<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 294</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210208">February 8, 2021</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S411">Mr. Marshall</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S348">Mr. Paul</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S407">Mr. Hagerty</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S347">Mr. Moran</cosponsor>, and <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for parental notification and intervention in the case of an unemancipated minor seeking an abortion.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5081D438A8FB49099D178F9D98F878B6"><section section-type="section-one" id="H8B067A4C369E471E96B337872BFEAF5A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parental Notification and Intervention Act</short-title></quote>.</text></section><section id="H0552699ADC8143C6B49FA783264904BB"><enum>2.</enum><header>Parental notification</header><subsection id="H23A5A24301B84CC5AA90436239477898"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for any person or organization in or affecting interstate or foreign commerce or who solicits or accepts Federal funds to perform any abortion on an unemancipated minor under the age of 18, to permit the facilities of the person or organization to be used to perform any abortion on such a minor, or to assist in the performance of any abortion on such a minor if the person or organization has failed to comply with all of the following requirements:</text><paragraph id="HCEED540BA41147238EFFF5A03B3141B3"><enum>(1)</enum><text display-inline="yes-display-inline">The provision of written notification to the parents (as defined in subsection (f)) of the minor informing the parents that an abortion has been requested for the minor, except that such notification is not required for a parent if the physician is presented with documentation showing with a reasonable degree of certainty that a court of record in the minor's State of residence has waived any parental notification. The court of record shall not waive any parental notification requirement unless there is clear and convincing evidence of physical abuse of the minor by such parent.</text></paragraph><paragraph id="H1B18023F6B244CFE9482DCC330574265"><enum>(2)</enum><text>Compliance with a 96-hour waiting period after notice has been received by the parents.</text></paragraph><paragraph id="H40C93360C2B948F089ACF6372C18D935"><enum>(3)</enum><text>Compliance with any injunction granted under section 3 relating to the abortion.</text></paragraph></subsection><subsection id="HEFCC807B6A424BFA801E9FB5F06BD5D5"><enum>(b)</enum><header>Fine for violation</header><text>Whoever willfully violates subsection (a) shall be fined not more than $100,000 or imprisoned not more than one year, or both, for each violation.</text></subsection><subsection id="H2820EF78F2E14D50BEAD8C71907A3268"><enum>(c)</enum><header>Exception</header><text>Subsection (a) shall not apply with respect to an unemancipated minor for whom an abortion is sought if a physician (other than the physician with principal responsibility for making the decision to perform the abortion) makes a determination that—</text><paragraph id="H9BEFA3397D7B4EA9852DF46EF909A782"><enum>(1)</enum><text>a medical emergency exists which, with reasonable medical certainty, so complicates the medical condition of the minor that the death of the minor would result from the failure to immediately treat her physical condition even though the treatment may result in the death of her unborn child;</text></paragraph><paragraph id="H57B22FC640B34C2A8A380CAD79C29820"><enum>(2)</enum><text>parental notification is not possible as a result of the medical emergency; and</text></paragraph><paragraph id="HB77C092C34DA4659AF56680BC2748EAB"><enum>(3)</enum><text>certifications regarding compliance with paragraphs (1) and (2) have been entered in the medical records of the minor, together with the reasons upon which the determinations are based, including a statement of relevant clinical findings.</text></paragraph></subsection><subsection id="H34CBCC0ABDEC46DC81CD8CC31143EA89"><enum>(d)</enum><header>Parental notification requirements</header><text>For purposes of this section, any parental notification provided to comply with the provisions of subsection (a) for a parent shall be—</text><paragraph id="H946B5A898EED4D3E8D448FE970A5A1E2"><enum>(1)</enum><text>delivered personally to the parent; or</text></paragraph><paragraph id="H60890B1C8F7A415B85CAD9DA567822A5"><enum>(2)</enum><text>provided through certified mail in accordance with all of the following procedures:</text><subparagraph id="H185EA8CBBE7F4FBD942D9AE7584F47D9"><enum>(A)</enum><text>The certified mail is addressed to the parent.</text></subparagraph><subparagraph id="H0845C63A3B844E9E9F050AF51686999B"><enum>(B)</enum><text>The address used is the dwelling or usual place of abode of the parent.</text></subparagraph><subparagraph id="HF26549CFD22F4BF4B01B76DAA47FD807"><enum>(C)</enum><text>A return receipt is requested.</text></subparagraph><subparagraph id="HF0EA8D3342684E008E379A4131C925E5"><enum>(D)</enum><text>The delivery is restricted to the parent.</text></subparagraph></paragraph></subsection><subsection id="idc45dfb3e7e884dfa9f6a7c6419380b8e"><enum>(e)</enum><header>Limitation</header><text>A mother seeking an abortion, or upon whom an abortion is performed, may not be found liable for a violation of this section. </text></subsection><subsection id="H8C034F70983D464E876BBEBB9B52A1D4"><enum>(f)</enum><header>Parent defined To include legal guardian</header><text>For purposes of this Act, the term <term>parent</term> includes, with respect to an unemancipated minor, any legal guardian of the minor.</text></subsection></section><section id="H9325F167AA264EA280769E852C8BAAFE"><enum>3.</enum><header>Parental intervention</header><text display-inline="no-display-inline">Any parent required to be notified pursuant to section 2 regarding an abortion of an unemancipated minor may bring an action in the Federal district court where the parent resides or where the unemancipated minor is located to enjoin the performance of the abortion. The court shall issue a temporary injunction barring the performance of the abortion until the issue has been adjudicated and the judgment is final. The court shall issue relief permanently enjoining the abortion unless the court determines that granting such relief would be unlawful.</text></section><section id="H3D30ADC7BD0C4B1293A11B42701C6414"><enum>4.</enum><header>Preemption</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to preempt any provision of State law to the extent that such State law establishes, implements, or continues in effect greater parental notification requirements or intervention rights regarding abortion than those provided under this Act.</text></section><section id="H4A011B9CF3FE41E7970E6D5A4CA073F5"><enum>5.</enum><header>Effective date and severability</header><subsection id="H456D1EC4A6824A23BDD2D21C2BE8F3C4"><enum>(a)</enum><header>Effective date</header><text>The provisions of this Act shall take effect upon its enactment.</text></subsection><subsection id="H84D1F1BDC8F345B9AA0A2A650DB90D64"><enum>(b)</enum><header>Severability</header><text>The provisions of this Act shall be severable. If any provision of this Act, or any application thereof, is found unconstitutional, that finding shall not affect any provision or application of the Act not so adjudicated.</text></subsection></section></legis-body></bill>
