<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 297</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210208">February 8, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself and <cosponsor name-id="S363">Mr. King</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To make exclusive the authority of the Federal Government to regulate the labeling of products made in the United States and introduced in interstate or foreign commerce, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"></legis-body><legis-body style="OLC" display-enacting-clause="no-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id30e02e6f-2707-44c8-8301-dcb1207979aa"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinforcing American-Made Products Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id38d61a57-854a-4d74-a54f-3bd48fe9d8f3"><enum>2.</enum><header display-inline="yes-display-inline">Exclusivity of Federal authority to regulate labeling of products made in the United States and introduced in interstate or foreign commerce</header><text display-inline="no-display-inline">Section 320933 of the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/15/45a">15 U.S.C. 45a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id282d6178-5276-45fa-86a6-872c5c46f7f0"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>To the extent</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7c4adb24-9250-4a25-94fd-f6488dad5704"><subsection commented="no" display-inline="no-display-inline" id="id7c03b7d4-9ad6-45b7-99d5-a62e1a7495b0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To the extent</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06fe0705-d379-4d0e-8e2b-824b91d1f9c8"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id124dffb0-54b4-4e41-a9f0-0d47959656d8"><subsection commented="no" display-inline="no-display-inline" id="idd958bef8-bb59-492f-b796-a8dc8ef130a3"><enum>(b)</enum><header display-inline="yes-display-inline">Effect on State law</header><paragraph commented="no" display-inline="no-display-inline" id="idD5E9CDD051DB4DD0BABCA7531F10DB1B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the provisions of this section shall supersede any provisions of the law of any State expressly relating to the extent to which a product is introduced, delivered for introduction, sold, advertised, or offered for sale in interstate or foreign commerce with a <quote>Made in the U.S.A.</quote> or <quote>Made in America</quote> label, or the equivalent thereof, in order to represent that such product was in whole or substantial part of domestic origin.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id407AB9BC1C1C429CABA6AE86FD51C300"><enum>(2)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">Nothing in this section shall preclude the application of the law of any State to the use of a label not in compliance with subsection (a).</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d25a1b5-befe-4962-b932-36562bf5844d"><enum>(3)</enum><text display-inline="yes-display-inline">in the third sentence of subsection (a), as so designated by paragraph (1), by striking <quote>Nothing in this section</quote> and inserting <quote>Except as provided in subsection (b), nothing in this section</quote>.</text></paragraph></section></legis-body></bill>
