which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to alter the definition of <quote>conviction</quote>, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCC7014DFAB8142A6A36676924CCB7224"><section section-type="section-one" id="H5221E93A8FF447768F2CF93888289C2F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Adjudications for Immigrants Act</short-title></quote>.</text></section><section id="H6A14F4500A4D450A861E2418BAD04CBC"><enum>2.</enum><header>Expungement and sentencing</header><subsection id="H9050D31D9A104212946D80BB75CB2DAA"><enum>(a)</enum><header>Definition of conviction</header><paragraph id="H478E0FF6BF9846DAA28EB6B8A2104353"><enum>(1)</enum><header>In general</header><text>Section 101(a)(48) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(48)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HB1E8C73086AA428BA277C56B2AECBB40"><paragraph id="HBAD9A9387EF5481DB6A252C63AB90A5D" indent="up1"><enum>(48)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8215B23E9AF8411294C15DADD95A9F83"><enum>(A)</enum><text>The term <term>conviction</term> means a formal judgment of guilt entered by a court.</text></subparagraph><subparagraph indent="up1" id="H81F83F28D9F5470E8FE3B65DE124086A"><enum>(B)</enum><text>The following may not be considered a conviction for purposes of this Act:</text><clause id="H91F0034B794D4B2AB6EEF3BE4D592F17"><enum>(i)</enum><text>An adjudication or judgment of guilt that has been dismissed, expunged, deferred, annulled, invalidated, withheld, vacated, or pardoned federally or by a State or locality, including by the President of the United States or by a person or agency authorized by State law to grant such pardon.</text></clause><clause id="HFDE135CF3BBF450BADAADA1D6B273159"><enum>(ii)</enum><text>Any adjudication in which the court has issued—</text><subclause id="HBB21E07B43524DC5ADEECD6D9A4DAC94"><enum>(I)</enum><text>a judicial recommendation against removal; </text></subclause><subclause id="H897018C2A9114DCFB5C66B710A9A2416"><enum>(II)</enum><text>an order of probation without entry of judgment; or </text></subclause><subclause id="H507A39E0C9F841C48624C6046940B78B"><enum>(III)</enum><text>any similar disposition. </text></subclause></clause><clause id="HD9666EA5058E493C8E3539313D6D4169"><enum>(iii)</enum><text> A judgment that is on appeal or is within the time to file direct appeal. </text></clause></subparagraph><subparagraph indent="up1" id="H329F98E270D04150B5B63799DFBDD0D1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H84365FCD577F466E9026252C2D8298B7"><enum>(i)</enum><text>Unless otherwise provided, with respect to an offense, any reference to a term of imprisonment or a sentence is considered to include only the period of incarceration ordered by a court.</text></clause><clause indent="up1" id="H9489517B38B146E49F2234478238E6CF"><enum>(ii)</enum><text>Any such reference shall be considered to exclude any portion of a sentence of which the imposition or execution was suspended.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H9EC59D13E1E54D568E30930B9F0DEDC0"><enum>(2)</enum><header>Retroactive applicability</header><text>The amendment made by this subsection shall apply with respect to any conviction, adjudication, or judgment entered before, on, or after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H4284D8B31DB545D1A97FDCF0211C96B7"><enum>(b)</enum><header>Judicial recommendation against removal</header><text>The grounds of inadmissibility and deportability under sections 212(a)(2) and 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref> and 1227(a)(2)) shall not apply to an alien with a criminal conviction if, after having provided notice and an opportunity to respond to the prosecuting authorities, the sentencing court issues a recommendation to the Secretary that the alien not be removed on the basis of the conviction. </text></subsection></section></legis-body></bill>
