id="id6EB63C43986C4BCBA560FC8DDBEA8B04"><enum>(3)</enum><header display-inline="yes-display-inline">Additional planning grants for States</header><text display-inline="yes-display-inline">In addition to the planning grants awarded under paragraph (1), as soon as practicable after the date of enactment of this paragraph, the Secretary shall award planning grants to States (other than States selected to conduct demonstration programs under paragraph (1) or (8) of subsection (d)) to develop proposals to participate in time-limited demonstration programs described in subsection (d) so that, beginning July 1, 2024, and every 2 years thereafter, up to 10 additional States may participate in the demonstration programs described in subsection (d) in accordance with paragraph (9) of that subsection.</text></paragraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59C486DDE40F4788B305DA7B7568715C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id24D5022AF1604DC798E5B4930A1BC230"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3)— </text><clause commented="no" display-inline="no-display-inline" id="id624FAF18CBC1451F899440082903F286"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>September 30, 2023</quote> and inserting <quote>September 30, 2025</quote>; id="id2A57ED647E8C4C39BFB0059BB7FBFF00"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (5)—</text><clause commented="no" display-inline="no-display-inline" id="id2C252C4E50564057AD227D30D981B432"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B), in the matter preceding clause (i), by striking <quote>that is furnished</quote> and inserting <quote>that is furnished by a State participating in an ongoing demonstration program under this subsection</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1F08E3DB7C8B4E45BAF1B2717D934586"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C)(iii)—</text><subclause commented="no" display-inline="no-display-inline" id="id2BD229B2E54C4FDAAEF8263B1572DB15"><enum>(I)</enum><text display-inline="yes-display-inline">in subclause (I), by striking <quote>September 30, 2023; and</quote> and inserting <quote>September 30, 2025;</quote>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4A93D697944746E5A1897AE4F4CD0B97"><enum>(II)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>under paragraph (8)</quote> and all that follows through the period and inserting <quote>under paragraph (8), during the first 24 fiscal quarter period (or any portion of such period) that the State participates in the demonstration program; and</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idCF63FBF1711A4530B4ED8727B8DFEA9C"><enum>(III)</enum><text display-inline="yes-display-inline">by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id658C3F639F5E400E9FADAF8F606C0C5A" act-name="" changed="added" reported-display-style="italic"><subclause commented="no" display-inline="no-display-inline" id="id2AA5FFE63B0E42369D775442F6C585D2"><enum>(III)</enum><text display-inline="yes-display-inline">in the case of a State selected to participate in the demonstration program under paragraph (9), during the first 16 fiscal quarter period (or any portion of such period) that the State participates in the demonstration program.</text></subclause><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id53BD140B3D5947849D1665D28263B6E4"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id23B706677F2D4BDD8192276A76DC3ECC" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="idF62B93E3BBEC4237BB814683695D6520"><enum>(D)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as prohibiting a State that participated in a demonstration program under this subsection that has ended from receiving Federal financial participation under title XIX of the Social Security Act for amounts expended by the State under a State plan under such title (or a waiver of such plan) for providing medical assistance for items and services, and carrying out activities, including continuing to pay for services under the prospective payment system established under subsection (c), that were provided or carried out by the State under the demonstration program, to the extent such financial participation is otherwise available under such title.</text></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe59d98cf5f34afea082bda8c88135d6"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (7)—</text><clause commented="no" display-inline="no-display-inline" id="id699b21c9ce0f4766bbbc9afb493f2cc2"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>through the year in which the last demonstration under this section ends</quote> after <quote>annually thereafter</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1d0b3921d16d4c19abbc9e4c05a1f80c"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subclause commented="no" display-inline="no-display-inline" id="id9910923336ff40b0bf999fa2844414c5"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>December 31, 2021</quote> and inserting <quote>September 30, 2025</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id42cbc937f2fc4cb9b6be65ef9a7c12ce"><enum>(II)</enum><text display-inline="yes-display-inline">by adding at the end the following new sentence: <quote>Such recommendations shall include data collected after 2019, where feasible.</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9cb0ba343db940699a266bb4a57e0347"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idec0d2b4fdc0841cbaf8ba9456e953b1a" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="id9c06ac693c744189922ccb30bbe68564"><enum>(C)</enum><header display-inline="yes-display-inline">Final evaluation</header><text display-inline="yes-display-inline">Not later than 24 months after all demonstration programs under this section have ended, the Secretary shall submit to Congress a final evaluation of such programs.</text></subparagraph><after-quoted-block display="yes">; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93D7DEF2A3BF4FF9A2C0C1582187F017"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (8)(A), by striking <quote>2 years</quote> and all that follows through the period and inserting <quote>6 years.</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE3B93B21D0DF4E2FACDA3646C9D9643E"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id04CF522F8868410D99F2C42BCD639331" act-name="" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="idC1B00BE3919D4759BEA40B7F467AD78B"><enum>(9)</enum><header display-inline="yes-display-inline">Further additional programs</header><subparagraph commented="no" display-inline="no-display-inline" id="id538BB9E1976B4EBD8739631E26F43E29"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to the States selected under paragraphs (1) and (8), the Secretary shall select any State that meets the requirements described in subparagraph (B) to conduct a demonstration program that meets the requirements of this subsection for 4 years.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id338FC5644B8647738E434F09F7B300C7"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The requirements described in this subparagraph with respect to a State are that the State—</text><clause commented="no" display-inline="no-display-inline" id="idD244F6FD1946453B9532D7A9448654F9"><enum>(i)</enum><text display-inline="yes-display-inline">was awarded a planning grant under paragraph (1) or (3) of subsection (c); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idC9B5B3E78A874438A5DEAB8E9AEC30BB"><enum>(ii)</enum><text display-inline="yes-display-inline">submits an application (in addition to any application that the State may have previously submitted under this section) that includes the information described in paragraph (2)(B).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id899083D71C2A457F91DCB3180A839C74"><enum>(C)</enum><header display-inline="yes-display-inline">Requirements for selected States</header><text display-inline="yes-display-inline">The requirements applicable to States selected under paragraph (8) pursuant to subparagraph (C) of such paragraph shall apply in the same manner to States selected under this paragraph. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6477C353BB13428E9E939407D91F2BD4"><enum>(D)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The Secretary shall not select more than 10 States to conduct a demonstration program under this paragraph for each 2 fiscal year period.</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDE60BB9C011D414A924A7FC8AEFB7281"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (f)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0FDEE7379BE342D8B33F3969CD3FB1CB"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC4E42E6ADDFC4DF092884BEA6EFDA46B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id697959326BBE411EB07F6AFC14DCB54D"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77559576B981482AACA911790E3183F6" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="id922B37D9ECF64EEBA3092C92AB5E9528"><enum>(C)</enum><text display-inline="yes-display-inline">for purposes of awarding planning grants under subsection (c)(3), providing technical assistance to States applying for grants under such subsection, and carrying out demonstration programs under subsection (d), $40,000,000 for fiscal year 2023, to remain available until expended. </text></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4981CA83AAF1410E9C64B242B41240D4"><enum>11002.</enum><header display-inline="yes-display-inline">Medicaid and telehealth</header><subsection commented="no" display-inline="no-display-inline" id="idB88D8D8BFC434E5F85B39ADA0D18A6F1"><enum>(a)</enum><header display-inline="yes-display-inline">Guidance to States on furnishing services through telehealth under Medicaid and CHIP</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary shall provide technical assistance and issue guidance to States on improving access to telehealth for services covered under Medicaid and CHIP, including with respect to:</text><paragraph commented="no" display-inline="no-display-inline" id="id5cc277b9d2a745aab77005a49f6e2ad8"><enum>(1)</enum><text display-inline="yes-display-inline">How States can adopt flexibilities under Medicaid and CHIP to expand access to covered services via telehealth, including when States may adopt such flexibilities without the need for approval of a State plan amendment or waiver. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide86d6a3fb61b4de8827fec7d1b704d41"><enum>(2)</enum><text display-inline="yes-display-inline">Best practices regarding billing for services, including recommended voluntary billing codes, modifiers, and place of service designations and how such billing codes, modifiers, and designations can be used to create consistent data sets.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1eb1ed0309ac441f824f741426847431"><enum>(3)</enum><text display-inline="yes-display-inline">Strategies for integrating telehealth services into value-based care models.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7df3853ff5545b59f43009605e71b8b"><enum>(4)</enum><text display-inline="yes-display-inline">Best practices from States that have used Medicaid waivers and other Medicaid authorities to expand access to telehealth, including during the COVID–19 public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act on January 31, 2020, entitled <quote>Determination that a Public Health Emergency Exists Nationwide as the Result of the 2019 Novel Coronavirus</quote>, including any renewal of such declaration. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9F2DB7E36D224457A4996A05732A672E"><enum>(5)</enum><text display-inline="yes-display-inline">Strategies to promote the delivery of accessible and culturally competent care via telehealth, including addressing the needs of individuals with disabilities, medically underserved urban and rural communities, racial and ethnic minorities such as American Indians and Alaska Natives, individuals with limited English proficiency, and individuals of different age groups including children, young adults, and seniors;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5cce3b93a52f4ac1b8a4aa8ad9d5a790"><enum>(6)</enum><text display-inline="yes-display-inline">Strategies for training and providing resources to commented="no" display-inline="no-display-inline" id="idE699ACBF58B144A58D12B3D967F259B4"><enum>(1)</enum><header display-inline="yes-display-inline">Guidance</header><subparagraph commented="no" display-inline="no-display-inline" id="id9C1219B273B24A83A972624361FDF2AC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Education, shall issue guidance to State Medicaid agencies, local educational agencies, and school-based entities to support the delivery of medical assistance to Medicaid and CHIP beneficiaries in school-based settings. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9C3EC69D5A3945DEB412B5E75F095782"><enum>(B)</enum><header display-inline="yes-display-inline">Required information</header><text display-inline="yes-display-inline">The guidance issued pursuant to subparagraph (A) shall—</text><clause commented="no" display-inline="no-display-inline" id="id2A7A8B5B36C94EA6B977B4CEDE463D42"><enum>(i)</enum><text display-inline="yes-display-inline">include updates to the May 2003 Medicaid School-Based Administrative Claiming Guide, the 1997 Medicaid and Schools Technical Assistance Guide, and other relevant guidance in effect on the date of enactment of this Act;</text></clause><clause commented="no" display-inline="no-display-inline" id="idCAA5A4F41C0845EDB55FA9AA6DECAE87"><enum>(ii)</enum><text display-inline="yes-display-inline">clarify that payments may be made to school-based entities under Medicaid for delivering assistance under Medicaid, including any such assistance provided in accordance with an individualized education program or under the policy described in the State Medicaid Director letter on payment for services issued on December 15, 2014 (#14-006);</text></clause><clause commented="no" display-inline="no-display-inline" id="idC8B02AFF2CA7473CA19179EE3931C66A"><enum>(iii)</enum><text display-inline="yes-display-inline">outline strategies and tools to reduce administrative burdens on, and simplify billing for, local educational agencies, in particular small and rural local educational agencies, and support compliance with Federal requirements regarding billing, payment, and recordkeeping, including by aligning direct service billing and school-based administrative claiming payment systems;</text></clause><clause commented="no" display-inline="no-display-inline" id="id58C04CDAF85342D9B7ACE953C248CF0E"><enum>(iv)</enum><text display-inline="yes-display-inline">include a comprehensive list of best practices and examples of approved methods that State Medicaid agencies and local educational agencies have used to pay for, and increase the availability of, assistance under Medicaid, including expanding State programs to include all Medicaid-enrolled students, providing early and periodic screening, diagnostic, and treatment (EPSDT) services in schools, utilizing telehealth, coordinating with community-based mental health and substance use disorder treatment providers and organizations, coordinating with managed care entities, and supporting the provision of culturally competent and trauma-informed care in school settings; and </text></clause><clause commented="no" display-inline="no-display-inline" id="idD40DA16D22A34A2F8B8A19BECF5DD3AE"><enum>(v)</enum><text display-inline="yes-display-inline">provide examples of the types of providers (which may include qualified school health personnel) that States may choose to enroll, deem, or otherwise treat as participating providers for purposes of school-based programs under Medicaid and best practices related to helping such providers enroll in Medicaid for purposes of participating in school-based programs under Medicaid. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idABC8B9A2606440B597F7B3EBAEF954E5"><enum>(2)</enum><header display-inline="yes-display-inline">Technical assistance center</header><subparagraph commented="no" display-inline="no-display-inline" id="id72702FA545BE4D88A4D41AD6FA95BA3E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Education, shall establish a technical assistance center to—</text><clause commented="no" display-inline="no-display-inline" id="id98BE25D3EA3E4087A76B3984D53A4F0D"><enum>(i)</enum><text display-inline="yes-display-inline">assist and expand the capacity of State Medicaid agencies and local educational agencies and school-based entities to provide assistance under Medicaid;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6EB5FAC161D54BD3ABF1D680B153A887"><enum>(ii)</enum><text display-inline="yes-display-inline">reduce administrative burdens for such agencies and health centers or entities;</text></clause><clause commented="no" display-inline="no-display-inline" id="id8E8A2EF2EB9048AC98B8E4E2148FDC7D"><enum>(iii)</enum><text display-inline="yes-display-inline">support State educational agencies, local educational agencies, and school-based entities in obtaining payment for the provision of assistance under Medicaid; </text></clause><clause commented="no" display-inline="no-display-inline" id="idBCCC31F2AB3F477488CF48D7A8DC3B47"><enum>(iv)</enum><text display-inline="yes-display-inline">ensure ongoing coordination and collaboration between the Department of Health and Human Services and the Department of Education with respect to the provision of, and payment for, assistance under Medicaid by local educational agencies; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id074C581F22E7438DB8BB7B4DA294F29D"><enum>(v)</enum><text display-inline="yes-display-inline">provide information to State and local educational agencies and States on how to utilize funding from the Department of Health and Human Services, the Department of Education, and other Federal agencies to ensure payment under Medicaid for assistance provided in school-based settings.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA0DC6554A5A548AAAA74BE55A7D56B19"><enum>(B)</enum><header display-inline="yes-display-inline">Small and rural schools</header><text display-inline="yes-display-inline">The Secretary shall ensure that the technical assistance center includes resources which are specifically designed to help support small and rural local educational agencies in obtaining payment for the provision of assistance under Medicaid. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52D5D28AE46E4D2C985C45963E821EA2"><enum>(C)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">The technical assistance center shall, on a biennial basis, submit to the Secretary a report on the work of the center that identifies the areas where the most assistance was requested.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC8D6C67CD10A467B8AFC49107AEACE5E"><enum>(3)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Out of any funds in the Treasury not otherwise appropriated, there is appropriated to the Secretary to carry out this subsection, $8,000,000, for fiscal year 2022, to remain available until expended. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id41619AE92FC541F6A4F7CF84E310C622"><enum>(b)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">There is authorized to be appropriated $50,000,000 for fiscal year 2022 for the Secretary to award grants to States for the purpose of implementing, enhancing, or expanding the provision of assistance through school-based entities under Medicaid or CHIP. A State shall not use any grant funds to provide medical assistance, child health assistance, or other health services. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id21F920D38D3F426AB5892C60AC006161"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id549B916AE3A0414F8A0AA74D1A6C7BEA"><enum>(1)</enum><header display-inline="yes-display-inline">CHIP</header><text display-inline="yes-display-inline">The term <term>CHIP</term> means the State children's health insurance program established under title XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id107DAE87E45B48E59C86D4792E071AB0"><enum>(2)</enum><header display-inline="yes-display-inline">Individualized education program</header><text display-inline="yes-display-inline">The term <term>individualized education program</term> has the meaning given such term in section 602(14) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(14)</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD08D33C892034015813383085BFE7E31"><enum>(3)</enum><header display-inline="yes-display-inline">Medicaid</header><text display-inline="yes-display-inline">The term <term>Medicaid</term> means the program established under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id292673658C694245991371566B32C672"><enum>(4)</enum><header display-inline="yes-display-inline">School-based entity</header><text display-inline="yes-display-inline">The term <term>school-based entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC385E99CEFF940C398576B7127141A05"><enum>(A)</enum><text display-inline="yes-display-inline">a school-based health center, as that term is defined in section 2110(c)(9) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397jj">42 U.S.C. 1397jj(c)(9)</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA0563849D5524BE68E82A31B74FB9EB4"><enum>(B)</enum><text display-inline="yes-display-inline">an entity that provides medical assistance in a school-based setting for which Federal financial participation is allowed under Medicaid. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id774FCAA826EE433B8BC762E560EA0966"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">Except as otherwise provided, the term <term>Secretary</term> means the Secretary of Health and Human Services. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5FF2A24601C44593B48ABCE7AD4A00B1"><enum>(6)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given that term in section 1101(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301(a)(1)</external-xref>) for purposes of titles XIX and XXI of such Act. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF234A86C71BC4115A9E625B79EDC14DA"><enum>(7)</enum><header display-inline="yes-display-inline">State educational agency; local educational agency</header><text display-inline="yes-display-inline">The terms <term>State educational agency</term> and <term>local educational agency</term> have the meaning given those terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id364081f338bb415aa132633905fb7bd4"><enum>11004.</enum><header display-inline="yes-display-inline">Review of State implementation of early and periodic screening, diagnostic, and treatment services</header><subsection commented="no" display-inline="no-display-inline" id="id0819902EA0F0470A9E9DDCB6D002C980"><enum>(a)</enum><header display-inline="yes-display-inline">Review</header><paragraph commented="no" display-inline="no-display-inline" id="idA4C56B37BF084002A160E5958C85C3CB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 24 months after the date of enactment of Act, and every 5 years thereafter, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf172b489f4c2469fa6d70394bc5be703"><enum>(A)</enum><text display-inline="yes-display-inline">review State implementation of the requirements for providing early and periodic screening, diagnostic, and treatment services under Medicaid in accordance with sections 1902(a)(43), 1905(a)(4)(B), and 1905(r) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(43)</external-xref>, 1396d(a)(4)(B), 1396d(r)), including with respect to the provision of such services by managed care organizations, prepaid inpatient health plans, prepaid ambulatory health plans, and primary care case managers; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca71ae3676b0443e9b7ac49a142e79b8"><enum>(B)</enum><text display-inline="yes-display-inline">identify gaps and deficiencies with respect to State compliance with such requirements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide03a8b033a934851b1e94a2957e61d38"><enum>(C)</enum><text display-inline="yes-display-inline">provide technical assistance to States to address such gaps and deficiencies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbecad41ea75b48e3bb3b48c274a7ee73"><enum>(D)</enum><text display-inline="yes-display-inline">issue guidance to States on the Medicaid coverage requirements for such services that includes best practices for ensuring children have access to comprehensive health care services, including children without a mental health or substance use disorder diagnosis.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9516BC4E828D427E81D092FD8CC758A0"><enum>(2)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after each date on which the Secretary completes the activities described in paragraph (1), the Secretary shall submit to the Committee on Finance of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the most recent activities completed for purposes of such paragraph that includes the findings made, and descriptions of actions taken by the Secretary or by States as a result of such activities, and any additional actions the Secretary plans to carry out or that States are required to carry out as a result of such activities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF92F68A32A264389BDC91CB3BAD5B0FA"><enum>(3)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Out of any funds in the Treasury not otherwise appropriated, there is appropriated to the Secretary to carry out this subsection, to remain available until expended, $5,000,000, for each of fiscal years 2023 and 2024, and $1,000,000 for each fiscal year thereafter.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2922C2FB44AA4DB9BBC494823FF91968"><enum>(b)</enum><header display-inline="yes-display-inline">GAO study and report</header><paragraph commented="no" display-inline="no-display-inline" id="id8B2F271BAC474BA6B023F0FC7666FD03"><enum>(1)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States (in this subsection referred to as the <term>Comptroller General</term>) shall conduct a study evaluating State implementation under Medicaid of the early and periodic screening, diagnostic, and treatment services benefit required for children by section 1905(a)(4)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)(4)(B)</external-xref>) and as defined in section 1905(r) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(r)</external-xref>) and provided in accordance with the requirements of section 1902(a)(43) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(43)</external-xref>), specifically with respect to State oversight of managed care organizations, prepaid inpatient health plans, prepaid ambulatory health plans, and primary care case managers, and shall provide recommendations as appropriate to improve State compliance with the requirements for providing such benefit, State oversight of managed care organizations, prepaid inpatient health plans, prepaid ambulatory health plans, and primary care case managers, and oversight of State programs under Medicaid by the Administrator of the Centers for Medicare &amp; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62347D5EB94D40C6956F0A9D0E58E5FD"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEFAC8B4AA9414DA9B90E18330D491FC8" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="idB41B0D0C10E8409CA6FE408A5BE80F43"><enum>(2)</enum><header display-inline="yes-display-inline">Support to schools and emergency departments</header><subparagraph commented="no" display-inline="no-display-inline" id="id78C2538971914C31BA1F79779FAE1BDE"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In addition to the activities required under paragraph (1), a pediatric mental health care access program referred to in subsection (a), with respect to which an award under such subsection may be used, may provide information, consultative support, training, and technical assistance to—</text><clause commented="no" display-inline="no-display-inline" id="idEB63884218614F3F942AA776E19DFE41"><enum>(i)</enum><text display-inline="yes-display-inline">emergency departments; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id25AAACA3AE9348A9833C7F9BE6D3DC1D"><enum>(ii)</enum><text display-inline="yes-display-inline">State educational agencies, local educational agencies, Tribal educational agencies, and elementary and secondary schools. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id64CD3DDE2FAD4661B80F35C6C2E2E07F"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements for certain recipients</header><text display-inline="yes-display-inline">An entity receiving information, consultative support, training, and technical assistance under subparagraph (A)(ii) shall operate in a manner consistent with, and shall ensure consistency with, the requirements of subsections (a) and (c) of section 4001 of the Elementary and Secondary Education Act with respect to such information, consultative support, training, and technical assistance.</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC52DED7E6BD449CAA7BE04A80EE7298F"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (3), as so redesignated, by inserting <quote>, and which may include a developmental-behavioral pediatrician</quote> before the period at the end of the first sentence;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id472C10C00CAE4EC3AA8F3B1C42CFF1F6"><enum>(4)</enum><text display-inline="yes-display-inline">in subsections (c), (d), and (f), by striking <quote>Indian tribe, or tribal organization</quote> each place it appears and inserting <quote>Indian Tribe, or Tribal organization</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0353B31074B45B6BA5E90C2B90C05D9"><enum>(5)</enum><text display-inline="yes-display-inline">in subsections (c) and (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id336505C14C704B508887A8811C8EDE92"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>a grant</quote> each place it appears and inserting <quote>an award</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBC3A6D7CDCB94F68A549F9C7831EE21D"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the grant</quote> and inserting <quote>the award</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6FD4CEACA2FD4CB48EC20CC2D3925263"><enum>(8)</enum><text display-inline="yes-display-inline">by redesignating subsection (g) as subsection (h);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1F94FB30EF024EB7BB9AD11862679115"><enum>(9)</enum><text display-inline="yes-display-inline">by inserting after subsection (f) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5D5668D83D4045B48E9916E71A5B1864" changed="added" reported-display-style="italic"><subsection commented="no" display-inline="no-display-inline" id="id9A199C1D12FA4B129A21E77ECC51F89B"><enum>(g)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">The Secretary may—</text><paragraph commented="no" display-inline="no-display-inline" id="id0113AE4A273548419BD44A2304432D87"><enum>(1)</enum><text display-inline="yes-display-inline">provide, or continue to provide, technical assistance to recipients of awards under subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC30275E112454571B6DC9E82B688C4EA"><enum>(2)</enum><text display-inline="yes-display-inline">award a grant or contract to an eligible public or nonprofit private entity (as determined by the Secretary) for the purpose of providing such technical assistance pursuant to this subsection.</text></paragraph></subsection><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD9F628A3A0B04D768AD6F090B5FA977E"><enum>(10)</enum><text display-inline="yes-display-inline">in subsection (h), as so redesignated, by striking <quote>$9,000,000 for the period of fiscal years 2018 through 2022</quote> and inserting <quote>$31,000,000 for each of fiscal years 2023 through 2027</quote>.</text></paragraph></section></title><title commented="no" level-type="subsequent" style="OLC" id="id1AFBE2C6CEA440D1B6E9B1A354CCE043"><enum>II</enum><header display-inline="yes-display-inline">Firearms</header><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id07DA451B73304149B43855E1D366B5ED"><enum>12001.</enum><header display-inline="yes-display-inline">Juvenile records</header><subsection commented="no" display-inline="no-display-inline" id="idF605D123B0C84874938089A1D5DE888A"><enum>(a)</enum><header display-inline="yes-display-inline">Improving NICS examination of juvenile records</header><paragraph commented="no" display-inline="no-display-inline" id="id1EE3F43DD94C407DA2C8EC1825924BFD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6A8B5358E5814032BDA2B00734CC51DE"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><clause commented="no" display-inline="no-display-inline" id="id3DBDB919BF444DDBB061D16AF2382031"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>, including as a juvenile</quote> after <quote>such person</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8FEFCD0ECD9C43DE870A0C6E92DED5A0"><enum>(III)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDD180E9E747540F79F2F86FBBCD645C0" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="ida3d315a9020346c3a39a7811e9c16f47" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a person less than 21 years of age, in addition to all other requirements of this chapter—</text><clause commented="no" display-inline="no-display-inline" id="id051C18A5725243AE8F10E4867298B2AF"><enum>(i)</enum><text display-inline="yes-display-inline">the system provides the licensee with a unique identification number;</text></clause><clause commented="no" display-inline="no-display-inline" id="idF8F4062EDD9C472DB5D15D8CE424CA67"><enum>(ii)</enum><text display-inline="yes-display-inline">3 business days (meaning a day on which State offices are open) have elapsed since the licensee contacted the system, and the system has not notified the licensee that cause exists to further investigate a possibly disqualifying juvenile record under subsection (d); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idC2D15200548E4315BDEBBFCCD72583E7"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of such a person with respect to whom the system notifies the licensee in accordance with clause (ii) that cause exists to further investigate a possibly disqualifying juvenile record under subsection (d), 10 business days (meaning a day on which State offices are open) have elapsed since the licensee contacted the system, and the system has not notified the licensee that—</text><subclause commented="no" display-inline="no-display-inline" id="id7511CBA531AC488E8746F4C18E41142E"><enum>(I)</enum><text display-inline="yes-display-inline">transferring the firearm to the other person would violate subsection (d) of this section; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4652922C84E04A50979B6ED78934151B"><enum>(II)</enum><text display-inline="yes-display-inline">receipt of a firearm by the other person would violate subsection (g) or (n) of this section, or State, local, or Tribal law; and</text></subclause></clause></subparagraph><after-quoted-block display="yes">;</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id057FD56A69F64A40A6B84660916D0E69"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subclause commented="no" display-inline="no-display-inline" id="id0A83B429CAD14C79A6F189E2C9EFB11B"><enum>(I)</enum><text display-inline="yes-display-inline">by inserting <quote>transfer or</quote> before <quote>receipt</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0596E2B9AE6E4AC08A4CE26165ABBF30"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>(g) or (n)</quote> and inserting <quote>(d), (g), or (n) (as applicable)</quote>.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFC168A51C0384858BB2D8C27FC88E374"><enum>(2)</enum><header display-inline="yes-display-inline">NICS requirements</header><text display-inline="yes-display-inline">Section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id034C24BEE25B43E88BE212BF3F380F35" changed="added" reported-display-style="italic"><subsection commented="no" display-inline="no-display-inline" id="idFD2CC8B10D794BA08864394D79E8FA2D"><enum>(l)</enum><header display-inline="yes-display-inline">Requirements relating to background checks for persons under age 21</header><text display-inline="yes-display-inline">If a licensee contacts the system established under this section regarding a proposed transfer of a firearm to a person less than 21 years of age in accordance with subsection (t) of section 922 of title 18, United States Code, the system shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id0B1F0AB3C4D24F4E8BEC79D7D6863D37"><enum>(1)</enum><text display-inline="yes-display-inline">immediately contact—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2249D0552B944881ADB85749A069DB7A"><enum>(A)</enum><text display-inline="yes-display-inline">the criminal history repository or juvenile justice information system, as appropriate, of the State in which the person resides for the purpose of determining whether the person has a possibly disqualifying juvenile record under subsection (d) of such section 922;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3CC2DEA611DF489CB63F1403F8E6DD88"><enum>(B)</enum><text display-inline="yes-display-inline">the appropriate State custodian of mental health adjudication records in the State in which the person resides to determine whether the person has a possibly disqualifying juvenile record under subsection (d) of such section 922; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1CEB5361072D40FD95A55DD5E8B2F0F2"><enum>(C)</enum><text display-inline="yes-display-inline">a local law enforcement agency of the jurisdiction in which the person resides for the purpose of determining whether the person has a possibly disqualifying juvenile record under subsection (d) of such section 922;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE68154D5FE3F44348EAAAB5E0F94E7C3"><enum>(2)</enum><text display-inline="yes-display-inline">as soon as possible, but in no case more than 3 business days, after the licensee contacts the system, notify the licensee whether cause exists to further investigate a possibly disqualifying juvenile record under subsection (d) of such section 922; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id143B8932F6BD40A7B7E0C7D8137A771F"><enum>(3)</enum><text display-inline="yes-display-inline">if there is cause for further investigation, as soon as possible, but in no case more than 10 business days, after the licensee contacts the system, notify the licensee whether—</text><subparagraph commented="no" display-inline="no-display-inline" id="idCC6BDCE0E3BE46EFA67B2943B585711C"><enum>(A)</enum><text display-inline="yes-display-inline">transfer of a firearm to the person would violate subsection (d) of such section 922; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66C7B327B787459B833BD166C3BA230B"><enum>(B)</enum><text display-inline="yes-display-inline">receipt of a firearm by the person would violate subsection (g) or (n) of such section 922, or State, local, or Tribal law.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE5CAEDB39144F72AEB651C6B786FEB0"><enum>(3)</enum><header display-inline="yes-display-inline">Sunset of requirements to contact State and local entities</header><text display-inline="yes-display-inline">Effective on September 30, 2032, paragraphs (1)(B) and (2) are repealed, and the provisions of law amended by those paragraphs are restored as if those paragraphs had not been enacted.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ebf2fca7d5e4c1dbc936e3d909be195"><enum>(b)</enum><header display-inline="yes-display-inline">Report on removing outdated, expired, or erroneous records</header><paragraph commented="no" display-inline="no-display-inline" id="id15A8BCAB227D496685C7BA0530C83B02"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On an annual basis for each fiscal year through fiscal year 2032, each State and Federal agency responsible for the submission of disqualifying records under subsection (d), (g), or (n) of section 922 of title 18, United States Code, to the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) shall submit to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives a report detailing the removal from the system of records that no longer prohibit an individual from lawfully acquiring or possessing a firearm under such subsection (d), (g), or (n).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfbe807e5dccf496c9200a99cfaf9c236"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted by a State or Federal agency under paragraph (1) shall include pertinent information on—</text><subparagraph commented="no" display-inline="no-display-inline" id="id06EDF710098A45208769169FF299F64F"><enum>(A)</enum><text display-inline="yes-display-inline">the number of records that the State or Federal agency removed from the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) during the reporting period;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0894676B0B144B78B2599E2CD5984512"><enum>(B)</enum><text display-inline="yes-display-inline">why the records were removed; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60D4D8553B4947B0A50159457DEABF53"><enum>(C)</enum><text display-inline="yes-display-inline">for each record removed, the nature of the disqualifying characteristic outlined in subsection (d), (g), or (n) of section 922 of title 18, United States Code, that caused the State or Federal agency to originally submit the record to the system.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id29A2418855814F9481B4ADAC4522A4F3"><enum>12002.</enum><header display-inline="yes-display-inline">Defining <quote>engaged in the business</quote></header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id3FEC57A5BBF446AFA51B7B7D2C4EC913"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (21)(C), by striking <quote>with the principal objective of livelihood and profit</quote> and inserting <quote>to predominantly earn a profit</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0B4F73B42754657AD79A18F60A160AD"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (22) through (29) as paragraphs (23) through (30), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF2369EC0651B4DA0A5FF26AD32FE4821"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (21) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB64C92D6F8844AF9B0FEB4447D65292F" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="id018d0870cd32445a89cea800719f8d7a" indent="up1"><enum>(22)</enum><text display-inline="yes-display-inline">The term <term>to predominantly earn a profit</term> means that the intent underlying the sale or disposition of firearms is predominantly one of obtaining pecuniary gain, as opposed to other intents, such as improving or liquidating a personal firearms collection: <proviso><italic>Provided</italic></proviso>, That proof of profit shall not be required as to a person who engages in the regular and repetitive purchase and disposition of firearms for criminal purposes or terrorism. For purposes of this paragraph, the term <term>terrorism</term> means activity, directed against United States persons, which—</text><subparagraph commented="no" display-inline="no-display-inline" id="id125c1f6bcd1b4871b451f702ccd09e56"><enum>(A)</enum><text display-inline="yes-display-inline">is committed by an individual who is not a national or permanent resident alien of the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3946e614757483da0752305c4f2004f"><enum>(B)</enum><text display-inline="yes-display-inline">involves violent acts or acts dangerous to human life which would be a criminal violation if committed within the jurisdiction of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1a7f489cf6aa4ac18098143e8bcad39f"><enum>(C)</enum><text display-inline="yes-display-inline">is intended—</text><clause commented="no" display-inline="no-display-inline" id="id9800693faaec4dbca3bdd68a4e31895f"><enum>(i)</enum><text display-inline="yes-display-inline">to intimidate or coerce a civilian population;</text></clause><clause commented="no" display-inline="no-display-inline" id="id69bae825be1f43c99b5c0b700fe8243c"><enum>(ii)</enum><text display-inline="yes-display-inline">to influence the policy of a government by intimidation or coercion; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id224924a2031c4b81985a37d0f176d5d8"><enum>(iii)</enum><text display-inline="yes-display-inline">to affect the conduct of a government by assassination or kidnapping.</text></clause></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0AB11C7E2ADD4B0F91F5971C33F64F99"><enum>12003.</enum><header display-inline="yes-display-inline">Use of Byrne grants for implementation of State crisis intervention programs</header><subsection commented="no" display-inline="no-display-inline" id="idAFCFFD62595A4C05B82221BE5B1BDF56"><enum>(a)</enum><header display-inline="yes-display-inline">Byrne JAG program</header><text display-inline="yes-display-inline">Section 501(a)(1) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152(a)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idEA5951C78FD2486BA843A488DB177045"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>or civil proceedings</quote> after <quote>criminal justice</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6A91BB5FBF404F99BE08EECE4E2B47B0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2F4B68AD26A446C8876A1505D5C9E621" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="idB0FB74ED800B41FA973B344382649A64"><enum>(I)</enum><text display-inline="yes-display-inline">Implementation of State crisis intervention court proceedings and related programs or initiatives, including but not limited to—</text><clause commented="no" display-inline="no-display-inline" id="id0956eca1cb954007bf9a3b83a84a7ad3"><enum>(i)</enum><text display-inline="yes-display-inline">mental health courts;</text></clause><clause commented="no" display-inline="no-display-inline" id="id416ce706ccf44a51a7d10aa7a16bde6b"><enum>(ii)</enum><text display-inline="yes-display-inline">drug courts;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1ac0b8f6b26646048c11303f9d40efdd"><enum>(iii)</enum><text display-inline="yes-display-inline">veterans courts; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0b7870504e9944fc93556e860d4eb054"><enum>(iv)</enum><text display-inline="yes-display-inline">extreme risk protection order programs, which must include, at a minimum—</text><subclause commented="no" display-inline="no-display-inline" id="id896b91727676421db54b784d2fa492f4"><enum>(I)</enum><text display-inline="yes-display-inline">pre-deprivation and post-deprivation due process rights that prevent any violation or infringement of the Constitution of the United States, including but not limited to the Bill of Rights, and the substantive or procedural due process rights guaranteed under the Fifth and Fourteenth Amendments to the Constitution of the United States, as applied to the States, and as interpreted by State courts and United States courts (including the Supreme Court of the United States). Such programs must include, at the appropriate phase to prevent any violation of constitutional rights, at minimum, notice, the right to an in-person hearing, an unbiased adjudicator, the right to know opposing evidence, the right to present evidence, and the right to confront adverse witnesses;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC1546A50AE474012A0811CB820B52443"><enum>(II)</enum><text display-inline="yes-display-inline">the right to be represented by counsel at no expense to the government;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idA2FF7CBD4E444CA3B7A8F699188CE94E"><enum>(III)</enum><text display-inline="yes-display-inline">pre-deprivation and post-deprivation heightened evidentiary standards and proof which mean not less than the protections afforded to a similarly situated litigant in Federal court or promulgated by the State’s evidentiary body, and sufficient to ensure the full protections of the Constitution of the United States, including but not limited to the Bill of Rights, and the substantive and procedural due process rights guaranteed under the Fifth and Fourteenth Amendments to the Constitution of the United States, as applied to the States, and as interpreted by State courts and United States courts (including the Supreme Court of the United States). The heightened evidentiary standards and proof under such programs must, at all appropriate phases to prevent any violation of any constitutional right, at minimum, prevent reliance upon evidence that is unsworn or unaffirmed, irrelevant, based on inadmissible hearsay, unreliable, vague, speculative, and lacking a foundation; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE7D5A216B2854371ACA72737E68B96AB"><enum>(IV)</enum><text display-inline="yes-display-inline">penalties for abuse of the program.</text></subclause></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide0d2c8e89b754adca6358d1f5e9e5225"><enum>(b)</enum><header display-inline="yes-display-inline">Annual report on crisis intervention programs</header><text display-inline="yes-display-inline">Section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida72bd8da47eb4387aee009f764f998bb" changed="added" reported-display-style="italic"><subsection commented="no" display-inline="no-display-inline" id="id81adab7e97694aee8b097d72d1393509"><enum>(h)</enum><header display-inline="yes-display-inline">Annual report on crisis intervention programs</header><text display-inline="yes-display-inline">The Attorney General shall publish an annual report with respect to grants awarded for crisis intervention programs or initiatives under subsection (a)(1)(I) that contains—</text><paragraph commented="no" display-inline="no-display-inline" id="idde7ce6ed0a0b4afeae269809c6e19132"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the grants awarded and the crisis intervention programs or initiatives funded by the grants, broken down by grant recipient;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0acc51e1c4874e7f84283f5f8c6b539f"><enum>(2)</enum><text display-inline="yes-display-inline">an evaluation of the effectiveness of the crisis intervention programs or initiatives in preventing violence and suicide;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc70368b1d490470ea55f1c41471f5a5b"><enum>(3)</enum><text display-inline="yes-display-inline">measures that have been taken by each grant recipient to safeguard the constitutional rights of an individual subject to a crisis intervention program or initiative; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d7073b0f81c4589a466c9df208b7bfc"><enum>(4)</enum><text display-inline="yes-display-inline">efforts that the Attorney General is making, in coordination with the grant recipients, to protect the constitutional rights of individuals subject to the crisis intervention programs or initiatives.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idd61dd7b01dc04465ace71f9add02fbc5"><enum>12004.</enum><header display-inline="yes-display-inline">Stop Illegal Trafficking in Firearms Act</header><subsection commented="no" display-inline="no-display-inline" id="idAC4B47697D364B23B01387E1074AFC7C"><enum>(a)</enum><header display-inline="yes-display-inline">Anti-straw purchasing and firearms trafficking amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id678231137cb440dbadff31bb3664d892"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id73014034fd05443d9d42e843ed86006e" changed="added" reported-display-style="italic"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idD64CF359CE144DBE959FE6C98F281B84"><enum>932.</enum><header display-inline="yes-display-inline">Straw purchasing of firearms</header><subsection commented="no" display-inline="no-display-inline" id="id35979296251a47b2aaa8fda4e26e1a87"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id40513fa8fcc948949661598bc499f7cb"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>drug trafficking crime</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6d39ea14f5cf4e20ad4d8fc6e4619e41"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given that term in section 924(c)(2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idadc7898983c64ec4a53f7a8deed46752"><enum>(B)</enum><text display-inline="yes-display-inline">includes a felony punishable under the law of a State for which the conduct constituting the offense would constitute a felony punishable under the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>), the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951 et seq.</external-xref>), or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/705">chapter 705</external-xref> of title 46;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0107de1cbe44e23be9e4c15da27ad81"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Federal crime of terrorism</term> has the meaning given that term in section 2332b(g)(5); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81e1641b3f2b40d99cf99a47aa0bda24"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>felony</term> means any offense under Federal or State law punishable by imprisonment for a term exceeding 1 year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8e644b5285cb4cd098d77c73a65f3b95"><enum>(b)</enum><header display-inline="yes-display-inline">Violation</header><text display-inline="yes-display-inline">It shall be unlawful for any person to knowingly purchase, or conspire to purchase, any firearm in or otherwise affecting interstate or foreign commerce for, on behalf of, or at the request or demand of any other person, knowing or having reasonable cause to believe that such other person—</text><paragraph commented="no" display-inline="no-display-inline" id="id757ef161c60b454a943672fca8cda97c"><enum>(1)</enum><text display-inline="yes-display-inline">meets the criteria of 1 or more paragraphs of section 922(d);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb3435f261bc42f081e1d0ed3a70af58"><enum>(2)</enum><text display-inline="yes-display-inline">intends to use, carry, possess, or sell or otherwise dispose of the firearm in furtherance of a felony, a Federal crime of terrorism, or a drug trafficking crime; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25e06c5e9a7b49b58cc9f175717ccbd5"><enum>(3)</enum><text display-inline="yes-display-inline">intends to sell or otherwise dispose of the firearm to a person described in paragraph (1) or (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide766efbf18d6476180a34c6e5f7b9789"><enum>(c)</enum><header display-inline="yes-display-inline">Penalty</header><paragraph commented="no" display-inline="no-display-inline" id="id27ee773696ff4d799560600b202a34f5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), any person who violates subsection (b) shall be fined under this title, imprisoned for not more than 15 years, or both.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c63353e787f44918f80131fcf23acf0"><enum>(2)</enum><header display-inline="yes-display-inline">Use in felonies, crimes of terrorism, or drug trafficking crimes</header><text display-inline="yes-display-inline">If a violation of subsection (b) is committed knowing or with reasonable cause to believe that any firearm involved will be used to commit a felony, a Federal crime of terrorism, or a drug trafficking crime, the person shall be sentenced to a term of imprisonment of not more than 25 years.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id115376ccdcba40fd8fa386f91b35d549"><enum>933.</enum><header display-inline="yes-display-inline">Trafficking in firearms</header><subsection commented="no" display-inline="no-display-inline" id="id887f3211739f43b3899939dbdc945c56"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person to—</text><paragraph commented="no" display-inline="no-display-inline" id="id4f056bb3838943c7ab882125e68c2e0a"><enum>(1)</enum><text display-inline="yes-display-inline">ship, transport, transfer, cause to be transported, or otherwise dispose of any firearm to another person in or otherwise affecting interstate or foreign commerce, if such person knows or has reasonable cause to believe that the use, carrying, or possession of a firearm by the recipient would constitute a felony (as defined in section 932(a));</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb52b3ea4d2964dd8b3304a5768f39b78"><enum>(2)</enum><text display-inline="yes-display-inline">receive from another person any firearm in or otherwise affecting interstate or foreign commerce, if the recipient knows or has reasonable cause to believe that such receipt would constitute a felony; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ea5548192aa4393a94b5e795301718a"><enum>(3)</enum><text display-inline="yes-display-inline">attempt or conspire to commit the conduct described in paragraph (1) or (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idadc36ec93cbf4f8abbc48143fe9d4658"><enum>(b)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (a) shall be fined under this title, imprisoned for not more than 15 years, or both.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5ba16fbbe7284db5bfe35843e141645b"><enum>934.</enum><header display-inline="yes-display-inline">Forfeiture and fines</header><subsection commented="no" display-inline="no-display-inline" id="ida7529af2bd8c4449a217c8e3333f27e4"><enum>(a)</enum><header display-inline="yes-display-inline">Forfeiture</header><paragraph commented="no" display-inline="no-display-inline" id="id17dfcf5422ee4eb09d3e74210266d19a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any person convicted of a violation of section 932 or 933 shall forfeit to the United States, irrespective of any provision of State law—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8db5b6118248462296c3e762182cd370"><enum>(A)</enum><text display-inline="yes-display-inline">any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id866d8292a2a44facbc272601bcb0cac1"><enum>(B)</enum><text display-inline="yes-display-inline">any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation, except that for any forfeiture of any firearm or ammunition pursuant to this section, section 924(d) shall apply.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59b3bab2146d41f192cff6a7b2763269"><enum>(2)</enum><header display-inline="yes-display-inline">Imposition</header><text display-inline="yes-display-inline">The court, in imposing sentence on a person convicted of a violation of section 932 or 933, shall order, in addition to any other sentence imposed pursuant to section 932 or 933, that the person forfeit to the United States all property described in paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc31b7d3ceacb4edab6ad9eb19c3a209f"><enum>(b)</enum><header display-inline="yes-display-inline">Fines</header><text display-inline="yes-display-inline">A defendant who derives profits or other proceeds from an offense under section 932 or 933 may be fined not more than the greater of—</text><paragraph commented="no" display-inline="no-display-inline" id="id991fa2e61011446a8e2b99299b7724d8"><enum>(1)</enum><text display-inline="yes-display-inline">the fine otherwise authorized by this part; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e8ca150ce1444fdbb7a70b0b703a435"><enum>(2)</enum><text display-inline="yes-display-inline">the amount equal to twice the gross profits or other proceeds of the offense under section 932 or 933.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6ffb042b56f4a4e97424fb6ba060886"><enum>(2)</enum><header display-inline="yes-display-inline">Title III authorization</header><text display-inline="yes-display-inline">Section 2516(1)(n) of title 18, United States Code, is amended by striking <quote>sections 922 and 924</quote> and inserting <quote>section 922, 924, 932, or 933</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf38f962dd5c46f682ddb7537319cec5"><enum>(3)</enum><header display-inline="yes-display-inline">Racketeering amendment</header><text display-inline="yes-display-inline">Section 1961(1)(B) of title 18, United States Code, is amended by inserting <quote>section 932 (relating to straw purchasing), section 933 (relating to trafficking in firearms),</quote> before <quote>section 1028</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idad91507de2f5480fa94caf4b358cf0f8"><enum>(4)</enum><header display-inline="yes-display-inline">Money laundering amendment</header><text display-inline="yes-display-inline">Section 1956(c)(7)(D) of title 18, United States Code, is amended by striking <quote>section 924(n)</quote> and inserting <quote>section 924(n), 932, or 933</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf7436a7c1a24090965c6f7dfb9a6f0f"><enum>(5)</enum><header display-inline="yes-display-inline">Directive to Sentencing Commission</header><text display-inline="yes-display-inline">Pursuant to its authority under section 994 of title 28, United States Code, and in accordance with this subsection, the United States Sentencing Commission shall review and amend its guidelines and policy statements to ensure that persons convicted of an offense under section 932 or 933 of title 18, United States Code, and other offenses applicable to the straw purchases and trafficking of firearms are subject to increased penalties in comparison to those currently provided by the guidelines and policy statements for such straw purchasing and trafficking of firearms offenses. In its review, the Commission shall consider, in particular, an appropriate amendment to reflect the intent of Congress that straw purchasers without significant criminal histories receive sentences that are sufficient to deter participation in such activities and reflect the defendant's role and culpability, and any coercion, domestic violence survivor history, or other mitigating factors. The Commission shall also review and amend its guidelines and policy statements to reflect the intent of Congress that a person convicted of an offense under section 932 or 933 of title 18, United States Code, who is affiliated with a gang, cartel, organized crime ring, or other such enterprise should be subject to higher penalties than an otherwise unaffiliated individual.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc692e30f33034edba50b6c569290eef4"><enum>(6)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5b7079f8-7cf6-4cd5-b869-486a45965b68" changed="added" reported-display-style="italic"><toc changed="added" reported-display-style="italic"><toc-entry bold="off" level="section" idref="idD64CF359CE144DBE959FE6C98F281B84">932. and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0ed655aefae4b4ea2d7bfe32565a13a"><enum>(3)</enum><text display-inline="yes-display-inline">by striking the matter following paragraph (9) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd0c8f6aa92604addb37fda26c2832642" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="ide44b48e223e84384a38b5a9d67a08516"><enum>(10)</enum><text display-inline="yes-display-inline">intends to sell or otherwise dispose of the firearm or ammunition in furtherance of a felony, a Federal crime of terrorism, or a drug trafficking offense (as such terms are defined in section 932(a)); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96bce311965b45d5a64afbfbf00d7534"><enum>(11)</enum><text display-inline="yes-display-inline">intends to sell or otherwise dispose of the firearm or ammunition to a person described in any of paragraphs (1) through (10).</text></paragraph><quoted-block-continuation-text commented="no" quoted-block-continuation-text-level="subsection">This subsection shall not apply with respect to the sale or disposition of a firearm or ammunition to a licensed importer, licensed manufacturer, licensed dealer, or licensed collector who pursuant to subsection (b) of section 925 is not precluded from dealing in firearms or ammunition, or to a person who has been granted relief from disabilities pursuant to subsection (c) of section 925.</quoted-block-continuation-text><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3101a6e2c2a54209b808ff1bd7b939a1"><enum>(c)</enum><header display-inline="yes-display-inline">Amendments to section 924<enum-in-header>(a)</enum-in-header></header><text display-inline="yes-display-inline">Section 924(a) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6cf88b57bad042b1b4b1fb5490328fc4"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>(d), (g),</quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd20d9d9bfc25472bbc351f2727276d17"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id733e8993be764909a29c5cb0a10483b9" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="id00c0454e9f944b71a4ea6b9848e19a38"><enum>(G)</enum><text display-inline="yes-display-inline">any offense under section 932 or 933.</text></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id30919a96675541a2af5d7e023a4af4ed"><enum>(e)</enum><header display-inline="yes-display-inline">Amendments to section 924<enum-in-header>(h)</enum-in-header></header><text display-inline="yes-display-inline">Section 924 of title 18, United States Code, is amended by striking subsection (h) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id18781F1258EC479484AC2CA164A1EBAB" changed="added" reported-display-style="italic"><subsection commented="no" display-inline="no-display-inline" id="idf8c05ec1e0e4468ba8a5bd449b18c266"><enum>(h)</enum><text display-inline="yes-display-inline">Whoever knowingly receives or transfers a firearm or ammunition, or attempts or conspires to do so, knowing or having reasonable cause to believe that such firearm or ammunition will be used to commit a felony, a Federal crime of terrorism, or a drug trafficking crime (as such terms are defined in section 932(a)), or a crime under the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>), the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>), the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>), or the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1901">21 U.S.C. 1901 et seq.</external-xref>), shall be fined under this title, imprisoned for not more than 15 years, or both.</text></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id4c3c540c7d764a57bdb1d5d3436a1279"><enum>(f)</enum><header display-inline="yes-display-inline">Amendments to section 924<enum-in-header>(k)</enum-in-header></header><text display-inline="yes-display-inline">Section 924 of title 18, United States Code, is amended by striking subsection (k) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9FA140BE33F423D83E1CD7331CB4E86" changed="added" reported-display-style="italic"><subsection commented="no" display-inline="no-display-inline" id="idcf515c9cc61d442099d04526d65b132d"><enum>(k)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idDDF698DEC483428BA4E5912F67253321"><enum>(1)</enum><text display-inline="yes-display-inline">A person who smuggles or knowingly brings into the United States a firearm or ammunition, or attempts or conspires to do so, with intent to engage in or to promote conduct that—</text><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idD8F3B4DCC7E046E383119E1C89274BB4"><enum>(A)</enum><text display-inline="yes-display-inline">is punishable under the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951 et seq.</external-xref>), or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/705">chapter 705</external-xref> of title 46; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idE229FFCB2C014412A9FB8959A6117087"><enum>(B)</enum><text display-inline="yes-display-inline">constitutes a felony, a Federal crime of terrorism, or a drug trafficking crime (as such terms are defined in section 932(a)), </text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">shall be fined under this title, imprisoned for not more than 15 years, or both.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19b98b0212084472a20530758a75bb5b" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A person who smuggles or knowingly takes out of the United States a firearm or ammunition, or attempts or conspires to do so, with intent to engage in or to promote conduct that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id19e63c9e55854e2e97fca2da0af8fbdd"><enum>(A)</enum><text display-inline="yes-display-inline">would be punishable under the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951 et seq.</external-xref>), or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/705">chapter 705</external-xref> of title 46, if the conduct had occurred within the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id031ce4d277094d8cb42cbc413aaa6172"><enum>(B)</enum><text display-inline="yes-display-inline">would constitute a felony or a Federal crime of terrorism (as such terms are defined in section 932(a)) for which the person may be prosecuted in a court of the United States, if the conduct had occurred within the United States,</text></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">shall be fined under this title, imprisoned for not more than 15 years, or both.</continuation-text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id3466e8ab9c3f4a5d913559eb0ed37f4d"><enum>(g)</enum><header display-inline="yes-display-inline">Prohibition on firearms or ammunition transfers to agents of drug cartels</header><text display-inline="yes-display-inline">The Department of Justice, and any of its law enforcement coordinate agencies, shall not conduct or otherwise facilitate the transfer of an operable firearm or ammunition to an individual if any law enforcement officer employed by the Department of Justice involved with the transfer knows or has reasonable cause to believe that the recipient of the firearm or ammunition is an agent of a drug cartel, unless law enforcement personnel of the United States continuously monitor or control the firearm or ammunition at all times.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id19cb6335fba6435fae7f5072196d96e0"><enum>(h)</enum><header display-inline="yes-display-inline">FFL access to law enforcement information</header><paragraph commented="no" display-inline="no-display-inline" id="idf956e9b0ff544c858ea911563ce4c624"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 103(b) of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901(b)</external-xref>), is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide2b3475b1752422ea1abae4fd92db839"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Not later than</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id50968812ddda458c82752ef6816cec27" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="id1b50d7d431e940798b1e83ceb2101f13"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide426d9a960334e06be811f583624a597"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf4819f6dfbe14d73acf7d445af1fb2c7" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="id62511cf3d6644d5bb1fd241151b08f3c"><enum>(2)</enum><header display-inline="yes-display-inline">Voluntary background checks</header><subparagraph commented="no" display-inline="no-display-inline" id="id7b99e5103e61486888a7967f1987b103"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this paragraph, the Attorney General shall promulgate regulations allowing licensees to use the national instant criminal background check system established under this section for purposes of voluntarily conducting an employment background check relating to a current or prospective employee. The Attorney General may not collect a fee for an employment background check under this subparagraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CC04F13F8E44819B690B9F1D0A27EDB"><enum>(B)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">Before conducting an employment background check relating to a current or prospective employee under subparagraph (A), a licensee shall—</text><clause commented="no" display-inline="no-display-inline" id="id7730233010bf46dfa0e026f7f9e9ab0d"><enum>(i)</enum><text display-inline="yes-display-inline">provide written notice to the current or prospective employee that the licensee intends to conduct the background check; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0cc6d737416c4aeeb90043a6c33cfa82"><enum>(ii)</enum><text display-inline="yes-display-inline">obtain consent to conduct the background check from the current or prospective employee in writing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12aec4ed486e4e8f917249cf240acfc8"><enum>(C)</enum><header display-inline="yes-display-inline">Exemption</header><text display-inline="yes-display-inline">An employment background check conducted by a licensee under subparagraph (A) shall not be governed by the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id995fcc30bcfb4e0c9f8e13a3d0d1b252"><enum>(D)</enum><header display-inline="yes-display-inline">Appeal</header><text display-inline="yes-display-inline">Any individual who is the subject of an employment background check conducted by a licensee under subparagraph (A) the result of which indicates that the individual is prohibited from possessing a firearm or ammunition pursuant to subsection (g) or (n) of section 922 of title 18, United States Code, may appeal the results of the background check in the same manner and to the same extent as if the individual had been the subject of a background check relating to the transfer of a firearm.</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcca8c48dd6734311bf665a31190f31b4"><enum>(2)</enum><header display-inline="yes-display-inline">Acquisition, preservation, and exchange of identification records and information</header><text display-inline="yes-display-inline">Section 534 of title 28, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8446e553aae04d3abe1de14ad9acd1c1"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="idcfd448ab09bc4923bceab207fcf2dc0a"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id17cbb0a4655241adba1f32d35c804ec0"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id12066d2a28934b61b65f57147c0dcb7d"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc1e1f33d54c94bd3871d81fb546742ed" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="id67759f3b8310417f8c651293a9014131"><enum>(5)</enum><text display-inline="yes-display-inline">provide a person licensed as an importer, manufacturer, or dealer of firearms under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18 with information necessary to verify whether firearms offered for sale to such licensees have been stolen.</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a4b9a61f04a413393f246cf506030ea"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>, except for dissemination authorized under subsection (a)(5) of this section</quote> before the period.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbff9fc3ef8ff4db19d24977f0ffbb3f9"><enum>(3)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, and without regard to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, the Attorney General shall promulgate regulations allowing a person licensed as an importer, manufacturer, or dealer of firearms under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to receive access to records of stolen firearms maintained by the National Crime Information Center operated by the Federal Bureau of Investigation, solely for the purpose of voluntarily verifying whether firearms offered for sale to such licensees have been stolen.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f915dd839404a798bd2e562a1ee87b0"><enum>(4)</enum><header display-inline="yes-display-inline">Statutory construction; evidence</header><subparagraph commented="no" display-inline="no-display-inline" id="id3973824da73b4602b8c02373b65df453"><enum>(A)</enum><header display-inline="yes-display-inline">Statutory construction</header><text display-inline="yes-display-inline">Nothing in this subsection or the amendments made by this subsection shall be construed—</text><clause commented="no" display-inline="no-display-inline" id="id1219ce4e3a334670bee0d3fdc802c27c"><enum>(i)</enum><text display-inline="yes-display-inline">to create a cause of action against any person licensed as an importer, manufacturer, or dealer of firearms under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, or any other person for any civil liability; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idcdf38c8c6e164ab3ad3960435dc5bf62"><enum>(ii)</enum><text display-inline="yes-display-inline">to establish any standard of care.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida04507b6dcce4a528b3dbc5eb3a052e5"><enum>(B)</enum><header display-inline="yes-display-inline">Evidence</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, evidence regarding the use or non-use by a person licensed as an importer, manufacturer, or dealer of firearms under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, of the systems, information, or records made available under this subsection or the amendments made by this subsection shall not be admissible as evidence in any proceeding of any court, agency, board, or other entity.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id65ab1ecf90584b788449bb3f2deba7ec"><enum>(i)</enum><header display-inline="yes-display-inline">Funding for existing ATF anti-straw purchasing campaign</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Bureau of Alcohol, Tobacco, Firearms, and Explosives $1,000,000 for each of fiscal years 2023 through 2027 to continue and expand current efforts with existing partners to educate persons licensed as an importer, manufacturer, or dealer of firearms under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, and the public to combat illegal straw purchases of firearms.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd1445fba755c4119990113d1dbac8166"><enum>(j)</enum><header display-inline="yes-display-inline">Local law enforcement reimbursement for assistance provided to DHS-HSI to prevent illegal trafficking</header><text display-inline="yes-display-inline">Section 432(d)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/240">6 U.S.C. 240(d)(2)</external-xref>) is amended by inserting <quote>salary reimbursement,</quote> after <quote>administrative,</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbf7d2d1a02a64cf09578a65ae4b1e5f1"><enum>(k)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section, or an amendment made by this section, shall be construed to allow the establishment of a Federal system of registration of firearms, firearms owners, or firearms transactions or dispositions.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id8aec39a064304a36818a7b147f5eaf2e"><enum>12005.</enum><header display-inline="yes-display-inline">Misdemeanor crime of domestic violence</header><subsection commented="no" display-inline="no-display-inline" id="idCEA51258E77742E6A05EC52F6FD4E3B0"><enum>(a)</enum><header display-inline="yes-display-inline">Defining <quote>dating relationship</quote></header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id87f245c57b4047c38231d4a9b29b3f3f"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (33)(A)(ii)—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddde91abf63d342809e5e5a5c7ae0aacf"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or by a person</quote> and inserting <quote>by a person</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf37c2ff6cf614b9c88d4d41e8cb2761e"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3a134b7749bc4694aa87ee07c2fd6b9c" changed="added" reported-display-style="italic"><paragraph commented="no" display-inline="no-display-inline" id="id4a8d9e57cdb247c693fbbbc414f8196f" indent="up1"><enum>(37)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ided6dc32aef814633a64524809e52e16f"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>dating relationship</term> means a relationship between individuals who have or have recently had a continuing serious relationship of a romantic or intimate nature.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd214c659fdc448d2951a484e6fb09e71" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Whether a relationship constitutes a dating relationship under subparagraph (A) shall be determined based on consideration of—</text><clause commented="no" display-inline="no-display-inline" id="id68a39d65bcd84773bf4e3629b1169c7f"><enum>(i)</enum><text display-inline="yes-display-inline">the length of the relationship;</text></clause><clause commented="no" display-inline="no-display-inline" id="idce398c0079a640b287f1e17c96df252b"><enum>(ii)</enum><text display-inline="yes-display-inline">the nature of the relationship; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9cf06d1ad7e44d939e344eaede20d7d7"><enum>(iii)</enum><text display-inline="yes-display-inline">the frequency and type of interaction between the individuals involved in the relationship.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75a5e9ca1e454d5384f8baf638ffed05" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A casual acquaintanceship or ordinary fraternization in a business or social context does not constitute a dating relationship under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7E0C560B9ACC43EB86EC48373B600521"><enum>(b)</enum><header display-inline="yes-display-inline">No retroactive application</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall not apply to any conviction of a misdemeanor crime of domestic violence entered before the date of enactment of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idB28B3244A787424186CB7C7901220225"><enum>(c)</enum><header display-inline="yes-display-inline">Limitations on convictions of crimes of domestic violence with respect to dating relationships</header><text display-inline="yes-display-inline">Section 921(a)(33) of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id729E53102FA141F6B115DE35A60476EB"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE5FA6B9B806D4686AA86D3F25BCEC4B1"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>subparagraph (C)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08EB8EC022A44C9EAB100341FA8A9BF4"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>State,,</quote> and inserting <quote>State,</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFF76CE7A4A2D4646B770371AF7969074"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33f7933db7904f929d0d0664797ae8bd" changed="added" reported-display-style="italic"><subparagraph commented="no" display-inline="no-display-inline" id="id2ecbb8c8ab084caa8712d8b5de754449" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">A person shall not be considered to have been convicted of a misdemeanor crime of domestic violence against an individual in a dating relationship for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had firearm rights restored unless the expungement, pardon, or restoration of rights expressly provides that the person may not ship, transport, possess, or receive firearms: <proviso><italic>Provided</italic></proviso>, That, in the case of a person who has not more than 1 conviction of a misdemeanor crime of domestic violence against an individual in a dating relationship, and is not otherwise prohibited under this chapter, the person shall not be disqualified from shipping, transport, possession, receipt, or purchase of a firearm under this chapter if 5 years have elapsed from the later of the judgment of conviction or the completion of the person's custodial or supervisory sentence, if any, and the person has not subsequently been convicted of another such offense, a misdemeanor under Federal, State, Tribal, or local law which has, as an element, the use or attempted use of physical force, or the threatened use of a deadly weapon, or any other offense that would disqualify the person under section 922(g). The national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref>) shall be updated to reflect the status of the person. Restoration under this subparagraph is not available for a current or former spouse, parent, or guardian of the victim, a person with whom the victim shares a child in common, a person who is cohabiting with or has cohabited with the victim as a spouse, parent, or guardian, or a person similarly situated to a spouse, parent, or guardian of the victim.</text></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title commented="no" level-type="subsequent" display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle A of title XXII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/651">6 U.S.C. 651 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8333255f6d984c69abffb93528d7bbe3" changed="added" reported-display-style="italic"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id68621e10be844b48b61412ca464518ae"><enum>2220D.</enum><header display-inline="yes-display-inline">Federal Clearinghouse on School Safety Evidence-based Practices</header><subsection commented="no" display-inline="no-display-inline" id="idd02f81ee916749a699373724abeab43c"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="idb7d7b7afb07a42c2b02158a94eea0f75"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Education, the Attorney General, and the Secretary of Health and Human Services, shall establish a Federal Clearinghouse on School Safety Evidence-based Practices (in this section referred to as the <quote>Clearinghouse</quote>) within the Department.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf43e05fd7dbb4b57baa7e7d99409d89a"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The Clearinghouse shall serve as a Federal resource to identify and publish online through SchoolSafety.gov, or any successor website, evidence-based practices and recommendations to improve school safety for use by State and local educational agencies, institutions of higher education, State and local law enforcement agencies, health professionals, and the general public.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1beb4c79dfe041038ca670fd52bb667a"><enum>(3)</enum><header display-inline="yes-display-inline">Personnel</header><subparagraph commented="no" display-inline="no-display-inline" id="id388a12705e9c4d8889be4f7970be3b97"><enum>(A)</enum><header display-inline="yes-display-inline">Assignments</header><text display-inline="yes-display-inline">The Clearinghouse shall be assigned such personnel and resources as the Secretary considers appropriate to carry out this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd96d3f78a1784c4cb38f0e1cd3fefdde"><enum>(B)</enum><header display-inline="yes-display-inline">Detailees</header><text display-inline="yes-display-inline">The Secretary of Education, the Attorney General, and the Secretary of Health and Human Services may detail personnel to the Clearinghouse.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id088fe04e09c54c55a5825ab1d5129b45"><enum>(4)</enum><header display-inline="yes-display-inline">Exemptions</header><subparagraph commented="no" display-inline="no-display-inline" id="id3ca8bed9140f49688fcf2b3cabbf4703"><enum>(A)</enum><header display-inline="yes-display-inline">Paperwork reduction act</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), shall not apply to any rulemaking or information collection required under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43589ed328e4451ea26cd28e7a2d74dd"><enum>(B)</enum><header display-inline="yes-display-inline">Federal advisory committee act</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply for the purposes of carrying out this section.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8aef236009e44ac8b8b0d6230e53afac"><enum>(b)</enum><header display-inline="yes-display-inline">Clearinghouse contents</header><paragraph commented="no" display-inline="no-display-inline" id="id2c6e6bdcbcfd4cdf9121a18d5bea6dce"><enum>(1)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In identifying the evidence-based practices and recommendations for the Clearinghouse, the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd3c2498bcca4d0ead6f0b963a68fc55"><enum>(A)</enum><text display-inline="yes-display-inline">consult with appropriate Federal, State, local, Tribal, private sector, and nongovernmental organizations, including civil rights and disability rights organizations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf18e413bc1d945108648d6219006bffe"><enum>(B)</enum><text display-inline="yes-display-inline">consult with the Secretary of Education to ensure that evidence-based practices published by the Clearinghouse are aligned with evidence-based practices to support a positive and safe learning environment for all students.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1cf9a6798aec42578126f59d5fd8463f"><enum>(2)</enum><header display-inline="yes-display-inline">Criteria for evidence-based practices and recommendations</header><text display-inline="yes-display-inline">The evidence-based practices and recommendations of the Clearinghouse shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9ff94e0b72754dd6b644f506db742cc0"><enum>(A)</enum><text display-inline="yes-display-inline">include comprehensive evidence-based school safety measures;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f81526c51584f5399a27b9a679b21f2"><enum>(B)</enum><text display-inline="yes-display-inline">include the evidence or research rationale supporting the determination of the Clearinghouse that the evidence-based practice or recommendation under subparagraph (A) has been shown to have a significant effect on improving the health, safety, and welfare of persons in school settings, including—</text><clause commented="no" display-inline="no-display-inline" id="idcb43724a42ca4090977a74e87f0fcde7"><enum>(i)</enum><text display-inline="yes-display-inline">relevant research that is evidence-based, as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), supporting the evidence-based practice or recommendation;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf0ea9e9967ad485893c1566aead23592"><enum>(ii)</enum><text display-inline="yes-display-inline">findings and data from previous Federal or State commissions recommending improvements to the safety posture of a school; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id2447b29be3d74f5282c85b816b287859"><enum>(iii)</enum><text display-inline="yes-display-inline">other supportive evidence or findings relied upon by the Clearinghouse in determining evidence-based practices and recommendations, as determined in consultation with the officers described in subsection (a)(3)(B);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0135a9626aa846dcbf7904f889e054b9"><enum>(C)</enum><text display-inline="yes-display-inline">include information on Federal programs for which implementation of each evidence-based practice or recommendation is an eligible use for the program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf151b908269d477da46a995bbfc41a64"><enum>(D)</enum><text display-inline="yes-display-inline">be consistent with Federal civil rights laws, including title II of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>), the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701 et seq.</external-xref>), and title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88cb305b21594f08884c75b6123bf96d"><enum>(E)</enum><text display-inline="yes-display-inline">include options for developmentally appropriate recommendations for use in educational settings with respect to children’s ages and physical, social, sensory, and emotionally developmental statuses.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided39fb1a2226484caef4fc5dc4b93652"><enum>(3)</enum><header display-inline="yes-display-inline">Past commission recommendations</header><text display-inline="yes-display-inline">The Clearinghouse shall present, as determined in consultation with the officers described in subsection (a)(3)(B), Federal, State, local, Tribal, private sector, and nongovernmental organization issued best practices and recommendations and identify any best practice or recommendation of the Clearinghouse that was previously issued by any such organization or commission.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7c02834e90384151a5c49f23298a45b8"><enum>(c)</enum><header display-inline="yes-display-inline">Assistance and training</header><text display-inline="yes-display-inline">The Secretary may produce and publish materials on the Clearinghouse to assist and train educational agencies and law enforcement agencies on the implementation of the evidence-based practices and recommendations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ebd09864bd845849797fff540b88a45"><enum>(d)</enum><header display-inline="yes-display-inline">Continuous improvement</header><text display-inline="yes-display-inline">The Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id43a3d344d1324bf4b75d060f27591c7a"><enum>(1)</enum><text display-inline="yes-display-inline">collect for the purpose of continuous improvement of the Clearinghouse—</text><subparagraph commented="no" display-inline="no-display-inline" id="idac597c92a2a148188c0eb197c618c4aa"><enum>(A)</enum><text display-inline="yes-display-inline">Clearinghouse data analytics;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa3141ab8c83406daa1984833c7beb80"><enum>(B)</enum><text display-inline="yes-display-inline">user feedback on the implementation of resources, evidence-based practices, and recommendations identified by the Clearinghouse; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6bd1cfdb1795402698d7bf8c4118bdcc"><enum>(C)</enum><text display-inline="yes-display-inline">any evaluations conducted on implementation of the evidence-based practices and recommendations of the Clearinghouse; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3adba6030aeb4263bc349f7026297e69"><enum>(2)</enum><text display-inline="yes-display-inline">in coordination with the Secretary of Education, the Secretary of Health and Human Services, and the Attorney General—</text><subparagraph commented="no" display-inline="no-display-inline" id="id182171dd1bd14c48a7c73a7d717a220d"><enum>(A)</enum><text display-inline="yes-display-inline">regularly assess and identify Clearinghouse evidence-based practices and recommendations for which there are no resources available through Federal Government programs for implementation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id703fbd86283b4bf89eef06750ba2cf4e"><enum>(B)</enum><text display-inline="yes-display-inline">establish an external advisory board, which shall be comprised of appropriate State, local, Tribal, private sector, and nongovernmental organizations, including organizations representing parents of elementary and secondary school students, representative from civil rights organizations, representatives of disability rights organizations, representatives of educators, representatives of law enforcement, and nonprofit school safety and security organizations, to—</text><clause commented="no" display-inline="no-display-inline" id="id4d10cb4cc4fc42d2a7b1d13a359aa162"><enum>(i)</enum><text display-inline="yes-display-inline">provide feedback on the implementation of evidence-based practices and recommendations of the Clearinghouse; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf11e385adfc54fdca4e9426698380212"><enum>(ii)</enum><text display-inline="yes-display-inline">propose additional recommendations for evidence-based practices for inclusion in the Clearinghouse that meet the requirements described in subsection (b)(2)(B).</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id63e901907f3e4b2eb179fff117468951"><enum>(e)</enum><header display-inline="yes-display-inline">Parental assistance</header><text display-inline="yes-display-inline">The Clearinghouse shall produce materials in accessible formats to assist parents and legal guardians of students with identifying relevant Clearinghouse resources related to supporting the implementation of Clearinghouse evidence-based practices and recommendations.</text></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="ida57eb2d3a29a47efa8306f5bd1941cc2"><enum>(b)</enum><header display-inline="yes-display-inline">Technical amendments</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; clearinghouse</header><subsection commented="no" display-inline="no-display-inline" id="id32c5608c3fbc42afbc7553001028461d"><enum>(a)</enum><header display-inline="yes-display-inline">Notification by the Secretary of Education</header><text display-inline="yes-display-inline">The Secretary of Education shall provide written notification of the publication of the Federal Clearinghouse on School Safety Evidence-based Practices (referred to in this section and section 13304 as the <quote>Clearinghouse</quote>), as required to be established under section 2220D of the Homeland Security Act of 2002, as added by section 13302 of this Act, to—</text><paragraph commented="no" display-inline="no-display-inline" id="id56a17f2962c5446e895075a8fbeb7f10"><enum>(1)</enum><text display-inline="yes-display-inline">every State and local educational agency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5aea4da565d4631a305a035df3aa12c"><enum>(2)</enum><text display-inline="yes-display-inline">other Department of Education partners in the implementation of the evidence-based practices and recommendations of the Clearinghouse, as determined appropriate by the Secretary of Education.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id952da51ac4c54fcd91a6348f113c8077"><enum>(b)</enum><header display-inline="yes-display-inline">Notification by the Secretary of Homeland Security</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall provide written notification of the publication of the Clearinghouse, as required to be established under section 2220D of the Homeland Security Act of 2002, as added by section 13302 of this Act, to—</text><paragraph commented="no" display-inline="no-display-inline" id="idb441ed5bbb324e22b193554a14b67ce2"><enum>(1)</enum><text display-inline="yes-display-inline">every State homeland security advisor;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida52222a66b014605b29e3419d633ced6"><enum>(2)</enum><text display-inline="yes-display-inline">every State department of homeland security; Homeland Security partners in the implementation of the evidence-based practices and recommendations of the Clearinghouse, as determined appropriate by the Secretary of Homeland Security.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfa9735a961a84e33b200272cdcb058a9"><enum>(c)</enum><header display-inline="yes-display-inline">Notification by the Secretary of Health and Human Services</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall provide written notification of the publication of the Clearinghouse, as required to be established under section 2220D of the Homeland Security Act of 2002, as added by section 13302 of this Act, to—</text><paragraph commented="no" display-inline="no-display-inline" id="id9e140f357474421aada845d7708b4b98"><enum>(1)</enum><text display-inline="yes-display-inline">every State department of public health; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id35db4a654c2e4c8c98053f65e69e548b"><enum>(2)</enum><text display-inline="yes-display-inline">other Department of Health and Human Services partners in the implementation of the evidence-based practices and recommendations of the Clearinghouse, as determined appropriate by the Secretary of Health and Human Services.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id014775b2c8b64f01ade87409001ffce7"><enum>(d)</enum><header display-inline="yes-display-inline">Notification by the Attorney General</header><text display-inline="yes-display-inline">The Attorney General shall provide written notification of the publication of the Clearinghouse, as required to be established under section 2220D of the Homeland Security Act of 2002, as added by section 13302 of this Act, to—</text><paragraph commented="no" display-inline="no-display-inline" id="id613b0bb801dd4ca3993aed6d0dce1f21"><enum>(1)</enum><text display-inline="yes-display-inline">every State department of justice; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8122ee019cc1446b9754116ee59e5f00"><enum>(2)</enum><text display-inline="yes-display-inline">other Department of Justice partners in the implementation of the evidence-based practices and recommendations of the Clearinghouse, as determined appropriate by the Attorney General.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5ff91fe1953040d68adefbaef4531281"><enum>13304.</enum><header display-inline="yes-display-inline">Grant program review</header><subsection commented="no" display-inline="no-display-inline" id="idf5d37148e4e94e14b6117f990707d665"><enum>(a)</enum><header display-inline="yes-display-inline">Federal grants and resources</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Clearinghouse or the external advisory board established under section 2220D of the Homeland Security Act of 2002, as added by this subtitle, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idbbbf3f429fc24f9eb81e04ea270aa035"><enum>(1)</enum><text display-inline="yes-display-inline">review grant programs and identify any grant program that may be used to implement evidence-based practices and recommendations of the Clearinghouse;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb8b608f817b4e888e8e2c479def319f"><enum>(2)</enum><text display-inline="yes-display-inline">identify any evidence-based practices and recommendations of the Clearinghouse for which there is not a Federal grant program that may be used for the purposes of implementing the evidence-based practice or recommendation as applicable to the agency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc837bd0cced4833a0519a04ee0327dd"><enum>(3)</enum><text display-inline="yes-display-inline">periodically report any findings under paragraph (2) to the appropriate committees of Congress.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbfa36e2457a649bf8033ae48eb795c02"><enum>(b)</enum><header display-inline="yes-display-inline">State grants and resources</header><text display-inline="yes-display-inline">The Clearinghouse shall, to the extent practicable, identify, for each State—</text><paragraph commented="no" display-inline="no-display-inline" id="id8cb1193ac37c456089bf165c34f1d8e4"><enum>(1)</enum><text display-inline="yes-display-inline">each agency responsible for school safety in the State, or any State that does not have such an agency designated;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfde310ac88804e20b50ebf19e95ac6fa"><enum>(2)</enum><text display-inline="yes-display-inline">any grant program that may be used for the purposes of implementing evidence-based practices and recommendations of the Clearinghouse; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6bd96315e8f643249bb7f54b156292f0"><enum>(3)</enum><text display-inline="yes-display-inline">any resources other than grant programs that may be used to assist in implementation of evidence-based practices and recommendations of the Clearinghouse.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idb37f0019f1734e4f986f619a5358f2cd"><enum>13305.</enum><header display-inline="yes-display-inline">Rules of construction</header><subsection commented="no" display-inline="no-display-inline" id="id31a76015b64c4200adb2f2943e43a58c"><enum>(a)</enum><header display-inline="yes-display-inline">Waiver of requirements</header><text display-inline="yes-display-inline">Nothing in this subtitle or the amendments made by this subtitle shall be construed to create, satisfy, or waive any requirement under—</text><paragraph commented="no" display-inline="no-display-inline" id="idd0f3469d7f37426187065dc1402baa93"><enum>(1)</enum><text display-inline="yes-display-inline">title II of the Americans With Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82d30c355eee4465acc63df097792358"><enum>(2)</enum><text display-inline="yes-display-inline">the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. Government to engage in an activity otherwise prohibited under section 103(b) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3403">20 U.S.C. 3403(b)</external-xref>).</text></subsection></section></subtitle><subtitle commented="no" level-type="subsequent" id="id13FD64D38C2F45648D1651AF6B437A57" style="OLC"><enum>D</enum><header display-inline="yes-display-inline">Amendment on ESEA Funding</header><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" 2024, $280,000,000, to remain available until expended, shall be made available for fiscal year 2025, and $280,000,000, to remain available until expended, shall be made available for fiscal year 2026: <proviso><italic>Provided further,</italic></proviso> That of the funds made available under this heading in this Act, the following amounts shall be for the following purposes in equal amounts for each of fiscal years 2022 through 2026—</text><paragraph commented="no" display-inline="no-display-inline" id="id3443ad59660d4f33923a7f5795298a98"><enum>(1)</enum><text display-inline="yes-display-inline">$750,000,000 shall be awarded pursuant to the formula allocation (adjusted in proportion to the relative amounts statutorily designated therefor) that was used in the fiscal year prior to the year for which funds are provided for the Edward Byrne Memorial Justice Assistance Grant program, as authorized by subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Acts of 1968 (<external-xref legal-doc="public-law" parsable-cite="pl/90/351">Public Law 90–351</external-xref>) (the <quote>1968 Act</quote>), and shall be for the purposes described in section 501(a)(1)(I) of title I of the 1968 Act, as amended by title II of division A of this Act: <proviso><italic>Provided further</italic></proviso>, That the allocation provisions under sections 505(a) through (e), the special rules for Puerto Rico under section 505(g), and section 1001(c) of title I of the 1968 Act shall not apply to the amount described in this id="idDEE8C583C90544A08C9CAE39C5172C6A"><header display-inline="yes-display-inline">COMMUNITY ORIENTED POLICING SERVICES PROGRAMS</header><text display-inline="no-display-inline">For an additional amount for <quote>Community Oriented Policing Services Programs</quote>, $100,000,000, to remain available until expended, for competitive grants to be administered by the Community Oriented Policing Services Office for purposes authorized under the STOP School Violence Act of 2018 (title V of division S of <external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>): <proviso><italic>Provided,</italic></proviso> That $20,000,000, to remain available until expended, shall be made available for fiscal year 2022, $20,000,000, to remain available until expended, shall be made available for fiscal year 2023, $20,000,000, to remain available until expended, shall be made available for fiscal year 2024, $20,000,000, to remain available until expended, shall be made available for fiscal year 2025, and $20,000,000, to remain available until expended, shall be made available for fiscal year 2026. </text></appropriations-small><appropriations-major commented="no" id="idCDA714CDA56F473898FC60113F254512"><header display-inline="yes-display-inline">GENERAL PROVISIONS—THIS id="id3430001052a1461d83ec794893c9180a"><enum>(a)</enum><text display-inline="yes-display-inline">The Department of Justice shall provide a detailed spend plan for the fiscal year 2022 and 2023 funds made available in this title to the Committees on Appropriations of the House of Representatives and the Senate within 45 days after the enactment of this Act and, for each of fiscal years 2024 through 2026, as part of the annual budget submission of the President under section 1105(a) of title 31, United States Code, the Attorney General shall submit a detailed spend plan for the funds made available in this title in that fiscal year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbc97e1c9bb4c4f9ea973013e841538f3"><enum>(b)</enum><text display-inline="yes-display-inline">The spend plan described in subsection (a) shall include a specific and detailed description of the intended administration, review processes, allowable purposes, eligibility requirements, and priority areas or weightings for the grant programs funded in this title. </text></subsection></section></title><title commented="no" level-type="subsequent" id="id1EE19A4D1B3546AE908CA18B5BDC5332" style="appropriations"><enum>II</enum><header display-inline="no-display-inline">DEPARTMENT OF HEALTH AND HUMAN SERVICES</header><appropriations-intermediate commented="no" id="idA1B2BFD4A9B741298A29680B83497FF1"><header display-inline="yes-display-inline">Substance abuse and mental health services administration</header></appropriations-intermediate><appropriations-small commented="no" id="id4085E77DC1A54E2E87F874857A530CE0"><header display-inline="yes-display-inline">HEALTH SURVEILLANCE AND PROGRAM SUPPORT</header><text display-inline="no-display-inline">For an additional amount for <quote>Health Surveillance and Program Support</quote>, $800,000,000, to remain available until September 30, 2025: <proviso><italic>Provided,</italic></proviso> That $312,500,000, to remain available until December 31, 2022, shall be made available for fiscal year 2022, $162,500,000, to remain available until September 30, 2023, shall be made available for fiscal year 2023, $162,500,000, to remain available until September 30, 2024, shall be made available for fiscal year 2024, and $162,500,000, to remain available until September 30, 2025, shall be made available for fiscal year 2025: <proviso><italic>Provided further,</italic></proviso> That of the funds made available under this heading in this Act, the following amounts shall be for the following purposes in equal amounts for each of fiscal years 2022 through 2025, unless stated otherwise—</text><paragraph commented="no" display-inline="no-display-inline" id="idcbb84d91b46d41999cc49d1ffb8fdbc0"><enum>(1)</enum><text display-inline="yes-display-inline">$250,000,000 shall be for grants for the community mental health services block grant program under subpart I of part B of title XIX of the Public Health Service Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaee8bf5b430444ce81d96e31ce04e67d"><enum>(2)</enum><text display-inline="yes-display-inline">$40,000,000 shall be for National Child Traumatic Stress Network;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id780f48ff89e94a40ac81d4cab1153b93"><enum>(3)</enum><text display-inline="yes-display-inline">$240,000,000 shall be for activities and services under Project AWARE, of which no less than $28,000,000 shall be for activities described in section 7134 of <external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda45da6da1ff4b2882a44f4eb68704b6"><enum>(4)</enum><text display-inline="yes-display-inline">$120,000,000 shall be for Mental Health Awareness Training; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" <proviso><italic>Provided further,</italic></proviso> That of the funds made available under this heading in this Act, the following amounts shall be for the following purposes in equal amounts for each of fiscal years 2022 through 2026, unless stated otherwise—</text><paragraph commented="no" display-inline="no-display-inline" id="id7763349d41cd44d38e303447f8c58487"><enum>(1)<?LEXA-Enum (1)?></enum><text display-inline="yes-display-inline">$60,000,000 shall be for primary care training and enhancement under section 747 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/293k">42 U.S.C. 293k</external-xref>) to provide mental and behavioral health care training as part of the training of pediatricians and other primary care clinicians who plan to provide care for pediatric populations and other vulnerable populations, such as victims of abuse or trauma, and individuals with mental health or substance use disorders: <proviso><italic>Provided further</italic></proviso>, That section 747(c)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/293k">42 U.S.C. 293k(c)(2)</external-xref>) shall not apply to funding made available in this paragraph: <proviso><italic>Provided further</italic></proviso>, That such funds shall be transferred to <quote>Health Resources and Services Administration—Health Workforce</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddde4098cb7e0425db07d56698f406c54"><enum>(2)</enum><text display-inline="yes-display-inline">$80,000,000 shall be for pediatric mental health care access under section 330M of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-19">42 U.S.C. 254c–19</external-xref>), in equal amounts for each of fiscal years 2022 through 2025: <proviso><italic>Provided further</italic></proviso>, That such funds $1,050,000,000, to remain available through September 30, 2025, for carrying out subpart 1 of part A of title IV and part B of title IV of the Elementary and Secondary Education of 1965 (referred to in this Act as <quote>ESEA</quote>), in addition to amounts otherwise available for such purposes: <proviso><italic>Provided,</italic></proviso> That $50,000,000, to remain available through September 30, 2023, shall be for carrying out part B of title IV of the ESEA: <proviso><italic>Provided further,</italic></proviso> That the Secretary shall increase support for the implementation of evidence-based practices intended to increase attendance and engagement of students in the middle grades and high school in community learning centers using funds in the preceding proviso: <proviso><italic>Provided further,</italic></proviso> That $1,000,000,000 shall be for activities under section 4108 of the ESEA and, notwithstanding section 4105 of such Act, States shall make awards on a competitive basis to high-need local educational agencies as determined by the State. </text></appropriations-intermediate><appropriations-intermediate commented="no" id="id5CD376B58A6C43F1A4531FA9AD1032E1"><header display-inline="yes-display-inline">Safe schools and citizenship education</header><text display-inline="no-display-inline">For an additional amount for <quote>Safe Schools and Citizenship Education</quote>, $1,000,000,000, to remain available through December 31, 2026: <proviso><italic>Provided,</italic></proviso> That $200,000,000, to remain available until March 31, 2023, shall be made available for fiscal year 2022, $200,000,000, to remain available until December 31, 2023, shall be made available for fiscal year 2023, $200,000,000, to remain available until December 31, 2024, shall be made available for fiscal year 2024, $200,000,000, to remain available until December 31, 2025, shall be made available for fiscal year 2025, and $200,000,000, to remain available until December 31, 2026, shall be made available for fiscal year 2026: <proviso><italic>Provided further,</italic></proviso> That not more than two percent of each of such amounts may be used for program administration, technical assistance, data collection, and dissemination of best practices: <proviso><italic>Provided further,</italic></proviso> That of the funds made available under this heading in this Act, the following amounts shall be available for the following purposes in equal amounts for each of fiscal years 2022 through 2026—</text><paragraph commented="no" display-inline="no-display-inline" id="id1970e36d0741407e80fb1a7ae6b694a4"><enum>(1)<?LEXA-Enum (1)?></enum><text display-inline="yes-display-inline">$500,000,000 shall be for carrying out School Based Mental Health Services Grants, in addition to amounts otherwise available for such purposes; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id011284536992484eb147b09b18bfae8e"><enum>(2)</enum><text display-inline="yes-display-inline">$500,000,000 shall be for carrying out Mental Health Services Professional Demonstration Grants, in addition to amounts otherwise available for such purposes. </text></paragraph></appropriations-intermediate><appropriations-major commented="no" id="idBFF045613C464612AF1623FFC91A1CB9"><header display-inline="yes-display-inline">GENERAL PROVISIONS—THIS TITLE</header></appropriations-major><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idD5ACB19B6A834FF68CA27D42042B3300"><enum>22001.<?LEXA-Enum 22001.?></enum><text display-inline="yes-display-inline">None of the funds made available by this title may be transferred in this or any future fiscal year pursuant to the authority in section 205 or section 302 of the Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2022 (division H of <external-xref legal-doc="public-law" parsable-cite="pl/117/103">Public Law 117–103</external-xref>), or any successor provision in a subsequently enacted appropriations Act, or section 241(a) of the Public Health Service Act. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id12F876F7E4634209AFF5C9853594D9F6"><enum>22002.</enum><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretaries of Health and Human Services and Education shall each provide a detailed spend plan of anticipated uses of funds made available to their respective Departments in this title, including estimated personnel and administrative costs, to the Committees on Appropriations of the House of Representatives and the Senate: <proviso><italic>Provided,</italic></proviso> That such plans shall be updated and submitted to such Committees every 60 days until all funds are expended: <proviso><italic>Provided further,</italic></proviso> That the spend plans shall be accompanied by a listing of each contract obligation incurred that exceeds $5,000,000 which has not previously been reported, including the amount of each such obligation: <proviso><italic>Provided further,</italic></proviso> That the Committees on Appropriations of the House of Representatives and the Senate shall be briefed on obligations quarterly until all funds are expended. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3984D158187D4EEB9152D76F65528FCE"><enum>22003.</enum><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretaries of Health and Human Services and Education shall each provide biweekly obligation reports for funds made available to their respective Departments in this title, including anticipated uses of funds made available in this title, to the Committees on Appropriations of the House of Representatives and the Senate: <proviso><italic>Provided,</italic></proviso> That such reports shall be updated and submitted biweekly to the Committees until all funds are expended.</text></section></title><title commented="no" level-type="subsequent" id="id7E0D0C9B55CC41FE84E4DD3F38951488" style="appropriations"><enum>III</enum><header display-inline="no-display-inline">GENERAL PROVISIONS—THIS DIVISION</header><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id00F777A17091432FAEC77F04F28E5765"><enum>23001.</enum><text display-inline="yes-display-inline">Each amount appropriated or made available by this division is in addition to amounts otherwise appropriated for the fiscal year involved.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id000B2CC54CEC4719B636FF00892C61EF"><enum>23002.</enum><text display-inline="yes-display-inline">No part of any appropriation contained in this division shall remain available for obligation beyond the current fiscal year unless expressly so provided herein.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idB61E48F7C2B7463E8E2EE6867D065B6F"><enum>23003.</enum><text display-inline="yes-display-inline">Unless otherwise provided for by this division, the additional amounts appropriated by this division to appropriations accounts shall be available under the authorities and conditions applicable to such appropriations accounts for fiscal year 2022.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id53E6CB51BB29463CAE4A8667848EE735"><enum>23004.</enum><text display-inline="yes-display-inline">Each amount provided by this division is designated by the Congress as being for an emergency requirement pursuant to section 4001(a)(1) and section 4001(b) of S. Con. Res. 14 (117th Congress), the concurrent resolution on the budget for fiscal year 2022.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id1E100743BD96422D806D3E784CAB8F51"><enum>23005.</enum><subsection commented="no" display-inline="yes-display-inline" id="id1ee8dab523874a1cae66a6e87f1647e1"><enum>(a)</enum><header display-inline="yes-display-inline">Statutory PAYGO scorecards</header><text display-inline="yes-display-inline">The budgetary effects of each division of this Act shall not be entered on either PAYGO scorecard maintained pursuant to section 4(d) of the Statutory Pay As-You-Go Act of 2010.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide7df7cea632943e99fd04705f54971fd"><enum>(b)</enum><header display-inline="yes-display-inline">Senate PAYGO scorecards</header><text display-inline="yes-display-inline">The budgetary effects of each division of this Act shall not be entered on any PAYGO scorecard maintained for purposes of section 4106 of H. Con. Res. 71 (115th Congress).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id614c61d5134d4bdcab76a398633d9fc5"><enum>(c)</enum><header display-inline="yes-display-inline">Classification of budgetary effects</header><text display-inline="yes-display-inline">Notwithstanding Rule 3 of the Budget Scorekeeping Guidelines set forth in the joint explanatory statement of the committee of conference accompanying Conference Report 105–217 and section 250(c)(7) and (c)(8) of the Balanced Budget and Emergency Deficit Control Act of 1985, the budgetary effects of this division shall be estimated for purposes of section 251 of such Act and as appropriations for discretionary accounts for purposes of the allocation to the Committee on<pagebreak></pagebreak> Appropriations pursuant to section 302(a) of the Congressional Budget Act of 1974 and section 4001 of S.
