which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the provision of financial literacy training and information relating to the Blended Retirement System to members of the Armed Forces.</official-title></form><legis-body><section id="id82630075A5934FB888BE9F276DC92834" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Re-open Enrollment for Servicemembers to Opt-in to Updated Retirement Choice for Enduring Security Act of 2021</short-title></quote> or the <quote><short-title>RESOURCES Act of 2021</short-title></quote>.</text></section><section id="id633BD31FD997402A87C0E3F41BBEF236"><enum>2.</enum><header>Improvements to financial literacy training; provision of information relating to the Blended Retirement System</header><subsection id="id4843E7186CB6407D803F2DC69C675A2A"><enum>(a)</enum><header>Improvements to financial literacy training</header><paragraph id="id50816E603D76430A8F02DCC5C144BD8B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) of section 992 of title 10, United States Code, is amended—</text><subparagraph id="id46AEA6EFE3DF4239B6FB97E546843A95"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)(C), by striking <quote>grade E–4</quote> and inserting <quote>grade E–6</quote>;</text></subparagraph><subparagraph id="id451894D250074DB6ABC2F9F9FCECD0B9"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBF5C1533E2F64F8A8F925F60D6295364"><paragraph id="id0A09C3ED3D0B492189269F749EBC05FD" indent="up1"><enum>(5)</enum><text>In carrying out the program to provide training under this subsection, the Secretary concerned shall—</text><subparagraph id="idDBB5482A7249443D921092724D95C5CC"><enum>(A)</enum><text>require the development of a standard curriculum across all military departments for such training that—</text><clause id="idF7473B00D99A47A998A955EAFF35640A"><enum>(i)</enum><text>focuses on ensuring that members of the armed forces who receive such training develop proficiency in financial literacy rather than focusing on completion of training modules;</text></clause><clause id="id97914C311BAF4B15A797AD347021B075"><enum>(ii)</enum><text>is based on best practices in the financial services industry, such as the use of a social learning approach and the incorporation of elements of behavioral economics or gam­i­fi­ca­tion; and</text></clause><clause id="idF65DCB1CC4344660924E9CED7914834D"><enum>(iii)</enum><text>is designed to address the needs of members and their families;</text></clause></subparagraph><subparagraph id="id1FF2FE49A5F2401DBC1BB1EA3AF50060"><enum>(B)</enum><text>ensure that such training—</text><clause id="id49A565C80DC348499FBD27B65E46F0DA"><enum>(i)</enum><text>is conducted by a financial services counselor who is qualified as described in paragraph (3) of subsection (b) or by other means as described in paragraph (2)(A)(ii) of that subsection; </text></clause><clause id="id8B27DD51507342ECAB95D77A85AB5BC9"><enum>(ii)</enum><text>is provided, to the extent practicable—</text><subclause id="id8FD848097C154BBF9CD639EDFB2E95B4"><enum>(I)</enum><text>in a class held in person with fewer than 50 attendees; or</text></subclause><subclause id="id2E0516A42CE8430EA35F2C6B6670D74E"><enum>(II)</enum><text>one-on-one between the member and a financial services counselor or a qualified representative described in subclause (III) or (IV) of subsection (b)(2)(A)(ii); and</text></subclause></clause><clause id="idCBCB205C2C274CD58895500FA62085C9"><enum>(iii)</enum><text>is provided using computer-based methods only if methods described in clause (ii) are impractical or unavailable;</text></clause></subparagraph><subparagraph id="idAD6B89812A6D4DE5B8729470E584A680"><enum>(C)</enum><text>ensure that—</text><clause id="id5F3C3FC8A1794373A34EA14DC09118DE"><enum>(i)</enum><text>an in-person class described in subparagraph (B)(i)(I) is available to the spouse of a member; and</text></clause><clause id="id234E7641E7454F9AB40CA63B33E33ED3"><enum>(ii)</enum><text>if a spouse of a member is unable to attend such a class in person—</text><subclause id="id475CC6708CA14C45BAB29FEBCE0FF93C"><enum>(I)</enum><text>training is available to the spouse through Military OneSource; and</text></subclause><subclause id="id9E013B5AF07B49678BC6C7201F204A01"><enum>(II)</enum><text>the member is informed during the in-person training of the member under subparagraph (B)(i) with respect to how the member's spouse can access the training;</text></subclause></clause></subparagraph><subparagraph id="id8F589122F52846538546527A19FD5AAC"><enum>(D)</enum><text>ensure that such training, and all documents and materials provided in relation to such training, are presented or written in manner that the Secretary determines can be understood by the average enlisted member.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3944AAA65F0A418F92AF2E1969485CAA"><enum>(2)</enum><header>Qualified representatives for counseling for members and spouses</header><text>Subsection (b)(2)(A)(ii) of such section is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9589c7a1cfc241c2bdcff3142eba1baf"><subitem id="idb62ff782e39b4d4790c40d75777a8325" indent="up4"><enum>(IV)<?LEXA-Enum (IV)?></enum><text>Through qualified representatives of banks or credit unions operating on military installations pursuant to an operating agreement with the Department of Defense or a military department.</text></subitem><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id056CC4517F1040FF883840A91C5BC8F2"><enum>(3)</enum><header>Provision of retirement information</header><text>Such section is further amended—</text><subparagraph id="id7FAC80CF9A1E415B97D3789AC6D3D4A9"><enum>(A)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (g), respectively; and</text></subparagraph><subparagraph id="id1A81EAAE16A641379ED6E99F90F74C27"><enum>(B)</enum><text>by inserting after subsection (c) the following new subsection (d):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id39B24DB1B30C4CBEBA406A3868D866DC"><subsection id="id65548730F1FF438A9A55233622C57A09"><enum>(d)</enum><header>Provision of retirement information</header><text>In each training under subsection (a) and in each meeting to provide counseling under subsection (b), a member of the armed forces shall be provided with—</text><paragraph id="id88FF522EA5C04D119BDD48C84DF2ECF6"><enum>(1)</enum><text>all forms relating to retirement that are relevant to the member, including with respect to the Thrift Savings Plan;</text></paragraph><paragraph id="idFFEBBF14A4514ACC9F2E549B67C6F2B2"><enum>(2)</enum><text>information with respect to how to find additional information; and</text></paragraph><paragraph id="id2F4BB0D04DA646B6AD0C8F6F74F3CA60"><enum>(3)</enum><text>contact information for counselors provided through—</text><subparagraph id="id969C1E8B37F244108F813BEC2883F3F0"><enum>(A)</enum><text>the Personal Financial Counselor program, the Personal Financial Management program, or Military OneSource; or</text></subparagraph><subparagraph id="id8A32491BD4AB4389A96F9BD6ED39AFCC"><enum>(B)</enum><text>nonprofit organizations or agencies that have in effect agreements with the Department of Defense to provide financial services counseling.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idFD9E7C7F95E1424FBF4050BC72F72EF5"><enum>(4)</enum><header>Advisory Council on Financial Readiness</header><text>Such section is further amended by inserting after subsection (e), as redesignated by paragraph (3)(A), the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id038AF72D0C674867AD13B8E8FFAB2EC0"><subsection id="idD99E313736714CBABBC21C276558002F"><enum>(f)</enum><header>Advisory Council on Financial Readiness</header><paragraph id="idb376911e14e7454c851680f791920735"><enum>(1)</enum><header>Establishment</header><text>There is established an Advisory Council on Financial Readiness (in this section referred to as the <quote>Council</quote>).</text></paragraph><paragraph id="idd5ed7dba04d24968971d51cda9a4759a"><enum>(2)</enum><header>Membership</header><subparagraph id="idED5EC6BEED574F2CAEAF6CE91677AE57"><enum>(A)</enum><header>In general</header><text>The Council shall consist of 12 members appointed by the Secretary of Defense, as follows:</text><clause id="id2DA2B8C327074CAE88884EAA4A50AB60"><enum>(i)</enum><text>Three shall be representatives of military support organizations. </text></clause><clause id="id93E3F390EA1D4F619DF4E181C95973D5"><enum>(ii)</enum><text>Three shall be representatives of veterans service organizations. </text></clause><clause id="id10BFA262777442B790D7A4A76617FF66"><enum>(iii)</enum><text>Three shall be representatives of private, nonprofit organizations with a vested interest in education and communication of financial education and financial services.</text></clause><clause id="id678BF3F4FE51467C889723C8C252FD8F"><enum>(iv)</enum><text>Three shall be representatives of governmental entities with a vested interest in education and communication of financial education and financial services.</text></clause></subparagraph><subparagraph id="id8D1603F02CF74D3ABF18F968DE205E18"><enum>(B)</enum><header>Qualifications</header><text>The Secretary shall appoint members to the Council from among individuals qualified to appraise military compensation, military retirement, and financial literacy training.</text></subparagraph><subparagraph id="id3ee802b2ace54d46b4b9abbb9aec41db"><enum>(C)</enum><header>Terms</header><text>Members of the Council shall serve for terms of three years, except that, of the members first appointed—</text><clause id="idB0FB3C539B684CD1AB8BC383D30F4A60"><enum>(i)</enum><text>four shall be appointed for terms of one year; </text></clause><clause id="idC06F71AFF5EC4BE8B454C59748E5FE85"><enum>(ii)</enum><text>four shall be appointed for terms of two years; and </text></clause><clause id="id2730C3ACCFD849549A815A12E9E9A701"><enum>(iii)</enum><text>four shall be appointed for terms of three years. </text></clause></subparagraph><subparagraph id="id99C29B91D05148F6B888B5A85FEF3231"><enum>(D)</enum><header>Reappointment</header><text>A member of the Council may be reappointed for additional terms.</text></subparagraph><subparagraph id="id9AB8E282EAA74FD6825ADFD13DF7076F"><enum>(E)</enum><header>Vacancies</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term of office for which such member's predecessor was appointed shall be appointed only for the remainder of such term. </text></subparagraph></paragraph><paragraph id="id3d212d45b421496ebd8f632557d65f68"><enum>(3)</enum><header>Duties and functions</header><text>The Council shall—</text><subparagraph id="id20C2727278744581AE95480349D67696"><enum>(A)</enum><text>advise the Secretary with respect to matters relating to the financial literacy and financial readiness of members of the armed forces; and </text></subparagraph><subparagraph id="idD295B65B79E348F38B181A707A1DB9D1"><enum>(B)</enum><text>submit to the Secretary recommendations with respect to those matters. </text></subparagraph></paragraph><paragraph id="id732C7219C5F74F29AA1F3FB2133604FC"><enum>(4)</enum><header>Meetings</header><subparagraph id="id27D3FC3B6AB34465866A1F5EB4DFF62E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Council shall meet not less frequently than twice each year and at such other times as the Secretary requests. </text></subparagraph><subparagraph id="id0E899F21C74542779216AA79A142824F"><enum>(B)</enum><header>During election period for Blended Retirement System</header><text>During the period beginning on the date of the enactment of the <short-title>Re-open Enrollment for Servicemembers to Opt-in to Updated Retirement Choice for Enduring Security Act of 2021</short-title> and ending at the end of the period provided for under section 1409(b)(4) and 12739(f) to elect to be enrolled in the Blended Retirement System, the Council shall meet not less frequently than every 90 days.</text></subparagraph><subparagraph id="id337C69EA9FEA461398EC3D1FCE7257FA"><enum>(C)</enum><header>Quorum</header><text>A majority of members shall constitute a quorum and action shall be taken only by a majority vote of the members present and voting. </text></subparagraph></paragraph><paragraph id="id47c93026ce7c4649ac8405400e68f2eb"><enum>(5)</enum><header>Support services</header><text>The Secretary—</text><subparagraph id="id442F72974DA948EEA0EF5C78CB398E33"><enum>(A)</enum><text>shall provide to the Council an executive secretary and such secretarial, clerical, and other support services as the Council considers necessary to carry out the duties of the Council; and</text></subparagraph><subparagraph id="id2D12212E36AF433E85BBE99BF647BCD6"><enum>(B)</enum><text>may request that other Federal agencies provide statistical data, reports, and other information that is reasonably accessible to assist the Council in the performance of the duties of the Council. </text></subparagraph></paragraph><paragraph id="id2ba942d31fb145df8e48fc3b1423275a"><enum>(6)</enum><header>Compensation</header><text>While away from their homes or regular places of business in the performance of services for the Council, members of the Council shall be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as persons employed intermittently in the Government service are allowed expenses under section 5703 of title 5. </text></paragraph><paragraph id="id3FE3DAACA64143CA8737E77BBE5957EC"><enum>(7)</enum><header>Annual report</header><text>Not less frequently than annually, the Secretary shall submit to Congress a report that—</text><subparagraph id="idB07E1936D2BF40608B7D782794BD9D9B"><enum>(A)</enum><text>describes each recommendation received from the Council during the preceding year; and</text></subparagraph><subparagraph id="id4ACB15E2D95B403BBB93E29E7F3F16E0"><enum>(B)</enum><text>includes a statement, with respect to each such recommendation, of whether the Secretary has implemented the recommendation and, if not, a description of why the Secretary has not implemented the recommendation.</text></subparagraph></paragraph><paragraph id="id50b0ed922c4b453d89c57a642d73d04a"><enum>(8)</enum><header>Termination</header><text>Section 14(a) of the Federal Advisory Committee Act (5 U.S.C. App.) (relating to termination) shall not apply to the Council. </text></paragraph><paragraph id="idDD123FC8127E4B0E8A68329D6C1FC065"><enum>(9)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idd04b25a57921407eadeeb07c022dc2ce"><enum>(A)</enum><header>Military support organization</header><text>The term <term>military support organization</term> means an organization that provides support to members of the armed forces and their families with respect to education, finances, health care, employment, and overall well-being.</text></subparagraph><subparagraph id="id192B2F0E9A8A4456B78FF4A574094B37"><enum>(B)</enum><header>Veterans service organization</header><text>The term <term>veterans service organization</term> means any organization recognized by the Secretary for the representation of veterans under section 5902 of title 38.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idD98E4519B15340799EF83312D4FCA149"><enum>(5)</enum><header>Report on effectiveness of financial services counseling</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees (as defined in section 101 of title 10, United States Code) a report on financial literacy training and financial services counseling provided under section 992 of title 10, United States Code, as amended by this subsection, that assesses—</text><subparagraph id="id5AA7A3A0AC30455D93643A3620FCA62E"><enum>(A)</enum><text display-inline="yes-display-inline">the effectiveness of such training and counseling, which shall be determined using actual localized data similar to the Unit Risk Inventory Survey of the Army; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA8FC9F840C54F16BF335A13ED914597"><enum>(B)</enum><text>whether additional training or counseling is necessary for enlisted members of the Armed Forces or for officers.</text></subparagraph></paragraph></subsection><subsection id="idECC8312788654D06A6F04589D05C0CA7"><enum>(b)</enum><header>Modifications to lump sum payments of certain retired pay</header><paragraph id="id31020C86A3604EC8957F364165F56C82"><enum>(1)</enum><header>Spousal consent to lump sum payment</header><text>Subsection (b) of section 1415 of title 10, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45F2248F096B487CA3BC07C652ABA1E3"><paragraph id="idF55503F1AAD74372BDCA8485923C0F92"><enum>(7)</enum><header>Spousal consent for election of lump sum payment</header><text>An eligible person who is married may not elect to receive a lump sum payment under this subsection without the concurrence of the person's spouse, unless the eligible person establishes to the satisfaction of the Secretary concerned—</text><subparagraph id="id11207ea5f5e7423db8ccfadf5b3313c5"><enum>(A)</enum><text>that the spouse's whereabouts cannot be determined; or</text></subparagraph><subparagraph id="id71b1a7a371bd4c44900de099a78078bc"><enum>(B)</enum><text>that, due to exceptional cir­cum­stances, requiring the person to seek the spouse's consent would otherwise be inappropriate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id85E0366D5D4A415BA0ADB14C19A97F33"><enum>(2)</enum><header>Disclosures relating to offer of lump sum payment</header><text display-inline="yes-display-inline">Such section is further amended—</text><subparagraph id="id5AABEB7FC7FD46DD9C93570CCD65894A"><enum>(A)</enum><text>by redesignating subsection (e) as subsection (g); and</text></subparagraph><subparagraph id="id666C8898FE214A60BC8865B58DC9D4BF"><enum>(B)</enum><text>by inserting after subsection (d) the following new subsections:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id83F25D4A89CE4248B3E2A5C3D6727105"><subsection id="id056FE50BCE814B129B3BC5EC96DF99B4"><enum>(e)</enum><header>Disclosures relating to offer of lump sum payment</header><paragraph id="id78B86B8E497141A5B3692827784758BE"><enum>(1)</enum><header>In general</header><text>Not later than 90 days before offering an eligible person a lump sum payment under this section, the Secretary of Defense shall provide a notice to the person, and the person's spouse, if married, that includes the following:</text><subparagraph id="idc06d9903a69c475dae4f703d7706c7ff"><enum>(A)</enum><text>A description of the available retirement benefit options, including—</text><clause id="id34E3E8A3E7FB489D9556ADCD6E4D481A"><enum>(i)</enum><text>the monthly covered retired pay that the person would receive after the person attains retirement age if the person is not already receiving such pay; </text></clause><clause id="id17355849C7A040AC9FF530FE7AA21D16"><enum>(ii)</enum><text>the monthly covered retired pay that the person would receive if payments begin immediately; and </text></clause><clause id="id64B7C4C1B22643FD906B55657F34E56B"><enum>(iii)</enum><text>the amount of the lump sum payment the person would receive if the person elects to receive the lump sum payment.</text></clause></subparagraph><subparagraph id="id62dca6639dec4c0ea511da3b33d0f5bb"><enum>(B)</enum><text>An explanation of how the amount of the lump sum payment was calculated, including the interest rate and mortality assumptions used in the calculation, and whether any additional benefits were included in the amount.</text></subparagraph><subparagraph id="idc11b34bab61a4d0f899aa90b7b99443b"><enum>(C)</enum><text>A description of how the option to take the lump sum payment compares to the value of the covered retired pay the person would receive if the person elected not to take the lump sum payment.</text></subparagraph><subparagraph id="id474db967a6ef41069bfdca3809a50b10"><enum>(D)</enum><text>A statement of whether, by purchasing a retail annuity using the lump sum payment, it would be possible to replicate the stream of payments the person would receive if the person elected not to take the lump sum payment.</text></subparagraph><subparagraph id="idfc8638fe484146208ea69c3e8e79197c"><enum>(E)</enum><text>A description of the potential implications of accepting the lump sum payment, including possible benefits and reductions in such benefits, investment risks, longevity risks, and loss of protection from creditors.</text></subparagraph><subparagraph id="id72b90c49d8a148c9867a550e51fa9c2d"><enum>(F)</enum><text>A description of the tax implications of accepting the lump sum payment, including rollover options, early distribution penalties, and associated tax liabilities.</text></subparagraph><subparagraph id="id84b1dde5f39146e6a7d78cc4e933a41c"><enum>(G)</enum><text>Instructions for how to accept or reject the offer of the lump sum payment and the date by which the person is required to accept or reject the offer.</text></subparagraph><subparagraph id="id108092dff809484d9e9a3b6ee371c8a1"><enum>(H)</enum><text>Contact information for the person to obtain more information or ask questions about the option to accept the lump sum payment, including the opportunity for a one-on-one meeting with a counselor provided through the Personal Financial Counselor program or the Personal Financial Management program.</text></subparagraph><subparagraph id="idf81794b28b2041b098c69793d8ad265d"><enum>(I)</enum><text>A statement that—</text><clause id="id375AADA0932948BBA1DE62691F0D654F"><enum>(i)</enum><text>financial advisers (other than financial services counselors provided through the Personal Financial Counselor program or the Personal Financial Management program) may not be required to act in the best interests of the person or the person's beneficiaries with respect to determining whether to take the lump sum payment; and </text></clause><clause id="idD98D1654E5AC4F5198C09AE1F0814F26"><enum>(ii)</enum><text>if the person or a beneficiary of the person is seeking financial advice from a financial adviser not affiliated with the armed forces, the person or beneficiary should obtain written confirmation that the adviser is acting as a fiduciary to the person or beneficiary.</text></clause></subparagraph><subparagraph id="idf4309960f6c648fbbff52d14d625cf26"><enum>(J)</enum><text>Such other information as the Secretary considers to be necessary or relevant.</text></subparagraph></paragraph><paragraph id="idB00AF036804C4385897C127FDE5D5D05"><enum>(2)</enum><header>Form</header><text>The Secretary shall ensure that any notice provided to an eligible person under paragraph (1)— </text><subparagraph id="id5CA97FF5324B45EA9A824C2CB4386C1F"><enum>(A)</enum><text>is written in manner that the Secretary determines can be understood by the average enlisted member of the armed forces; and</text></subparagraph><subparagraph id="idB802BBD8074C45CEAE4E99C3CCA6E147"><enum>(B)</enum><text>is presented in a manner that is not biased for or against acceptance of the offer of the lump sum payment.</text></subparagraph></paragraph></subsection><subsection id="id24152FBBEA124801AE5D552D230D7473"><enum>(f)</enum><header>Report required</header><text>Not later than one year after the date of the enactment of the <short-title>Re-open Enrollment for Servicemembers to Opt-in to Updated Retirement Choice for Enduring Security Act of 2021</short-title>, and annually thereafter, the Secretary shall submit to the congressional defense committees report that—</text><paragraph id="idB634FA6AD4534D2CA7BE61416792BC8E"><enum>(1)</enum><text>sets forth the number of members of the armed forces who take a lump sum payment under this section; and</text></paragraph><paragraph id="idD211B6F9A2014E67ADA901F6D1F940DF"><enum>(2)</enum><text>describes the details of the arrangements relating to taking such a payment, including—</text><subparagraph id="idF015F2BEB34B4681BD555D9AA4E0BED9"><enum>(A)</enum><text>whether members have taken a lump sum payment in exchange for reduced future benefits; and</text></subparagraph><subparagraph id="idA47B06E614A54405832ACFA92E5DF29F"><enum>(B)</enum><text>information relating to the members who have taken a lump sum payment, such as the age and rank of such members.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id9A0D933928EA448C9B7C2A52012C6BD9"><enum>(c)</enum><header>Additional election period for Blended Retirement System</header><paragraph id="id22C1094661F74445B574491C4AFF578A"><enum>(1)</enum><header>Additional election period for members of uniformed services</header><text>Section 1409(b)(4) of title 10, United States Code, is amended—</text><subparagraph id="id0425177BDF0347DBABBF29FC35616227"><enum>(A)</enum><text>by striking subparagraph (A) and inserting the following new subparagraph (A):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEC8F0D8CA62C456BBD78995BA314F45E"><subparagraph id="id83d65487563a4bd9ae2bee06f52f16ca"><enum>(A)</enum><header>Reduced multiplier for full TSP members</header><clause id="id9E6406322E0D4FC78705425D987F1144"><enum>(i)</enum><header>In general</header><text>Notwithstanding paragraphs (1), (2), and (3), in the case of a member described in clause (ii) (referred to as a <quote>full TSP member</quote>)—</text><subclause id="idf4c59eb162884e79bf702721a0017406"><enum>(I)</enum><text>paragraph (1)(A) shall be applied by substituting <quote>2</quote> for <quote>2½</quote>;</text></subclause><subclause id="idf286f5cf73f142ae85a79d5ba9b712c3"><enum>(II)</enum><text>clause (i) of paragraph (3)(B) shall be applied by substituting <quote>60 percent</quote> for <quote>75 percent</quote>; and</text></subclause><subclause id="id14a85721a3a04057bb1782b8a28375c1"><enum>(III)</enum><text>clause (ii)(I) of such paragraph shall be applied by substituting <quote>2</quote> for <quote>2½</quote>. </text></subclause></clause><clause id="id74C0442E12FA40999F9DF976DDE7DF1F"><enum>(ii)</enum><header>Full TSP members</header><text>A member described in this clause is—</text><subclause id="id1CD8158C8C0F4CCB9EC6E7752D978AC6"><enum>(I)</enum><text>a member who first becomes a member of the uniformed services on or after January 1, 2018; </text></subclause><subclause id="id18894CD57A3C4B8B8037DE1F872D8A08"><enum>(II)</enum><text>a member described in subparagraph (B) who makes the election described in that subparagraph; or</text></subclause><subclause id="idFC8F429709E049698DA1D3F8B6A633F8"><enum>(III)</enum><text>a member who made the election described in subparagraph (B), as in effect on the day before the date of the enactment of the <short-title>Re-open Enrollment for Servicemembers to Opt-in to Updated Retirement Choice for Enduring Security Act of 2021</short-title>.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id045DDF5B2F6B4B7C9DAFBFB3A11EA4E0"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following new subparagraph (B):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF3138F3B698849B69B8F17E64E9127DD"><subparagraph id="id07a55ecb0d4b4f609319d7e3b32bc00d"><enum>(B)</enum><header>Election to participate in modernized retirement system</header><text>Pursuant to subparagraph (C), a member of a uniformed service serving on December 31, 2017, who has served in the uniformed services for fewer than 12 years as of the date selected by the Secretary of Defense under subparagraph (C)(i)(I), may elect, in exchange for the reduced multipliers described in subparagraph (A) for purposes of calculating the retired pay of the member, to receive Thrift Savings Plan contributions pursuant to section 8440e(e) of title 5.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idF239536CB1454C1C8E43D6EEA58AE2DB"><enum>(C)</enum><text>in subparagraph (C)(i), by striking <quote>the period</quote> and all that follows and inserting that following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id525BE1B8543D4720A25D8D67A8BDF37E"><text>the period that—</text><subclause id="id6BC59343D5AD4FF8BC5156F59089664C"><enum>(I)</enum><text>begins on a date selected by the Secretary of Defense, which—</text><item id="id1ADBBBE63E8C4148890864ACA8896D7E"><enum>(aa)</enum><text>may be not earlier than January 1, 2023, and not later than January 1, 2024; and</text></item><item id="id4608EE936DFC4008B2CB7351002DA460"><enum>(bb)</enum><text>shall be the same as the date selected under section 12739(f)(2)(B)(i)(I)(aa); and </text></item></subclause><subclause id="idB672E4E2D7B1446A842B58933839BAB0"><enum>(II)</enum><text>ends on the date that is 180 days after the date selected under subclause (I).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id79760BAA80E140E19EDAA3BF226496B4"><enum>(D)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></subparagraph><subparagraph id="id30F4EF962767489D8B18200365B5D6DF"><enum>(E)</enum><text>by inserting after subparagraph (D) the following new subparagraph (E):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id866BEC538846457AAECA06F79E4C766E"><subparagraph id="id79BAAF7EE1E447E386C54E7C6E3A161A"><enum>(E)</enum><header>Special rules relating to the second election period</header><text>The Secretary concerned shall—</text><clause id="id72EC177408F644F391B7DEFD425C24E9"><enum>(i)</enum><text>to the extent practicable, provide to each member described in subparagraph (B) (and the member's spouse, if married)—</text><subclause id="idEF5B28FE9D644FF8B30AFF5CC4B0C634"><enum>(I)</enum><text>a class, to be held in person and with fewer than 50 attendees, on the Blended Retirement System and the differences between that system and the predecessor retirement system; and</text></subclause><subclause id="id182416e3d8c44d65b12f5fb74b5d92f0"><enum>(II)</enum><text>financial counseling described in section 992(b) focused on the suitability of the Blended Retirement System in the context of the member's personal circumstances; </text></subclause></clause><clause id="idC83D4EB30A204BEE8B1315F5C85412C1"><enum>(ii)</enum><text>require each such member to make the election described in subparagraph (B) or decline to make that election; </text></clause><clause id="id63873CA368D94C3492E6CC43E3E3D3A6"><enum>(iii)</enum><text>document the decision of the member under clause (ii) in a statement that describes the features of the Blended Retirement System and of the predecessor retirement system; and</text></clause><clause id="id4743802BA51244809E7F2A42DCC00C8B"><enum>(iv)</enum><text>have the member (and the member's spouse, if married) sign the statement described in clause (iii) to acknowledge understanding of those features.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idDD9519BC293B467CB9262B08446EA3E2"><enum>(2)</enum><header>Additional election period for members of reserve components</header><text>Section 12739(f) of title 10, United States Code, is amended—</text><subparagraph id="id08673BBFEF104AD394C74C38DB4B096D"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following new paragraph (1):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7BA51A7562E443BD9685558433CB3DB7"><paragraph id="ide14a978f3be048169865c94c96334c85"><enum>(1)</enum><header>Reduced multiplier for full TSP members</header><subparagraph id="id481DB236472B40CEA549BC9711953842"><enum>(A)</enum><header>In general</header><text>Notwithstanding subsection (a) or (c), in the case of a person described in subparagraph (B) (referred to as a <quote>full TSP member</quote>)—</text><clause id="ida34a9ac4590c41ed889f02717a25f1e5"><enum>(i)</enum><text>subsection (a)(2) shall be applied by substituting <quote>2 percent</quote> for <quote>2½ percent</quote>;</text></clause><clause id="idba3b99aaed4e4293bcaabd59e03f7d41"><enum>(ii)</enum><text>subparagraph (A) of subsection (c)(2) shall be applied by substituting <quote>60 percent</quote> for <quote>75 percent</quote>; and</text></clause><clause id="id77114dcf1a8b4d51859ae542ef8e288e"><enum>(iii)</enum><text>subparagraph (B)(ii) of such subsection shall be applied by substituting <quote>2 percent</quote> for <quote>2½ percent</quote>. </text></clause></subparagraph><subparagraph id="id49A46094BC5E45238BB5B3A635D87DFB"><enum>(B)</enum><header>Full TSP members</header><text>A person described in this subparagraph is—</text><clause id="id466346E62A7F4EC28502923191606B7F"><enum>(i)</enum><text>a person who first performs reserve component service on or after January 1, 2018, after not having performed regular or reserve component service on or before that date;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2095CFC7831D4D31A5CB68B5EFEF1884"><enum>(ii)</enum><text display-inline="yes-display-inline">a person described in paragraph (2)(A) who makes the election described in that paragraph; or</text></clause><clause id="id54A38570BF77462A9B503447A569F401"><enum>(iii)</enum><text>a person who made the election described in paragraph (2)(A), as in effect on the day before the date of the enactment of the <short-title>Re-open Enrollment for Servicemembers to Opt-in to Updated Retirement Choice for Enduring Security Act of 2021</short-title>.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB47743FF915E40A4B500AA19BAD18735"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id5BE442F340CD41DBA6DD4311037D1064"><enum>(i)</enum><text>by striking subparagraph (A) and inserting the following new subparagraph (A):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC5376E6DFBBE40A8904DC7ACD568E2F0"><subparagraph id="ida54cd9e9f1c148718ca657a0e70fc977"><enum>(A)</enum><header>In general</header><text>Pursuant to subparagraph (B), a person performing reserve component service on December 31, 2017, who has performed fewer than 12 years of service as of the date selected by the Secretary of Defense under subparagraph (B)(i)(I) (as computed in accordance with section 12733 of this title), may elect, in exchange for the reduced multipliers described in paragraph (1) for purposes of calculating the retired pay of the person, to receive Thrift Savings Plan contributions pursuant to section 8440e(e) of title 5.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idA5AEF5375EDC46ED86CA782B875F8D39"><enum>(ii)</enum><text>in subparagraph (B)(i), by striking <quote>the period</quote> and all that follows and inserting that following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id0F23C68BA94540B59AF95208B5768E75"><text>the period that—</text><subclause id="id62FDA166C9BA4BA8AB4483538BB0F36A"><enum>(I)</enum><text>begins on a date selected by the Secretary of Defense, which—</text><item id="id9DF3092540F541BB868576745073A7FC"><enum>(aa)</enum><text>may be not earlier than January 1, 2023, and not later than January 1, 2024; and</text></item><item id="id2FD6C159A3714F91AC32B4BBE4455204"><enum>(bb)</enum><text>shall be the same as the date selected under section 1409(b)(4)(C)(i)(I)(aa); and</text></item></subclause><subclause id="id9F15B2B8913F4D4B819BDF08858AC53C"><enum>(II)</enum><text>ends on the date that is 180 days after the date selected under subclause (I).</text></subclause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="id71157E7E471B4BD6A8C36F54BD45E0DB"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph commented="no" id="id5D64B68770DE4EB9B0A8EAD5F424B7EF"><enum>(D)</enum><text>by inserting after paragraph (2) the following new paragraph (3):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E45904A5A8540C4ADDF51F11081B53D"><paragraph id="id5C1E9F51003340BA833777919A870255"><enum>(3)</enum><header>Special rules relating second election period</header><text>The Secretary concerned shall—</text><subparagraph id="idEC048A956F234ABCB8C8748281C28E87"><enum>(A)</enum><text>to the extent practicable, provide to each person described in paragraph (2)(A) (and the person's spouse, if married)—</text><clause id="id5000EB57093640AFA592D3F3E6433EDE"><enum>(i)</enum><text>a class, to be held in person and with fewer than 50 attendees, on the Blended Retirement System and the differences between that system and the predecessor retirement system; and</text></clause><clause id="idCB83A7D2309846CB8F601682B205E5C8"><enum>(ii)</enum><text>financial counseling described in section 992(b) focused on the suitability of the Blended Retirement System in the context of the person's personal cir­cum­stances; </text></clause></subparagraph><subparagraph id="idE13BCF9AAC1B4728BF644DBC1609A69F"><enum>(B)</enum><text>require each such person to make the election described in paragraph (2)(A) or decline to make that election; </text></subparagraph><subparagraph id="id08F3A709132D406CA6BC798CA2244E9A"><enum>(C)</enum><text>document the decision of the member under subparagraph (B) in a statement that describes the features of the Blended Retirement System and of the predecessor retirement system; and</text></subparagraph><subparagraph id="idB7E3C7F6784647C19D598C2CCFC7E88E"><enum>(D)</enum><text>have the member (and the member's spouse, if married) sign the statement described in subparagraph (C) to acknowledge understanding of those features.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3526880BCD8442F5A82F8C06FE0548E8"><enum>(3)</enum><header>Conforming amendment</header><text>Section 8440e(e)(1) of title 5, United States Code, is amended—</text><subparagraph id="idA6BD0D29547546D7A0162CA49AD88E94"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idD5DA8771160841FBB510109C46E26E76"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id56F9E76916C6495FA78EF93043D2159C"><enum>(i)</enum><text>in clause (ii), by striking <quote>has</quote> and inserting <quote>had</quote>;</text></clause><clause id="id2D916E6F48514D4EA73D3C177E8B0BFC"><enum>(ii)</enum><text>by striking clause (iii) and inserting the following new clause (iii):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF6B2F1F490B349DCB386CEE7CC627EEB"><clause id="id14454C9B30D74973983F8790BD3F4B3D"><enum>(iii)</enum><text>made the election described in section 1409(b)(4)(B) or 12729(f)(2) of title 10, as in effect before the date of the enactment of the <short-title>Re-open Enrollment for Servicemembers to Opt-in to Updated Retirement Choice for Enduring Security Act of 2021</short-title>, to receive Thrift Savings Plan contributions under this subsection in exchange for the reduced multipliers described in section 1409(b)(4)(A) or 12739(f)(1) of title 10, as applicable and so in effect, for purposes of calculating the retired pay of the member; or</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id85447F2DE2AD48DAA4D03C6605FAF5BE"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEB83DC9114104764899B42081D52E830"><subparagraph id="id55081128B12B4519B406287B4CFE6EE8"><enum>(C)</enum><text>who—</text><clause id="id1b425133686f45c6b5646c0612a49e83"><enum>(i)</enum><text>first entered a uniformed service before January 1, 2018;</text></clause><clause id="id71248e9769854472a20fc6c36df07b48"><enum>(ii)</enum><text>has completed fewer than 12 years of service in the uniformed services as of the date selected by the Secretary of Defense under sections 1409(b)(4)(C)(i)(I)(aa) and 12739(f)(2)(B)(i)(I)(aa); and</text></clause><clause id="id84fc34b6f78e41a1ae80a59441e3938e"><enum>(iii)</enum><text>makes the election described in section 1409(b)(4)(B) or 12729(f)(2) of title 10 to receive Thrift Savings Plan contributions under this subsection in exchange for the reduced multipliers described in section 1409(b)(4)(A) or 12739(f)(1) of title 10, as applicable, for purposes of calculating the retired pay of the member.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id049EECB651544A03A56A84C0E8732E31"><enum>(4)</enum><header>Training of certain officers</header><text>The Secretary of Defense shall ensure that each member of the armed forces in pay grade E–9 or below or in pay grade O–6 or below receives training with respect to the features of the Blended Retirement System, without regard to whether the member is eligible to make an election between the Blended Retirement System and the predecessor retirement system, so that member is able to answer the questions of other members if necessary.</text></paragraph></subsection><subsection id="id95450B19BEDA475788F5FC05FDE417BF"><enum>(d)</enum><header>Report on improved access to Thrift Savings Plan</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Federal Retirement Thrift Investment Board shall submit to Congress a plan for improving the access of members of the Armed Forces to information about the Thrift Savings Plan that—</text><paragraph id="idA3EB5C1F9257451B9F6869980B9CF8E7"><enum>(1)</enum><text display-inline="yes-display-inline">takes into account the time likely to pass between the mailing of account information to a member of the Armed Forces and the time the member is likely to receive the information; and</text></paragraph><paragraph id="id35D6F7F9BDCF4073A64FD48AF1FA6BF0"><enum>(2)</enum><text>makes recommendations for statutory changes necessary to improve such access.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5373AB03625C4123A38888DAEB7B1DCC"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Defense may prescribe such regulations as are necessary to carry out the amendments made by this section.</text></subsection></section></legis-body></bill>
