<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2977</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211007">October 7, 2021</action-date><action-desc><sponsor name-id="S316">Mr. Whitehouse</sponsor> (for himself and <cosponsor name-id="S236">Mr. Inhofe</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow State manufacturing extension partnerships to award grants to small- and medium-sized manufacturers for the purpose of training new workers to replace departing experienced workers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Retain Innovation and Manufacturing Excellence (RIME) Act of 2021</short-title></quote>.</text></section><section id="idCC3DF48368F84C92B2AED02C9F6B71C9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idD7E54C8BD615468FAC71A1A235282F2C"><enum>(1)</enum><header>Center</header><text>The term <term>Center</term> has the meaning given the term in section 25(a) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(a)</external-xref>).</text></paragraph><paragraph id="id3859205A251E4813934C90069D38338B"><enum>(2)</enum><header>Eligible manufacturers</header><text>The term <term>eligible manufacturer</term> means a manufacturer that—</text><subparagraph id="id3592DBE8F7F3449EBF4DB91E6CDC89DA"><enum>(A)</enum><text>is a small business concern, as that term is defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8FB1DAF7E45F4BF1B9F9040D3871FC9E"><enum>(B)</enum><text>has an existing relationship with a Center.</text></subparagraph></paragraph></section><section id="id27F7013692584631ADAB62450E390E2A"><enum>3.</enum><header>Pilot program</header><subsection id="idDDE71FB76F2A40FCA36EB3E54EA645A2"><enum>(a)</enum><header>In general</header><text>The Secretary of Commerce shall establish a pilot program to award National Institute of Standards and Technology Manufacturing Extension Partnership (MEP) grants to help ensure an adequately trained manufacturing workforce. Under the program, eligible Centers may award MEP grants to eligible manufacturers to retain retiring employees for up to 90 days for the purpose of transferring job-specific skills and training to existing or new employees. The length of each grant shall be determined through negotiations between the Center and the eligible manufacturer.</text></subsection><subsection id="id729FEBE871194BC5A8639A674913FB69"><enum>(b)</enum><header>Eligibility</header><text>In order to be eligible to receive funding and award grants under the program, a Center must meet the following criteria:</text><paragraph id="id7007C86377C44141B2681A42DAEF4B14"><enum>(1)</enum><text>A Center must be able to document evidence of an aging workforce within manufacturing firms that are seeking assistance with retaining skills and knowledge of their operations.</text></paragraph><paragraph id="idA340E7595778477BA8924DD05BDFEB92"><enum>(2)</enum><text>A Center shall establish a transparent application process for eligible manufacturing firms that may include one or more of the following preferences:</text><subparagraph id="id5B5B1D98144A43DAB87D950BF70CD0C2"><enum>(A)</enum><text>A preference for manufacturers that employ veterans discharged or released under honorable conditions.</text></subparagraph><subparagraph id="id9A02980A32554F648FE08954A27156EC"><enum>(B)</enum><text>A preference for manufacturing firms from industry sectors that are most in need of assistance as determined by the local MEP.</text></subparagraph><subparagraph id="id3AF6CDFF90C7437F8A8AB1909873C6ED"><enum>(C)</enum><text>A preference for manufacturing firms with a facility in the State or region for an extended period of time before the application is submitted (as determined by the Center).</text></subparagraph><subparagraph id="id20BD99615BF24EE9A73768D20B573463"><enum>(D)</enum><text>A preference for manufacturing firms that have an existing relationship with the local MEP.</text></subparagraph></paragraph><paragraph id="idD5AFC78EE8B94035879D47898B4863AD"><enum>(3)</enum><text>A Center must be able to demonstrate their ability to assess, advise, and train manufacturers on how to transfer the job-specific skills and training through the implementation of a training structure and train-the-trainer program focused on knowledge capture and transfer.</text></paragraph></subsection><subsection id="ida32fb3853505449488fa8f3bd6014b43"><enum>(c)</enum><header>Training</header><text>In awarding grants pursuant to this section, consideration shall be given to the use of funds by Centers to assist manufacturers that are experiencing high employee turnover due to their inability to transfer required job-specific skills and training to new employees with the implementation of training structures and train-the-trainer programs.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idBE599A9D3A9F43B89F7FD668CCD54355"><enum>(d)</enum><header>Cost sharing</header><text>To be eligible for a grant under the pilot program under this section, a Center shall demonstrate that 50 percent of the amount of the funds awarded are matched from non-Federal sources. Those sources may include State and local agencies engaged in workforce development, foundations engaged in workforce development, or an in-kind contribution from an employer that would stand to directly benefit from the grant received by the Center.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idA944D2AAD9FE4EB7AAF73527901286D8"><enum>(e)</enum><header display-inline="yes-display-inline">Number and size of awards</header><paragraph commented="no" display-inline="no-display-inline" id="idCF008D7A746E45999655C61D8BCE2869"><enum>(1)</enum><header display-inline="yes-display-inline">Number</header><text>The Secretary may award up to 25 grants to Centers under the pilot program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDB13A5B3E00644A1B1E082CEE79F2AE6"><enum>(2)</enum><header>Size</header><text>Each award under the program shall be for not less than $50,000 and not more than $500,000.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="idCFBF01258016495E926A24C6861AE47F"><enum>(f)</enum><header>Administrative expenses</header><text>A Center receiving a grant under the pilot program may use up to 5 percent of the amount of the grant for the administration of expenses incurred by the Center in distributing grants to eligible manufacturers under the pilot program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idEE800C539E3D424AB8029C9774B5109A"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the National Institute of Standards and Technology $10,000,000 to carry out the pilot program.</text></subsection></section></legis-body></bill>
