<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2960</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211007">October 7, 2021</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> (for himself, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, and <cosponsor name-id="S359">Mr. Heinrich</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To encourage reduction of disposable plastic products in units of the National Park System, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAC3B4B9127024BF780A9BB90300B9215"><section section-type="section-one" id="H37D93B221F014C568B14B3B361F968CB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reducing Waste in National Parks Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H24AF347383BE4965872D6F657EF85361"><enum>2.</enum><header>Disposable plastic products reduction in units of the National Park System</header><subsection id="H2D218FB2D7FD43D388D7CD3A58010172"><enum>(a)</enum><header>Program for reduction of disposable plastic products in units of the NPS</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director shall establish, for the National Park System a program for reduction of disposable plastic products and, if applicable, elimination of the sale and distribution of disposable plastic products under subsection (b). Each regional director shall implement the plan for park units in their region.</text></subsection><subsection id="H46B0219353244A28BE7A19AC4BBA316C"><enum>(b)</enum><header>Elimination of sale and distribution of disposable plastic products</header><paragraph id="HB30D83728D6C441AB91D188886525751"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each regional director concerned shall eliminate the sale of water in disposable plastic products and the sale and distribution of other disposable plastic products to the greatest extent feasible in the relevant unit of the National Park System after consideration of the following factors, when applicable, with respect to the relevant unit:</text><subparagraph id="HD4DD9FB3869042F49EFA5337F52AA308"><enum>(A)</enum><text>The costs and benefits to the overall operations.</text></subparagraph><subparagraph id="HE10175A151E04B8FADA0DBC853EFAF32"><enum>(B)</enum><text>The amount of waste that would be eliminated.</text></subparagraph><subparagraph id="H66B0020FBE2448A0A44DC965668199F7"><enum>(C)</enum><text display-inline="yes-display-inline">The infrastructure costs and funding sources for bottle refill stations.</text></subparagraph><subparagraph id="H49AF8717EB94470284C81A07757EE2A7"><enum>(D)</enum><text>Any contractual implications with respect to concessioners, including considerations of new leaseholder surrender interest or possessory interest.</text></subparagraph><subparagraph id="H57694C3F3CC44AF38CDFE93981C7D235"><enum>(E)</enum><text display-inline="yes-display-inline">The operational costs of bottle refill stations, including utilities and regular public health testing.</text></subparagraph><subparagraph id="H0188663D35AC42C29E26B6B91860F2A1"><enum>(F)</enum><text display-inline="yes-display-inline">The cost and availability of bisphenol A-free reusable containers.</text></subparagraph><subparagraph id="H8A51B9202EE04979BA3966B1F697885A"><enum>(G)</enum><text>The effect on concessioner and cooperation association sales revenue.</text></subparagraph><subparagraph id="H7B1089EFED1F484F85C6244A68848451"><enum>(H)</enum><text>The availability of water within concession food service operations.</text></subparagraph><subparagraph id="HE86835598B884706B52D9663B38874EA"><enum>(I)</enum><text>The ability to provide visitor education in the unit and online so that visitors may come prepared with their own water bottles.</text></subparagraph><subparagraph id="H475BA9D6A3E04183A919A21A96B9F5EC"><enum>(J)</enum><text>Input from the National Park Service Office of Public Health.</text></subparagraph><subparagraph id="H948719EE87194D65ADC3C7B98333EC71"><enum>(K)</enum><text>The feasibility of posting signs so that visitors can easily find bottle refill stations.</text></subparagraph><subparagraph id="H08C02452CA0D40FFB94C7C47823CA305"><enum>(L)</enum><text>Safety considerations for visitors who may resort to not carrying enough water or drinking from surface water sources with potential exposure to disease.</text></subparagraph><subparagraph id="H3BBFDDF41BA94C368D17AB69A7A6106F"><enum>(M)</enum><text display-inline="yes-display-inline">Any input from concessioners and cooperating associations within the relevant unit.</text></subparagraph></paragraph><paragraph id="HAB8AA0B0F1AD41A2AFED80D564239D1B"><enum>(2)</enum><header>Units of NPS previously eliminated sale of water in disposable plastic products</header><text display-inline="yes-display-inline">With respect to a unit of the National Park System that did not offer for sale water in disposable plastic products before the date of the enactment of this Act, the applicable superintendent of the relevant unit may continue to not offer for sale water in disposable plastic bottles.</text></paragraph></subsection><subsection id="H8CCD38C2C24E4DA399E134A5D6ADB632"><enum>(c)</enum><header>Proactive visitor education strategy</header><text display-inline="yes-display-inline">Each regional director concerned shall develop for the relevant unit of the National Park System a proactive visitor education strategy to address visitor expectations of water availability and explain the rationale for the program and its implementation in the relevant unit.</text></subsection><subsection id="HF66FE2FF4FEB4F29BFE2D9487A18CCA1"><enum>(d)</enum><header>Continuity within unit of the NPS</header><text display-inline="yes-display-inline">Each regional director concerned shall, to the extent possible, implement the program in a manner that is consistent throughout the relevant unit of the National Park System, including incorporation of such program into any agreement with an organization operating within the relevant unit, including a concessioner operating plan and cooperating association scope of sales.</text></subsection><subsection commented="no" id="H5C29A0A46D284F7CB261F6D6A5E5463C"><enum>(e)</enum><header>Biennial evaluation</header><text display-inline="yes-display-inline">Each regional director concerned shall, not less than once every 2 years—</text><paragraph id="HBAF498902CA4492A9DF7989AE6C157DD"><enum>(1)</enum><text display-inline="yes-display-inline">conduct an evaluation of the program for the relevant unit of the National Park System, including—</text><subparagraph commented="no" id="H84A223BCE3BB474A898DCEA1BD48B2CB"><enum>(A)</enum><text>public response to the program;</text></subparagraph><subparagraph commented="no" id="H23BE5350C7FB45369E0201680DDE36B3"><enum>(B)</enum><text display-inline="yes-display-inline">visitor satisfaction with the availability of water;</text></subparagraph><subparagraph commented="no" id="H421B909410C34C92B6EC0C7C04B1F037"><enum>(C)</enum><text display-inline="yes-display-inline">buying behavior with respect to products sold in disposable plastic products;</text></subparagraph><subparagraph commented="no" id="HCC912ACAABB0457780328D5CFE6A46DE"><enum>(D)</enum><text display-inline="yes-display-inline">public safety including information on cases of dehydration or exposure to disease from drinking from surface water; and</text></subparagraph><subparagraph commented="no" id="HD530BCD5F28E402EA943BFBCB613C1B8"><enum>(E)</enum><text>disposable plastic bottle collection rates; and</text></subparagraph></paragraph><paragraph id="HCEE3752BD5D741AAA7FE600BAEBEB7CF"><enum>(2)</enum><text display-inline="yes-display-inline">submit the evaluation to the Director and the Secretary of the Interior.</text></paragraph></subsection><subsection id="HB484AD6163DB49108B946D028B0B200A"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this Act—</text><paragraph id="H1A2E77C8AB224F70BE849B00886474B9"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the National Park Service;</text></paragraph><paragraph display-inline="no-display-inline" id="H7FC5C1849A7A4CEA88C03C48182E35A9"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>disposable plastic products</term> includes—</text><subparagraph id="H143761CCC9484FB494275B2127AB35E7"><enum>(A)</enum><text>disposable plastic beverage bottles;</text></subparagraph><subparagraph id="H239D971592D24450817F45AAA2098F12"><enum>(B)</enum><text>carryout bags made from film plastic;</text></subparagraph><subparagraph id="HBA430B5AC35F404FA7A2898A112F7A2E"><enum>(C)</enum><text>plastic food ware, including plastic food ware products marketed as compostable or biodegradable; and</text></subparagraph><subparagraph id="H77E60BA8881D41549DC81C4691ADF696"><enum>(D)</enum><text>expanded polystyrene products;</text></subparagraph></paragraph><paragraph id="HCD2A0D8344FF45FF8EB1625B000C1D71"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>program</term> means the program for recycling and reduction of disposable plastic products established under subsection (a); and</text></paragraph><paragraph id="HD0863673A5A142EA896FCB9DED78C17E"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>regional director concerned</term> means, with respect to a unit of the National Park System, the regional director of the region of the National Park System in which the relevant unit is located, working in coordination with the superintendent of such unit.</text></paragraph></subsection></section></legis-body></bill>
