which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Federal tort against social media companies that cause bodily injury to children or harm the mental health of children.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Big Tech Tort Act</short-title></quote>.</text></section><section id="idBE22665EECEA468D97AAC26AB266B266"><enum>2.</enum><header>Federal tort for social media harm to children</header><subsection id="id198A3428E5504E91A42CE8B8A674084D"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id21F08FD4EE914BD28F492949B7573AFC"><enum>(1)</enum><text>the term <term>covered interactive computer service</term> means an interactive computer service—</text><subparagraph id="id700c800ac95b481a94d374b28c1804a6"><enum>(A)</enum><text>provided through a website, online application, or mobile application (including a single interactive computer service that is provided through more than one such website or application);</text></subparagraph><subparagraph id="id08e153274be0440b99c05c4c076a94dc"><enum>(B)</enum><text>through which information provided by another information content provider is distributed;</text></subparagraph><subparagraph id="id33a1c65d3bb74e54b52ba871917c8ca6"><enum>(C)</enum><text>that enables an individual user to create an account for the purpose of viewing, generating, or modifying content that can be viewed, shared, or otherwise interacted with by other third-party users of the interactive computer service; and</text></subparagraph><subparagraph id="idb875c84773494e94be65a93b336419f0" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>that does not have peer-to-peer messaging as its principal function;</text></subparagraph></paragraph><paragraph id="id53F5CBDDA616470F86F22A63B3ADE003"><enum>(2)</enum><text>the term <term>interactive computer service</term> has the meaning given the term in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>); and</text></paragraph><paragraph id="id1789EF056359441D838E5D71EF4B450C"><enum>(3)</enum><text>the term <term>social media company</term>—</text><subparagraph id="id4416CCD24C4349CDB0BB15B8F168DD06"><enum>(A)</enum><text>means a company that provides, in or affecting interstate or foreign commerce, a covered interactive computer service; and</text></subparagraph><subparagraph id="id8662C7447AC24EFEB301224F519A3539"><enum>(B)</enum><text>does not include an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code.</text></subparagraph></paragraph></subsection><subsection id="id72F4E7CE776044958F8E113AB64305C6"><enum>(b)</enum><header>Liability</header><text>A social media company shall be liable in accordance with this section to any individual who suffers bodily injury or harm to mental health that is attributable, in whole or in part, to the individual's use of a covered interactive computer service provided by the social media company when the individual was less than 16 years of age.</text></subsection><subsection id="id24C44B523A474263BBF0783C96962FBD"><enum>(c)</enum><header>Private right of action</header><text>An individual who suffers bodily injury or harm to mental health that is attributable, in whole or in part, to the individual's use of a covered interactive computer service provided by a social media company as described in subsection (b) may bring a civil action against the social media company in an appropriate district court of the United States or a State court of competent jurisdiction for—</text><paragraph id="id1042FDCF4BF04347B77913FBEB0C1AA7"><enum>(1)</enum><text>compensatory damages in an amount equal to the greater of—</text><subparagraph id="idDA24C9B4C98B4DB882DE485CA43D8266"><enum>(A)</enum><text>the amount obtained by—</text><clause id="id7DDEE4D13FD1407E8E6EECA26D38BDE2"><enum>(i)</enum><text>for each year in which the individual suffered such injury or harm attributable, in whole or in part, to such use, dividing—</text><subclause id="id30537D635CEE4915866836ED8CDE3F8A"><enum>(I)</enum><text>the annual revenue of the social media company in the United States during that year, by</text></subclause><subclause id="id1D69256E75C84D69997AB543690185B5"><enum>(II)</enum><text>the number of active users of the covered interactive computer service during the month that had the fewest such users during that year; and</text></subclause></clause><clause id="id37E43C4734E0462B995F260D37741F13"><enum>(ii)</enum><text>adding together the amounts calculated under clause (i) for each year in which the individual suffered such injury or harm attributable, in whole or in part, to such use; or</text></clause></subparagraph><subparagraph id="id64FEFDC913BE4C508C0084641F487A9F"><enum>(B)</enum><text>actual damages;</text></subparagraph></paragraph><paragraph id="id897BE2C4DC9C40438C3BD8B1599C5106"><enum>(2)</enum><text>punitive damages; and</text></paragraph><paragraph id="id829AA0E647F14F8E80BC459ADF53D08D"><enum>(3)</enum><text>attorney's fees and costs.</text></paragraph></subsection><subsection id="id6002DDCA82004CFEB1A230716E6E6C4F"><enum>(d)</enum><header>Affirmative defense</header><text>It shall be an affirmative defense to an action brought by or on behalf of a user of a covered interactive computer service provided by a social media company under subsection (c) that the social media company, at all relevant times—</text><paragraph id="id9F8B428CC4834DF794DE15074FD2026B"><enum>(1)</enum><text>took reasonable, affirmative steps to ascertain the age of each user of the covered interactive computer service; and</text></paragraph><paragraph id="id7EA41C5E998F423683F6930D386167CF"><enum>(2)</enum><text>did not know and had no reason to know that the user in question was less than 16 years of age when the user used the interactive computer service.</text></paragraph></subsection><subsection id="id037016AD3DE94A07BFF732A05437C3D0"><enum>(e)</enum><header>Effective date; applicability</header><text>This Act—</text><paragraph id="idAD6F87AB121C46DFB4A8AC2978450F32"><enum>(1)</enum><text>shall take effect on the date that is 180 days after the date of enactment of this Act; and</text></paragraph><paragraph id="id58FD3A7A601D4F288EEF651C507D652A"><enum>(2)</enum><text>shall not apply to any use of a covered interactive computer service that took place before the effective date under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
