A191DB73C302FE02"><enum>(c)</enum><header display-inline="yes-display-inline">State or other governmental entity defined</header><text display-inline="yes-display-inline">In this section, the term <term>State, territory, or other governmental entity</term> means any entity to which a payment may be made directly to the entity under this title other than a Tribal government, as defined in sections 601(g), 602(g), and 604(d), and an eligible Tribal government, as defined in section 605(f).</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section></legis-body><attestation><attestation-group><attestation-date date="20211019" chamber="Senate">Passed the Senate October 19, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
