<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2928</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20211004">October 4, 2021</action-date><action-desc><sponsor name-id="S414">Mr. Ossoff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 245 of title 18, United States Code, to expand protections for election workers, polling places, and other election infrastructure against threats and violence.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Election Worker and Polling Place Protection Act</short-title></quote>.</text></section><section id="id1748CDD949D24D0698ED0BC5F7789C35"><enum>2.</enum><header>Federally protected activities</header><text display-inline="no-display-inline">Section 245 of title 18, United States Code, is amended—</text><paragraph id="id9F2469E791154CF58D98D67D1B664B70"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idC2BF30B0A29947F8A14F3EE641568CD5"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>willfully</quote> and inserting <quote>, or violence, or threat of harm to any person or property, intentionally</quote>;</text></subparagraph><subparagraph id="idCCA913ECE5CB4CD7A87BD2553121E281"><enum>(B)</enum><text>in paragraph (1)(A), by inserting <quote>, or any agent, contractor, or vendor of a legally authorized election official assisting in the administration of any primary, special, or general election</quote> before the semicolon at the end; and</text></subparagraph><subparagraph id="id9A43BAF21D1D4CCAACAC18EB88312D64"><enum>(C)</enum><text>in the undesignated matter following paragraph (5), by striking <quote>of this section</quote> each place it appears and inserting <quote>of this subsection</quote>; </text></subparagraph></paragraph><paragraph id="idAF2F623563494F619A0450BD7C8D1708"><enum>(2)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="id5E4A8E534309408BB1BE2B4373F5CD35"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF49B84FE158E48FFA9CCDA232371A9AF"><subsection id="idCE1C98E617A94E1C858E9684CF006B72"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAA13BA34E88C42C68244411C34DE5BC7"><enum>(1)</enum><text>Whoever, whether or not acting under color of law, intentionally physically damages or threatens to physically damage any physical property being used as a polling place or tabulation center or other election infrastructure shall be fined under this title, or imprisoned not more than 1 year, or both; and if bodily injury results from the acts committed in violation of this subsection or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined under this title, or imprisoned not more than 10 years, or both; and if death results from the acts committed in violation of this subsection or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years or for life, or both.</text></paragraph><paragraph id="idA5AFE7CAAEA840359754933749DBCEBE" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, de minimus damage or threats of de minimus damage to physical property, such as graffiti, shall not be considered a violation of paragraph (1).</text></paragraph><paragraph indent="up1" id="id6ECACEB94C1247FE899B75E9A3380CE2"><enum>(3)</enum><text>In this subsection, the term <term>election infrastructure</term> means any office of an election official, staff, worker, or volunteer or any physical, mechanical, or electrical device, structure, or tangible item used in the process of creating, distributing, voting, returning, counting, tabulating, auditing, storing, or other handling of voter registration or ballot information.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
