which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 230 of the Communications Act of 1934 to reaffirm civil rights, victims’ rights, and consumer protections.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Against Fraud, Exploitation, Threats, Extremism, and Consumer Harms Act</short-title></quote> or the <quote><short-title>SAFE TECH Act</short-title></quote>.</text></section><section id="id2BB615DE88CF4BFE9735BA5502ED9A97"><enum>2.</enum><header>Communications Decency Act improvements</header><text display-inline="no-display-inline">Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is amended—</text><paragraph id="idFC45D336C9684995B3E308EBEA615B8E"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="id8960D41D19584533879D39794DB524DF"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id286CB0EE3FD74FE5BBBBCB17ED0BE99D"><enum>(i)</enum><text>by striking <quote>No provider</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88CC775DEDF84A18933AB4685886CAEF"><subparagraph id="idE4BC570842564E32BE9C3244EFAAD60E"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (3), no provider</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause><clause id="idC102E1027ADF499ABC60E7A2E8339CB5"><enum>(ii)</enum><text>by striking <quote>any information</quote> and inserting <quote>any speech</quote>;</text></clause><clause id="id1E3C0FA485504E8896388ADF10D96B4F"><enum>(iii)</enum><text>by inserting before the period at the end the following: <quote>, unless the provider or user has accepted payment to make the speech available or, in whole or in part, created or funded the creation of the speech</quote>; and</text></clause><clause id="id6479CFD5CE8D401AA0B67B45E41C78D4"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3EDF3F13DAE46CEBB7CB7E9852D438D"><subparagraph id="idE58381BEE200493183D14B16182E8A01"><enum>(B)</enum><header>Affirmative defense</header><text>In any action in which the defendant raises subparagraph (A) as a defense, the defendant shall have the burden of persuasion, by a preponderance of the evidence, that the defendant is a provider or user of an interactive computer service and is being treated as the publisher or speaker of speech provided by another information content provider.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idD38E4909F3204A1EAAED8F3FB0E9D334"><enum>(B)</enum><text>in paragraph (2)(B), by striking <quote>paragraph (1)</quote> and inserting <quote>subparagraph (A)</quote>; and</text></subparagraph><subparagraph id="idF72C020E32BD4161A75E9E532CA3A1C9"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id033E80EFE414458E812C6D1FA992E81A"><paragraph id="idC997C5919671470F919DF1785EBD868D"><enum>(3)</enum><header>Exclusion from <quote>Good Samaritan</quote> Immunity</header><subparagraph id="id4dc7b9256f2e40908ec773b82a2c4baa"><enum>(A)</enum><header>Injunctive relief</header><text>Paragraph (1) shall not apply to any request for injunctive relief arising from the failure of an interactive computer service provider to remove, restrict access to or availability of, or prevent dissemination of material that is likely to cause irreparable harm.</text></subparagraph><subparagraph id="id629daeac8ca34dc395257f97a7106851"><enum>(B)</enum><header>Limitation of liability</header><text>In the case of an interactive computer service provider that complies with an order granting injunctive relief described in subparagraph (A), such compliance shall not subject the interactive computer service provider to liability for removing, restricting access to or availability of, or preventing dissemination of material subject to the order.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1487AA22961F4677A5F81A93F7568FA7"><enum>(2)</enum><text>in subsection (e), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id286335853BFA4E8397EB66DC2C00A440"><paragraph id="id7c597fb3bb8d4ec7a67e699f3046b3b5"><enum>(6)</enum><header>No effect on civil rights laws</header><text>Nothing in this section shall be construed to limit, impair, or prevent any action alleging discrimination on the basis of any protected class, or conduct that has the effect or consequence of discriminating on the basis of any protected class, under any Federal or State law.</text></paragraph><paragraph id="id6E5825F8FB9E403DAA80FA599265BFE5"><enum>(7)</enum><header>No effect on antitrust laws</header><text>Nothing in this section shall be construed to prevent, impair, or limit any action brought under Federal or State antitrust law.</text></paragraph><paragraph id="id0CE7F5980A5346D7B58BE94D04296120"><enum>(8)</enum><header>No effect on stalking, harassment, or intimidation laws</header><text>Nothing in this section shall be construed to prevent, impair, or limit any action alleging stalking, cyberstalking, harassment, cyberharassment, or intimidation based, in whole or in part, on sex (including sexual orientation and gender identity), race, color, religion, ancestry, national origin, or physical or mental disability brought under Federal or State law. </text></paragraph><paragraph id="idDCBAA4644B214AB78811608B677F7EAE"><enum>(9)</enum><header>No effect on international human rights law</header><text>Nothing in this section shall be construed to prevent, impair, or limit any action brought under section 1350 of title 28, United States Code.</text></paragraph><paragraph id="id220403A6A5324824B4ED4ADCB731BF10"><enum>(10)</enum><header>No effect on wrongful death actions</header><text>Nothing in this section shall be construed to prevent, impair, or limit any civil action for a wrongful death.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
