<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2978</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211007">October 7, 2021</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, and <cosponsor name-id="S350">Mr. Rubio</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Treasury to consider certain transactions related to precious metals for purposes of identifying jurisdictions of primary money laundering concern, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id3ED1FD769D4843E690E734D84B33DAB4"><enum>1.</enum><header>Consideration of certain transactions involving precious metals for purposes of identifying jurisdictions of primary money laundering concern</header><text display-inline="no-display-inline">Section 5318A(c)(2) of title 31, United States Code, is amended—</text><paragraph id="id82DA7FF0393D422098AA7C1A4C52A401"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="idFA2BA54E6D234001BF99934C40383B99"><enum>(A)</enum><text>by redesignating clauses (iii) through (vii) as clauses (iv) through (viii), respectively; and</text></subparagraph><subparagraph id="id2004F3B52F2F40D69FB894EBFC2574ED"><enum>(B)</enum><text>by inserting after clause (ii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id301B54AC56B148C3ACE32372B4AA8EB9"><clause id="id3B3D68CACA6F4CF9B30C8D1663644591"><enum>(iii)</enum><text>the extent to which the jurisdiction or financial institutions operating in that jurisdiction facilitate transactions that are related to precious metals and are subject to being blocked pursuant to sanctions imposed by the United States under any statute or Executive order;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id3701F5DCAE16402CA37AEF8FB15B2ACF"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="id32848DC62CD947729993FDDAB96BC181"><enum>(A)</enum><text>by redesignating clauses (ii) and (iii) as clauses (iii) and (iv), respectively; and</text></subparagraph><subparagraph id="id5DDF13BD0D2E4E879678372F5B4039BD"><enum>(B)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id50E36CD5E1A745D598601343852B0DB5"><clause commented="no" display-inline="no-display-inline" id="idAD89A30E2C39469C8B432C33DF040485"><enum>(iv)</enum><text>the extent to which such financial institutions, transactions, or types of accounts are used to facilitate transactions that are related to precious metals and are subject to being blocked pursuant to sanctions imposed by the United States under any statute or Executive order;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
