<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2997</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211019">October 19, 2021</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit a COVID–19 vaccination requirement for eligibility in nutrition programs.</official-title></form><legis-body><section id="id1F2FBA3A514347BF8B6A54E081F6BD07" section-type="section-one"><enum>1.</enum><header>Prohibition of COVID–19 vaccination requirement for eligibility in nutrition programs</header><subsection id="id24BCB72B35504536A5F44595C4B96DF8"><enum>(a)</enum><header>Definition of nutrition program</header><text display-inline="yes-display-inline">In this section, the term <quote>nutrition program</quote> means—</text><paragraph id="id616EE624C880489B81AA4EAA0229E42E"><enum>(1)</enum><text>the special supplemental nutrition program for women, infants, and children established under section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>);</text></paragraph><paragraph id="id955E4D320CBE4E71BBB88989D504A06E"><enum>(2)</enum><text>the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); </text></paragraph><paragraph id="id915750ca84464c1381e6d8d176b82c47"><enum>(3)</enum><text>the school breakfast program established under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text></paragraph><paragraph id="id13731044e41a4c19ae01291a68602571"><enum>(4)</enum><text>the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></paragraph></subsection><subsection id="id5124F9368F1548C2A0E26EC8869AA02B"><enum>(b)</enum><header>Prohibition</header><text>In carrying out a nutrition program, the Secretary of Agriculture—</text><paragraph id="id29AB702968DD4FF6BE9E09CA43B439D6"><enum>(1)</enum><text>may not require a person to have received a COVID–19 vaccination for eligibility to participate in the nutrition program; and</text></paragraph><paragraph id="idB428D2A805B94997888E2BD985945F81"><enum>(2)</enum><text>shall prohibit a State agency carrying out the nutrition program from requiring a person to have received a COVID–19 vaccination for eligibility to participate in the nutrition program.</text></paragraph></subsection></section></legis-body></bill>
