Conservation and renewable energy programs priority.</toc-entry></toc></subsection></section><section id="id5AFE557C25804D39B5EC3768EAA25314"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1FCBF8E6C3CC4A709D7A420CF6AEDC78"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id47C491EC65EF493C9EFE7F4F4AC2AF57"><enum>(2)</enum><header>Socially disadvantaged farmer or rancher</header><text>The term <term>socially disadvantaged farmer or rancher</term> means a farmer or rancher who is a member of a socially disadvantaged group.</text></paragraph><paragraph id="idbab09965085f4325af91f85a97506793"><enum>(3)</enum><header>Socially disadvantaged group</header><text>The term <term>socially disadvantaged group</term> means a group whose members have been subjected to racial or ethnic prejudice because of their identity as members of a group without regard to their individual qualities. </text></paragraph></section><title id="id1a904c6f8ade4c1ca734664dda3a88e7"><enum>I</enum><header>Department of Agriculture Civil Rights Reforms</header><section id="id6ec322a484ec4831b3c352052c4a4ab1"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id0194a4442a004deb89782a8276415d12"><enum>(1)</enum><header>Assistant secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Agriculture for Civil Rights.</text></paragraph><paragraph id="id44494f6230124cc38bd7149d58d33bcb"><enum>(2)</enum><header>Board</header><text>The term <term>Board</term> means the Department of Agriculture Civil Rights Oversight Board established by section 102(a).</text></paragraph><paragraph id="id940df11bed55449b92d9859812ad00f7"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Equity Commission established by section 103(a)(1).</text></paragraph><paragraph id="idef8d6f51d36f414e8e04295e6b085cc9"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Office of the Assistant Secretary.</text></paragraph></section><section id="id2f384bce5a8e488cacb5870d83d96641"><enum>102.</enum><header>Independent Civil Rights Oversight Board</header><subsection id="id03a794fd47e74a899cc6d63bfcba8ae2"><enum>(a)</enum><header>In general</header><text>There is established in the Department of Agriculture an independent board, to be known as the <quote>Department of Agriculture Civil Rights Oversight Board</quote>—</text><paragraph id="id67cc1c545d994c18ac510ee14064585a"><enum>(1)</enum><text>to oversee the Office; and</text></paragraph><paragraph id="ide620e0379b424c3d968059b18f96d8be"><enum>(2)</enum><text>to protect the rights of individuals who seek to file, or do file, a discrimination complaint with the Office. </text></paragraph></subsection><subsection id="id4354409b0fab4068a695bb7651868eea"><enum>(b)</enum><header>Duties</header><text>The Board shall—</text><paragraph id="ideeed3e52fd1a4ef293c4adac6fc86a16"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id42a4cb725dfa4678adce9c0ff16059af"><enum>(A)</enum><text>conduct a de novo review with fact finding power, including notice and opportunity for a hearing, of any appeal of a decision made by the Office, including any appeal of a dismissal of a complaint; and</text></subparagraph><subparagraph id="id955ee228682c4ed180148d8e893ac0d8" indent="up1"><enum>(B)</enum><text>issue a written decision within 180 days of receipt of an appeal or dismissal described in subparagraph (A);</text></subparagraph></paragraph><paragraph id="id751cae67f2ad4504b13a4789cf0fc7a4"><enum>(2)</enum><text>investigate reports of discrimination within the Department of Agriculture, make findings of fact and conclusions of law in accordance with the findings, and recommend to the Secretary appropriate actions relative to specific findings; </text></paragraph><paragraph id="idcde5e163f96f42709e8594b273f99521"><enum>(3)</enum><text>recommend improvements to Department of Agriculture policies and procedures to address patterns and practices of discrimination and to prevent further discrimination; </text></paragraph><paragraph id="ide24ebbcdee13410f893dc52843980641"><enum>(4)</enum><text>conduct regular reviews to assess the compliance of the Office with civil rights, fair employment, and pay equity laws and policies applicable to the Office;</text></paragraph><paragraph id="id4911f739a485405fb645218e933963b6"><enum>(5)</enum><text>provide oversight over Farm Service Agency county committees;</text></paragraph><paragraph id="id451b942794364c4a9790510dabc044b9"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idd619af421b6e4ab9b00d17bcda5e4821"><enum>(A)</enum><text>assess the progress made by the programs and policies established under this Act and the amendments made by this Act; and</text></subparagraph><subparagraph id="id6e14077bfe1240bca1b27d07bd2064ca" indent="up1"><enum>(B)</enum><text>submit recommendations for improvements to those programs or policies to the Secretary; and</text></subparagraph></paragraph><paragraph id="idf978a458ab124a3883f439a6381d584b"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id29ecbb698df44953839385cd40fd80fa"><enum>(A)</enum><text>prepare an annual report on the status of socially disadvantaged farmers and ranchers and the treatment of socially disadvantaged farmers and ranchers by the Department of Agriculture;</text></subparagraph><subparagraph id="ide665bfd22a1047158051c95ffe9598e7" indent="up1"><enum>(B)</enum><text>make each report prepared under subparagraph (A) publicly available; and</text></subparagraph><subparagraph id="id98d0adeede7b4398a4ecb2752d14301b" indent="up1"><enum>(C)</enum><text>submit each report prepared under subparagraph (A) to the Attorney General.</text></subparagraph></paragraph></subsection><subsection id="idd44098f72aec4e4cb12552d5d1a80bfb"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for each of fiscal years 2021 through 2030 such sums as are necessary to carry out this section.</text></subsection></section><section id="id26996925f13540418f114ead295602f5"><enum>103.</enum><header>Equity Commission</header><subsection id="ide3b688d7547c4c3095cb0f4d52349fe1"><enum>(a)</enum><header>Establishment</header><paragraph id="id3532f0ce96d840dcb461d68428ad4a83"><enum>(1)</enum><header>In general</header><text>There is established in the Department of Agriculture the Equity Commission, the purposes of which are—</text><subparagraph id="idb42fbf86551e454cb5105258b2cfb78b"><enum>(A)</enum><text>to study historical and continuing discrimination by the Department of Agriculture against Black farmers and ranchers that is fostered or perpetuated by the laws, policies, or practices of the Department of Agriculture; and </text></subparagraph><subparagraph id="id00585d71e95a44c89fe723542f85b996"><enum>(B)</enum><text>to recommend actions to end the systematic disparities in treatment of Black farmers and ranchers, particularly by the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="idd616cde1ca31464c9f57917b7934d0a4"><enum>(2)</enum><header>Membership</header><subparagraph id="id24582af1236047de938b15f02be1ac04"><enum>(A)</enum><header>Composition</header><text>The Commission shall be composed of 9 members, to be appointed by the Secretary, of whom—</text><clause id="id83029440254949859f80bf7c1d8e6b8c"><enum>(i)</enum><text>3 shall be Black farmers or ranchers with not less than 10 years of experience in farming or ranching; </text></clause><clause id="id767e62d5a9604e1cbb45b720e6916b3b"><enum>(ii)</enum><text>3 shall be employees or board members of nonprofit organizations that have not less than 7 years of experience providing meaningful agricultural, business assistance, legal assistance, or advocacy services to Black farmers or ranchers; and </text></clause><clause id="id9d1af74d206644d7a43292c58edcaf64"><enum>(iii)</enum><text>3 shall be faculty or staff from 1890 Institutions (as defined in section 2 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>)) or the University of the District of Columbia.</text></clause></subparagraph><subparagraph id="id3d7e872b7d7448aa838c6aad45ae1f7a"><enum>(B)</enum><header>Date</header><text>The appointments of the members of the Commission shall be made not later than 90 days after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id61f01c715ae84133a51548d71b90b8f0"><enum>(3)</enum><header>Period of appointment; vacancies</header><subparagraph id="idd01e3088f7664b329e762424a9f8b533"><enum>(A)</enum><header>In general</header><text>A member of the Commission shall be appointed for the life of the Commission.</text></subparagraph><subparagraph id="id97a6e013be664757910ce2c6a1d1b112"><enum>(B)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text><clause id="id9fb934c9b48e47d4aa1596704d5627d7"><enum>(i)</enum><text>shall not affect the powers of the Commission; and</text></clause><clause id="id57a51ed080d24e45937a35500b7331f9"><enum>(ii)</enum><text>shall be filled in the same manner as the original appointment.</text></clause></subparagraph></paragraph><paragraph id="idc1020b8c1aec4b2b84fc31615b1f0b94"><enum>(4)</enum><header>Meetings</header><subparagraph id="id31b035487d5741a9ae7ab61e799f4e21"><enum>(A)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed, the Commission shall hold the first meeting of the Commission.</text></subparagraph><subparagraph id="ide4c29d66691c4d10be12191948c74bdf"><enum>(B)</enum><header>Frequency</header><text>The Commission shall meet at the call of the Chairperson.</text></subparagraph><subparagraph id="id6deedc2166244ce18c49358a32148223"><enum>(C)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text></subparagraph></paragraph><paragraph id="id7ec3e65e26c34dab897ec19d56d62806"><enum>(5)</enum><header>Chairperson and vice chairperson</header><text>The Commission shall select a Chairperson and Vice Chairperson from among the members of the Commission.</text></paragraph></subsection><subsection id="id41b5ab11387f476494e608e9487e8c7f"><enum>(b)</enum><header>Duties of the commission</header><paragraph id="id18acf6f4988e451089f57e76f177c376"><enum>(1)</enum><header>Study</header><text>The Commission shall study discrimination against Black farmers and ranchers by the Department of Agriculture, including by conducting investigations of—</text><subparagraph id="idc67f8a9bc266450fbb03461bd1477448"><enum>(A)</enum><text>the prevalence of discrimination against Black farmers and ranchers in Department of Agriculture agencies and programs, including Farm Service Agency county committees; and</text></subparagraph><subparagraph id="id718a80338e39461981ba80928fed21c6"><enum>(B)</enum><text>the status of claimants who filed for relief under the settlement agreement and consent decree in Pigford v. Glickman, 185 F.R.D. 82 (D.D.C. 1999) or the settlement agreement in In re Black Farmers Discrimination Litigation, Misc. No. 08–mc–0511 (PLF), with a particular focus on the status of claimants who did not receive payments.</text></subparagraph></paragraph><paragraph id="idccd031f028bf462ca7a8b77c60420d00"><enum>(2)</enum><header>Recommendations</header><text>The Commission shall develop recommendations for—</text><subparagraph id="id41c56903da26485ba9a89dc6df6155e5"><enum>(A)</enum><text>ending the systematic disparities in treatment of Black farmers and ranchers, particularly by the Department of Agriculture;</text></subparagraph><subparagraph id="id83b9699a7dfe476eb9b2f0b916c6aaa7"><enum>(B)</enum><text>improving the structure of Farm Service Agency county committees to better serve socially disadvantaged farmers and ranchers, including, if necessary, recommending the elimination and replacement of those committees; and</text></subparagraph><subparagraph id="id7e5b7d1365d0447a8438631f4d77cf9a"><enum>(C)</enum><text>addressing any mishandling of payments identified through studying the matters under paragraph (1)(B).</text></subparagraph></paragraph><paragraph id="idb5764f6c4b8e4232bfb0b6ae4f1db1b5"><enum>(3)</enum><header>Outreach</header><text>In studying the matters under paragraph (1) and developing recommendations under paragraph (2), the Commission shall—</text><subparagraph id="id42D71EAE370349A79937A8D206426856"><enum>(A)</enum><text>consult with the Socially Disadvantaged Farmers and Ranchers Policy Research Center; and</text></subparagraph><subparagraph id="idB5A3216C16B445B09A04CD457F0ACDB6"><enum>(B)</enum><text>hold town hall meetings with socially disadvantaged farmers and ranchers, researchers, and civil rights advocates.</text></subparagraph></paragraph><paragraph id="id4183cf0a6a664613a33482b984202020"><enum>(4)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Commission shall make publicly available a detailed report that describes—</text><subparagraph id="idad02d0bb3dea43d19bf1d436364500c9"><enum>(A)</enum><text>the findings of the study under paragraph (1); and</text></subparagraph><subparagraph id="ida0b114ed26534a1d87be0a4b862e0cae"><enum>(B)</enum><text>the recommendations developed under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="idedec4f369dd94573aba8c35cd773c31b"><enum>(c)</enum><header>Powers of commission</header><paragraph id="id82e4d99656854878835c4196e757fef7"><enum>(1)</enum><header>Hearings</header><text>The Commission shall hold open, televised, and public hearings, during which the Commission may sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers advisable to carry out this section.</text></paragraph><paragraph id="idd7b99896b1014a0da8e33d78a192cde0"><enum>(2)</enum><header>Information from Federal agencies</header><subparagraph id="id94d273f275314e4eb3cfd76b5fb10099"><enum>(A)</enum><header>In general</header><text>The Commission may secure directly from a Federal department or agency such information as the Commission considers necessary to carry out this section.</text></subparagraph><subparagraph id="ida5da1cdf6be24c6a895cdf6e503e3dff"><enum>(B)</enum><header>Furnishing information</header><text>On request of the Chairperson of the Commission, the head of the department or agency shall furnish the information to the Commission.</text></subparagraph></paragraph><paragraph id="id879643c9714048888f887282371d7b89"><enum>(3)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the Federal Government.</text></paragraph><paragraph id="ide68bf858b8dd47dcb2671da25a5e8149"><enum>(4)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text></paragraph></subsection><subsection id="id0414db3d6cc54af58f389951b48c9002"><enum>(d)</enum><header>Commission personnel matters</header><paragraph id="iddeb8cd55c8534036813756b5adb7d819"><enum>(1)</enum><header>Compensation of members</header><text>A member of the Commission who is not an officer or employee of the Federal Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the Commission.</text></paragraph><paragraph id="idcd3c63242df044229dc695b002fc7331"><enum>(2)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></paragraph><paragraph id="id0b9b8fb982b0487d897c1efcf7725c6c"><enum>(3)</enum><header>Staff</header><subparagraph id="id6e33594a8c4d425d8d87999282558300"><enum>(A)</enum><header>In general</header><text>The Chairperson of the Commission may, without regard to the civil service laws (including regulations), appoint and terminate an executive director and such other additional personnel as may be necessary to enable the Commission to perform its duties, except that the employment of an executive director shall be subject to confirmation by the Commission.</text></subparagraph><subparagraph id="id6ba8f7a1f75243dc91d472c9f78563bc"><enum>(B)</enum><header>Compensation</header><text>The Chairperson of the Commission may fix the compensation of the executive director and other personnel without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the executive director and other personnel may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title.</text></subparagraph></paragraph><paragraph id="id8b1e5216fbef400a86ef594227acaa64"><enum>(4)</enum><header>Detail of government employees</header><text>A Federal Government employee may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></paragraph><paragraph id="id71def056859e49d49d107a5318ef7482"><enum>(5)</enum><header>Procurement of temporary and intermittent services</header><text>The Chairperson of the Commission may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, at rates for individuals that do not exceed the daily equivalent of the annual rate of basic pay prescribed for level V of the Executive Schedule under section 5316 of that title.</text></paragraph></subsection><subsection id="id0c047a8dc6f1435195dcee2759975363"><enum>(e)</enum><header>Termination of commission</header><text>The Commission shall terminate on the date that is 30 days after the date on which the Commission makes publicly available the report under subsection (b)(4).</text></subsection><subsection id="id36c4085b0ff644c08a493f59e0613e96"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated for each of fiscal years 2021 through 2030 such sums as are necessary to carry out this section.</text></subsection></section><section id="ida8f0f72cb50b44eab7814ae11fdb4b8b"><enum>104.</enum><header>Office of the Assistant Secretary for Civil Rights reforms</header><subsection id="id3fda40fd644044ebaa3b6a6f2db50894"><enum>(a)</enum><header>Ombudsman</header><text>The Secretary shall establish in the Department of Agriculture a position of Civil Rights Ombudsman—</text><paragraph id="id541F832D2472408BAEE76AEEFFB4964E"><enum>(1)</enum><text>to assist individuals in navigating Office programs; and</text></paragraph><paragraph id="id54024FD383CA49A7857505D599883E7C"><enum>(2)</enum><text>to provide recommendations to the Secretary for grants provided under subsection (g). </text></paragraph></subsection><subsection id="id75c3940c1aac432f8d92092d343c068f"><enum>(b)</enum><header>Deadline for decisions</header><text>Not later than 180 days after the date on which the Office receives a civil rights complaint, the Assistant Secretary shall make a final decision of the Assistant Secretary regarding the merit of the complaint and the appropriate disposition of the matter.</text></subsection><subsection id="id45d55297e0784927acdb8f9b4560ee9f"><enum>(c)</enum><header>Appeals to Board</header><paragraph id="idb20a20e4396f424b90ec76b9e594db6e"><enum>(1)</enum><header>In general</header><text>A person that receives an adverse decision or dismissal by the Office on a civil rights complaint filed by the person may appeal the decision or dismissal to the Board for a final decision.</text></paragraph><paragraph id="id63d36a1f165a4086a6cd9716945670f5"><enum>(2)</enum><header>Deadline</header><text>An appeal under paragraph (1) shall be filed not later than 1 year after the date of the adverse decision or dismissal described in that paragraph.</text></paragraph><paragraph id="id56384e659eb7468e9784375eff3c8edd"><enum>(3)</enum><header>Effect of board decision</header><text>A decision of the Board on an appeal filed under paragraph (1), or a dismissal of such an appeal for lack of jurisdiction, shall constitute exhaustion of administrative remedies and be reviewable in Federal court.</text></paragraph></subsection><subsection id="idd1dfce8a956d43efa23982647969a95f"><enum>(d)</enum><header>Moratorium on foreclosures</header><text>The Secretary shall not take any action on a foreclosure proceeding against any farmer or rancher during any period that a civil rights complaint filed by the farmer or rancher with the Office is outstanding, including an appeal to the Board under subsection (c)(1).</text></subsection><subsection id="id42a105933ea849e0ae6a7c051d4e40b3"><enum>(e)</enum><header>Reports</header><text>The Assistant Secretary shall—</text><paragraph id="id80db3861fdb94d0893f5e345eaa95f76"><enum>(1)</enum><text>publish on the website of the Office and submit to the Board a report of each civil rights complaint filed with the Office and the results of each such complaint; and</text></paragraph><paragraph id="id026be05344a6437db41da2d8c35c3932"><enum>(2)</enum><text>include in each report described in paragraph (1) a description of the race, ethnicity, gender, and geographic region of the complainant.</text></paragraph></subsection><subsection id="id58eeec5fbf3649d59242442d6e2b1f5a"><enum>(f)</enum><header>Prohibition on interference by the office of the general counsel</header><text>The Office of General Counsel of the Department of Agriculture shall not have any involvement with the investigation, adjudication, or resolution of any civil rights complaint brought against the Secretary. </text></subsection><subsection id="ide8518c9adef147688509d05df5f74d2a"><enum>(g)</enum><header>Grants</header><paragraph id="id16df8ea35c8d4b849ea79f69e49fca39"><enum>(1)</enum><header>In general</header><text>The Secretary, based on recommendations from the Civil Rights Ombudsman, shall provide grants to community-based organizations and advocates with a history of working with socially disadvantaged farmers and ranchers to provide technical assistance to farmers and ranchers seeking to file a civil rights complaint with the Office.</text></paragraph><paragraph id="id3d058320ac4e452f9f3ca31aa454b1ae"><enum>(2)</enum><header>Funding</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $50,000,000 for each of fiscal years 2021 through 2030 to carry out this subsection.</text></paragraph></subsection><subsection id="ida34bb22a3e9b4211964436994ef87c75"><enum>(h)</enum><header>Direct reporting to the Secretary of Agriculture</header><text>Section 218(c) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6918">7 U.S.C. 6918(c)</external-xref>) is amended—</text><paragraph id="idE436FBB172D040E7AC4F82B6119904C0"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Duties of</header-in-text></quote>;</text></paragraph><paragraph id="id566F5E758B72419AB94319EDB0E0958F"><enum>(2)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and indenting appropriately;</text></paragraph><paragraph id="idDA442D982FCF461C8F435D775B793DEB"><enum>(3)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB0624EA74C304DA88C75A8F0A1456E50"><paragraph id="id2A6BF9F516254F26AF9C8647A0127CAA"><enum>(1)</enum><header>Duties</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id20468AE8A5214F6D9700EADFB2E1A39A"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCBE163E5D06B4BF1884501917DF8FA03"><paragraph id="id2B7ACD838E8643BD8A35994CF9DB23A5"><enum>(2)</enum><header>Direct reporting to the Secretary</header><text>If the Secretary establishes the position of Assistant Secretary for Civil Rights under subsection (a)(3), the Assistant Secretary for Civil Rights shall report directly to the Secretary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id35277AF01CE441259C3C1B781F5823CD"><enum>(i)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under subsection (g)(2), there are authorized to be appropriated for each of fiscal years 2021 through 2030 such sums as are necessary to carry out this section and the amendments made by this section.</text></subsection></section><section id="id22405ad2730b40f48e1dca47caeb6174"><enum>105.</enum><header>Data collection and reporting</header><subsection id="id2d49d5a288564687a2917df20924f4ad"><enum>(a)</enum><header>In general</header><text>The Secretary shall make publicly available annual reports describing data on the recipients of Department of Agriculture assistance, including assistance from farm subsidy programs, and the amounts of the assistance, delineated by the race, ethnicity, and gender of the recipients.</text></subsection><subsection id="id893fcd778c8d44e993f71e3968c1ca61"><enum>(b)</enum><header>ERS research of socially disadvantaged farmers and ranchers</header><text>The Secretary, acting through the Administrator of the Economic Research Service, shall conduct research on the status of socially disadvantaged farmers and ranchers, including—</text><paragraph id="id7770fde3fc914545ac1ebcd732ae7a0e"><enum>(1)</enum><text>the share of land ownership of those socially disadvantaged farmers and ranchers as compared to all farmers and ranchers, delineated by the race, ethnicity, and gender of the landowners; </text></paragraph><paragraph id="id2431a1f28ffc4e07af70dc7f46b1f433"><enum>(2)</enum><text>the share of the amount of assistance those socially disadvantaged farmers and ranchers receive from the Department of Agriculture as compared to all farmers and ranchers, delineated by the race, ethnicity, and gender of the recipients;</text></paragraph><paragraph id="idc0e26b72953a4d699a2554e4fccdc670"><enum>(3)</enum><text>the share, status, and receipt of Farm Credit System loans by socially disadvantaged farmers and ranchers as compared to all farmers and ranchers, delineated by the race, ethnicity, and gender of the recipients; and</text></paragraph><paragraph id="id1fafc3380e6f4111af9b088ff4196421"><enum>(4)</enum><text>an assessment of the reasons for disparities in land ownership, assistance from the Department of Agriculture, and Farm Credit System loans for socially disadvantaged farmers and ranchers compared to all farmers and ranchers. </text></paragraph></subsection><subsection id="id6fcd66e585324a0b8e305b6df7a35d9f"><enum>(c)</enum><header>ERS research of farmworkers</header><text>The Secretary, acting through the Administrator of the Economic Research Service, shall conduct research on the demographics and status of farmworkers, including—</text><paragraph id="idB2BD0D80FE5A49A187E37A69035A2627"><enum>(1)</enum><text>the races, ethnicities, ages, localities, wages and benefits, and working conditions of farmworkers; </text></paragraph><paragraph id="idC3BED66C2FFA48A7B2E242072EC10DDE"><enum>(2)</enum><text>the economic contributions of farmworkers to the United States economy; and</text></paragraph><paragraph id="idC3867E61E0E14EF3BDE2F90757CAF2D8"><enum>(3)</enum><text>satisfaction of farmworkers with their employment. </text></paragraph></subsection><subsection id="id58d3eeb23dc544ac84a9fc60aad1e8da"><enum>(d)</enum><header>Census of agriculture</header><text>The Secretary, acting through the Administrator of the National Agricultural Statistics Service, shall—</text><paragraph id="id83331a9012374e71927a63f73d1f3514"><enum>(1)</enum><text>investigate historical changes in reporting methodology and misreporting of Black farmers and ranchers in the census of agriculture; </text></paragraph><paragraph id="idadfb56aa27f44ad7bc7b7e4cad0bae99"><enum>(2)</enum><text>develop procedures to ensure that census of agriculture surveys accurately capture the status of socially disadvantaged farmers and ranchers engaged in urban agriculture; and</text></paragraph><paragraph id="idf7a1fba5b839443aa1dbf4b9b68ecac2"><enum>(3)</enum><text>conduct, concurrently with each census of agriculture, a review to assess—</text><subparagraph id="id36737CC1DB9F42AB86941CFA5CB37334"><enum>(A)</enum><text>the outreach and methodologies used in conducting the census of agriculture; and </text></subparagraph><subparagraph id="id6EF2E951DD714E70ADA774584E18D727"><enum>(B)</enum><text>how such outreach and methodologies have affected the counting of socially disadvantaged farmers and ranchers.</text></subparagraph></paragraph></subsection><subsection id="id5093f6e72e004044896710883e712603"><enum>(e)</enum><header>Corporate ownership of farmland</header><text>The Secretary shall annually conduct, and annually make publicly available reports describing, in-depth research and analysis of corporate (domestic and foreign) land investment and ownership in the United States, with specific attention given to the impact of corporate land investment and ownership on—</text><paragraph id="id61a5d1f177a441059724e1d1026a2eeb"><enum>(1)</enum><text>land consolidation trends in the United States;</text></paragraph><paragraph id="id927feb2a3426401b9888523c4d641978"><enum>(2)</enum><text>challenges and opportunities for new and beginning farmers and ranchers accessing land for farming or ranching;</text></paragraph><paragraph id="id136af08050dd4e588efc5c300059c0ad"><enum>(3)</enum><text>challenges and opportunities for members of socially disadvantaged groups accessing land for farming or ranching; and</text></paragraph><paragraph id="idaea196a500e540bd902931392e627a73"><enum>(4)</enum><text>crop selection and production trends. </text></paragraph></subsection><subsection id="ide1c146fc357a4d49853dcf4fe8445584"><enum>(f)</enum><header>Funding</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $10,000,000 for each of fiscal years 2021 through 2030 to carry out this section.</text></subsection></section></title><title id="idA9652FB359B44F21BDAE0C52A0FDB26E" style="OLC"><enum>II</enum><header>Black Farmer Land Grants</header><section section-type="subsequent-section" id="id0E11D28D30084E3B8BA78B59CEF17DC5"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="idcf3a6ced471f4ed8beee4a2c2bd4e1d4"><enum>(1)</enum><header>Animal feeding operation</header><text>The term <term>animal feeding operation</term> means a lot or facility at which—</text><subparagraph id="id6636513d8a604003913399ae092082ae"><enum>(A)</enum><text>for not less than a total of 45 days in any 12-month period, animals (other than aquatic animals) are—</text><clause id="idbf17b77084154d03befbc5689388e5d5"><enum>(i)</enum><text>stabled or confined; and</text></clause><clause id="ideab5e13d2afa43bd811202fe09111084"><enum>(ii)</enum><text>fed or maintained; and</text></clause></subparagraph><subparagraph id="idf5700a53c0d84ef4bbfdc9019f843815"><enum>(B)</enum><text>crops, vegetation, forage growth, or postharvest residues are not sustained in the normal growing season over any portion of the lot or facility. </text></subparagraph></paragraph><paragraph id="id8D6BEB5064F44505AF5FD9ACB0840E64"><enum>(2)</enum><header>Eligible Black individual</header><text>The term <term>eligible Black individual</term> means a person who—</text><subparagraph id="id232CF0283C5840E0A77688CBEF2E23FB"><enum>(A)</enum><text>was born in the United States; </text></subparagraph><subparagraph id="id74985706A67E4BA8AE9617C21431F415"><enum>(B)</enum><text>is at least 21 years of age;</text></subparagraph><subparagraph id="id7EAB05E7DF644C9CBA12A3BD5B990804"><enum>(C)</enum><text>has previously identified as Black or African American; and </text></subparagraph><subparagraph id="idCB74DC751DAD43A3BBC6502C5805B1E4"><enum>(D)</enum><text>has at least 1 parent of African ancestry.</text></subparagraph></paragraph><paragraph id="idD552EA89645A46E3B74FB3DC6B39E8E9"><enum>(3)</enum><header>Farmer training</header><text>The term <term>farmer training</term> means a program that—</text><subparagraph id="id497EACD3D0654F149C838C1E4E0E8965"><enum>(A)</enum><text>provides eligible Black individuals and other enrollees with the basic skills to operate a farm or ranch profitably with a primary focus on regenerating the soil, ecosystem, and local community;</text></subparagraph><subparagraph id="id0930740f02bb4e51807cc665320f1717"><enum>(B)</enum><text>provides a course of study that is equivalent to not less than 30 academic credit hours of study, which may be provided as direct in-field instruction;</text></subparagraph><subparagraph id="id2d6625c5df814753aac7a9ad2c78b418"><enum>(C)</enum><text>is approved by the Undersecretary of the Equitable Land Access Service as an authorized program to meet the farmer training program requirement under section 207(a) for recipients of land grants under section 203(a)(2);</text></subparagraph><subparagraph id="id97b913dc7357430c81b34df88ec0b067"><enum>(D)</enum><text>focuses training on low-capital-intensive techniques and technologies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida34f685f974e4ca882ad76588782aa1a"><enum>(E)</enum><text>includes a robust study of local and regional food systems and the market opportunities those systems present. </text></subparagraph></paragraph><paragraph id="idF4772E10E29E40DC8E009A3FC5D88179"><enum>(4)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means—</text><subparagraph id="id1D7A5F38B6944FCF8A938951DD23F4D0"><enum>(A)</enum><text>an organization—</text><clause id="id250B7E1E1A0E41D985CBC21CC98CE286"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id0436B7BEA9E04EF69017C04AEE78D911"><enum>(I)</enum><text>described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under 501(a) of that Code; or</text></subclause><subclause indent="up1" id="id6CA4D0C4812F4315AE650DCE106B7B9E"><enum>(II)</enum><text>that has a fiscal sponsor that is an organization described in subclause (I);</text></subclause></clause><clause id="idB19AAE953F3C44E2BE42CB1A4770291C"><enum>(ii)</enum><text>that has not less than 3 years of experience providing meaningful agricultural, business assistance, legal assistance, or advocacy services to Black farmers or ranchers; and </text></clause><clause id="idF508B82B906B4BED9E73E9AF20ECE234"><enum>(iii)</enum><text>at least 50 percent of the members of the board of directors of which are Black; and</text></clause></subparagraph><subparagraph id="idF259C7A60A2046398881692B7B6EE751"><enum>(B)</enum><text>an 1890 Institution (as defined in section 2 of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601</external-xref>)), including the University of the District of Columbia.</text></subparagraph></paragraph><paragraph id="id5BEFC03386DD49C48FB2738B05F617B7"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary, acting through the Under Secretary of Agriculture for Equitable Land Access.</text></paragraph></section><section id="idE3D9098724884E8C9A80F5F2DBE97FE7"><enum>202.</enum><header>Establishment of the Under Secretary of Agriculture for Equitable Land Access and the Equitable Land Access Service</header><subsection id="id789CC31491154EE8BC7CB6EC816A6DFF"><enum>(a)</enum><header>Establishment</header><text>The Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6901">7 U.S.C. 6901</external-xref> et seq.) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id4C61D21B7723446AAE9BAE7A322ED334"><subtitle id="id50EABFB98D45426391A13074925FDEDA" style="OLC"><enum>L</enum><header>Equitable Land Access</header><section section-type="subsequent-section" id="idF2D1DC07EA2243808749A51E7D03628B"><enum>297.</enum><header>Under Secretary of Agriculture for Equitable Land Access</header><subsection id="id19A5160921F34A76B9B50C2CDF85890F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish in the Department the position of Under Secretary of Agriculture for Equitable Land Access.</text></subsection><subsection id="id1A27D25D96484DF59E5D7AE01D299F3B"><enum>(b)</enum><header>Confirmation required</header><text>The Under Secretary of Agriculture for Equitable Land Access shall be appointed by the President, by and with the advice and consent of the Senate.</text></subsection><subsection id="id07812613FC854AC6A087BBC6F275C2DB"><enum>(c)</enum><header>Functions</header><text>The Secretary shall delegate to the Under Secretary of Agriculture for Equitable Land Access the functions of the Department carried out through the Equitable Land Access Service.</text></subsection></section><section id="id1298156BA66A462F84C58DA2FF972F9C"><enum>297A.</enum><header>Equitable Land Access Service</header><subsection id="id62BFC79DA617414BA4374E50B22AAF97"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department the Equitable Land Access Service.</text></subsection><subsection id="id24A329AEE5DC452EA6356D7A44AB6B4D"><enum>(b)</enum><header>Under Secretary</header><text>The Equitable Land Access Service shall be headed by the Under Secretary of Agriculture for Equitable Land Access.</text></subsection><subsection id="id69850D4784DB478AB4050091FCD20407"><enum>(c)</enum><header>Functions</header><text>The Secretary shall carry out through the Equitable Land Access Service title II of the <short-title>Justice for Black Farmers Act of 2021</short-title>.</text></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3EE49DFD546B4C1781CF0914EECD9644"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="idE2C00061A1CC489A803EFBE66B0B2922"><enum>(1)</enum><text>Subtitle A of the Department of Agriculture Reorganization Act of 1994 is amended by redesignating section 225 (<external-xref legal-doc="usc" parsable-cite="usc/7/6925">7 U.S.C. 6925</external-xref>) as section 224A.</text></paragraph><paragraph id="id5C7A950D411548CAB0345AC1B9F90872"><enum>(2)</enum><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2C326786B53E427D995CCFBAAB019E25"><paragraph id="id3C5ED8E96AE348A68DE3EEE3DC530026"><enum>(11)</enum><text>The authority of the Secretary to carry out the amendments made to this Act by the <short-title>Justice for Black Farmers Act of 2021</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id224BA34E79AE4E3491E296D68B5B65DB"><enum>(3)</enum><text>Section 5314 of title 5, United States Code, is amended by inserting after the item relating to the Under Secretary of Agriculture for Marketing and Regulatory Programs the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id61DF1E22E79F4603B1F9F30F9A5ACE66"><list level="paragraph"><list-item>Under Secretary of Agriculture for Equitable Land Access.</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idFA78C52354F0473CA7D20293C31EBBBE"><enum>203.</enum><header>Provision of land grants</header><subsection id="idB972705EE5AA4132802D045483F98611"><enum>(a)</enum><header>In general</header><text>The Secretary shall—</text><paragraph id="id08BBAFF2E6004D46AD8FE40AEB2EDA52"><enum>(1)</enum><text>purchase from willing sellers, at a price not greater than fair market value, available agricultural land in the United States; and</text></paragraph><paragraph id="id9062AE9EDEED45ECA82D5925F9EDB807"><enum>(2)</enum><text>subject to section 205, convey grants of that land to eligible Black individuals at no cost to the eligible Black individuals.</text></paragraph></subsection><subsection id="idb5578ee7480d49d282c976c15b3b04a1"><enum>(b)</enum><header>Requirement</header><text>To the maximum extent practicable, if sufficient applications are submitted by eligible Black individuals, the Secretary shall convey not less than 20,000 land grants to eligible Black individuals under subsection (a)(2) for each of fiscal years 2021 through 2030. </text></subsection><subsection id="id8E361E600B1849B1B92D6F3F9B3262E9"><enum>(c)</enum><header>Maximum acreage</header><text>A land grant to an eligible Black individual under subsection (a)(2) shall be not more than 160 acres. </text></subsection><subsection id="id9C42DDF465674AA992A5AD9CA107F9E8"><enum>(d)</enum><header>Applications</header><paragraph id="id15376F3F5610434B9B39113EE514F1BA"><enum>(1)</enum><header>In general</header><text>An eligible Black individual seeking a land grant under subsection (a)(2) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a legal description of the land identified under section 204 of which the eligible Black individual is seeking the grant.</text></paragraph><paragraph id="id50A391E0B12F44C790BD25F31337F96E"><enum>(2)</enum><header>Qualified entities</header><subparagraph id="id818D57545E064CE79D0BEF4C12CBEF00"><enum>(A)</enum><header>In general</header><text>A qualified entity that receives a grant under section 208 may submit to the Secretary an application under paragraph (1) on behalf of 1 or more eligible Black individuals seeking a land grant under subsection (a)(2).</text></subparagraph><subparagraph id="idC216DA2461E0473EACE4A713D7238A3B"><enum>(B)</enum><header>Applications to subdivide and convey</header><text>If applicable, an application submitted under subparagraph (A) shall include a proposal for how the land will be subdivided and conveyed separately to eligible Black individuals as described in section 204(b).</text></subparagraph></paragraph></subsection><subsection id="id23f88c00240e44878f9a162a0a8a237d"><enum>(e)</enum><header>Priority</header><text>The Secretary shall give priority to applications submitted under subsection (c) for land grants to—</text><paragraph id="id94a2f1053329417b9a60a1cf46e67037"><enum>(1)</enum><text>eligible Black individuals who are currently farmers or ranchers;</text></paragraph><paragraph id="ida2b025b9767d4e4a979c75ce82c84594"><enum>(2)</enum><text>eligible Black individuals with a family history of land dispossession;</text></paragraph><paragraph id="idd7cd5d4b5f454258a09f508025bcee01"><enum>(3)</enum><text>eligible Black individuals with experience in agriculture, including experience obtained through participation in the Farm Conservation Corps established under section 209; and</text></paragraph><paragraph id="id6fd5845a9ef8478bba4f6fbe1897eacc"><enum>(4)</enum><text>eligible Black individuals who are veterans. </text></paragraph></subsection><subsection id="id9f609d3c67fd4228bf9e72922dbd6839"><enum>(f)</enum><header>Funding</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $8,000,000,000 for each of fiscal years 2021 through 2030 to carry out this section. </text></subsection></section><section id="id166F79C8FD5641099818E18BF151F7E3"><enum>204.</enum><header>Identification of land</header><subsection id="id2248BCC5384C4E88898CC3591EDCCB4F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall refer an eligible Black individual seeking a land grant under section 203 to a qualified entity that receives a grant under section 208 to assist the eligible Black individual in identifying available agricultural land in the United States that is suitable for purchase by the Secretary and conveyance to the eligible Black individual under section 203.</text></subsection><subsection id="id608901AE8ECB4CBE942C2549E0E6D92A"><enum>(b)</enum><header>Subdivisions</header><text>In carrying out subsection (a), a qualified entity may assist eligible Black individuals in identifying land described in that subsection that is suitable to be subdivided and conveyed separately to multiple eligible Black individuals under section 203.</text></subsection></section><section id="idEEA16807352548D299AD2AFA60D424BA"><enum>205.</enum><header>Restrictions on conveyed land</header><subsection id="id7FEF201A4F164027B306AE80F196B76F"><enum>(a)</enum><header>In general</header><text>Before conveying a land grant under section 203(a)(2), the Secretary shall attach to the land an easement requiring that the land be—</text><paragraph id="idD0E5CF1B41DE492F9DFB7C2F2411F222"><enum>(1)</enum><text>restricted in perpetuity for agricultural use, but with an allowance for constructing or improving and maintaining 1 primary residence and housing for farmworkers on the land; and </text></paragraph><paragraph id="idA65A0BD6F33249FD935F23433B2D65F8"><enum>(2)</enum><text>subject in perpetuity to the conservation requirements that—</text><subparagraph id="ida3f42a59ac9c416a9f9390a5d12d8e55"><enum>(A)</enum><text>an animal feeding operation may not be operated on the land, with the exception that an animal feeding operation with fewer than 299 animal units may be operated during times of the year that outdoor access is not possible due to weather conditions; and</text></subparagraph><subparagraph id="id45c007dde460458eb18ba02a097837dc"><enum>(B)</enum><text>the land shall be subject to applicable highly erodible land and wetland conservation requirements in effect on the date of enactment of this Act under subtitles B and C of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3811">16 U.S.C. 3811</external-xref> et seq.).</text></subparagraph></paragraph></subsection><subsection id="id84cd6fdeb0f54bc5a9491c0e82fd54d1"><enum>(b)</enum><header>Right of reentry</header><paragraph id="idBD79C0801DD34F9FBFC4D5FF556A6D4E"><enum>(1)</enum><header>In general</header><text>A deed conveying a land grant under section 203(a)(2) shall include a right of reentry for the Secretary if the Secretary—</text><subparagraph id="id02863086A77D40FA8E461881CD55A3B5"><enum>(A)</enum><text>determines, after giving notice and a reasonable opportunity for a hearing, that a requirement described in subsection (a) of an easement attached to that land has been violated; and</text></subparagraph><subparagraph id="id6519C1D1B6284342BD3D508967630D65"><enum>(B)</enum><text>determines that the violation has not been remedied within 60 days after the date of the determination under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id23737A261837459ABC0FD612452D5D1E"><enum>(2)</enum><header>Expiration</header><text>The right of reentry described in paragraph (1) shall expire on the date that is 5 years after the date of conveyance.</text></paragraph></subsection><subsection id="idc8ea134708d9448e832826548397a167"><enum>(c)</enum><header>Right of first refusal</header><paragraph id="id19956EF941AE44548926FD3033F95385"><enum>(1)</enum><header>In general</header><text>Beginning on the day after the expiration date described in subsection (b)(2)—</text><subparagraph id="idDDA0D0D05D8A4DAAAAA18EEF3B280BF3"><enum>(A)</enum><text>the recipient of the land grant may sell the land; but </text></subparagraph><subparagraph id="idFE5B59D005D14EB8B3FDA263F72F61AA"><enum>(B)</enum><text>the Secretary shall have a right of first refusal to purchase the land at the appraised value of the land.</text></subparagraph></paragraph><paragraph id="id8573FFD268234F8B8560E5A01A5AF2BE"><enum>(2)</enum><header>Delegation</header><text>The Secretary may, on a case-by-case basis, delegate the right of first refusal under paragraph (1)(B) to a qualified entity that requests the delegation.</text></paragraph></subsection><subsection id="id55F377EC411644DAAA5FE3FE648520EA"><enum>(d)</enum><header>Requirement</header><text>If the Secretary purchases land under subsection (c)(1)(B), the Secretary shall convey the land to another eligible Black individual under section 203(a)(2).</text></subsection></section><section id="idADC501DC31874F3D83B8DF6DDF10A5BA"><enum>206.</enum><header>Eligibility for assistance</header><subsection id="id8517A7ECD1E24E7FAAFF23BE9675D463"><enum>(a)</enum><header>Farm operating loans</header><paragraph id="id568C4A1646784B7B9D41CEAC482C4F9D"><enum>(1)</enum><header>Eligible Black individuals</header><text>Beginning on the date of conveyance of a land grant under section 203(a)(2), the eligible Black individual that receives the land grant shall be eligible for a direct operating loan under subtitle B of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941</external-xref> et seq.), notwithstanding any borrower eligibility requirements under subparagraph (B) or (D) of section 311(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941(a)(1)</external-xref>) for such a loan.</text></paragraph><paragraph id="id05a28fe9e3274a189b67c4a0cce94124"><enum>(2)</enum><header>Socially disadvantaged farmers and ranchers</header><text>During the 5-year period beginning on the date of enactment of this Act, any socially disadvantaged farmer or rancher shall be eligible for a direct operating loan under subtitle B of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941</external-xref> et seq.), notwithstanding any borrower eligibility requirements under subparagraph (B) or (D) of section 311(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1941">7 U.S.C. 1941(a)(1)</external-xref>) for such a loan.</text></paragraph><paragraph id="id3A0DC9A952A44C6E877381C182054539"><enum>(3)</enum><header>Interest and deferment</header><text>In the case of an operating loan under paragraph (1) or (2)—</text><subparagraph id="id9377BA480EE9424EB4206A1EC10A54FC"><enum>(A)</enum><text>the interest rate shall be zero percent for the first 7 years of the term of the loan; and</text></subparagraph><subparagraph id="idA78EC714CEB541058EB76EAA6458E72E"><enum>(B)</enum><text>the Secretary of Agriculture shall defer payments for the first 24 months.</text></subparagraph></paragraph></subsection><subsection id="idf143e4097f70406b86573a43407f738c"><enum>(b)</enum><header>Single family home mortgages</header><text>Beginning on the date of conveyance of a land grant under section 203(a)(2), the eligible Black individual that receives the land grant shall be eligible for a direct loan under section 502 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1472">42 U.S.C. 1472</external-xref>), notwithstanding any borrower eligibility requirements for such a loan, for the construction or improvement of a single family home on the conveyed land.</text></subsection><subsection id="id82d12a51f71043e1a82dca69f6547f22"><enum>(c)</enum><header>Funding</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2021 through 2030. </text></subsection></section><section id="id279CAFF3CDEA4EBC87A1DD045297A714"><enum>207.</enum><header>Completion of farmer training program and succession planning</header><subsection id="idBF455C662A304223869B8091CD9DAAED"><enum>(a)</enum><header>Required training</header><text display-inline="yes-display-inline">As a condition on the receipt of a land grant under section 203(a)(2), any recipient who does not have at least 2 years of prior experience in agriculture shall be required to complete, at no cost, a farmer training program established pursuant to section 208(a)(4).</text></subsection><subsection id="id3A3CD39D75EB4108ABF3C2F463309B5F"><enum>(b)</enum><header>Optional training</header><text>Any eligible Black individual who has at least 2 years of prior experience in agriculture, and any socially disadvantaged farmer or rancher, may complete, at no cost, a farmer training program established pursuant to section 208(a)(4).</text></subsection><subsection id="id5e2320f6849745ffb8598de8a21fd30b"><enum>(c)</enum><header>Succession planning</header><text>As a condition on the receipt of a land grant under section 203(a)(2), each recipient shall collaborate with a qualified entity to develop a succession plan.</text></subsection></section><section id="id96E5CFA2DAA54F379A636B06B9FDAFA7"><enum>208.</enum><header>Grants for qualified entities</header><subsection id="idB334408BA1914FECB3E996B28D4294C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to provide grants to qualified entities to use as operating amounts—</text><paragraph id="id2DB0A60581E7400DA7C2DDA8AF0552C4"><enum>(1)</enum><text display-inline="yes-display-inline">to support eligible Black individuals in identifying land under section 204, including developing proposals for how land may be subdivided as described in subsection (b) of that section;</text></paragraph><paragraph id="id7DF4D53812854E09B961B6344914B39A"><enum>(2)</enum><text>to support eligible Black individuals in acquiring that land through a land grant under section 203(a)(2), including by submitting applications on behalf of eligible Black individuals under section 203(d)(2); </text></paragraph><paragraph id="id90a5e7dcd6694a1b84e7366dfa173e6e"><enum>(3)</enum><text>to support eligible Black individuals in starting up farm operations on that land; </text></paragraph><paragraph id="id1614d261bee84021904ad60750597478"><enum>(4)</enum><text>to provide eligible Black individuals and socially disadvantaged farmers and ranchers with farmer training; and </text></paragraph><paragraph id="id9ff9b00de5814e42be6d07b323b8f338"><enum>(5)</enum><text>to provide other assistance, including legal advocacy, succession planning, and support for the development of farmer cooperatives, to eligible Black individuals and other Black farmers and ranchers.</text></paragraph></subsection><subsection id="id46b004057f344117813af292e4c95179"><enum>(b)</enum><header>Funding</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $1,000,000,000 for each of fiscal years 2021 through 2030 to carry out this section.</text></subsection></section><section id="id9428d45060db4f23859621dd51a311a5"><enum>209.</enum><header>Farm Conservation Corps</header><subsection id="idf931274adec84975864ad5d295a6a6ec"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a civilian conservation corps, to be known as the <quote>Farm Conservation Corps</quote> to provide young adults ages 18 to 29 from socially disadvantaged groups with the academic, vocational, and social skills necessary to pursue long-term, productive careers in farming and ranching.</text></subsection><subsection id="id740d75be045a4a52bae50e9c38671f4d"><enum>(b)</enum><header>Requirement</header><text>To the maximum extent practicable, the Secretary shall enroll not fewer than 20,000 young adults in the Farm Conservation Corps pursuant to subsection (a) in each of fiscal years 2021 through 2030.</text></subsection><subsection id="id0193448d67e6408a8eb1a90dfd0c1004"><enum>(c)</enum><header>Farmworker services</header><text>Members of the Farm Conservation Corps shall serve as on-farm apprentices, at no cost, to—</text><paragraph id="id8E9A270B741041078DEA756CED13CB7B"><enum>(1)</enum><text>socially disadvantaged farmers and ranchers, the annual gross farm income of whom is less than $250,000;</text></paragraph><paragraph id="idD92AF8E8E332439DA52A42541CCB6D6F"><enum>(2)</enum><text>beginning farmers and ranchers, the annual gross farm income of whom is less than $250,000; and</text></paragraph><paragraph id="idb10fb395b66f493a8f47cd3f674f9d09"><enum>(3)</enum><text>farmers and ranchers operating certified organic farms (as defined in section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>)), the annual gross farm income of whom is less than $250,000. </text></paragraph></subsection><subsection id="ide3f8eabea1634d42bc3ffabbdaef8b66"><enum>(d)</enum><header>Duration of participation</header><text>An individual shall serve in the Farm Conservation Corps for not more than 2 years.</text></subsection><subsection id="id1d6f24f3c5bc4f1d972c9f4605dc2f92"><enum>(e)</enum><header>Housing and care</header><text>The Secretary shall provide to each member of the Farm Conservation Corps, for the duration of the participation—</text><paragraph id="idA547C3FA479941589022D7A6063157B3"><enum>(1)</enum><text>housing, subsistence, clothing, medical attention (including hospitalization), and transportation; or </text></paragraph><paragraph id="idF72A4A7339BA4AB5A04DF8FE2FF2A6AD"><enum>(2)</enum><text>a cash allowance sufficient for the applicable locality to cover costs described in paragraph (1).</text></paragraph></subsection><subsection id="id11862d56de1a447ab813d48b0eef3e01"><enum>(f)</enum><header>Compensation</header><text>Members of the Farm Conservation Corps shall be paid for their services as a farmworker at a rate consistent with the minimum wage applicable to a nonimmigrant described in section 101(a)(15)(H)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)</external-xref>) for services as a farmworker in the applicable locality. </text></subsection><subsection id="ida8f7681ec0474f15ba527e99f67574a6"><enum>(g)</enum><header>Funding</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $1,000,000,000 for each of fiscal years 2021 through 2030 to carry out this section.</text></subsection></section><section id="idc88b733b960e4867a4e901b511169779"><enum>210.</enum><header>Annual report to Congress</header><text display-inline="no-display-inline">The Secretary shall submit to Congress and make publicly available annual reports describing data on land grants under this title, including—</text><paragraph id="id9BCB2C65E08A46C7A80A2443958216C6"><enum>(1)</enum><text display-inline="yes-display-inline">the number of land grants;</text></paragraph><paragraph id="id0E62B41409594DBA981E15C7BD003962"><enum>(2)</enum><text display-inline="yes-display-inline">the recipients of land grants;</text></paragraph><paragraph id="id3EEB155003214C699FA85D2C557E291C"><enum>(3)</enum><text>the total number of acres of land granted;</text></paragraph><paragraph id="id58B9F19A73364714ADDA5DA5B8F05E5D"><enum>(4)</enum><text>the number of acres of land granted by county; and</text></paragraph><paragraph id="id3DD72DB9D3044AC2998B17F64A30C99D"><enum>(5)</enum><text>the types of new farming or ranching operations established on the granted land.</text></paragraph></section></title><title id="id09B43114C040400BA60FFD23FDAEE344" style="OLC"><enum>III</enum><header>Funding for Historically Black Colleges and Universities </header><section id="id2D5B3ECEA65A47B692D0C94557D7F354"><enum>301.</enum><header>Funding for historically Black colleges and universities</header><subsection id="id04AAD83DA8E64CE8900D6DF8A16F4426"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $500,000,000 for fiscal year 2021 and each of the succeeding 9 fiscal years for the Secretary of Education to provide funding to part B institutions (as defined in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>)).</text></subsection><subsection id="idbfc6a2c5e09f4430b55dc9ddd90ae9db"><enum>(b)</enum><header>Use of funding</header><text>The funding provided by subsection (a) shall be used by part B institutions described in that subsection—</text><paragraph id="id86ce38b0155b4a95bfcf17bd56181731"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8ED6655960B94F77A35DA1D52EFE3ACA"><enum>(A)</enum><text>to commence new courses of study and expand existing courses of study focused on careers in agriculture, agriculture-related fields, or other related disciplines; and </text></subparagraph><subparagraph id="id2FB9E18C8950431AA90BE940FF92EAEF" indent="up1"><enum>(B)</enum><text>to recruit students for those courses of study; and</text></subparagraph></paragraph><paragraph id="id933de1209d994f1dae817dc377f82e55"><enum>(2)</enum><text>to commence research to further the study of—</text><subparagraph id="idE2ABFDE35EE94676B9AAF502443B3B94"><enum>(A)</enum><text>regenerative agricultural practices; and </text></subparagraph><subparagraph id="id17E012061C6A45D6A2F0B75A8A0EE777"><enum>(B)</enum><text>market opportunities for socially disadvantaged farmers and ranchers.</text></subparagraph></paragraph></subsection></section><section id="id0271A6CE04DA4C0394AE84187F1C6345"><enum>302.</enum><header>USDA/1890 National Scholars Program</header><text display-inline="no-display-inline">The National Agricultural Research, Extension, and Teaching Policy Act of 1977 is amended by inserting after section 1446 (<external-xref legal-doc="usc" parsable-cite="usc/7/3222a">7 U.S.C. 3222a</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0EF3C8E72C1C406EBFF9136791424962"><section id="id2BA32C23CF8A4125A64EAF8BC37F9A78"><enum>1446A.</enum><header>USDA/1890 National Scholars Program</header><subsection id="id28905F5A364C41D6B64A12AF1459BB52"><enum>(a)</enum><header>Definition of program</header><text>In this section, the term <term>program</term> means the USDA/1890 National Scholars Program established by the Secretary.</text></subsection><subsection id="idBC1BA0315B3F4657A2132B461494390B"><enum>(b)</enum><header>Authorization</header><text>The Secretary shall continue to carry out the program.</text></subsection><subsection id="idC2B27BCB24F042728E2A9AF77B5E1FFB"><enum>(c)</enum><header>Funding</header><text>There is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, $20,000,000 for each fiscal year to carry out the program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="id8f5bb353115b47c1952431983812a3ec"><enum>IV</enum><header>Land Retention and Credit Assistance</header><section id="id12cd8d83cdb34efb9a04b98fc9fa3b08"><enum>401.</enum><header>Protections for land ownership</header><subsection id="idcb8e640756db4943a1d02228639ff557"><enum>(a)</enum><header>Relending program To resolve ownership and succession on farmland</header><text>Section 310I(g) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1936c">7 U.S.C. 1936c(g)</external-xref>) is amended by striking <quote>through 2023</quote> and inserting <quote>and 2020 and $50,000,000 for each of fiscal years 2021 through 2023</quote>.</text></subsection><subsection id="id13bc1e4fa2f14dca883f90ea6e5232b8"><enum>(b)</enum><header>Reports on land access and farmland ownership data collection</header><text>Section 12607(c) of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/2204i">7 U.S.C. 2204i(c)</external-xref>) is amended by striking <quote>through 2023</quote> and inserting <quote>and 2020 and $10,000,000 for each of fiscal years 2021 through 2023</quote>.</text></subsection><subsection id="id1d33b2a479374c1abe6fe18d18e928c4"><enum>(c)</enum><header>Family farmer income</header><text>Section 101(18)(A) of title 11, United States Code, is amended, in the matter preceding clause (i), by striking <quote>50 percent</quote> and inserting <quote>30 percent</quote>.</text></subsection></section><section id="idabea07a368bf46ddaf3506f8f0cfd789"><enum>402.</enum><header>Access to credit for socially disadvantaged farmers and ranchers</header><subsection id="id0a4f0a322d924cb9901f60394a668fdb"><enum>(a)</enum><header>National Socially Disadvantaged Farmer and Rancher Bank</header><paragraph id="idCEE10124BC10457E9B024EC0CB8621D5"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="idCC439A59AD1E46EFAB7358B1C267630C"><enum>(A)</enum><text>the term <term>Bank</term> means the National Socially Disadvantaged Farmer and Rancher Bank established under paragraph (2); </text></subparagraph><subparagraph id="id47BB1B1F541249E8AF40E02079AE4AC1"><enum>(B)</enum><text>the term <term>community development financial institution</term> has the meaning given the term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>); and</text></subparagraph><subparagraph id="idAF925C9C3B4D432981D3DD5E609279EF"><enum>(C)</enum><text>the term <term>eligible entity</term> means—</text><clause id="idB4D08EB2F1024EE0B4C58A621A01F0DD"><enum>(i)</enum><text>a credit union, mutual savings bank, or mutual savings and loan association—</text><subclause id="id000F10B8EBA148399E5BCED088D96610"><enum>(I)</enum><text>that— </text><item id="idB3509FF728984B3B96A551372356F48B"><enum>(aa)</enum><text>is operated on a cooperative, not-for-profit basis; and</text></item><item id="idB777EF896A8D44A892F4C7BABF6EC037"><enum>(bb)</enum><text>provides financial services or facilities for the benefit of—</text><subitem id="id70399F5360364E1DA5C516B98661C4FF"><enum>(AA)</enum><text>the members of the entity; or</text></subitem><subitem id="idF3B6F959299E428F8A1B648B900035E3"><enum>(BB)</enum><text>voting stockholders who are the ultimate recipients of those financial services or facilities; and</text></subitem></item></subclause><subclause id="idAE9D0C16F15F431AB7606AF68080C92B"><enum>(II)</enum><text>not less than 60 percent of the members or voting stockholders of which are socially disadvantaged farmers or ranchers; or</text></subclause></clause><clause id="idE42093B0E653479CBE539BFB90006807"><enum>(ii)</enum><text>a not-for-profit community development financial institution, if not less than 75 percent of the total dollar value of the loans made by the institution consist of loans made to socially disadvantaged farmers or ranchers.</text></clause></subparagraph></paragraph><paragraph id="id8A8FD8A854B44C2BA2AAF84E43B0D737"><enum>(2)</enum><header>Establishment of Bank</header><subparagraph id="idB4E19BDC14174FB6A6EB337D8F506ED6"><enum>(A)</enum><header>In general</header><text>Congress hereby creates and charters a bank to be known as the National Socially Disadvantaged Farmer and Rancher Bank, the sole mission of which shall be to provide financing and other assistance in accordance with the requirements of this subsection.</text></subparagraph><subparagraph id="idEE2DD434B93041008C7879DC379E0CC1"><enum>(B)</enum><header>Board of Directors</header><clause id="idDD6A6F66C66943878A487AB30871D1B2"><enum>(i)</enum><header>In general</header><text>The Bank shall be governed by a Board of Directors—</text><subclause id="idEDC465075B394BD8A70CFB4A61050060"><enum>(I)</enum><text>which shall consist of 13 members; and</text></subclause><subclause id="idA36D97F76E5143828CDBA5726F6E6ABB"><enum>(II)</enum><text>each member of which shall be appointed by the President, by and with the advice and consent of the Senate.</text></subclause></clause><clause id="idD7C8B2E75E2441D1B243F83471812344"><enum>(ii)</enum><header>Term</header><text>Each member of the Board of Directors of the Bank shall serve for a term of 3 years.</text></clause></subparagraph></paragraph><paragraph id="idCE86647786E64D1BB91468D44A244353"><enum>(3)</enum><header>Lending authority</header><subparagraph id="idDBF132C64CAE4A83A341FB29FD3D1BEA"><enum>(A)</enum><header>In general</header><text>The Bank may make loans and loan guarantees to eligible entities.</text></subparagraph><subparagraph id="id306535457E8946D8928105FE9BC58A00"><enum>(B)</enum><header>Terms</header><text>With respect to a loan made by the Bank to an eligible entity— </text><clause id="idF40EFB709F014B00990FF06BFAB12A1B"><enum>(i)</enum><text>the term of the loan shall be 30 years;</text></clause><clause id="idA461B1BBD29A4CDE9FF31F18DF0EB6A2"><enum>(ii)</enum><text>the interest rate with respect to the loan shall be the interest rate on 30-year Treasury bonds, as of the date on which the loan is made; and</text></clause><clause id="idF9296106375847DDAC307A8A688A99DE"><enum>(iii)</enum><text>before the end of the term described in clause (i), the eligible entity—</text><subclause id="id18219AB1D3EA48BBA13FBF262E35AB9D"><enum>(I)</enum><text>shall not be required to make any principal payments with respect to the loan; and</text></subclause><subclause id="id695CB25CE38040B9A7C48C5FCD59ADC4"><enum>(II)</enum><text>shall make interest payments with respect to the loan.</text></subclause></clause></subparagraph><subparagraph id="id62C4CB16074E4D4FA9C4B76B24AA1FEE"><enum>(C)</enum><header>Condition of financing for certain eligible entities</header><text>With respect to a loan or loan guarantee made under this paragraph to an eligible entity described in paragraph (1)(C)(ii), the Bank, as a condition of the financing, shall require the eligible entity to ensure that, for the full term of the loan or loan guarantee made by the Bank, not less than 75 percent of the total dollar value of the loans made by the eligible entity consist of loans made to socially disadvantaged farmers or ranchers.</text></subparagraph></paragraph><paragraph id="id539163053DAE4052860D4C6D5CA4A8DE"><enum>(4)</enum><header>Grant program</header><subparagraph id="id55212FDC02A14977A2C2BF62C336DB57"><enum>(A)</enum><header>In general</header><text>The Bank shall establish a program through which the Bank may make a grant to assist— </text><clause id="id1D76A50876C5424F8BA53A143EBE2A74"><enum>(i)</enum><text>an entity in becoming an eligible entity; or </text></clause><clause id="id07B60450E69346678EE5345391227299"><enum>(ii)</enum><text>an eligible entity with the commencement or expansion of operations of the eligible entity, including with respect to outreach, education, and training activities.</text></clause></subparagraph><subparagraph id="id712298A31C9A4B0E97DB9798BBC5916B"><enum>(B)</enum><header>Grant amount</header><text>The amount of a grant made under the program established under subparagraph (A) shall be not more than $3,000,000.</text></subparagraph><subparagraph id="id8E734A96E22543C6A3308DD0F72CFEFA"><enum>(C)</enum><header>First award</header><text>The first grant made by the Bank under the program established under subparagraph (A) shall be to an entity, not less than 60 percent of the members or stockholders of which are Black farmers or ranchers.</text></subparagraph></paragraph><paragraph id="id0F2672311B0945FAB45E3676023CF759"><enum>(5)</enum><header>Technical assistance</header><text>The Bank shall establish a program to provide technical assistance to eligible entities, including assistance in obtaining— </text><subparagraph id="id90D182DE5B304B119F74B7BDA1B65EDB"><enum>(A)</enum><text>approval from the National Credit Union Administration Board under section 104 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1754">12 U.S.C. 1754</external-xref>); and</text></subparagraph><subparagraph id="id3831D4B9727C417582E6F068E7A2CBED"><enum>(B)</enum><text>certification from the Community Development Financial Institutions Fund established under section 104(a) of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4701">12 U.S.C. 4701</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="idC9871E6745ED4B4FA6BF597D107B25AE"><enum>(6)</enum><header>Funding</header><subparagraph id="id0D3AA404BEDE48F49257F753AC97BDEB"><enum>(A)</enum><header>In general</header><text>There are appropriated to the Bank, out of any amounts in the Treasury not otherwise appropriated, $1,000,000,000 to carry out this subsection—</text><clause id="id707326B81FB54193897125729F57933B"><enum>(i)</enum><text>which shall remain available until expended; and</text></clause><clause id="idF3CE39D8240C49708AEC259A82260068"><enum>(ii)</enum><text>of which—</text><subclause id="idB5C760F2042E4C078AD8769D344D5D22"><enum>(I)</enum><text>not less than $50,000,000 shall be used to make grants under the program established under paragraph (4); and</text></subclause><subclause id="idF607F85F627642CF92ECA0EB7AAF7E5C"><enum>(II)</enum><text>not less than $50,000,000 shall be used to provide technical assistance under paragraph (5).</text></subclause></clause></subparagraph><subparagraph id="id61F7E7F72A2742A8980DF51B38CA2454"><enum>(B)</enum><header>Emergency designation</header><clause id="id711BF33068014C11A5BDB8AD0004AA95"><enum>(i)</enum><header>In general</header><text>The amounts provided under this paragraph are designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>). </text></clause><clause id="id3C53F5C200844D89A81FD267D5C82D77"><enum>(ii)</enum><header>Designation in Senate</header><text>In the Senate, this subsection is designated as an emergency requirement pursuant to section 4112(a) of H. Con. Res. 71 (115th Congress), the concurrent resolution on the budget for fiscal year 2018.</text></clause></subparagraph></paragraph></subsection><subsection id="id1be63454878c45ffba8b02bb055e193f"><enum>(b)</enum><header>CFPB authority To investigate claims of discrimination by farm credit system institutions</header><text>Section 5.31 of the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2267">12 U.S.C. 2267</external-xref>) is amended—</text><paragraph id="id77372eb453104929a8cfc184009e9bd9"><enum>(1)</enum><text>in the first sentence, by striking <quote>The Farm</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id823313d1816045a7936e484494b27bb7"><subsection id="id9a4786136bbf49e88bbbb6cc601bc3b6"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), the Farm</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ide324fc7af93e4b829e2c86ecc9d3d2c2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05af90e7b03a4daebb17fcd293bb7776"><subsection id="id62f561854a7d4fd39d692535a36d6c81"><enum>(b)</enum><header>Bureau of consumer financial protection</header><text>The Bureau of Consumer Financial Protection shall have enforcement authority over institutions and institution-affiliated parties with respect to claims of discrimination.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id87d3e0303290480185562850b5cf6d16"><enum>(c)</enum><header>Establishment of funding goals</header><text>The Secretary shall establish goals for the funding of programs to address racial disparities in the recipients of assistance provided by the Department of Agriculture, including the programs under section 2501 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279</external-xref>), to ensure that those programs directly support socially disadvantaged farmers and ranchers.</text></subsection><subsection id="id477c4e57ce1b4f4e8cfb09c343e89a98"><enum>(d)</enum><header>Public awareness campaigns</header><paragraph id="id70e5abd0cf314c1f85a775e520dad61e"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="id3d9de7e798254c77907d1aa54a08bc35"><enum>(A)</enum><text>conduct public awareness campaigns for socially disadvantaged farmers and ranchers relating to programs available for socially disadvantaged farmers and ranchers through the Department of Agriculture; and</text></subparagraph><subparagraph id="id0801840574264d38a7989100040db99a"><enum>(B)</enum><text>use 50 percent of the amount made available under paragraph (2) to provide funding for community organizations with history of working with socially disadvantaged farmers and ranchers to conduct community-based outreach.</text></subparagraph></paragraph><paragraph id="idafdf5a6e485e4c08897c30a77ade943e"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $50,000,000.</text></paragraph></subsection></section><section id="idb45c9be688cd4918b387c76da87e7bcd"><enum>403.</enum><header>Additional credit assistance</header><subsection id="idcc3baa2aa1a9480aa00656fdd11da6c7"><enum>(a)</enum><header>Refinancing of debt with farm loans</header><paragraph id="id27d1b89bce3d4527870e46c2e27db010"><enum>(1)</enum><header>Purposes of farm ownership loans</header><text>Section 303(a)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1923">7 U.S.C. 1923(a)(1)</external-xref>) is amended by striking subparagraph (E) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idff75341bfd144a9c8318ab6311a07aad"><subparagraph id="id72a43aa065914c579931bcf1b72fc724"><enum>(E)</enum><text>refinancing indebtedness.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="iddebf12ccbea144768c9fbf76c06a9a90"><enum>(2)</enum><header>Purposes of operating loans</header><text>Section 312(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1942">7 U.S.C. 1942(a)</external-xref>) is amended by striking paragraph (9) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id653261000fea4f5bad6301aca955a791"><paragraph id="id125cad7fe50f4b1fb66f67d7b1207800"><enum>(9)</enum><text>refinancing the indebtedness of a borrower; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id93156e616cb6447bb51a168b45683a82"><enum>(b)</enum><header>Removal of eligibility restriction based on previous debt write-Down or other loss</header><text>Section 373 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008h">7 U.S.C. 2008h</external-xref>) is amended—</text><paragraph id="id1da2e97224e843599bfb549d90d5471f"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idbeddf691106b413d92c67ecf97f3f6f7"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>and subsection (d)</quote> after <quote>paragraph (2)</quote>; and</text></subparagraph><subparagraph id="id6c8a656ef36a486c913afa33ecc1ba77"><enum>(B)</enum><text>in paragraph (2)(A)—</text><clause id="id4e14053ad7eb40f6b6d279948e5f21bd"><enum>(i)</enum><text>by striking clause (i);</text></clause><clause id="idda7c563b1e2441b18caaf94ed3f6bab5"><enum>(ii)</enum><text>in clause (ii), by striking <quote>chapters 11, 12, or 13 of Title 11 of the</quote> and inserting <quote>chapter 11, 12, or 13 of title 11,</quote>; and</text></clause><clause id="id8895be3079da40cb8118a31adf7c8f49"><enum>(iii)</enum><text>by redesignating clauses (ii) and (iii) as clauses (i) and (ii), respectively; and</text></clause></subparagraph></paragraph><paragraph id="idb7ad07b4b6ee49a783cfa5999c98ccdc"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb2e5fdb335f84908b1bf592b34578689"><subsection id="id8fb25bcd3d9240698b012c1d2f1567ed"><enum>(d)</enum><header>Prohibition on eligibility restriction based on debt write-Down or other loss</header><text>The Secretary shall not restrict the eligibility of a borrower for a farm ownership or operating loan under subtitle A or B based on a previous debt write-down or other loss to the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ida251cf18604d4cacb73961d1162ddfb5"><enum>(c)</enum><header>Authorization for loans</header><text>Section 346(b)(1) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1994">7 U.S.C. 1994(b)(1)</external-xref>) is amended—</text><paragraph id="id1f18d913eca44546940ace540e6385be"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>$10,000,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$20,000,000,000 for each of fiscal years 2021 through 2023</quote>; and</text></paragraph><paragraph id="id56a2e4cfd1b44169925c6ad2aaa70367"><enum>(2)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id930c52fc0ef74afaa897b768c00bd51f"><subparagraph id="ide05b7b0df29942d28680f9a7d381835b"><enum>(A)</enum><text>$10,000,000,000 shall be for farm ownership loans under subtitle A; and</text></subparagraph><subparagraph id="id64dab92ba86640f89ba16d39534f9cdd"><enum>(B)</enum><text>$10,000,000,000 shall be for operating loans under subtitle B.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id68030e6591f7476bb25ad8d73a508aa9"><enum>(d)</enum><header>Loan forgiveness for settlements applicants in Pigford I</header><paragraph id="id5bc30a8a33a14315838ec0348ba00069"><enum>(1)</enum><header>Definition of covered borrower</header><text>In this subsection, the term <term>covered borrower</term> means a Black farmer or rancher that—</text><subparagraph id="id4a7b2acc116043daa164986a09531124"><enum>(A)</enum><text>submitted a claim under the settlement agreement and consent decree in Pigford v. Glickman, 185 F.R.D. 82 (D.D.C. 1999); and</text></subparagraph><subparagraph id="id00d5731f321d4323abd2839bfad54f21"><enum>(B)</enum><text>as of the date of enactment of this Act, has indebtedness on a loan made or guaranteed by the Secretary.</text></subparagraph></paragraph><paragraph id="id6570b6cacb684f3fadc614b350a37084"><enum>(2)</enum><header>Loan forgiveness</header><text>The Secretary shall—</text><subparagraph id="id15e0b881f48547529e1b79aa93db05ab"><enum>(A)</enum><text>forgive the indebtedness of a covered borrower on a loan made by the Secretary; and</text></subparagraph><subparagraph id="id8d60ff13aa0347b68b87a4e9132b8c62"><enum>(B)</enum><text>require a lender of a loan guaranteed by the Secretary for a covered borrower to forgive the indebtedness of that covered borrower on that loan.</text></subparagraph></paragraph><paragraph id="id63fa1ad34e824f5b8aea0830af518075"><enum>(3)</enum><header>Reimbursement for payments and other funds seized</header><text>The Secretary shall provide to a covered borrower a payment equal to the amount, if any, of payments of tax refunds, payments under the old-age, survivors, and disability insurance benefits program established under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref> et seq.), and any other funds of the covered borrower that were seized after the date of the settlement agreement and consent decree described in paragraph (1)(A) in partial or full satisfaction of debt that, if the payments or other funds had not been seized, would have been forgiven under this subsection. </text></paragraph><paragraph id="id11908c6b30fa44139e0a44183a2752b8"><enum>(4)</enum><header>Farmer grants</header><text>The Secretary shall provide to a covered borrower a grant equal to 30 percent of the amount of the debt forgiven with respect to the covered borrower under this subsection. </text></paragraph></subsection><subsection id="idcdfe6435b6174ec993003e1012e61919"><enum>(e)</enum><header>Farm service agency loan eligibility for heirs with undivided property ownership interests</header><text>Subtitle D of the Consolidated Farm and Rural Development Act is amended by inserting after section 331F (<external-xref legal-doc="usc" parsable-cite="usc/7/1981f">7 U.S.C. 1981f</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id692593222C7643139BD11D2D8A06D7F6"><section id="idD4027382E5674C1F8001F63D2FB4AE86"><enum>331G.</enum><header>Eligibility of tenants in common for loans</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a tenant in common shall be eligible for a direct or guaranteed farm ownership loan under subtitle A, a direct or guaranteed operating loan under subtitle B, or a direct or guaranteed emergency loan under subtitle C if the tenant in common submits to the Secretary an agreement—</text><paragraph id="id47B4AD6BB99B43A29DFBDED0F0C305E1"><enum>(1)</enum><text display-inline="yes-display-inline">entered into by each person that owns a property interest in or to the applicable property; and</text></paragraph><paragraph id="id091B399A209C47379CE8245A439DACD6"><enum>(2)</enum><text display-inline="yes-display-inline">that includes—</text><subparagraph id="idbd6097e4f9e04faaa36c390b632091c4"><enum>(A)</enum><text>clear identification of—</text><clause id="idA7D954BA2A6144EFB3A6872F69FBEF90"><enum>(i)</enum><text>the owners of the property, as of the date on which the agreement is submitted; and </text></clause><clause id="id1EE676992BDD4C99926A887B14372BF9"><enum>(ii)</enum><text>the percentages of ownership of each owner described in clause (i);</text></clause></subparagraph><subparagraph id="id797942711f4d46b4ad8d1b89e0b7067b"><enum>(B)</enum><text>identification of the property and a description of the proposed use of the property;</text></subparagraph><subparagraph id="ide295aab96d1140669209c96f3fb9a615"><enum>(C)</enum><text>a process for payment of expenses and application and disbursement of any proceeds or profits among the owners of the property;</text></subparagraph><subparagraph id="id89e9043ee77b4747ba3fe7622643a883"><enum>(D)</enum><text>appointment of a lead responsible person for farm management;</text></subparagraph><subparagraph id="id78d50b4247fd4e7db5385d37ef7b8b6c"><enum>(E)</enum><text>a dispute resolution process; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1e6d2c658e24afc858502dac466ba03"><enum>(F)</enum><text>a buy-out provision that allows an heir of the property to sell the property interest of the heir in and to the property.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2e1e9d11208b43388abc53e7a8e4ea24"><enum>404.</enum><header>Foreclosure moratorium</header><text display-inline="no-display-inline">Effective during the period beginning on the date of enactment of this Act and ending on the date that is 1 year after the date on which the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19 (or any successor declaration) is lifted, there shall be a moratorium on the Department of Agriculture instituting or completing any foreclosure action on a loan secured by a first or subordinate lien on real property that includes a residence and farmland. </text></section></title><title style="OLC" id="id431C445B659D4BB58C9BAB6ECFAFF1A2"><enum>V</enum><header>Agricultural System Reforms</header><subtitle id="id716D4B7C5A124C6384643DA0FC24C482" style="OLC"><enum>A</enum><header>Amendments to Packers and Stockyards Act, 1921</header><section commented="no" id="id66883acbd95547719db3055bd53a30aa"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/182">7 U.S.C. 182(a)</external-xref>) is amended—</text><paragraph id="id9a0f8c3b935e4b52bcb9e6ec0c89835d"><enum>(1)</enum><text>in paragraph (8), by striking <quote>for slaughter</quote> and all that follows through <quote>of such poultry</quote> and inserting <quote>under a poultry growing arrangement, regardless of whether the poultry is owned by that person or another person</quote>;</text></paragraph><paragraph id="id9ef454ebed4a48fda18a969f5c73f552"><enum>(2)</enum><text>in paragraph (9), by striking <quote>and cares for live poultry for delivery, in accord with another's instructions, for slaughter</quote> and inserting <quote>or cares for live poultry in accordance with the instructions of another person</quote>;</text></paragraph><paragraph id="idC3D76D99F2C24894BF928BB401A1AA71"><enum>(3)</enum><text>in each of paragraphs (1) through (9), by striking the semicolon at the end and inserting a period;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd0efce98f30d49c08a137b8f0b7294f8"><enum>(4)</enum><text>in paragraph (10)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id969055F4CCEF473F919366542AE7FB28"><enum>(A)</enum><text>by striking <quote>for the purpose of either slaughtering it or selling it for slaughter by another</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14691AB6F7B34357A4836863792D096F"><enum>(B)</enum><text>by striking <quote>; and</quote> at the end and inserting a period; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idECD201611A6C44AA8A220B5930A0300A"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block id="HAD39E27124AE4D1185DBCA5BFB00A4BD"><paragraph id="H756AD5B6CBA54058863DBE67AE7D0389"><enum>(15)</enum><header>Formula price</header><subparagraph id="HDE35D934E67A4515B46048A510734E09"><enum>(A)</enum><header>In general</header><text>The term <term>formula price</term> means any price term that establishes a base from which a purchase price is calculated on the basis of a price that will not be determined or reported until a date that is after the date on which the forward price is established.</text></subparagraph><subparagraph id="HA4C0856A132E41F5903FB85828D02EE0"><enum>(B)</enum><header>Exclusion</header><text>The term <term>formula price</term> does not include—</text><clause id="H009005FBA6194651ADA342A6DE472B2D"><enum>(i)</enum><text>any price term that establishes a base from which a purchase price is calculated on the basis of a futures market price; or</text></clause><clause id="H1370182050C1408199D1EF31DCCD25D"><enum>(ii)</enum><text>any adjustment to the base for quality, grade, or other factors relating to the value of livestock or livestock products that are readily verifiable market factors and are outside the control of the packer.</text></clause></subparagraph></paragraph><paragraph id="H6AFA2E3776264B258BC0DC9BCBD1E977"><enum>(16)</enum><header>Forward contract</header><text>The term <term>forward contract</term> means an oral or written contract for the purchase of livestock that provides for the delivery of the livestock to a packer at a date that is more than 7 days after the date on which the contract is entered into, without regard to whether the contract is for—</text><subparagraph id="HF71E947B0A2C4AD68763508215BE79C8"><enum>(A)</enum><text>a specified lot of livestock; or</text></subparagraph><subparagraph id="H3701E2A77A464E8395744DA262DFC281"><enum>(B)</enum><text>a specified number of livestock over a certain period of time.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id68b206ba105148738e935a5e206b46de"><enum>502.</enum><header>Unlawful practices</header><subsection id="idF3A71097F70A4977B2DEE7793818FB43"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) is amended—</text><paragraph id="id3967546224F845129FAD362338BBDB62"><enum>(1)</enum><text>by redesignating subsections (a) through (f) and (g) as paragraphs (1) through (6) and (10), respectively, and indenting appropriately;</text></paragraph><paragraph id="id2ADACF482D7443C599BF3508E02FB5B8"><enum>(2)</enum><text>by striking the section designation and all that follows through <quote>It shall be</quote> in the matter preceding paragraph (1) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF7DDCA4C4FCD4BF8911DEC92BC4A3DCF"><section id="id758497FABB9245D8BC7353B8A5583844"><enum>202.</enum><header>Unlawful acts</header><subsection id="id73C08783AD3C455C947FD14651995398"><enum>(a)</enum><header>In general</header><text>It shall be</text></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idB382177AD5374055B770A8BCE551A950"><enum>(3)</enum><text>in subsection (a)—</text><subparagraph id="idA6D6472447B0448FA8BF765C103E8045"><enum>(A)</enum><text>in the matter preceding paragraph (1) (as so redesignated), by striking <quote>to:</quote> and inserting <quote>to do any of the following:</quote>;</text></subparagraph><subparagraph id="idB2E954CF4F834EFB877809E242FFBBFE"><enum>(B)</enum><text>in each of paragraphs (1) through (6) (as so redesignated), by striking <quote>; and</text></clause><clause id="id901138b345b449fa95f723072e8f511b"><enum>(iii)</enum><text>by striking <quote>(3)</quote> and inserting <quote>(C)</quote>;</text></clause></subparagraph><subparagraph id="idF353498228894A27B6D2A51D576DA91B"><enum>(D)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9A609B187D6341C6B6663678C8CC036A"><paragraph id="idC016E7D6F73F4F648444E8D6D618077A"><enum>(7)</enum><text>Use, in effectuating any sale of livestock, a forward contract that—</text><subparagraph id="H20BFA452C70B4B24A1BFBC87E6A0CF1C"><enum>(A)</enum><text>does not contain a firm base price that may be equated to a fixed dollar amount on the date on which the forward contract is entered into;</text></subparagraph><subparagraph id="HA92FCFFC0BBA4D5099EC4B16F902DB40"><enum>(B)</enum><text>is not offered for bid in an open, public manner under which—</text><clause id="HCEDDFA81B6174102B0DC6ECA4EDE06B0"><enum>(i)</enum><text>buyers and sellers have the opportunity to participate in the bid;</text></clause><clause id="H4769922F2857493386FA9D672B044391"><enum>(ii)</enum><text>more than 1 blind bid is solicited; and</text></clause><clause id="HEEC0D2F8133344FEAE2045A7D432CC3"><enum>(iii)</enum><text>buyers and sellers may witness bids that are made and accepted;</text></clause></subparagraph><subparagraph id="HAD91EC8A39B6488EB31864F187AAE0D5"><enum>(C)</enum><text>is based on a formula price; or</text></subparagraph><subparagraph id="H6995D7D0BF944B74A353AC1F40B84C01"><enum>(D)</enum><text>provides for the sale of livestock in a quantity in excess of—</text><clause id="H715524320E754326A6A62885A7B2BE69"><enum>(i)</enum><text>in the case of cattle, 40 cattle;</text></clause><clause id="H1447788377044CEBB9E9CD30BC3610D6"><enum>(ii)</enum><text>in the case of swine, 30 swine; and</text></clause><clause id="H527BBD33841F43C0B35CB5E4CE2BFFBB"><enum>(iii)</enum><text>in the case of another type of livestock, a comparable quantity of that type of livestock, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id6C4174B2A6714648970934FE0F509581"><enum>(8)</enum><text>Own or feed livestock directly, through a subsidiary, or through an arrangement that gives a packer operational, managerial, or supervisory control over the livestock, or over the farming operation that produces the livestock, to such an extent that the producer of the livestock is not materially participating in the management of the operation with respect to the production of the livestock, except that this paragraph shall not apply to—</text><subparagraph id="idF6DD2DF3F11A44D8B0FA7D4718C22390"><enum>(A)</enum><text>an arrangement entered into not more than 7 business days before slaughter of the livestock by a packer, a person acting through the packer, or a person that directly or indirectly controls, or is controlled by or under common control with, the packer;</text></subparagraph><subparagraph id="idD83D0A418CA3491C8C882794E2D41E17"><enum>(B)</enum><text>a cooperative or entity owned by a cooperative, if a majority of the ownership interest in the cooperative is held by active cooperative members that—</text><clause id="id24A43FAC032A42D28E2204E588630ABF"><enum>(i)</enum><text>own, feed, or control the livestock; and</text></clause><clause id="id9B1A50FE2FFB4DF1B537DEF589FC3514"><enum>(ii)</enum><text>provide the livestock to the cooperative for slaughter;</text></clause></subparagraph><subparagraph id="id23AAF7BF9D934C139AF4879613664564"><enum>(C)</enum><text>a packer that is not required to report to the Secretary on each reporting day (as defined in section 212 of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635a">7 U.S.C. 1635a</external-xref>)) information on the price and quantity of livestock purchased by the packer; or</text></subparagraph><subparagraph id="id61ED511AF4044F1396BBEEACC0B3D7C4"><enum>(D)</enum><text>a packer that owns only 1 livestock processing plant.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c2f16651b5544dca43240496665cc19"><enum>(9)</enum><text display-inline="yes-display-inline">Take any action that adversely affects or is likely to adversely affect competition, regardless of whether there is a business justification for the action.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id520FDC892E264BA0B701DD26358A0A5A"><enum>(E)</enum><text>in paragraph (10) (as so redesignated), by striking <quote>subdivision (a), (b), (c), (d), or (e)</quote> and inserting <quote>paragraphs (1) through (9)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E448AB83BFE4E0E8CCA73232C7DF3B5"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2F99B8D93FF74E6F8D9FCDD4BC288F76"><subsection id="id5E4CEE5294F0452D96B0ED0938B5244B"><enum>(b)</enum><header>Unfair, discriminatory, and deceptive practices and devices</header><text display-inline="yes-display-inline">Acts by a packer, swine contractor, or live poultry dealer that violate subsection (a)(1) include the following:</text><paragraph id="id474af8e1ae8d4f248c86059b1a8f6a5a"><enum>(1)</enum><text>Refusal to provide, on the request of a livestock producer, swine production contract grower, or poultry grower with which the packer, swine contractor, or live poultry dealer has a marketing or delivery contract, the relevant statistical information and data used to determine the compensation paid to the livestock producer, swine production contract grower, or poultry grower, as applicable, under the contract, including—</text><subparagraph id="id0ff0f9672cc14c619e0ea6a8a5e09e36"><enum>(A)</enum><text>feed conversion rates by house, lot, or pen;</text></subparagraph><subparagraph id="id5a964b71bb524fb2bb6a42f40fe5f0d2"><enum>(B)</enum><text>feed analysis;</text></subparagraph><subparagraph id="idda9ab9432d924af3bea54ee514b7b2f4"><enum>(C)</enum><text>breeder history;</text></subparagraph><subparagraph id="id380d4a81bfc143278977dada22e33d54"><enum>(D)</enum><text>quality grade;</text></subparagraph><subparagraph id="idf36d1554ee4c429fa74bae6cbc4ed67b"><enum>(E)</enum><text>yield grade; and</text></subparagraph><subparagraph id="id21568b63b56544fc9d9919ab47f0b1e5"><enum>(F)</enum><text>delivery volume for any certified branding program (such as programs for angus beef or certified grassfed or Berkshire pork).</text></subparagraph></paragraph><paragraph id="id39008bd768a6415e87997b61d326cdec"><enum>(2)</enum><text>Conduct or action that limits or attempts to limit by contract the legal rights and remedies of a livestock producer, swine production contract grower, or poultry grower, including the right—</text><subparagraph id="idf8da1a6dd93a46599f0ed9469fc8424d"><enum>(A)</enum><text>to a trial by jury, unless the livestock producer, swine production contract grower, or poultry grower, as applicable, is voluntarily bound by an arbitration provision in a contract;</text></subparagraph><subparagraph id="ide6aa6a4266584760b6575eb027c977d1"><enum>(B)</enum><text>to pursue all damages available under applicable law; and</text></subparagraph><subparagraph id="id6c042dd5c8634728a9a2ab3ddce5023e"><enum>(C)</enum><text>to seek an award of attorneys' fees, if available under applicable law.</text></subparagraph></paragraph><paragraph id="id4175c14b395542e092353f0f20f572c9"><enum>(3)</enum><text>Termination of a poultry growing arrangement or swine production contract with no basis other than an allegation that the poultry grower or swine production contract grower failed to comply with an applicable law, rule, or regulation.</text></paragraph><paragraph id="id387b1ae4c29246649adbd21687eab664"><enum>(4)</enum><text>A representation, omission, or practice that is likely to mislead a livestock producer, swine production contract grower, or poultry grower regarding a material condition or term in a contract or business transaction.</text></paragraph></subsection><subsection commented="no" id="id0A71B4F56B9043B7897665328D1A945E"><enum>(c)</enum><header>Undue or unreasonable preferences, advantages, prejudices, and disadvantages</header><paragraph commented="no" id="idCB344519DA664AF3973FCB7F868DEA30"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Acts by a packer, swine contractor, or live poultry dealer that violate subsection (a)(2) include the following:</text><subparagraph id="id9081b920d60f4affbd001b5b0cfdd514"><enum>(A)</enum><text>A retaliatory action (including coercion or intimidation) or the threat of retaliatory action—</text><clause id="id6DD7A4E9E9EF46AA887B09D677A374BF"><enum>(i)</enum><text>in connection with the execution, termination, extension, or renewal of a contract or agreement with a livestock producer, swine production contract grower, or poultry grower aimed to discourage the exercise of the rights of the livestock producer, swine production contract grower, or poultry grower under this Act or any other law; and</text></clause><clause id="id0C4D36A4511D4F09892EE95BF11A98FB"><enum>(ii)</enum><text>in response to lawful communication (including as described in paragraph (2)), association, or assertion of rights by a livestock producer, swine production contract grower, or poultry grower.</text></clause></subparagraph><subparagraph id="id646FA79D07E7427982CEC1A19A6A4FAC"><enum>(B)</enum><text>Use of the tournament system for poultry as described in paragraph (3).</text></subparagraph></paragraph><paragraph commented="no" id="id854ba61358e141e1806f41622e023872"><enum>(2)</enum><header>Lawful communication described</header><text>A lawful communication referred to in paragraph (1)(A)(ii) includes—</text><subparagraph commented="no" id="idb7d955602d684116baec978f5437a28f"><enum>(A)</enum><text>a communication with officials of a Federal agency or Members of Congress;</text></subparagraph><subparagraph commented="no" id="idb026bee8999d4d16ae1293e724ce49d4"><enum>(B)</enum><text>any lawful disclosure that demonstrates a reasonable belief of a violation of this Act or any other law; and</text></subparagraph><subparagraph commented="no" id="idd0157471688b4b4699b55d0c9c3ef740"><enum>(C)</enum><text>any other communication that assists in carrying out the purposes of this Act.</text></subparagraph></paragraph><paragraph id="id87417874338b460691cd8284b6d323d6"><enum>(3)</enum><header>Use of tournament system for poultry</header><subparagraph id="id0455a5ac97c94b25b114fd0716a938ee"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a live poultry dealer shall be in violation of subsection (a)(2) if the live poultry dealer determines the formula for calculating the pay of a poultry grower in a tournament group by comparing the performance of the birds of other poultry growers in the group using factors outside the control of the poultry grower and within the control of the live poultry dealer.</text></subparagraph><subparagraph id="idF63716A77EAA47F79EFE82AF43741B79"><enum>(B)</enum><header>Exception</header><text>Under subparagraph (A), a live poultry dealer shall not be found in violation of subsection (a)(2) if the live poultry dealer demonstrates through clear and convincing evidence that the inputs and services described in subparagraph (C) that were used in the comparative evaluation were substantially the same in quality, quantity, and timing, as applicable, for all poultry growers in the tournament group.</text></subparagraph><subparagraph id="id41adc6bc00ee42509a6aa1cb2e96a0ec"><enum>(C)</enum><header>Inputs and services described</header><text>The inputs and services referred to in subparagraph (B) include, with respect to poultry growers in the same tournament group—</text><clause id="idc95f95dd09e74ddeab5346b8edcbced9"><enum>(i)</enum><text>the quantity, breed, sex, and age of chicks delivered to each poultry grower;</text></clause><clause id="id6507c9a39710461083c5d1ca3d59c3a9"><enum>(ii)</enum><text>the breed and age of the breeder flock from which chicks are drawn for each poultry grower;</text></clause><clause id="idac4968f57dab4fda99b8adf47d69aaff"><enum>(iii)</enum><text>the quality, type (such as starter feed), and quantity of feed delivered to each poultry grower;</text></clause><clause id="id1466e62cd1d14a1b92307199be485317"><enum>(iv)</enum><text>the quality of and access to medications for the birds of each poultry grower;</text></clause><clause id="id8cbcea041728465ebe647d9c5d74bd3c"><enum>(v)</enum><text>the number of birds in a flock delivered to each poultry grower;</text></clause><clause id="id9a6d022ed6a14f0a985e4a2c8ba12270"><enum>(vi)</enum><text>the timing of the pick-up of birds for processing (including the age of the birds and the number of days that the birds are in the care of the poultry grower) for each poultry grower;</text></clause><clause id="idb3d814ddb8924797ae59dc32139c370f"><enum>(vii)</enum><text>the death loss of birds during pick-up, transport, and time spent at the processing plant for each poultry grower;</text></clause><clause id="idd010ba6b599b4764882ad1abd7f919d6"><enum>(viii)</enum><text>condemnations of parts of birds due to actions in processing for each poultry grower;</text></clause><clause id="id8da8428f93334a15810d3c82535aa599"><enum>(ix)</enum><text>condemnations of whole birds due to the fault of the poultry grower;</text></clause><clause id="ida7c21f4f6f134d9bb5ca4ed4c99a8305"><enum>(x)</enum><text>the death loss of birds due to the fault of the poultry grower;</text></clause><clause id="idbf11bbd44b7f4c83aa4a35c24440eeee"><enum>(xi)</enum><text>the stated reasons for the cause of the death losses and condemnations described in clauses (vii) through (x);</text></clause><clause id="id1b5762e30dd74c868e4fbf5f9e3901f2"><enum>(xii)</enum><text>the type and classification of each poultry grower; and</text></clause><clause id="id0fa18a1af5174ef190b0b161b5e05c92"><enum>(xiii)</enum><text>any other input or service that may have an impact on feed conversion to weight gain efficiency or the life span of the birds of each poultry grower.</text></clause></subparagraph></paragraph></subsection><subsection id="id8C88BAA30F2C47299C74391300E91C81"><enum>(d)</enum><header>Harm to competition not required</header><text>In determining whether an act, device, or conduct is a violation under paragraph (1) or (2) of subsection (a), a finding that the act, device, or conduct adversely affected or is likely to adversely affect competition is not required.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1d06892ac2794bb2ab9f4d042bbaa6ea"><enum>(b)</enum><header>Effective date</header><paragraph id="id4ff7afb06b61422c89c9c4fe97f8d16d"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), paragraph (8) of section 202(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) (as designated by subsection (a)(2)) shall take effect on the date of enactment of this Act.</text></paragraph><paragraph id="id2c2ad4c3c3be40138d34e1e56cf46f5e"><enum>(2)</enum><header>Transition rules</header><text>In the case of a packer that, on the date of enactment of this Act, owns, feeds, or controls livestock intended for slaughter in violation of paragraph (8) of section 202(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) (as designated by subsection (a)(2)), that paragraph shall take effect—</text><subparagraph id="idcbb311e452454ec4a5586d219d005f3c"><enum>(A)</enum><text>in the case of a packer of swine, beginning on the date that is 18 months after the date of enactment of this Act; and</text></subparagraph><subparagraph id="id168654e468444eeaa279d75d10176b65"><enum>(B)</enum><text>in the case of a packer of any other type of livestock, beginning not later than 180 days after the date of enactment of this Act, as determined by the Secretary.</text></subparagraph></paragraph></subsection></section><section section-type="subsequent-section" id="id23DB75AB011447AF85A5C2119D4DD0A0"><enum>503.</enum><header>Spot market purchases of livestock by packers</header><text display-inline="no-display-inline">The Packers and Stockyards Act, 1921, is amended by inserting after section 202 (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida17fc3dacb5e4a318a0c537c93e05607"><section id="idff86cc72140f4a6ab98ade0adc14f1bb"><enum>202A.</enum><header>Spot market purchases of livestock by packers</header><subsection id="id1151b46cddb14ce28187875423251c98"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id537a58af7f9c4047bdf2badadd3c050a"><enum>(1)</enum><header>Covered packer</header><subparagraph id="id27d473d3853e408c8761d8be69b7750e"><enum>(A)</enum><header>In general</header><text>The term <term>covered packer</term> means a packer that is required under subtitle B of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1635">7 U.S.C. 1635</external-xref> et seq.) to report to the Secretary each reporting day information on the price and quantity of livestock purchased by the packer.</text></subparagraph><subparagraph id="id02eadd7808874020baeed5b1e040e378"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered packer</term> does not include a packer that owns only 1 livestock processing plant.</text></subparagraph></paragraph><paragraph id="idafc725679ef1464e8d2123eb5d096384"><enum>(2)</enum><header>Nonaffiliated producer</header><text>The term <term>nonaffiliated producer</term> means a producer of livestock—</text><subparagraph id="idac0739f768d243b5b5e6b2f3a8fbe031"><enum>(A)</enum><text>that sells livestock to a packer;</text></subparagraph><subparagraph id="id2b4e1dbfe4934002906fddb6d5fc506b"><enum>(B)</enum><text>that has less than 1 percent equity interest in the packer;</text></subparagraph><subparagraph id="idf381d3b6fe3c401cb0ebc9a00d182656"><enum>(C)</enum><text>that has no officers, directors, employees, or owners that are officers, directors, employees, or owners of the packer;</text></subparagraph><subparagraph id="idf5a54508029b49a1ab54dc2a8ffd063e"><enum>(D)</enum><text>that has no fiduciary responsibility to the packer; and</text></subparagraph><subparagraph id="id0926aa2c441741a786c9f4e934a45d3c"><enum>(E)</enum><text>in which the packer has no equity interest.</text></subparagraph></paragraph><paragraph id="idd60d4a58127a4d3190eaf37f7747ff99"><enum>(3)</enum><header>Spot market sale</header><subparagraph id="idef076ec959914615a43a4d78bd37b009"><enum>(A)</enum><header>In general</header><text>The term <term>spot market sale</term> means a purchase and sale of livestock by a packer from a producer—</text><clause id="id3d6ae62fa7414e00b0a9870b1da35a3e"><enum>(i)</enum><text>under an agreement that specifies a firm base price that may be equated with a fixed dollar amount on the date the agreement is entered into;</text></clause><clause id="id64677b8d39bc4103b911450ea2b69b56"><enum>(ii)</enum><text>under which the livestock are slaughtered not more than 7 days after the date on which the agreement is entered into; and</text></clause><clause id="iddfcd0aaf5a0545fb9f09533eb2020f8b"><enum>(iii)</enum><text>under circumstances in which a reasonable competitive bidding opportunity exists on the date on which the agreement is entered into.</text></clause></subparagraph><subparagraph id="id2e03873a370f4b0cb60273e549ce8127"><enum>(B)</enum><header>Reasonable competitive bidding opportunity</header><text>For the purposes of subparagraph (A)(iii), a reasonable competitive bidding opportunity shall be considered to exist if—</text><clause id="id4cdf59496bfd4aa3816d504b9a9c2810"><enum>(i)</enum><text>no written or oral agreement precludes the producer from soliciting or receiving bids from other packers; and</text></clause><clause id="id6deef161813044718ddb76000eb3394c"><enum>(ii)</enum><text>no circumstance, custom, or practice exists that—</text><subclause id="idf1ad4166065d4c5fb1406a3bc943f798"><enum>(I)</enum><text>establishes the existence of an implied contract (as determined in accordance with the Uniform Commercial Code); and</text></subclause><subclause id="idb9ec9e0209a74637af320b84236f49a9"><enum>(II)</enum><text>precludes the producer from soliciting or receiving bids from other packers.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="idcb35c2d3195d4ade9d963d446c7da688"><enum>(b)</enum><header>General rule</header><text>Of the quantity of livestock that is slaughtered by a covered packer during each reporting day in each plant, the covered packer shall slaughter not less than the applicable percentage specified in subsection (c) of the quantity through spot market sales from nonaffiliated producers.</text></subsection><subsection id="ida8c4a8d77f7a4e5d9decdfdad0802a45"><enum>(c)</enum><header>Applicable percentages</header><paragraph id="id0ebe02ee70834f21b537867ce87b78ab"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the applicable percentage shall be 50 percent.</text></paragraph><paragraph id="idd819ee21fcc54a1e953a4042491e75e5"><enum>(2)</enum><header>Exceptions</header><text>In the case of a covered packer that reported to the Secretary in the 2018 annual report that more than 60 percent of the livestock of the covered packer were committed procurement livestock, the applicable percentage shall be the greater of—</text><subparagraph id="id2f5ec9314a7d452ca0003730f7f486ef"><enum>(A)</enum><text>the difference between the percentage of committed procurement so reported and 100 percent; and</text></subparagraph><subparagraph commented="no" id="id1fb06e98daa849f6b1effed1ae32eab0"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idcd04429c5edd4f97b28c876eb2c1736e"><enum>(i)</enum><text>during calendar year 2021, 20 percent;</text></clause><clause commented="no" id="id9675b38339c2495b9f4eeb395a7c64a4" indent="up1"><enum>(ii)</enum><text>during each of calendar years 2022 and 2023, 30 percent; and</text></clause><clause commented="no" id="id82217600f6b643d294bd61378ddc7dd2" indent="up1"><enum>(iii)</enum><text>during calendar year 2024 and each calendar year thereafter, 50 percent.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id56ab0d5afd674b869afad577a4020b1d"><enum>(d)</enum><header>Nonpreemption</header><text>This section does not preempt any requirement of a State or political subdivision of a State that requires a covered packer to purchase on the spot market a greater percentage of the livestock purchased by the covered packer than is required under this section.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="id20da10dc58f34fcd8fcb2bdffe14d655"><enum>504.</enum><header>Investigation of live poultry dealers</header><subsection id="idf0a0baf79c2947cb8c364ddaec41e28c"><enum>(a)</enum><header>Administrative enforcement authority over live poultry dealers</header><text>Sections 203, 204, and 205 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/193">7 U.S.C. 193</external-xref>, 194, 195) are amended by inserting <quote>, live poultry dealer,</quote> after <quote>packer</quote> each place it appears.</text></subsection><subsection id="idb429b1caa1dc4e27a5a02194fc89a7b0"><enum>(b)</enum><header>Authority To request temporary injunction or restraining order</header><text>Section 408(a) of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/228a">7 U.S.C. 228a(a)</external-xref>) is amended by inserting <quote>or poultry care</quote> after <quote>on account of poultry</quote>.</text></subsection><subsection id="id6340a5d56a2a41dea46b9fa1c2fbffef"><enum>(c)</enum><header>Violations by live poultry dealers</header><text>Section 411 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/228b-2">7 U.S.C. 228b–2</external-xref>) is amended—</text><paragraph id="id2c7a90b817a04c4a89eb1e33778b5825"><enum>(1)</enum><text>in subsection (a), in the first sentence, by striking <quote>any provision of section 207 or section 410 of</quote>; and</text></paragraph><paragraph id="idC2440E917618498592301E93F4D2AFF9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0D4C4959E03F43A3BA1080818B8E8C70"><subsection id="id3FB5D678FA4A41E3A0D12128A17E0823"><enum>(k)</enum><header>Funding for climate stewardship practices</header><text>Of the funds made available under subsection (a)(3)(B), the Secretary shall set aside $2,000,000,000 for each of fiscal years 2021 through 2030 to be used exclusively to enroll in the conservation stewardship program contracts comprised predominantly of conservation activities relating to climate stewardship practices (as defined in section 1240L(d)(1)) or bundles of practices comprised predominantly of conservation activities relating to climate stewardship practices (as so defined).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idE06E6BE0B0E44F1B93C4BD9B611EC063"><enum>523.</enum><header>Rural Energy for America Program</header><text display-inline="no-display-inline">Section 9007 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8107">7 U.S.C. 8107</external-xref>) is amended—</text><paragraph id="id2F6BB20AE99241F287EDBE3FDAC3549D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(3)(A), by striking <quote>25</quote> and inserting <quote>40</quote>; and</text></paragraph><paragraph id="id46D9BD5A17554EB18C1546053B4E3050"><enum>(2)</enum><text>in subsection (f)(1)—</text><subparagraph id="idD3622EAB9A104E4DB940A46E47D2B9DA"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idE27C3FE34A8547529D9FF0488DC431D8"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>for fiscal</quote> and all that follows through the period at the end and inserting <quote>for each of fiscal years 2014 through 2020; and</quote>; and</text></subparagraph><subparagraph id="idED7639F888C5481B838B8528D3C89991"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCC37FFFC8460412FAC379FFD3E2AF85F"><subparagraph id="idFB23BB5DA34A41EC9DDE2E68381AF800"><enum>(F)</enum><text>$500,000,000 for fiscal year 2021 and each fiscal year thereafter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id5123a6d3f6b64729b7d8177ebf205d0a"><enum>524.</enum><header>Conservation and renewable energy programs priority</header><text display-inline="no-display-inline">Each socially disadvantaged farmer or rancher, including each eligible Black individual that receives a land grant under section 203(a)(2), shall be given priority—</text><paragraph id="idC0B0EFA0541942E5987F2263983C202E"><enum>(1)</enum><text>for conservation technical assistance under the Soil Conservation and Domestic Allotment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/590a">16 U.S.C. 590a</external-xref> et seq.);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61DF8D068C5E44B994116E1F6D9F67E1"><enum>(2)</enum><text>under the conservation stewardship program under subchapter B of that chapter (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-21">16 U.S.C. 3839aa–21</external-xref> et seq.); and</text></paragraph><paragraph id="id64AD8A51095A4D688169DF612188909D"><enum>(3)</enum><text>under the Rural Energy for America Program established under section 9007 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8107">7 U.S.C. 8107</external-xref>).</text></paragraph></section></subtitle></title></legis-body></bill>
