Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To list certain perfluoroalkyl and polyfluoroalkyl substances as hazardous air pollutants, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Release Of Toxics Emissions, Contamination, and Transfer Act of 2021</short-title></quote> or the <quote><short-title>PROTECT Act of 2021</short-title></quote>.</text></section><section id="id92F006456D6E4D34ABF566FEDED87F41"><enum>2.</enum><header>Listing of perfluoroalkyl and polyfluoroalkyl substances as hazardous air pollutants</header><subsection id="id57511669BC0D4F27A9E56C27E0108331"><enum>(a)</enum><header>Listing</header><paragraph id="idD4B196DE7A8841B49DF0CA528C1ED2EC"><enum>(1)</enum><header>Initial listing</header><text>Section 112(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idC05C8125B24F4B37BE4A578BA68D501D" style="OLC" act-name=""><paragraph id="id0BCC72E9D577413CBD08410489996D65"><enum>(8)</enum><header>Perfluoroalkyl and polyfluoroalkyl substances</header><subparagraph id="idC56B0597C8494A399D68EA321BCE440E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), beginning on the date of enactment of the <short-title>Prevent Release Of Toxics Emissions, Contamination, and Transfer Act of 2021</short-title>, the following substances are included on the list of hazardous air pollutants under paragraph (1):</text><clause id="idE58DD72DCE8D4549943D4C040731E44F"><enum>(i)</enum><text>Perfluorooctanoic acid and its salts.</text></clause><clause id="id83767dc1b53947de87bf4d7adfa999bb"><enum>(ii)</enum><text>Perfluorooctanesulfonic acid and its salts.</text></clause><clause id="id3b1ea9c4306740c6927564a001a4fcdf"><enum>(iii)</enum><text>Perfluorobutanesulfonic acid. </text></clause><clause id="ide4793b2f39fa4c9096ac58c6f5fecaab"><enum>(iv)</enum><text>Hexafluoropropylene oxide dimer acid and its ammonium salt (commonly referred to as <quote>GenX chemicals</quote>).</text></clause></subparagraph><subparagraph id="id0D21087360894860A1016628171A4E99"><enum>(B)</enum><header>Implementing regulations</header><clause id="id65EAA75AA8094D67B0E4DC38B489AA6E" commented="no"><enum>(i)</enum><header>Source categories</header><text>Notwithstanding any other provision of this section, not later than 2 years after the date of enactment of the <short-title>Prevent Release Of Toxics Emissions, Contamination, and Transfer Act of 2021</short-title>, the Administrator shall revise the list of the categories and subcategories of major sources and area sources established under subsection (c)(1) to include the categories and subcategories of the substances described in subparagraph (A).</text></clause><clause commented="no" id="id5C5774251B0F462B85BA8A621B31D6B2"><enum>(ii)</enum><header>Other regulations</header><text>Notwithstanding any other provision of this section and except as provided in clause (i), not later than 5 years after the date of enactment of the <short-title>Prevent Release Of Toxics Emissions, Contamination, and Transfer Act of 2021</short-title>, the Administrator shall finalize the emission standards and other regulations necessary under this section for the substances included on the list of hazardous air pollutants under subparagraph (A).</text></clause><clause commented="no" id="id3FE70CA0376441499F9BD1EC9E36F221"><enum>(iii)</enum><header>Savings clause</header><text>The Administrator may not enforce the listing of any hazardous air pollutant under subparagraph (A) until the regulations issued under clause (ii) are finalized.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idC6302EAFC59F497088B44464DED0C62F"><enum>(2)</enum><header>Additional listings</header><subparagraph id="id11E39256C3D8483A833A47743AA2F1D2"><enum>(A)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this Act, the Administrator of the Environmental Protection Agency (referred to in this Act as the <quote>Administrator</quote>) shall determine whether to issue, in accordance with section 112 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412</external-xref>), final rules adding perfluoroalkyl and polyfluoroalkyl substances other than the perfluoroalkyl and polyfluoroalkyl substances described in subsection (b)(8) of that section to the list of hazardous air pollutants established under subsection (b) of that section.</text></subparagraph><subparagraph id="id8EE99CF2220A4955A676C634CC5D9B78"><enum>(B)</enum><header>Sources categories</header><text>Not later than 2 years after the date on which a final rule is issued pursuant to subparagraph (A), the Administrator shall revise the list of the categories and subcategories of major sources and area sources established under section 112(c)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(c)(1)</external-xref>) to include the categories and subcategories of major sources and area sources of the perfluoroalkyl and polyfluoroalkyl substances listed pursuant to that final rule.</text></subparagraph><subparagraph id="idFB71F59C9087463CB3A553FC5529815E" commented="no"><enum>(C)</enum><header>Other regulations</header><text>Notwithstanding any other provision of section 112 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412</external-xref>) and except as provided in subparagraph (B), not later than 5 years after the date of enactment of this Act, the Administrator shall finalize the emission standards and other regulations necessary under that section for the substances described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id29DB389D4FEE46B1B346BDB2D91E94AE"><enum>(b)</enum><header>Petitions</header><text>Nothing in this Act or an amendment made by this Act affects the requirement that the Administrator grant or deny a petition under section 112(b)(3)(A) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(b)(3)(A)</external-xref>) within 18 months of the receipt of the petition, including a petition with respect to a substance described in subsection (a)(2)(A).</text></subsection><subsection id="idB344B7C86ABF4998A261414B795C4B49"><enum>(c)</enum><header>Quantification</header><text>For each substance added to the list of hazardous air pollutants established under section 112(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(b)</external-xref>) pursuant to this Act or under an amendment made by this Act, the Administrator shall—</text><paragraph id="idA1832BC3CCE643D49D6EEFFA0E5143FA"><enum>(1)</enum><text>provide support and services to advance the understanding of sources of emissions of the substance, or an appropriate surrogate for that substance, the state of technology for control of those emissions, and measurement approaches to quantify and measure those emissions; and</text></paragraph><paragraph id="idBAA3E932B67048208BE1E7CFAEE92CED"><enum>(2)</enum><text>to the extent practicable, continue to develop and improve the relevant source testing and ambient air measurement methodologies to facilitate—</text><subparagraph id="id1CE2CF11837C43CC9550DA6A94254749"><enum>(A)</enum><text>the identification of emissions sources of the substance; and</text></subparagraph><subparagraph id="id7720CB810484460B966046A7B70C30D7"><enum>(B)</enum><text>the detection and reporting of the emitted amounts of the substance.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
