which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a socioeconomic labor threshold and use that threshold for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41, United States Code.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Service Contract Modernization Act</short-title></quote>.</text></section><section id="id20C643ED2C5B498A819011031F39A1F9"><enum>2.</enum><header>Socioeconomic labor threshold</header><subsection id="id907CEE26372F4D098E6CFF76A360BE1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this Act, the socioeconomic labor threshold is—</text><paragraph id="id156F6AA94D4C4ABC876B5A6175A4866D"><enum>(1)</enum><text display-inline="yes-display-inline">for the period beginning on the date of enactment of this Act and ending on October 1 following such date of enactment, the amount determined by the Secretary of Labor under subsection (b)(1); and</text></paragraph><paragraph id="id9E164EF5535B494F81F0D48D3593F84B"><enum>(2)</enum><text>for each 1-year period beginning on October 1 following such date of enactment, the amount determined by the Secretary of Labor under subsection (b)(2).</text></paragraph></subsection><subsection id="idAD884D58FA404564BDDC299E950A5B16" commented="no"><enum>(b)</enum><header>Inflation adjustments</header><paragraph commented="no" id="id5967AB1F2A1041C09BE4DC5D65518142"><enum>(1)</enum><header>Initial period</header><text>The amount determined under this paragraph for the period described in subsection (a)(1) shall be $2,500 as—</text><subparagraph commented="no" id="idD994E825CDC1449DA582F79890D26B11"><enum>(A)</enum><text>increased by the percentage increase in the Consumer Price Index for All Urban Consumers (all items; United States city average), as published by the Bureau of Labor Statistics, comparing—</text><clause commented="no" id="id747118F4EC104E3180851AFB2564A88C"><enum>(i)</enum><text>such Consumer Price Index for October of 1965; and</text></clause><clause commented="no" id="id5085490E1B3E4188B89E751A98650AFE"><enum>(ii)</enum><text>such Consumer Price Index for the most recent month as of the date of enactment of this Act for which such Consumer Price Index is available; and</text></clause></subparagraph><subparagraph commented="no" id="idA2A1529CCCD243FD97469DED1047F152"><enum>(B)</enum><text>(if applicable), rounded to the nearest multiple of $100.</text></subparagraph></paragraph><paragraph commented="no" id="id2A8B0F80CF5044DDAA3A1A1A36213AED"><enum>(2)</enum><header>Subsequent periods</header><subparagraph commented="no" id="id8F549EEF42AF4AD585AC19E46FA099DE"><enum>(A)</enum><header>In general</header><text>The amount determined under this paragraph for the applicable period described in subsection (a)(2) shall be the amount in effect on the date of such determination as—</text><clause commented="no" id="id7D99DE74F6CB43F3A511086D8F92D8A7"><enum>(i)</enum><text>increased (if applicable) from such amount by the annual percentage increase, if any, in the Consumer Price Index for All Urban Consumers (all items; United States city average), as published by the Bureau of Labor Statistics, from the preceding year as calculated in accordance with subparagraph (B); and</text></clause><clause commented="no" id="idDECAA1938D8A411B825CFC0F58ED98DE"><enum>(ii)</enum><text>(if applicable) rounded to the nearest multiple of $100.</text></clause></subparagraph><subparagraph id="idB3C4AB365A284E9FBEC56DC4DCE0711F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Consumer Price Index</header><text>In making the determination under subparagraph (A) and calculating the percentage increase in the Consumer Price Index for All Urban Consumers under subparagraph (A)(i), the Secretary of Labor shall compare the Consumer Price Index for All Urban Consumers (all items; United States city average), as determined by the Bureau of Labor Statistics, for June of the calendar year in which such determination is made with the Consumer Price Index for All Urban Consumers (all items; United States city average), as determined by the Bureau of Labor Statistics, for June of the preceding calendar year.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id5D9726B7033649D48B74139F4BA7DADC"><enum>(C)</enum><header>Rule of construction</header><text>With respect to a determination under subparagraph (A) of the amount in effect under this paragraph for an applicable period under subsection (a)(2), if there is not an annual percentage increase in the Consumer Price Index for All Urban Consumers (all items; United States city average) from the preceding year as described in subparagraph (A)(i), the amount in effect under this subsection for such applicable period shall be the amount in effect under subsection (a) on the date of such determination.</text></subparagraph></paragraph></subsection></section><section id="id2015E3DBDDED45A680FBDFE9A80BD1D4"><enum>3.</enum><header>Amendments to the McNamara-O'Hara Service Contract Act</header><subsection id="id5F02DAC8A37F47878461287F515C5682"><enum>(a)</enum><header>Definition</header><text>Section 6701 of title 41, United States Code, is amended—</text><paragraph id="id4CEB472E6BA84CB791AA5FD9479A5C44"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="id80C1DEAFD08D432D81D6B27229F7A677"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id936F356CB61F4FDBBF25F08ACE915A71"><paragraph id="idE0A60AB3DD6E4450B505989516AB862D"><enum>(4)</enum><header>Socioeconomic labor threshold</header><text>The term <term>socioeconomic labor threshold</term> means the socioeconomic labor threshold established under section 2 of the <short-title>Service Contract Modernization Act</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4150595230FE48F79CD20E64E600BE21"><enum>(b)</enum><header>Applicability threshold</header><text display-inline="yes-display-inline">Section 6702(a)(2) of title 41, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="id30313D47FED14B13A06263F08242A7DC"><paragraph id="idD8963A522C54465FB3C3C69BFA7C802F"><enum>(2)</enum><text>involves an amount exceeding—</text><subparagraph id="id2C46094600ED4C198A9954FF9D20F50A"><enum>(A)</enum><text>for contracts and bid specifications made prior to the date of enactment of the <short-title>Service Contract Modernization Act</short-title>, $2,500; and</text></subparagraph><subparagraph id="idAE19E28B67F14DB196B5BD423E3D8CD0"><enum>(B)</enum><text>for contracts and bid specifications made on or after such date of enactment, the socioeconomic labor threshold.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
