which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to establish new requirements for State homes for veterans that receive per diem from the Secretary of Veterans Affairs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HDEDEEB22A41D40299B99A6273BCA6784"><section section-type="section-one" id="H9B5F37AC66CC4457BB09AB03AF04B1BF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Care for Veterans Act</short-title></quote>.</text></section><section commented="no" section-type="subsequent-section" id="HAA9150B9459742BA932CF45BA3284399"><enum>2.</enum><header>Requirement that State homes for veterans have governing bodies and administrators and payments to assist State homes in hiring infection pre­ven­tion­ists</header><subsection commented="no" id="H2D7311733D1B46EA93B5513BD1A447C6"><enum>(a)</enum><header>Governing bodies and administrators</header><paragraph commented="no" id="id744F5909F39F4363AE9EA1DB5E637D76"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1741">section 1741</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id22E9ED3AFBFC4A6A9E413B363788C526"><section id="idD7E5F98FC55D4C008ECFC12FCFE6F65D"><enum>1741A.</enum><header>Administration requirements</header><text display-inline="no-display-inline">As a condition on the receipt of per diem payments under this subchapter, a State home shall—</text><paragraph id="HB1185F1ACC4548FCA3016C9896291C34"><enum>(1)</enum><text>have a governing body that—</text><subparagraph id="H34627F8F032541E7B510C4BABFE36241"><enum>(A)</enum><text>is legally responsible for establishing and implementing policies regarding the management and operation of the State home;</text></subparagraph><subparagraph id="HAD222DC1091E4DFD9962F0868602C349"><enum>(B)</enum><text>consists of more than one person; and</text></subparagraph><subparagraph id="HFBC913901EC041EC8A758FD60BD5D38D"><enum>(C)</enum><text>appoints an administrator or deputy superintendent described in paragraph (2);</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H19174B49C47444808252F2AAEA969E0F"><enum>(2)</enum><text display-inline="yes-display-inline">employ an administrator or deputy superintendent who—</text><subparagraph id="HACB5CFBD2E8943B5B01274638121847A"><enum>(A)</enum><text display-inline="yes-display-inline">is licensed by the State, if required by State law; and</text></subparagraph><subparagraph id="H156968B4CE634822A249EB583FEE0910"><enum>(B)</enum><text display-inline="yes-display-inline">meets standards established by the Secretary of Health and Human Services under sections 1819(f)(4) and 1919(f)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-3">42 U.S.C. 1395i–3(f)(4)</external-xref>, 1396r(f)(4));</text></subparagraph></paragraph><paragraph id="H2CCE69D825F54C15B2DF47E27079D2D2"><enum>(3)</enum><text>employ an infection preventionist (as that term is defined in section 1744A of this title); and</text></paragraph><paragraph id="HFB8E4233961E4204804D024CA1DFE429"><enum>(4)</enum><text>include in information submitted each year to the Secretary—</text><subparagraph id="H8BFFB72993B94A98ABA56ED8FA3EFE2B"><enum>(A)</enum><text>the name of the infection pre­ven­tion­ist employed under paragraph (3); and</text></subparagraph><subparagraph id="H2AD3F13DF23C48BEB8B52272688647AA"><enum>(B)</enum><text display-inline="yes-display-inline">an emergency plan, updated annually, in case of a public health emergency or other disaster.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idD3B1DC12BCB34DC49AEFD2C85D4C2B6F"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by inserting after the item relating to section 1741 the following new item:</text><quoted-block style="USC" id="id84f2e244-f6c9-416f-b86c-8f19b5c99a74"><toc><toc-entry level="section" idref="idD7E5F98FC55D4C008ECFC12FCFE6F65D">1741A. Administration requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H661F944E8CE549BD898CE5E3C30941CB"><enum>(b)</enum><header>Funding of infection preventionists</header><paragraph commented="no" id="HAE494AD7A1D043CD944B2AAC6B502144"><enum>(1)</enum><header>Establishment</header><text>Such subchapter is further amended by inserting after section 1744 the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="HE4D0C891FDA74F47976869E5CDCD2CA2"><section commented="no" id="H2D99CFAB9A0E4753AEE874A0C41B7F48"><enum>1744A.</enum><header>Hiring and retention of infection pre­ven­tion­ists: payments to assist States</header><subsection commented="no" id="H35DE0C86BEFB4555B0F42B6F37E1D31A"><enum>(a)</enum><header>Payment program</header><text display-inline="yes-display-inline">The Secretary shall make payments to States under this section for the purpose of assisting State homes in the hiring and retention of infection preventionists.</text></subsection><subsection commented="no" id="H263EB7CD70DE404EB5F2631042732CFE"><enum>(b)</enum><header>Eligible recipients</header><text display-inline="yes-display-inline">Payments to a State for a fiscal year under this section shall, subject to submission of an application, be made to any State that during that fiscal year receives per diem payments under this subchapter for that fiscal year.</text></subsection><subsection id="HF32C82259668499DBD52C26EE81BB238"><enum>(c)</enum><header>Limitations on amount of payment</header><text display-inline="yes-display-inline">A payment under this section may not be used to provide more than 50 percent of the salary or wages for an infection preventionist for a fiscal year.</text></subsection><subsection id="HD1F85F8B5EEF4175A3E98767A7F75171"><enum>(d)</enum><header>Applications</header><paragraph commented="no" display-inline="yes-display-inline" id="id1ABF56061BD64EAB8816595BA54CAD4D"><enum>(1)</enum><text display-inline="yes-display-inline">A payment under this section for any fiscal year with respect to any State home may only be made based upon an application submitted by the State seeking such payment with respect to that State home.</text></paragraph><paragraph id="id49EF62BADDC84946BDA4827D816ABE7D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each application under paragraph (1) shall describe the salary or wages of the infection preventionist.</text></paragraph></subsection><subsection id="H6701E2B9E7A24A08AE33B7FD2B6EEF84"><enum>(e)</enum><header>Source of funds</header><text display-inline="yes-display-inline">Payments under this section shall be made from funds available for other payments under this subchapter.</text></subsection><subsection id="H74EA8F72D9DF42758F4DE4E948DDC214"><enum>(f)</enum><header>Disbursement</header><text display-inline="yes-display-inline">Payments under this section to a State home shall be made as part of the disbursement of payments under section 1741 of this title with respect to that State home.</text></subsection><subsection id="HA7FC4BB873194F51B70A0A8820683E0F"><enum>(g)</enum><header>Use of certain receipts</header><text display-inline="yes-display-inline">The Secretary shall require as a condition of any payment under this section that, in any case in which the State home receives a refund payment made by an employee in breach of the terms of an agreement for employee assistance that used funds provided under this section, the payment shall be returned to the incentive program account for the State home and credited as a non-Federal funding source.</text></subsection><subsection id="H0FAB77CF147C497CA3CAFCF75CA30323"><enum>(h)</enum><header>Annual report</header><paragraph commented="no" display-inline="yes-display-inline" id="H367B535846444FBF85E519081507AFED"><enum>(1)</enum><text>Any State home receiving a payment under this section for any fiscal year, shall, as a condition of the payment, be required to agree to provide to the Secretary a report setting forth in detail the use of funds received through the payment.</text></paragraph><paragraph id="HB13A1D97F7804A2892FD564290DABB1E" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id60EF7012F61A4811A2D553310DDD6033"><enum>(A)</enum><text display-inline="yes-display-inline">Each report under paragraph (1) for a fiscal year shall be provided to the Secretary not later than 60 days after the end of the fiscal year and shall be subject to audit by the Secretary.</text></subparagraph><subparagraph indent="up1" id="idCFBF3615BDF648BDBBA3D222648EA71C"><enum>(B)</enum><text display-inline="yes-display-inline">Eligibility for payment under this section for any fiscal year is contingent upon the receipt by the Secretary of the annual report under this subsection for the previous fiscal year in accordance with this subsection.</text></subparagraph></paragraph></subsection><subsection id="H0074DCB35B744EB3959127F80B4E3C5B"><enum>(i)</enum><header>Regulations</header><paragraph commented="no" display-inline="yes-display-inline" id="idFC9428CC7FBE4B82AEF00BDBED2C23B4"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall prescribe regulations to carry out this section.</text></paragraph><paragraph id="id0B55DAB358C14ACBA77A2A5A0871B5FB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Regulations required under paragraph (1) shall include the establishment of criteria for the award of payments under this section.</text></paragraph></subsection><subsection id="HFA2356D20A2049A8BAD759E6D37068DE"><enum>(j)</enum><header>Infection preventionist defined</header><text>In this section, the term <term>infection preventionist</term>, with respect to a State home, means an individual—</text><paragraph id="H206686E95B094C87B0F2C1418DAB3336"><enum>(1)</enum><text display-inline="yes-display-inline">who has primary professional training in nursing, medical technology, microbiology, epidemiology, or a related field;</text></paragraph><paragraph id="H0C504D9AAB5C4E1582D92C1CF0E3EB32"><enum>(2)</enum><text display-inline="yes-display-inline">whom the Secretary determines is qualified by education, training, experience, or certification;</text></paragraph><paragraph id="HE917177DEDFC45B68EE835AB24EE8737"><enum>(3)</enum><text display-inline="yes-display-inline">who works at least part-time at the State home; and</text></paragraph><paragraph id="HD1FE0427753E4D0FB44868959D40BD58"><enum>(4)</enum><text display-inline="yes-display-inline">who has completed specialized training in infection prevention and control.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC23087ED27324465A99C992EEFF60D7E"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such subchapter is amended by inserting after the item
