of judgeships for the United States Court of Appeals for the Ninth Circuit and certain district courts of the United States, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judicial Efficiency Improvement Act</short-title></quote>.</text></section><section id="ID9C9E081B1DDA4B63B85EDBCA4C1C3425"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ID3C8D9A7CA3A549BCA8A010D80CFB9F37"><enum>(1)</enum><header>Former ninth circuit</header><text>The term <term>former ninth circuit</term> means the ninth judicial circuit of the United States as in existence on the day before the effective date of this Act.</text></paragraph><paragraph id="IDD03369A604A94B508A8003ED0EAE75A2"><enum>(2)</enum><header>New ninth circuit</header><text>The term <term>new ninth circuit</term> means the ninth judicial circuit of the United States established by the amendment made by section 3(2)(A).</text></paragraph><paragraph id="ID973AB9D79BD242C78F38971793E00C4F"><enum>(3)</enum><header>Twelfth circuit</header><text>The term <term>twelfth circuit</term> means the twelfth judicial circuit of the United States established by the amendment made by section 3(2)(B).</text></paragraph></section><section id="ID9C3A140BA27E4E77B9F72D37ABB496D1"><enum>3.</enum><header>Number and composition of circuits</header><text display-inline="no-display-inline">Section 41 of title 28, United States Code, is amended—</text><paragraph id="IDA37A2E31B79E409791ECC43B0A7D7B5B"><enum>(1)</enum><text>in the matter preceding the table, by striking <quote>thirteen</quote> and inserting <quote>fourteen</quote>; and</text></paragraph><paragraph id="ID23A6DB96E7DF43FFB884F581DB6524E6"><enum>(2)</enum><text>in the table—</text><subparagraph id="IDE4D590CD6253439BBA91804B7BEDEF98"><enum>(A)</enum><text>by striking the item relating to the ninth circuit and inserting the following:</text><quoted-block id="ID5AC6A9ECBFB946F5A40A95214535B086"><enum>4.</enum><header>Circuit court judgeships</header><subsection id="ID4DD654739A3748D5BD4366001A0BE1D2"><enum>(a)</enum><header>New Judgeships</header><text>The President shall appoint, by and with the advice and consent of the Senate, 2 additional circuit judges for the new ninth circuit, whose official duty station shall be in California.</text></subsection><subsection id="ID6E5EE4384FAE486E975A73B4A2323570"><enum>(b)</enum><header>Temporary Judgeships</header><paragraph id="ID0173D2D37CF14470989A4DE240CE669A"><enum>(1)</enum><header>Appointment of judges</header><text>The President shall appoint, by and with the advice and consent of the Senate, 2 additional circuit judges for the former ninth circuit, whose official duty station shall be in California.</text></paragraph><paragraph id="ID6A544559CE1A458F9FA5CE70B4F58ABE"><enum>(2)</enum><header>Effect of vacancies</header><text>The first 2 vacancies in the position of circuit judge for the new ninth circuit occurring 10 years or more after judges are first confirmed to fill both temporary circuit judgeships created by this subsection shall not be filled.</text></paragraph></subsection><subsection id="ID27822D2620B74B99B65C5FCF105D8310"><enum>(c)</enum><header>Effective Date</header><text>This section shall take effect on the date of enactment of this Act.</text></subsection></section><section id="IDE9B2A4D37FC04DBC919BF65489E2576B"><enum>5.</enum><header>Number of circuit judges</header><text display-inline="no-display-inline">The table in section 44(a) of title 28, United States Code, is amended—</text><paragraph id="ID035C987F40234C8982DFA58C66B25370"><enum>(1)</enum><text>by striking the item relating to the ninth circuit and inserting the following:</text><quoted-block id="ID2C61CE38C9F64566A127E5543C638557"><enum>6.</enum><header>Places of circuit court</header><text display-inline="no-display-inline">The table in section 48(a) of title 28, United States Code, is amended—</text><paragraph id="ID57028C14706A484B97B2AADA6BEC4799"><enum>(1)</enum><text>by striking the item relating to the ninth circuit and inserting the following:</text><quoted-block indent="up1"><enum/><text>and</text></paragraph><paragraph id="IDEB3FC6932D5E4FDC9DE0B5DDDFF9ECE6"><enum>(2)</enum><text>by inserting after the item relating to the eleventh circuit the colname="column2" leader-modify="clr-ldr">Las Vegas, Phoenix, Portland, Seattle.</entry></row></tbody></tgroup></table><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="ID2C1883F5B4DF44A3839ED3149172BBA1"><enum>7.</enum><header>Location of Twelfth Circuit headquarters</header><text display-inline="no-display-inline">The offices of the Circuit Executive of the Twelfth Circuit and the Clerk of the Court of the Twelfth Circuit shall be located in Seattle, Washington.</text></section><section id="ID5779260AC0084583A0F053A57F4464C5"><enum>8.</enum><header>Assignment of circuit judges</header><text display-inline="no-display-inline">Each circuit judge of the former ninth circuit who is in regular active service and whose official duty station on the day before the effective date of this Act—</text><paragraph id="ID6B92688F6C354F81A2D2D3DE63A0FDFC"><enum>(1)</enum><text>is in California, Guam, Hawaii, or the Northern Mariana Islands shall be a circuit judge of the new ninth circuit as of that effective date; and</text></paragraph><paragraph id="ID978EEB17098D450D82D0BACD86E14908"><enum>(2)</enum><text>is in Alaska, Arizona, Idaho, Montana, Nevada, Oregon, or Washington shall be a circuit judge of the twelfth circuit as of that effective date.</text></paragraph></section><section id="ID2641F7210E5448549BF981498A509ADA"><enum>9.</enum><header>Election of assignment by senior judges</header><text display-inline="no-display-inline">Each judge who is a senior circuit judge of the former ninth circuit on the day before the effective date of this Act—</text><paragraph id="id12350D7356FF493A860D8D283B9C7DA8"><enum>(1)</enum><text display-inline="yes-display-inline">may elect to be assigned to the new ninth circuit or the twelfth circuit as of that effective date; and</text></paragraph><paragraph id="idB5BE726A627B4865970938B530C82AE2"><enum>(2)</enum><text display-inline="yes-display-inline">shall notify the Director of the Administrative Office of the United States Courts of the election made under paragraph (1).</text></paragraph></section><section id="ID779A20077AB84FE0A7D45E1D65805CF7"><enum>10.</enum><header>Seniority of judges</header><text display-inline="no-display-inline">The seniority of each judge who is assigned under section 8 or elects to be assigned under section 9 shall run from the date of commission of the judge as a judge of the former ninth circuit.</text></section><section id="ID796F53FB528742EC9450BD91AA490754"><enum>11.</enum><header>Application to cases</header><text display-inline="no-display-inline">The following apply to any case in which, on the day before the effective date of this Act, an appeal or other proceeding has been filed with the former ninth circuit:</text><paragraph id="IDD2FD4FA5130541FCB3CDC74E15FF105F"><enum>(1)</enum><text>Except as provided in paragraph (3), if the matter has been submitted for decision, further proceedings with respect to the matter shall be had in the same manner and with the same effect as if this Act had not been enacted.</text></paragraph><paragraph id="ID75714FF1743B491AB91A957FD2F9EC94"><enum>(2)</enum><text>If the matter has not been submitted for decision, the appeal or proceeding, together with the original papers, printed records, and record entries duly certified, shall, by appropriate orders, be transferred to the court to which the matter would have been submitted had this Act been in full force and effect on the date on which the appeal was taken or other proceeding commenced, and further proceedings with respect to the case shall be had in the same manner and with the same effect as if the appeal or other proceeding had been filed in that court.</text></paragraph><paragraph id="IDF05A0FCCDADD4D79A668CFCDEB47018F"><enum>(3)</enum><text>If a petition for rehearing en banc is pending on or after the effective date of this Act, the petition shall be considered by the court of appeals to which the petition would have been submitted had this Act been in full force and effect on the date on which the appeal or other proceeding was filed with the court of appeals.</text></paragraph></section><section id="ID782E9DF61B3E44209590551202CBCB71"><enum>12.</enum><header>Temporary assignment of circuit judges among circuits</header><text display-inline="no-display-inline">Section 291 of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="ID29C83ED31AB6402C8110DA5A4F15E2E3"><subsection id="IDE5997F91331C4DE2BD51D233E3FA2538"><enum>(c)</enum><text>The chief judge of the Ninth Circuit may, in the public interest and upon request by the chief judge of the Twelfth Circuit, designate and assign temporarily any circuit judge of the Ninth Circuit to act as circuit judge in the Twelfth Circuit.</text></subsection><subsection id="ID3D0C8F86DE9343B8BF3A71E7D3116CE7"><enum>(d)</enum><text>The chief judge of the Twelfth Circuit may, in the public interest and upon request by the chief judge of the Ninth Circuit, designate and assign temporarily any circuit judge of the Twelfth Circuit to act as circuit judge in the Ninth Circuit.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ID5734A6A186604A0386349A01D8D3FD15"><enum>13.</enum><header>Temporary assignment of district judges among circuits</header><text display-inline="no-display-inline">Section 292 of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="ID41183012DCB7481A941E02043B2DB8C6"><subsection id="IDDE8DE7BB12DC4EE38A3102CD6D1BFFED"><enum>(f)</enum><text>The chief judge of the United States Court of Appeals for the Ninth Circuit may in the public interest—</text><paragraph id="IDE1305E9D0E6349A3B16C31E24589ECEF"><enum>(1)</enum><text>upon request by the chief judge of the Twelfth Circuit, designate and assign one or more district judges within the Ninth Circuit to sit upon the Court of Appeals of the Twelfth Circuit, or a division thereof, whenever the business of that court so requires; and</text></paragraph><paragraph id="ID28B84A58B3B54F70A43EE32E790FB0ED"><enum>(2)</enum><text>designate and assign temporarily any district judge within the Ninth Circuit to hold a district court in any district within the Twelfth Circuit.</text></paragraph></subsection><subsection id="ID30D160A4BBBF4DFD9691837534AF5CBB"><enum>(g)</enum><text>The chief judge of the United States Court of Appeals for the Twelfth Circuit may in the public interest—</text><paragraph id="IDF4B660CD3CBA4C47BD4653B83DEBE95E"><enum>(1)</enum><text>upon request by the chief judge of the Ninth Circuit, designate and assign one or more district judges within the Twelfth Circuit to sit upon the Court of Appeals of the Ninth Circuit, or a division thereof, whenever the business of that court so requires; and</text></paragraph><paragraph id="IDFDF6E1D525CE4766983865CB446F70D5"><enum>(2)</enum><text>designate and assign temporarily any district judge within the Twelfth Circuit to hold a district court in any district within the Ninth Circuit.</text></paragraph></subsection><subsection id="ID26BC64436F334AD58EF123AD22F144BE"><enum>(h)</enum><text>Any designation or assignment under subsection (f) or (g) shall be in conformity with the rules or orders of the court of appeals of, or the district within, as applicable, the circuit to which the judge is designated or assigned.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id04A82EA0C8EA41E5BFC23F689DDAFBC7"><enum>14.</enum><header>District judges for the district courts</header><subsection id="iddaac0b6038d14b0c9d76d46e5ab44be0"><enum>(a)</enum><header>Additional judgeships</header><text>The President shall appoint, by and with the advice and consent of the Senate—</text><paragraph id="idD73282DD91974EDB8A9366B5CCACBBEB"><enum>(1)</enum><text>4 additional district judges for the district of Arizona;</text></paragraph><paragraph id="idB877D345AD6040D4B5C5C734DD08DBDC"><enum>(2)</enum><text>15 additional district judges for the central district of California;</text></paragraph><paragraph id="id748F0F1D06674AC8B8F550D176F4C0A8"><enum>(3)</enum><text>4 additional district judges for the eastern district of California;</text></paragraph><paragraph id="id494FBFCCE66449BAA5CAC12971515A0E"><enum>(4)</enum><text>5 additional district judges for the northern district of California;</text></paragraph><paragraph id="idD635337E4A37426D9D81454F6D255304"><enum>(5)</enum><text>6 additional district judges for the southern district of California;</text></paragraph><paragraph id="id4A537B6425724C3BB303676AF1930EDC"><enum>(6)</enum><text>2 additional district judges for the district of Colorado;</text></paragraph><paragraph id="id124065B0F7DE4E479417CFFB80FB488A"><enum>(7)</enum><text>2 additional district judges for the district of Delaware;</text></paragraph><paragraph id="idCA56FE886BC340F3AEE3218D18794F80"><enum>(8)</enum><text>7 additional district judges for the middle district of Florida;</text></paragraph><paragraph id="id21FE7FB32FA54EDCAB0A96DB1010B85D"><enum>(9)</enum><text>1 additional district judge for the northern district of Florida;</text></paragraph><paragraph id="id85E494213C314736A6AAA869DC3DF0AA"><enum>(10)</enum><text>3 additional district judges for the southern district of Florida;</text></paragraph><paragraph id="id83B2BB06AFE84A478E701BA0B3DB642A"><enum>(11)</enum><text>2 additional district judges for the northern district of Georgia;</text></paragraph><paragraph id="id6D07FD436C35459293A0C25939AA701C"><enum>(12)</enum><text>1 additional district judge for the district of Idaho;</text></paragraph><paragraph id="id4777EC1E150A42779EE6504C5A4CC6BF"><enum>(13)</enum><text>2 additional district judges for the southern district of Indiana;</text></paragraph><paragraph id="id6A182FB371014FCAA3BDD7E6E14C4FD7"><enum>(14)</enum><text>1 additional district judge for the district of Iowa;</text></paragraph><paragraph id="id38726ECFCACE4A16A383385929247923"><enum>(15)</enum><text>5 additional district judges for the district of New Jersey;</text></paragraph><paragraph id="idF79BBE19744549FE8306C40082A32218"><enum>(16)</enum><text>1 additional district judge for the district of New Mexico;</text></paragraph><paragraph id="id9F7AEAB4A05C49C295006B7C2C7AD5EE"><enum>(17)</enum><text>2 additional district judges for the eastern district of New York;</text></paragraph><paragraph id="idF3F61F3DC8544198B5336CED1768DE3B"><enum>(18)</enum><text>1 additional district judge for the southern district of New York;</text></paragraph><paragraph id="id7729FC72CCF344C6B70DD22DED08152F"><enum>(19)</enum><text>1 additional district judge for the western district of New York;</text></paragraph><paragraph id="id8A359C96AC174FC5B5391F20DEFD80C0"><enum>(20)</enum><text>2 additional district judges for the eastern district of Texas;</text></paragraph><paragraph id="id65BBA79C1A0542689577739AD091ED85"><enum>(21)</enum><text>4 additional district judges for the southern district of Texas; and</text></paragraph><paragraph id="id5D0EF9FFDF4B4C4EBB339BA41207B081"><enum>(22)</enum><text>6 additional district judges for the western district of Texas.</text></paragraph></subsection><subsection id="idEC7EA0F540B94DCEB9B404BEAA7AF706"><enum>(b)</enum><header>Conversion of temporary judgeships</header><text>The existing judgeships for the district of Kansas and the eastern district of Missouri authorized by section 203(c) of the Judicial Improvements Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/650">Public Law 101–650</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note) and the existing judgeships for the district of Arizona, the central district of California, the southern district of Florida, the eastern district of Missouri, the district of New Mexico, the western district of North Carolina, and the eastern district of Texas authorized by section 312(c) of the 21st Century Department of Justice Appropriations Authorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/107/273">Public Law 107–273</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note), as of the date of enactment of this Act, shall be authorized under section 133 of title 28, United States Code, and the incumbents in those offices shall hold the office under section 133 of title 28, United States Code, as amended by this Act.</text></subsection><subsection id="id9cde329dca8f4e8fbf3e1d477d7dcfa4"><enum>(c)</enum><header>Technical and conforming amendments</header><text>The table contained in section 133(a) of title 28, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ideeb0fb2671b7417f8a018f51af00928b"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the item relating to the district of Arizona and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2BC3096152FC4C368C2ACCFB06BF598D"><table blank-lines-before="1" align-to-level="section" frame="none" line-rules="no-gen" rule-weights="0.0.0.4.0.0" subformat="S6211" table-type="2-Entry:-2-text,-bold-hds"><tgroup cols="2" display-inline="yes-display-inline">The court of appeals for the ninth circuit as constituted on the day before the effective date of this Act may take any administrative action that is required to carry out this Act and the amendments made by this Act.</text></subsection><subsection id="idE169F1D3F5AB4BF0A3D9884FD1FD43D3"><enum>(b)</enum><header>Administrative termination</header><text display-inline="yes-display-inline">The court described in subsection (a) shall cease to exist for administrative purposes 2 years after the date of enactment of this Act.</text></subsection></section><section id="IDE72B421185124F7986DE8307827C7E27"><enum>16.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act, including funds for additional court facilities.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ID274A4A5CEACC4D1E845A173E3C4C23F4"><enum>17.</enum><header>Effective date</header><text
