<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2953</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211007">October 7, 2021</action-date><action-desc><sponsor name-id="S412">Mr. Tuberville</sponsor> (for himself, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Internal Revenue Service from requiring financial institutions to report on the financial transactions of their customers.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Financial Privacy Act of 2021</short-title></quote>.</text></section><section id="id7F7B0F44F0D14DB4BE4B339B6374298E"><enum>2.</enum><header>Prohibiting the Internal Revenue Service from requiring financial institutions to report on financial transactions of customers</header><subsection id="idA1FCBD40E1454881B6C3B4FBE40BD1EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), the Internal Revenue Service shall not be permitted to create or implement any new financial account information reporting program that—</text><paragraph id="id40A1762F6B3C42B0AA7003D7DF02F287"><enum>(1)</enum><text display-inline="yes-display-inline">was not in effect as of October 1, 2021, and</text></paragraph><paragraph id="id459E7F0CB29942DBB53D54F96F1D620C"><enum>(2)</enum><text display-inline="yes-display-inline">would require financial institutions to report data on financial accounts in an information return listing balances, transactions, transfers, or inflows or outflows of any kind.</text></paragraph></subsection><subsection id="id32F213DE04CA46D4BDD39F4847A6FFA5"><enum>(b)</enum><header>Rule of construction</header><paragraph id="id746833B79FEE46E9AA5A12B793F70F30"><enum>(1)</enum><header>In general</header><text>Nothing in this Act shall preempt, limit, or supersede, or be construed to preempt, limit, or supersede, any provision of, or requirement under, the Bank Secrecy Act or any regulations promulgated under such Act.</text></paragraph><paragraph id="idD56A087865FC4D49B79318A58DA6F187"><enum>(2)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>Bank Secrecy Act</term> means—</text><subparagraph id="id5E5D127DD3A543BA9101A3411E47E5F2"><enum>(A)</enum><text>section 21 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1829b">12 U.S.C. 1829b</external-xref>),</text></subparagraph><subparagraph id="id9A421AB402084187832C9C3A129D9992"><enum>(B)</enum><text>chapter 2 of title I of <external-xref legal-doc="public-law" parsable-cite="pl/91/508">Public Law 91–508</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/12/1951">12 U.S.C. 1951 et seq.</external-xref>), and</text></subparagraph><subparagraph id="idE3D1FB817AAF4E8CA1C5D42FE5B3552D"><enum>(C)</enum><text>subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
