<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2895</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210929">September 29, 2021</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> (for himself, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S345">Mr. Johnson</cosponsor>, <cosponsor name-id="S346">Mr. Lee</cosponsor>, and <cosponsor name-id="S411">Mr. Marshall</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Department of Transportation and other agencies from promulgating rules requiring a person to provide proof of COVID–19 vaccination in order to engage in interstate commerce or travel, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Unconstitutional Vaccine Mandates for Interstate Commerce Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id8A593BE2570D45A5977287147B7FAEA7"><enum>2.</enum><header>Prohibition on proof of COVID–19 vaccination requirements</header><subsection id="id5A9E727BEB9C424898FFDB8A985F8E0C"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, an agency or department described in subsection (b) may not promulgate any rule to require a person to provide proof of COVID–19 vaccination of any kind in order to engage in interstate commerce or travel. </text></subsection><subsection id="idB992E0DEB1514940BBE1585700C60ADB"><enum>(b)</enum><header>Agencies and departments described</header><text>An agency or department referred to in subsection (a) is any of the following:</text><paragraph id="id98F9CEC70A5A4F44B0C9BB92522A1A5E"><enum>(1)</enum><text>The Department of Transportation. </text></paragraph><paragraph id="id9D32C7F67F80429B991E94AF2E6AA184"><enum>(2)</enum><text>The National Railroad Passenger Corporation (commonly referred to as <quote>Amtrak</quote>).</text></paragraph><paragraph id="id04B25C930ED94A76A78DCDE69C56B21D"><enum>(3)</enum><text>The Surface Transportation Board. </text></paragraph><paragraph id="idDBA42C4622664FB48BBD98EE8B49DF8E"><enum>(4)</enum><text>The Transportation Security Administration. </text></paragraph><paragraph id="id0A170F73C2CC4CEEA868703D8926DD67"><enum>(5)</enum><text>The National Transportation Safety Board. </text></paragraph><paragraph id="id8CE6ECF13F43487E84B824AC08B0B451"><enum>(6)</enum><text>The Federal Maritime Commission. </text></paragraph><paragraph id="id81D0DA42DBB84073B0BACF2FA011E225"><enum>(7)</enum><text>The Department of Commerce. </text></paragraph></subsection><subsection id="id8534901D66524425A48BD82FF552AB55"><enum>(c)</enum><header>Limitation on the use of HHS suspension of entries and imports authority</header><text>Section 361(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264(e)</external-xref>) is amended by adding at the end the following: <quote>Nothing in this section shall be construed to authorize the Secretary of Health and Human Services to mandate vaccination against COVID–19 as a prerequisite for engaging in interstate commerce or travel.</quote>.</text></subsection></section></legis-body></bill>
