Hugh Conor McDowell Safety in Armed Forces Equipment Act of 2021</short-title></quote>. </text></section><section id="HC400BF51EBC24FF483B6CACE1B91AFEE"><enum>2.</enum><header>Pilot program for tactical vehicle safety data collection</header><subsection id="HF3AA5D7DBB914F51AF90914D9CA25BE8"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of the Army and the Secretary of the Navy shall jointly carry out a pilot program to evaluate the feasibility of using data recorders to monitor, assess, and improve the readiness and safety of the operation of military tactical vehicles.</text></subsection><subsection id="H4F80FB82E3C147009FDDDCECACEFF0F7"><enum>(b)</enum><header>Purposes</header><text>The purposes of the pilot program are—</text><paragraph id="H27E29439F3954287B225402B38DD8476"><enum>(1)</enum><text>to allow for the automated identification of hazards and potential hazards on and off military installations;</text></paragraph><paragraph id="H3247766E07974F4EA8CC1CC0B0890D5F"><enum>(2)</enum><text display-inline="yes-display-inline">to mitigate and increase awareness of hazards and potential hazards on and off military installations;</text></paragraph><paragraph id="H7C0C133DD455428E8006D6386C41AA08"><enum>(3)</enum><text>to identify near-miss accidents;</text></paragraph><paragraph id="H53C1FBE3ADF34F478D7A18450253B601"><enum>(4)</enum><text>to create a standardized record source for accident investigations;</text></paragraph><paragraph id="H7FE0FBC201254D9DBDD83AC5A1CE0313"><enum>(5)</enum><text>to assess individual driver proficiency, risk, and readiness;</text></paragraph><paragraph id="HA617099707E747BAA1397A395F3CE987"><enum>(6)</enum><text display-inline="yes-display-inline">to increase consistency in the implementation of military installation and unit-level range safety programs across military installations and units;</text></paragraph><paragraph id="H57E129789D7F40D7B80A169F795ED5FA"><enum>(7)</enum><text display-inline="yes-display-inline">to evaluate the feasibility of incorporating metrics generated from data recorders into the safety reporting systems and to the Defense Readiness Reporting System as a measure of assessing safety risks, mitigations, and readiness;</text></paragraph><paragraph id="H10DA6469C56841A4980F928105A0F03E"><enum>(8)</enum><text>to determine the costs and benefits of retrofitting data recorders on legacy platforms and including data recorders as a requirement in acquisition of military tactical vehicles; and</text></paragraph><paragraph id="HBAAF58E3D2EA42ADA20EF310637D7344"><enum>(9)</enum><text>any other matters as determined by the Secretary concerned.</text></paragraph></subsection><subsection id="HCADCE02888084CA5AB29592C6632B88B"><enum>(c)</enum><header>Requirements</header><text>In carrying out the pilot program, the Secretary of the Army and the Secretary of the Navy shall—</text><paragraph id="HE5B036927A2A408ABD4466D2C84528EC"><enum>(1)</enum><text>assess the feasibility of using commercial technology, such as smartphones or technologies used by insurance companies, as a data recorder;</text></paragraph><paragraph id="H5D93B66CA1044819B86690939295A08F"><enum>(2)</enum><text>test and evaluate a minimum of two data recorders that meet the pilot program requirements;</text></paragraph><paragraph id="H3093AB5B6A394BEE9A34EE9889D91AE7"><enum>(3)</enum><text>select a data recorder capable of collecting and exporting the telemetry data, event data, and driver identification during operation and accidents;</text></paragraph><paragraph id="H96A5AE3CCAD9496EBD3ECC67A078CA05"><enum>(4)</enum><text>install and maintain a data recorder on a sufficient number of each of the military tactical vehicles listed under subsection (f) at installations selected by the Secretary concerned under subsection (e) for statistically significant results;</text></paragraph><paragraph id="HA4CFF27C09BE4769970DA47EB753CED6"><enum>(5)</enum><text>establish and maintain a database that contains telemetry data, driver data, and event data captured by the data recorder;</text></paragraph><paragraph id="H4943499458214CF7B3C09A02BE944631"><enum>(6)</enum><text>regularly generate for each installation selected under subsection (e) a dataset that is viewable in widely available mapping software of hazards and potential hazards based on telemetry data and event data captured by the data recorders;</text></paragraph><paragraph id="H5775FDC5F9E0469C9608FF390550EE14"><enum>(7)</enum><text display-inline="yes-display-inline">generate actionable data sets and statistics on individual, vehicle, and military installation;</text></paragraph><paragraph id="H71330462C0844F1A8E38CB13945E271C"><enum>(8)</enum><text display-inline="yes-display-inline">require commanders at the installations selected under subsection (e) to incorporate the actionable data sets and statistics into the installation range safety program;</text></paragraph><paragraph id="H05CBDDC0599C47638201C8C364FF4CEE"><enum>(9)</enum><text display-inline="yes-display-inline">require unit commanders at the installations selected under subsection (e) to incorporate the actionable data sets and statistics into the unit driver safety program;</text></paragraph><paragraph id="H85E155A6EEE740169774545CFE8D4D8D"><enum>(10)</enum><text>evaluate the feasibility of integrating data sets and statistics to improve driver certification and licensing based on data recorded and generated by the data recorders;</text></paragraph><paragraph id="HF33B785BD1CD4BC38003E6FBEA5CC37B"><enum>(11)</enum><text>use open architecture to the maximum extent practicable; and</text></paragraph><paragraph id="H9B30278520A04670BAEA53B806A94905"><enum>(12)</enum><text>carry out any other activities determined by the Secretary as necessary to meet the purposes under subsection (b).</text></paragraph></subsection><subsection id="HF3E3BFA49DA8486E8A9AD142F1052175"><enum>(d)</enum><header>Implementation plan</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of the Army and the Secretary of the Navy shall develop a plan for implementing the pilot program.</text></subsection><subsection id="HE6FF54FCE5914ED7A94C22B20182BA43"><enum>(e)</enum><header>Locations</header><text display-inline="yes-display-inline">Each Secretary concerned shall carry out the pilot program at not fewer than one military installation in the United States selected by the Secretary concerned that meets the following conditions:</text><paragraph id="H3454315C33BF4BA488C175C6C1654C8F"><enum>(1)</enum><text>Contains the necessary force structure, equipment, and maneuver training ranges to collect driver and military tactical vehicle data during training and routine operation.</text></paragraph><paragraph id="HA601712EEC3D43B0BF15C679F6C186C9"><enum>(2)</enum><text>Represents at a minimum one of the five training ranges identified in the study by the Comptroller General of the United States titled <quote>Army and Marine Corps Should Take Additional Actions to Mitigate and Prevent Training Accidents</quote> that did not track unit location during the training events.</text></paragraph></subsection><subsection id="H18665165FA954BD4A016C2CD68C7C9DC"><enum>(f)</enum><header>Covered military tactical vehicles</header><text>The pilot program shall cover the following military tactical vehicles:</text><paragraph id="H16322842D9A54C008F88E44B5EED826D"><enum>(1)</enum><text>Army Strykers.</text></paragraph><paragraph id="HFDF1C0B58A7C45AE935B127ED1186AFC"><enum>(2)</enum><text>Marine Corps Light Armored Vehicles.</text></paragraph><paragraph id="HF182128E1BC2497C9A8674B7CEC43401"><enum>(3)</enum><text>Army Medium Tactical Vehicles.</text></paragraph><paragraph id="H41601E493D7C464E8316417B1237878D"><enum>(4)</enum><text>Marine Corps Medium Tactical Vehicle Replacements.</text></paragraph></subsection><subsection id="H90F900E70E5D4BD59868E47D00E03B24"><enum>(g)</enum><header>Metrics</header><text display-inline="yes-display-inline">The Secretaries shall develop metrics to evaluate the effectiveness of the pilot program in monitoring, assessing, and improving vehicle safety, driver readiness, and mitigation of risk.</text></subsection><subsection id="HA090D90A253742189B2B97470E211B52"><enum>(h)</enum><header>Reports</header><paragraph id="HD4CE74AB213A4C4A9D0E821A09CEFEE8"><enum>(1)</enum><header>Initial</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of the Army and the Secretary of the Navy shall jointly submit to the congressional defense committees a report on the pilot program that addresses the plan for implementing the requirements under subsection (c), including the established metrics under subsection (g).</text></paragraph><paragraph id="H58CA9E42DFC04A8FB15ABF6F4D51A237"><enum>(2)</enum><header>Interim</header><text display-inline="yes-display-inline">Not later than three years after the commencement of the pilot program, the Secretary of the Army and the Secretary of the Navy shall jointly submit to the congressional defense committees a report on the status of the pilot program, including the preliminary results in carrying out the pilot program, the metrics generated during the pilot program, disaggregated by military tactical vehicle, location, and service, and the implementation plan under subsection (d).</text></paragraph><paragraph id="HD2BC273D41C54A559B80BDBE49DA120E"><enum>(3)</enum><header>Final</header><subparagraph id="id85CE817B338F4C46B480B3127FE6B6C5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the termination of the pilot program, the Secretary of the Army and the Secretary of the Navy shall jointly submit to the congressional defense committees a report on the results of the program.</text></subparagraph><subparagraph id="id8E7839ECD1944104BF7BD7C1D787369A"><enum>(B)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by subparagraph (A) shall—</text><clause id="H9D1FAF0AD2C7442C91BB5F1E8EAA0FF1"><enum>(i)</enum><text>assess the effectiveness of the pilot program in meeting the purposes under subsection (b);</text></clause><clause id="H85BE49477F3244588143077A6675B3BA"><enum>(ii)</enum><text>include the metrics generated during the pilot program, disaggregated by military tactical vehicle, location, and service;</text></clause><clause id="HB7C7F8868D4A458E800387D62C8FFD10"><enum>(iii)</enum><text>include the views of range personnel, unit commanders, and members of the Armed Forces involved in the pilot program on the level of effectiveness of the technology selected;</text></clause><clause id="H14E8AEA366C94AFCA4E4D4CC6D6EF186"><enum>(iv)</enum><text display-inline="yes-display-inline">provide a cost estimate for equipping legacy military tactical vehicles with data recorders;</text></clause><clause id="H01E075C124884DFEA72F93D3F4AC4123"><enum>(v)</enum><text>determine the instances in which data recorders should be a requirement in the acquisition of military tactical vehicles;</text></clause><clause id="H5AFA0267DAD94BA7A284252B35217410"><enum>(vi)</enum><text>recommend whether the pilot program should be expanded or made into a program of record; and</text></clause><clause id="HC850A44CE63344DB9AC3FA0B22118F9E"><enum>(vii)</enum><text>recommend any statutory, regulatory, or policy changes required to support the purposes under subsection (b).</text></clause></subparagraph></paragraph></subsection><subsection id="H3FB3D37213224110A434F3C03C44F021"><enum>(i)</enum><header>Termination</header><text>The authority to carry out the pilot program under subsection (a) shall terminate five years after the date of the enactment of this Act.</text></subsection><subsection id="H139B7ED9CA084C338FCA8724F293B5A2"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H49F1F50E36374C51B6C07CEA374508B7"><enum>(1)</enum><header>Accident</header><text>The term <term>accident</term> means a collision, rollover, or other mishap involving a motor vehicle.</text></paragraph><paragraph id="idBE972FE1CDD940ECA17688F81BD21A13"><enum>(2)</enum><header>Congressional defense committees</header><text>The term <term>congressional defense committees</term> has the meaning given that term in section 101(a)(16) of title 10, United States Code.</text></paragraph><paragraph id="H0DDD6AE5533A42B3B7CA9BD162796A30"><enum>(3)</enum><header>Data recorder</header><text>The term <term>data recorder </term> means technologies installed in a motor vehicle to record driver identification, telemetry data, and event data related to the operation of the motor vehicle.</text></paragraph><paragraph id="H5D7A3238E7CB42F28996DCECD4B41B50"><enum>(4)</enum><header>Driver identification</header><text>The term <term>driver identification</term> means data enabling the unique identification of the driver operating a motor vehicle.</text></paragraph><paragraph id="H20CC804AF09247ED870EF322DE819CCF"><enum>(5)</enum><header>Event data</header><text>The term <term>event data</term> includes data related to—</text><subparagraph id="H27694977B260428D87517D3B53D4DE35"><enum>(A)</enum><text>the start and conclusion of each vehicle operation;</text></subparagraph><subparagraph id="H004E7625D7904C2DABFFEE4720AEE91F"><enum>(B)</enum><text>a vehicle accident;</text></subparagraph><subparagraph id="H6AFBDD13AB3D493FB1CBA2BDCEC876AA"><enum>(C)</enum><text>a vehicle acceleration, velocity, or location with an increased potential for an accident; or</text></subparagraph><subparagraph id="H40B036E6AC044A8EB93BFCB1864BC703"><enum>(D)</enum><text>a vehicle orientation with an increased potential for an accident.</text></subparagraph></paragraph><paragraph id="HC20D2614A27C41B4AEA80A1BBA267390"><enum>(6)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="H3D17B92410FE4415AC307BEDFA8C3B26"><enum>(A)</enum><text>the Secretary of the Army with respect to matters concerning the Army; and</text></subparagraph><subparagraph id="H1F30013B36964E5C96C56B7CE6071684"><enum>(B)</enum><text>the Secretary of the Navy with respect to matters concerning the Navy and Marine Corps.</text></subparagraph></paragraph><paragraph id="H2F8050E60E2C476DBC5FFBCFBC5DA954"><enum>(7)</enum><header>Telemetry data</header><text>The term <term>telemetry data</term> includes—</text><subparagraph id="H42523704639B40B594F4AA5FEE41222C"><enum>(A)</enum><text>time;</text></subparagraph><subparagraph id="HCD480C9CF4374679A28E3957FC91DCF4"><enum>(B)</enum><text>vehicle distance traveled;</text></subparagraph><subparagraph id="HC3424E193CC04455944546D0F4A556CE"><enum>(C)</enum><text>vehicle acceleration and velocity;</text></subparagraph><subparagraph id="H3AF1B73AEB8941DDB81835A2DBE91DC6"><enum>(D)</enum><text>vehicle orientation, including roll, pitch, and yaw; and</text></subparagraph><subparagraph id="HFB76EC0FCFD045838CA1D27D740278FC"><enum>(E)</enum><text>vehicle location in a geographic coordinate system, including elevation.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
