<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2947</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211006">October 6, 2021</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Housing and Urban Development to provide a disclosure notice to homebuyers of properties owned by the Department of Housing and Urban Development that are located in special flood hazard areas, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flood Risk Transparency for Homebuyers Act</short-title></quote>.</text></section><section id="id08400C6A3E104C47AA7524BBCC93136C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idCAE60D34C1224CD68295D5D6B94BD5EE"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="idE3AAB0D3CCE64A15BE030D377114ACEA"><enum>(2)</enum><header>Covered property</header><text>The term <term>covered property</term> means a 1-to-4 unit residential property—</text><subparagraph id="id5C1C95A55BA64E97807E1C71E8474973"><enum>(A)</enum><text>acquired by the Department as a result of a foreclosure action on a mortgage insured by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id2C33F7803CD445D198FB2381E366EBA4"><enum>(B)</enum><text>located in a special flood hazard area according to a flood hazard boundary map or flood insurance rate map issued by the Administration. </text></subparagraph></paragraph><paragraph id="id8A35B4D5BEC94948963F70EA66AFDD51"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph><paragraph id="id21FEB116AC1B4A6A896DCC94C03CEC8E"><enum>(4)</enum><header>National Flood Insurance Program</header><text>The term <term>National Flood Insurance Program</term> means the program established under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001 et seq.</external-xref>).</text></paragraph><paragraph id="id903316CE0F5E41F4B7D064944F887375"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph><paragraph id="idCA552A5A9B3E45DA969EAFE71A3D9A58"><enum>(6)</enum><header>Severe repetitive loss property</header><text>The term <term>severe repetitive loss property</term> has the meaning given the term in section 1307(h) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4014">42 U.S.C. 4014(h)</external-xref>).</text></paragraph></section><section id="id321331A6B6CA4AB68A6EB2D670C0283A"><enum>3.</enum><header>Requirement to provide disclosure to homebuyers of properties located in special flood hazard areas</header><subsection id="id11B6868C080F48E781EB766EF3450242"><enum>(a)</enum><header>In general</header><text>When listing a covered property for sale by the Department, the Secretary shall provide a disclosure notice that includes—</text><paragraph id="id6070573839C54725975FFCED6E9BB4C0"><enum>(1)</enum><text>the estimated monthly cost of insurance for the covered property under the National Flood Insurance Program for the zip code in which the covered property is located; and</text></paragraph><paragraph id="id6A627191703F45DEAB0885888FD26E40"><enum>(2)</enum><text>whether the covered property is a severe repetitive loss property.</text></paragraph></subsection><subsection id="id62ED5AF555B74259BE61323AA7C296E3"><enum>(b)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary and the Administrator shall submit to Congress a joint report on covered properties sold by the Department for which claims were filed under the National Flood Insurance Program during the year covered by the report, including whether the covered property is a severe repetitive loss property.</text></subsection></section></legis-body></bill>
