BILL</legis-type><official-title>To establish a commission to study the war in Afghanistan.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Afghanistan War Commission Act of 2021</short-title></quote>.</text></section><section id="id94353AC20F4F4299939DA2AC4B41C66F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id89D4545BFB22446A8F71B52CA46CCAE2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Applicable period</header><text>The term <quote>applicable period</quote> means the period beginning June 1, 2001, and ending August 30, 2021. </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id4F7FC6290D354DC8817BBE47578A100B"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph display-inline="no-display-inline" commented="no" id="id36445F41DCD3469FA89156F8BF70A016"><enum>(A)</enum><text>the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idF6A7AB606AD243C39AFC447E3462127F"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate; </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idB424F17388E940ADB11F6581D12E64CE"><enum>(C)</enum><text>the Select Committee on Intelligence of the Senate;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id6045720F579641B7BAEA27C9662F95A1"><enum>(D)</enum><text>the Committee on Armed Services of the House of Representatives;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idC10FA24D6121468EB9A748171F400F3C"><enum>(E)</enum><text>the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id0C76D29268D6486BB59419F9FB7558C3"><enum>(F)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id7A2F55EB22E84CB3B6B6D928E4781104"><enum>(3)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given that term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>).</text></paragraph></section><section id="idAC9D96ADCA9E497E9D5D46400D7DC8F8"><enum>3.</enum><header>Establishment of Commission</header><subsection id="ID9094F1A9C08E470F98EFD4A6441E648B"><enum>(a)</enum><header>Establishment</header><text>There is established the Afghanistan War Commission (in this Act referred to as the <quote>Commission</quote>).</text></subsection><subsection id="IDE532E66A39BA47A4B3C6C106FE7AFC3E"><enum>(b)</enum><header>Membership</header><paragraph id="ID98E88B9CDDD64A25924F418989203619"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of 13 members of whom—</text><subparagraph id="IDE6F671BFFDAC47D282F3BC3CDCD0B1E0"><enum>(A)</enum><text>1 shall be appointed by the President;</text></subparagraph><subparagraph id="ID709F34ABC9434AC48B155FB2D8DFA764"><enum>(B)</enum><text>1 shall be appointed by the Chairman of the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph id="id54C675FC44E3412A985E8FDD0B06CD33"><enum>(C)</enum><text>1 shall be appointed by the ranking member of the Committee on Armed Services of the Senate; </text></subparagraph><subparagraph id="id6C981422750D471684512B9562BA680D"><enum>(D)</enum><text>1 shall be appointed by the Chairman of the Committee on Armed Services of the House of Representatives; </text></subparagraph><subparagraph id="id5E639E892E6843CEAE35CF07D12A5BB0"><enum>(E)</enum><text>1 shall be appointed by the ranking member of the Committee on Armed Services of the House of Representatives;</text></subparagraph><subparagraph id="idB3C66AC6B21F4AC3AE02AEE0670CD7E5"><enum>(F)</enum><text>1 shall be appointed by the Chairman of the Committee on Foreign Relations of the Senate; </text></subparagraph><subparagraph id="id205C856F6AD24054832C09FA96CB6F5C"><enum>(G)</enum><text>1 shall be appointed by the ranking member of the Committee on Foreign Relations of the Senate; </text></subparagraph><subparagraph id="idE96910C7234B444B853A74C2648E5D21"><enum>(H)</enum><text>1 shall be appointed by the Chairman of the Committee on Foreign Affairs of the House of Representatives;</text></subparagraph><subparagraph id="id8BD8F5350B55472D85D4AE41F8314A25"><enum>(I)</enum><text>1 shall be appointed by the ranking member of the Committee on Foreign Affairs of the House of Representatives;</text></subparagraph><subparagraph id="idEF818CE2F6BE4A12BCE72C6FA02FC1CB"><enum>(J)</enum><text>1 shall be appointed by the Chairman of the Select Committee on Intelligence of the Senate; </text></subparagraph><subparagraph id="idBBF512559EC045A6B7BE68A3FA8E841B" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text>1 shall be appointed by the ranking member of the Select Committee on Intelligence of the Senate; </text></subparagraph><subparagraph id="idAE7480D9B1BC495CB6645CE721213DE4"><enum>(L)</enum><text>1 shall be appointed by the Chairman of the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph><subparagraph id="id79276ED855044843BD969799E80E644E"><enum>(M)</enum><text>1 shall be appointed by the ranking member of the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="ID4217AF69D0CB4807A61C9A1A978EFD7C"><enum>(2)</enum><header>Qualifications</header><text>It is the sense of Congress that each member of the Commission appointed under paragraph (1) should have significant professional experience from a position in—</text><subparagraph id="idDB31A620D1B64A59872F6AF89EEE55B2"><enum>(A)</enum><text>the Department of Defense; </text></subparagraph><subparagraph id="id523F71932C6F4721971550D376FFAA09"><enum>(B)</enum><text>the Department of State; </text></subparagraph><subparagraph id="id7E44252AD9CC4B5AB2B3946D68132B12"><enum>(C)</enum><text>the intelligence community; or</text></subparagraph><subparagraph id="idB484E9A15F9346A09D5918FE529ACA37"><enum>(D)</enum><text>the United States Agency for International Development.</text></subparagraph></paragraph><paragraph id="idD723F882DD9E4219A19A1E6C4D9B4F02"><enum>(3)</enum><header>Prohibitions</header><text>A member of the Commission appointed under paragraph (1) may not— </text><subparagraph id="idDD31A3A601A043958847CF64507E5171"><enum>(A)</enum><text>be a current or former member of Congress;</text></subparagraph><subparagraph id="id99C5BB40138647878591DDAFB2567E18"><enum>(B)</enum><text>have served in military or civilian positions having significant operational or strategic responsibilities in Afghanistan during the applicable period; or</text></subparagraph><subparagraph id="id800717B4ECEE4BFEB235D489B952D13B"><enum>(C)</enum><text>have been a party to any United States or coalition defense contract during the applicable period.</text></subparagraph></paragraph><paragraph id="ID4F911B8DB59248E29F059E5131713461" commented="no"><enum>(4)</enum><header>Date</header><text>The appointments of the members of the Commission shall be made not later than 60 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="ID49FC1DF7437F4D65827F32F3B59A5C61" commented="no"><enum>(c)</enum><header>Period of appointment; vacancies</header><paragraph id="id074CAA8C186848F69A84BF8EB7E8B53B" commented="no"><enum>(1)</enum><header>In general</header><text>A member of the Commission shall be appointed for the life of the Commission. </text></paragraph><paragraph id="id2ABA6BEF0A7647CD9CF8FFBE31E586FA" commented="no"><enum>(2)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text><subparagraph id="id76B0CB8404734FF6A1DF2A252ED8694F" commented="no"><enum>(A)</enum><text>shall not affect the powers of the Commission; and</text></subparagraph><subparagraph id="id484DA57A7CD74ED1BC86CBF65528ABB5" commented="no"><enum>(B)</enum><text>shall be filled in the same manner as the original appointment.</text></subparagraph></paragraph></subsection><subsection id="idCF0A1C97534F42D0AE40072C4235EF91" commented="no"><enum>(d)</enum><header>Meetings</header><paragraph id="ID713A12DE7D79416DBEBDD4057F256299" commented="no"><enum>(1)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed, the Commission shall hold the first meeting of the Commission.</text></paragraph><paragraph id="ID67F067576FFC463A842A5F7DA6A093C8" commented="no"><enum>(2)</enum><header>Frequency</header><text>The Commission shall meet at the call of the Chairperson.</text></paragraph><paragraph id="ID7A3C368FA83449AD90220C7B181165BB" commented="no"><enum>(3)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text></paragraph></subsection><subsection id="ID79CF96D103FD4274ADF268D788E44827"><enum>(e)</enum><header>Chairperson and Vice Chairperson</header><text>The Commission shall select a Chairperson and a Vice Chairperson from among the members of the Commission.</text></subsection></section><section id="id71D579D25A4349199A3268A95E67C466"><enum>4.</enum><header>Purpose of Commission</header><text display-inline="no-display-inline"> The purpose of the Commission is to examine the war in Afghanistan, create strategic and grand strategic lessons learned, and develop recommendations for the Government of the United States and future policymakers and senior military decision makers in the United States.</text></section><section id="ID1BEFE42505154C978032F979F250D7A9"><enum>5.</enum><header>Duties of Commission</header><subsection id="ID788980AB1AD147B0BAC1850A124EAF38"><enum>(a)</enum><header>Study</header><paragraph id="id62AF15664933400A884F2E0F46F8F096"><enum>(1)</enum><header>In general</header><text>The Commission shall conduct a thorough study of all matters relating to combat operations, reconstruction and security force assistance activities, intelligence operations, and diplomatic activities of the United States pertaining to the war in Afghanistan. </text></paragraph><paragraph id="id6E48BBCE5AC64C5883CC64BB7B98FD19"><enum>(2)</enum><header>Matters Studied</header><text>The matters studied by the Commission shall include—</text><subparagraph id="id1538074F12CB4B9E8AF7940B8E55D874"><enum>(A)</enum><text>the activities and actions of the United States immediately prior to the attacks on September 11, 2001, and during the initial invasion of Afghanistan by the United States;</text></subparagraph><subparagraph id="id51ED99DE14E14BA19F30E767126A376E"><enum>(B)</enum><text>the resurgence of the Taliban during the applicable period;</text></subparagraph><subparagraph id="idD0165ADD167F4CCAA5B800647C9A689E"><enum>(C)</enum><text>the transition to security force assistance and counter-terrorism operations in Afghanistan;</text></subparagraph><subparagraph id="idA544A982F2654058938AF90835FAED38"><enum>(D)</enum><text>peace negotiations involving the United States, the Islamic Republic of Afghanistan, and the Taliban; and</text></subparagraph><subparagraph id="idE9911B153AE04D96903915EBAD931C94"><enum>(E)</enum><text>the withdrawal of the United States military from Afghanistan.</text></subparagraph></paragraph><paragraph id="idB7CAC0F40DDA4C819C2AE95802ABBE39"><enum>(3)</enum><header>Contents</header><text>The study required under paragraph (1) shall include the following elements:</text><subparagraph id="id364635853DBD4B87889DC838D1549BDB"><enum>(A)</enum><text>An analysis of the political and strategic decisions that influenced—</text><clause id="idBB5750735D1B4F2EB70BDFF0D038D65D"><enum>(i)</enum><text>interactions of the Government of the United States with the Government of Afghanistan; </text></clause><clause id="idBA7C1BE4F4954C97812ADABD8CB97A6C"><enum>(ii)</enum><text>the strategic objectives of the war during the applicable period; </text></clause><clause id="idC9A62DF5A10F4D7E87D962C8B4B8496A"><enum>(iii)</enum><text>the number of members of the Armed Services in Afghanistan during the applicable period; and</text></clause><clause id="idB7A37975C0B2403B8DFF2F338C6221C7"><enum>(iv)</enum><text>measures of effectiveness used for measuring progress towards strategic objectives. </text></clause></subparagraph><subparagraph id="idEE309075ED8B465290DB74C3DA3B2DD9"><enum>(B)</enum><text>A statement addressing the military, diplomatic, and intelligence interactions of the United States with Pakistan during the applicable period.</text></subparagraph><subparagraph id="id0D9D1D2FF9BC4ACDB6FA34F73449CD4C" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>An examination of the participation in the war in Afghanistan by member states of the North Atlantic Treaty Organization.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id32E012A9BEC042ADA159DE2290B2B12A"><enum>(D)</enum><text>An examination of the long-term impact of the war in Afghanistan on government institutions in the United States.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id3EBDD864EF7846E4A97C240D43D35089"><enum>(E)</enum><text>A description of any other matters that the Commission determines significantly affected the conduct and the outcome of the war in Afghanistan.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id356D3ACCE0614DFC90241F4058C74D4B"><enum>(F)</enum><text>Recommendations for legislation and administrative actions to address any mistakes in the conduct of the war in Afghanistan identified by the Commission.</text></subparagraph></paragraph></subsection><subsection id="ID5ACA7C0C1D834A10AC71A79903A1D294"><enum>(b)</enum><header>Report required</header><paragraph id="id1AE8A659D63E4E63B38F3CA341B4812F"><enum>(1)</enum><header>In general</header><subparagraph id="idA26E127DF4C64913B7C0ED190F7CA3D0"><enum>(A)</enum><header>Annual report</header><text>Not later than 1 year after the date of the initial meeting of the Commission, and annually thereafter, the Commission shall submit to the appropriate congressional committees a report describing the progress of the Commission.</text></subparagraph><subparagraph id="id2B9428F39FE841D1AF634F00E2C0363B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Final report</header><text>Not later than 4 years after the date of the initial meeting of the Commission, the Commission shall submit to the President and Congress a report that contains a detailed statement of the findings and conclusions of the Commission, together with the recommendations of the Commission.</text></subparagraph></paragraph><paragraph id="idD722941911704EE7943B73D386EE3624"><enum>(2)</enum><header>Form</header><text>The report required by paragraph (1)(B) shall be submitted and publicly released on a Government website in unclassified form but may contain a classified annex. </text></paragraph></subsection></section><section id="IDBF35816E08534CFC835DB84FCD77111A"><enum>6.</enum><header>Powers of Commission</header><subsection id="ID78DA905C4EAE49B0AF74CB57183B6E1A"><enum>(a)</enum><header>Hearings</header><text>The Commission may hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers advisable to carry out this Act.</text></subsection><subsection commented="no" id="id385B0BF713C84647989A51A8BF846505"><enum>(b)</enum><header>Assistance from Federal agencies</header><paragraph commented="no" id="id6CFF3D1F0F4C47AC8217BC1B0912A80B"><enum>(1)</enum><header>Information</header><subparagraph commented="no" id="id03B4F3592AD44AC5BB98277E37F689C3"><enum>(A)</enum><header>In general</header><text>The Commission may secure directly from a Federal department or agency such information as the Commission considers necessary to carry out this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEEC5F6AA1ADB46588943EF27D3AC4D94"><enum>(B)</enum><header>Furnishing information</header><text>On request of the Chairperson of the Commission, the head of the department or agency shall expeditiously furnish the information to the Commission.</text></subparagraph></paragraph><paragraph id="id07D6FB316FC942FEBB92084820102194"><enum>(2)</enum><header>General services</header><text>Upon the request of the Commission, the Administrator of General Services shall provide to the Commission, on a reimbursable basis, the administrative support services and office space necessary for the Commission to carry out its purposes and functions under this Act.</text></paragraph></subsection><subsection id="ID697F1CDBA8724CB4AD225E5D97B10BD6" commented="no"><enum>(c)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the Federal Government.</text></subsection><subsection id="IDCC4D9C4DC9ED4F319C2D4949548B9F15"><enum>(d)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text></subsection></section><section id="ID5B2226B82D614F6AA60C08533C1FED30"><enum>7.</enum><header>Commission personnel matters</header><subsection id="IDF9E4CF3EA6AC4F01B81923D97C022F5A"><enum>(a)</enum><header>Compensation of members</header><text>A member of the Commission who is not an officer or employee of the Federal Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the Commission.</text></subsection><subsection id="ID8AB9CAB7544542CBBCD32562861B7980" commented="no"><enum>(b)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission. </text></subsection><subsection id="ID771CB422D4684EF88424586CBA7942C6"><enum>(c)</enum><header>Staff</header><paragraph id="ID99AD8891AD904A7EBF3A1D3EE5A99435"><enum>(1)</enum><header>In general</header><text>The Chairperson, in consultation with the Vice Chairperson of the Commission, may, without regard to the civil service laws (including regulations), appoint and terminate an executive director and such other additional personnel as may be necessary to enable the Commission to perform its duties, except that the employment of an executive director shall be subject to confirmation by the Commission.</text></paragraph><paragraph id="id98F90A33D3F246ABB75C9BEBD7B63603"><enum>(2)</enum><header>Qualifications for personnel</header><text>The Chairperson and the Vice Chairperson of the Commission shall give preference in such appointments under paragraph (1) to individuals from academic backgrounds, and former military personnel should include representation from the reserve components.</text></paragraph><paragraph id="IDB23DD631FF0E49B589B943F8049F018B"><enum>(3)</enum><header>Compensation</header><text>The Chairperson, in consultation with the Vice Chairperson of the Commission, may fix the compensation of the executive director and other personnel without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the executive director and other personnel may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title.</text></paragraph></subsection><subsection id="idB4694BEB7DFB4B548F1D2D75F4DADAD5"><enum>(d)</enum><header>Detail of government employees</header><text>A Federal Government employee may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></subsection><subsection id="IDD761928855434025A0BC6D8D636885FE"><enum>(e)</enum><header>Procurement of temporary and intermittent services</header><text>The Chairperson, in consultation with the Vice Chairperson of the Commission, may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, at rates for individuals that do not exceed the daily equivalent of the annual rate of basic pay prescribed for level V of the Executive Schedule under section 5316 of that title.</text></subsection></section><section id="ID8E18677BEB06432BA5DE4BCFA806C638"><enum>8.</enum><header>Termination of Commission</header><text display-inline="no-display-inline">The Commission shall terminate 90 days after the date on which the Commission submits the report required under section 5(b).</text></section><section id="IDC0F48F3EB7C340C9BB05BD65FEBEFDFD"><enum>9.</enum><header>Authorization of appropriations</header><subsection id="ID63EE352E9DFE40EB9A3B30CEEB859169"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to the Commission such amounts as necessary to carry out activities under this Act.</text></subsection><subsection id="ID6A19DE8CCE8E4896A5BC5FC109FC57BD" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Availability</header><text>Any sums appropriated under the authorization contained in this section shall remain available, without fiscal year limitation, until the date of the termination of the Commission under section 8.</text></subsection></section></legis-body></bill>
