which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 35, United States Code, to address matters relating to the Patent Trial and Appeal Board of the United States Patent and Trademark Office, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring the America Invents Act</short-title></quote>.</text></section><section id="id54DFE93A1B0745E195824AF9178DCC7D"><enum>2.</enum><header>Patents</header><text display-inline="no-display-inline">Title 35, United States Code, is amended—</text><paragraph id="idF37255F581E842E293303AD3C4483C65"><enum>(1)</enum><text>in section 6—</text><subparagraph id="idDD99CCDAB8554D8B8ABB33789DD5AEB6"><enum>(A)</enum><text>in subsection (c)— </text><clause id="idFE7AA1943D684B0EA443B1046132E6D6"><enum>(i)</enum><text>in the second sentence, by striking <quote>Only the</quote> and inserting <quote>The</quote>; and</text></clause><clause id="id86D1CB809EC544D2986375577AE6FFCC"><enum>(ii)</enum><text>by adding at the end the following: <quote>After the constitution of a panel of the Patent Trial and Appeal Board under this subsection has been made public, any changes to the constitution of that panel shall be noted in the record.</quote>;</text></clause></subparagraph><subparagraph id="id95398CC80DF7479C9088072F031458CA"><enum>(B)</enum><text>by redesignating subsection (d) as subsection (e); </text></subparagraph><subparagraph id="id870E8BC99F8F4178984D6F0CAF110FA2"><enum>(C)</enum><text>by inserting after subsection (c) the following:</text><quoted-block id="idB2D569037FD04B32B4528D3A05FA144D" style="OLC" act-name=""><subsection id="id0546F809E4A742F7889119A9B6934FC2"><enum>(d)</enum><header>Review by Director</header><paragraph id="idA84EDB7126DC43578BB3DDDC0D3D5850"><enum>(1)</enum><header>In general</header><text>With respect to a final decision of the Patent Trial and Appeal Board—</text><subparagraph id="idF049861D307342EC9980F7C8BE2E19F0"><enum>(A)</enum><text>the Director may, on the initiative of the Director, review, and modify or set aside, the decision; and</text></subparagraph><subparagraph id="id24EB2EA46A774BCF8512C2F73CB977AB"><enum>(B)</enum><text>if the decision is issued under section 318 or 328, a party to the applicable inter partes or post-grant review may request that the Director review, and modify or set aside, the decision.</text></subparagraph></paragraph><paragraph id="id9683CBECC9F94B1286B6576F56D6F4BE"><enum>(2)</enum><header>Requirement</header><text>Any review by the Director under paragraph (1) shall be issued in a separate written opinion that—</text><subparagraph id="id0F91371F02604AD48BC9A7F4CC0FAD60"><enum>(A)</enum><text>is made part of the public record; and</text></subparagraph><subparagraph id="id7BBDA7708FFD409EAFD0E2215FCF5FF5"><enum>(B)</enum><text>sets forth the reasons for the review, modification, or setting aside of the final decision of the Patent Trial and Appeal Board.</text></subparagraph></paragraph><paragraph id="idEFD1F8A6789C43E5BAD5D5C8D3D93E80"><enum>(3)</enum><header>Timeline and bases for review</header><text>Not later than 18 months after the date of enactment of the <short-title>Restoring the America Invents Act</short-title>, the Director shall promulgate rules addressing the following issues:</text><subparagraph id="idE7C2F4CBFC5241559E6FE38E03CC005E"><enum>(A)</enum><text>With respect to review of a decision on the initiative of the Director under paragraph (1)(A)—</text><clause id="id7B0247978C854D6F9AAE051362D91B75"><enum>(i)</enum><text>the timeline under which the Director may review the decision, which shall be consistent with the requirements under section 318(e) or 328(e), if applicable; and</text></clause><clause id="id1C4B219F160C410EA1BC14BA58571CBC"><enum>(ii)</enum><text>the bases on which the Director may review the decision. </text></clause></subparagraph><subparagraph id="id372E836327914F01A3F0E12492A46718"><enum>(B)</enum><text>With respect to a request by a party under paragraph (1)(B)—</text><clause id="idC4F21D642837413DB5BF40E35868D7D5"><enum>(i)</enum><text>the timeline for submitting such a request;</text></clause><clause id="id91B60FC4B7BA4884861577BCEA71D834"><enum>(ii)</enum><text>the content that the party is required to include in such a request; </text></clause><clause id="idF6B4EC55CD21437696336FB4B427FA52"><enum>(iii)</enum><text>the bases on which the party may submit such a request; and</text></clause><clause id="id09E35D616DF943979B0DC3ECEE97290A"><enum>(iv)</enum><text>the timeline for any response or reply to such a request such that the request can be decided within the deadline imposed under section 318(e) or 328(e), as applicable.</text></clause></subparagraph></paragraph><paragraph id="idF869C395D7F3476FAA4EEDD9372E0964"><enum>(4)</enum><header>Rule of construction</header><text>For the purposes of an appeal permitted under section 141, any decision on review issued by the Director under this subsection shall be deemed a final decision of the Patent Trial and Appeal Board.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id38C3B870698F48C38B59ED1AEC48BD1F"><enum>(D)</enum><text>in subsection (e), as so redesignated—</text><clause id="id142C81072FD94A55BD541F13D2557153"><enum>(i)</enum><text>in the first sentence— </text><subclause id="idB974BA1A47064A5D944CB25E6D5CA90A"><enum>(I)</enum><text>by striking <quote>of this subsection</quote> and inserting <quote>of the <short-title>Restoring the America Invents Act</short-title></quote>;</text></subclause><subclause id="idFED817F9A03542EDA6942106A674B23A"><enum>(II)</enum><text>by inserting <quote>or the Secretary</quote> after <quote>appointment by the Director</quote>; and</text></subclause><subclause id="id781BDC73F4FE4C3894B351F23A753051"><enum>(III)</enum><text>by inserting <quote>or the Secretary, as applicable,</quote> after <quote>on which the Director</quote>; and</text></subclause></clause><clause id="id1E9EA932018A415DB8E8CD9721FDACF0"><enum>(ii)</enum><text>in the second sentence—</text><subclause id="id3DD7B3469E314C0493FF5822504A6960"><enum>(I)</enum><text>by inserting <quote>, or, before the date of enactment of the <short-title>Restoring the America Invents Act</short-title>, having performed duties no longer performed by administrative patent judges,</quote> after <quote>by the Director</quote>; and</text></subclause><subclause id="id879A0A7F32FF49EB942B5910B41743A8"><enum>(II)</enum><text>by striking <quote>that the administrative patent judge so appointed</quote> and inserting <quote>that the applicable administrative patent judge</quote>;</text></subclause></clause></subparagraph></paragraph><paragraph id="idD7140EA393A541019CD6A701AE3C3346"><enum>(2)</enum><text>in section 302, in the first sentence, by inserting <quote>, including a governmental entity,</quote> after <quote>A person</quote>;</text></paragraph><paragraph id="id6A3DC04BC9524F90A3F589BBCB8AFFAB"><enum>(3)</enum><text>in chapter 31—</text><subparagraph id="id38EE4405376843248147E644DD3B18F0"><enum>(A)</enum><text>in section 311—</text><clause id="idC51926DC2FA44D5AB64DFA00F4B1BB2E"><enum>(i)</enum><text>in subsection (a), in the first sentence, by inserting <quote>, including a governmental entity,</quote> after <quote>a person</quote>; and</text></clause><clause id="idC8AA8CCD29D74BD59A8CEC59C484B00F"><enum>(ii)</enum><text>in subsection (b), by striking <quote>under section 102</quote> and all that follows through the period at the end and inserting the following: “under—</text><quoted-block id="id76C39E567878475792F2ED09F69D56D2" style="OLC" act-name=""><paragraph id="idABABF81950774B67B06CE5B9C64B5CBA"><enum>(1)</enum><text>section 102 or 103 and only on the basis of—</text><subparagraph id="idF59AA2C2D79F4B45BB4BD36867208D13"><enum>(A)</enum><text>prior art consisting of patents or printed publications; or</text></subparagraph><subparagraph id="id390FC29F650B4EE1AD3E210F33E06E4A"><enum>(B)</enum><text>admissions in the patent specification, drawings, or claims; or</text></subparagraph></paragraph><paragraph id="id3F201DF723B646849CA5CE9C6AE40EE1"><enum>(2)</enum><text>statutory or obviousness-type double patenting on the basis of—</text><subparagraph id="idAEC913567D18497095E3F1E6851A5100"><enum>(A)</enum><text>patents or printed publications; or</text></subparagraph><subparagraph id="idB766815CE29845E08D5C395E003C37B5"><enum>(B)</enum><text>admissions in the patent specification, drawings, or claims.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idE82F1590D2B04A159A2A50DBE283DB7C"><enum>(B)</enum><text>in section 314—</text><clause id="idBCEA17C7F435438EA7A69AA3BA7A1940"><enum>(i)</enum><text>in subsection (a), by striking <quote>The Director may not authorize an inter partes review to be instituted unless</quote> and inserting the following: <quote>Subject only to the discretion of the Director under section 325(d)(4), a petition that meets the requirements of this chapter shall be instituted if</quote>; and</text></clause><clause id="id716A4674244B4C75ABBAA994E265C192"><enum>(ii)</enum><text>in subsection (d)—</text><subclause id="id36E4D40E0D204A4EAB70875A22F30E2B"><enum>(I)</enum><text>by inserting <quote>or maintain</quote> after <quote>to institute</quote>; and</text></subclause><subclause id="idE41E364525EC4D83BE0EA81B7D4212AE"><enum>(II)</enum><text>by striking <quote>section</quote> and inserting <quote>chapter</quote>;</text></subclause></clause></subparagraph><subparagraph id="idD0573874CA4F4C829F242A5949C81A34"><enum>(C)</enum><text>in section 315—</text><clause id="id79547E0373F8437EAAF7A49D0E907120"><enum>(i)</enum><text>in subsection (a)(1)— </text><subclause id="idFD78C4E8BF8E4FF28A5C080E7BD57CB7"><enum>(I)</enum><text>by striking <quote>An inter partes</quote> and inserting the following:</text><quoted-block id="id934756653E70485DAB2890A2C8E3B5F2" style="OLC" act-name=""><subparagraph id="id25F6EE30458742A9BFA2BF7716643E86"><enum>(A)</enum><header>In general</header><text>An inter partes</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="id4A48E38DF5544E5A98AC2A4194CF4712"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block id="idF3D7FC3EA8294A37A56C310E9AC0140B" style="OLC" act-name=""><subparagraph id="idE2CFA3000F754A7FB2A99C7FC2626489"><enum>(B)</enum><header>Rule of construction</header><text>Subparagraph (A) may not be construed to prevent an inter partes review from being instituted if a complaint in a civil action described in that subparagraph has been dismissed without prejudice.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="id3B78FA0479B64FD08BCE15D4729FF7A2"><enum>(ii)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4B71FD8EC40A49B68A1DE2D470508E93"><subsection id="idFFEE50DA06D443738A17C9FA109C0915"><enum>(b)</enum><header>Patent owner’s action</header><paragraph id="idE1CE4EF5A4DE49479FD22DC95CC094B7"><enum>(1)</enum><header>In general</header><text>An inter partes review may not be instituted if the petition requesting the proceeding is filed more than 1 year after the date on which the petitioner, real party in interest, or privy of the petitioner is served with a complaint alleging infringement of the patent. The time limitation set forth in the preceding sentence shall be subject to the following limitations: </text><subparagraph id="idE263F732CF964535A37DE27EE4EA0C3D"><enum>(A)</enum><text>The time limitation shall not apply— </text><clause id="idDAAA46EE08D3400D9CCB82704E1B54EF"><enum>(i)</enum><text>to a request for joinder under subsection (c); or</text></clause><clause id="id87306A8BA7C7498EBB2754FFEA5EADB8"><enum>(ii)</enum><text>if the complaint is dismissed without prejudice.</text></clause></subparagraph><subparagraph id="id32BE0677BD304110AAC3E5B4CF3E3DF4"><enum>(B)</enum><text>If new or amended claims issue from reexamination after the petitioner, real party in interest, or privy of the petitioner is served with the complaint, an inter partes review of those claims may be instituted if the petition requesting the review is filed not later than 1 year after the date on which the challenged claims are asserted in the action.</text></subparagraph></paragraph><paragraph id="id817F41C67AF541E0A0094F3B764FD2EF"><enum>(2)</enum><header>Request for stay</header><subparagraph id="id1DA550FFE0624514A87B467A6AB65AAE"><enum>(A)</enum><header>In general</header><text>If a party seeks a stay of a civil action brought under section 281 alleging infringement of a patent that is also subject to an inter partes review, the court shall decide whether to stay the civil action based on whether—</text><clause id="id5AA2332F7BB841E98C942528E444559D"><enum>(i)</enum><text>the outcome of the inter partes review will likely simplify the issues in question in the civil action and streamline the proceedings in the civil action;</text></clause><clause id="idDE03AAF8C6524E769DEEC0CDBE1A69FF"><enum>(ii)</enum><text>as of the date on which the stay is requested, discovery in the civil action is complete;</text></clause><clause id="idE9B8530C09654C81B37C7B9DCAAEE1B2"><enum>(iii)</enum><text>a stay, or the denial thereof, would— </text><subclause id="idA25C125F8580466287F89BB1A9D1BF6A"><enum>(I)</enum><text>unduly prejudice the nonmoving party; or </text></subclause><subclause id="idBB7C62A1B4E243118CB1B36E5E3F3F48"><enum>(II)</enum><text>present a clear tactical advantage for the moving party; and</text></subclause></clause><clause id="id92BFA675C34546B4A13C854360D1E4EE"><enum>(iv)</enum><text>a stay, or the denial thereof, will reduce the burden of litigation on the parties to the civil action and the court.</text></clause></subparagraph><subparagraph id="id722E664582AD484FBE4CF11A469F1F7F"><enum>(B)</enum><header>Review</header><text>A party may take an immediate interlocutory appeal from the decision of a district court of the United States under subparagraph (A). The United States Court of Appeals for the Federal Circuit shall review the district court’s decision to ensure consistent application of established precedent, and such review shall be de novo.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idDB9C0C3C400241A28FCA0A640566598D"><enum>(iii)</enum><text>in subsection (c)—</text><subclause id="id2FBC7C878BB643689C04992D49268744"><enum>(I)</enum><text>by striking <quote>If the Director</quote> and inserting the following:</text><quoted-block id="id9A6DC0E33BCE4B3FA3D5882F8A9CD682" style="OLC" act-name=""><paragraph id="idC8D113FFF0574C68B0F071D3C69DC009"><enum>(1)</enum><header>In general</header><text>If the Director</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="id412A6A2961814E26BEE52A9ECE29020E"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block id="id139484AFB53D46E19B5B09177CE060E2" style="OLC" act-name=""><paragraph id="idC7790F4916EC49F3A644FD4D1011244A"><enum>(2)</enum><header>Estoppel</header><text>Any person joined as a party to an inter partes review, and any real party in interest or privy of such person, shall be estopped under subsection (e) to the same extent as if that person, real party in interest, or privy had been the first petitioner in that inter partes review.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="id1BF82B5ABD8A409A879BC8C55A13CDAE"><enum>(iv)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block id="id6E7E41E041E647A4AF644B21245BF93C" style="OLC" act-name=""><subsection id="id7C1410C668EA4534B872124283853FA2"><enum>(d)</enum><header>Multiple proceedings</header><paragraph id="id28552DD659AF4A8E98A53D1308D5E750"><enum>(1)</enum><header>In general</header><text>Notwithstanding sections 135(a), 251, and 252, and chapter 30, during the pendency of an inter partes review, if another proceeding or matter involving the patent is before the Office, or if there is a pending application claiming the benefit of a common filing date to the patent under section 120 or 121— </text><subparagraph id="id600BBD03CD814F069B7129C8A86CD844"><enum>(A)</enum><text>the parties shall notify the Director; and </text></subparagraph><subparagraph id="idE22078AFF8134E72AD3621AE363CB9EB"><enum>(B)</enum><text>the Director shall issue a decision determining the manner in which the other proceeding or matter may proceed, including providing for stay, transfer, consolidation, or termination of any such proceeding or matter.</text></subparagraph></paragraph><paragraph id="id5EA42FFCBC7D441D9879695E4C177830"><enum>(2)</enum><header>No extension</header><text>A decision of the Director under paragraph (1)(B) may not— </text><subparagraph id="id9CBF6A22BDC749E08CBDC82DC20CC671"><enum>(A)</enum><text>extend any statutory deadline under this chapter; or</text></subparagraph><subparagraph id="idE0F416625578436384A9B76994A4224D"><enum>(B)</enum><text>terminate an inter partes proceeding in favor of an ex parte proceeding.</text></subparagraph></paragraph><paragraph id="idE3AA8F5D9CD44DB89899EE7C3146F42E"><enum>(3)</enum><header>Presumption</header><text>For the purposes of this subsection, if the multiple proceedings described in paragraph (1) are of like type and are filed reasonably close in time, there shall be a rebuttable presumption that the Director shall consolidate the proceedings under that paragraph.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id1811824725EE41169D3C3D6937BB9D38"><enum>(v)</enum><text>in subsection (e)—</text><subclause id="idF1C808E82D2C4B3DB5046E00BE3C6B97"><enum>(I)</enum><text>in paragraph (1)—</text><item id="id14223E2B10FC4B47AE9F17058ACC5ACC"><enum>(aa)</enum><text>by striking <quote>The petitioner in</quote> and inserting the following:</text><quoted-block id="idABED19C085F14055829411B4A36E5A92" style="OLC" act-name=""><subparagraph id="idE2727C474CFE4590AE448FD502780F19"><enum>(A)</enum><header>Estoppel against petitioner</header><text>The petitioner in</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></item><item id="idEF1F5C924FBE476D93A774083C4D0D92"><enum>(bb)</enum><text>in subparagraph (A), as so designated, by inserting <quote>, after the time for appeal of the decision has expired or any such appeal has terminated,</quote> after <quote>may not</quote>; and</text></item><item id="id88712E011BCC422183E99EC0004419CE"><enum>(cc)</enum><text>by adding at the end the following:</text><quoted-block id="id57182E8A119D4145A48E104538D2BF6E" style="OLC" act-name=""><subparagraph id="id8BF360C3B6BD4BD3BB66FA9D083D7AA2"><enum>(B)</enum><header>Estoppel against patent owner</header><text>The Office may not issue to a patent owner any claim that is not patentably distinct from a claim that was issued and was subsequently— </text><clause id="id56EFE57E735A48B686F7F08E741064EE"><enum>(i)</enum><text>found to be unpatentable; or </text></clause><clause id="id5BAF8973A9EA4F939BE0F8AB57071D49"><enum>(ii)</enum><text>canceled in any proceeding before the Office, including under section 135, 251, 253, 301, 311, or 321.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></item></subclause><subclause id="id737E5084B5EC4257922E065946ED9BCC"><enum>(II)</enum><text>in paragraph (2)—</text><item id="id1B3020D190DC4F56B0D3354089A093C5"><enum>(aa)</enum><text>by inserting <quote>that the claim is not unpatentable</quote> after <quote>section 318(a)</quote>; </text></item><item id="idA6F756EE9DFE4630A474DC7B250F977A"><enum>(bb)</enum><text>by inserting <quote>, after the time for appeal of the decision has expired or any such appeal has terminated,</quote> after <quote>may not</quote>; and</text></item><item id="id5E9A0B3D998E41D5BF249199C34F2D5A"><enum>(cc)</enum><text>by inserting <quote>or 1498</quote> after <quote>section 1338</quote>;</text></item></subclause></clause></subparagraph><subparagraph id="id0F2142FA025D4CA886B2FC82819889BE"><enum>(D)</enum><text>in section 316—</text><clause id="id037E6EF63A404363A0EDF001139CA8EB"><enum>(i)</enum><text>in subsection (a)(11), by inserting <quote>or consolidation under section 315(d)</quote> after <quote>under section 315(c)</quote>;</text></clause><clause id="id08A874CA58334DDFB88DF4C9D2623D3F"><enum>(ii)</enum><text>in subsection (c)—</text><subclause id="id948E3FD46B934354955BBC4A42888C4A"><enum>(I)</enum><text>by striking <quote>The Patent</quote> and inserting the following:</text><quoted-block id="id6C01E175270E4EFEB959152AD2E37A61" style="OLC" act-name=""><paragraph id="id9B85B731309E4934B0302D4A9697D3E6"><enum>(1)</enum><header>In general</header><text>The Patent</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="id03E1B11AE65C45948732C32FC6978C6E"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block id="id3E03C4EB69414BD6BB771C1A844592F4" style="OLC" act-name=""><paragraph id="idB9A8B65837EF4B22854A118175C2E2A2"><enum>(2)</enum><header>Ex parte communication</header><text>An officer who has review authority, supervisory authority, or disciplinary authority with respect to an administrative patent judge of the Patent Trial and Appeal Board (or a delegate of such an officer), and who is not a member of a panel described in section 6(c), shall refrain from ex parte communication with such a judge who is a member of that panel concerning any pending matter before that panel, except as allowed under the Code of Conduct for United States Judges.</text></paragraph><after-quoted-block>; </text></subparagraph><subparagraph id="id32183B714D9F47B6B03A52BD355C0224"><enum>(B)</enum><text>the Patent Trial and Appeal Board shall— </text><clause id="id623189A1ADBD440D8D19D642F772A4A1"><enum>(i)</enum><text>examine the substitute claim; or </text></clause><clause id="idCDDF8A0433944F8E8210881A8B5E4207"><enum>(ii)</enum><text>notwithstanding subsection (c)(2), refer the substitute claim to the Director, who shall cause an examination of the substitute claim to be made within the time limits for the applicable inter partes review; and</text></clause></subparagraph><subparagraph id="id4E08674106BB40929CD265FE34225F03"><enum>(C)</enum><text>the Director may establish, by regulation, fees for examination of the substitute claim in such amounts as the Director determines to be reasonable, taking into consideration the aggregate costs of examination.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="id175AFA83DC70406988DA4D070E693A22"><enum>(E)</enum><text>in section 318—</text><clause id="id9EF5D494FBD14300BFB498312C35B011"><enum>(i)</enum><text>in subsection (b), by inserting <quote>, not later than 60 days after the date on which the parties to the inter partes review have informed the Director that the time for appeal has expired or any appeal has terminated,</quote> after <quote>the Director shall</quote>; and</text></clause><clause id="idE32AECB9AF6A4D97B9201A41D64E4DA3"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block id="id1867E4074BA547FBBDD283604DF86E3C" style="OLC" act-name=""><subsection id="id4CDA7860B2084832B97D26027ED1295C"><enum>(e)</enum><header>Rehearing</header><text>Not later than 120 days after the date on which the Patent Trial and Appeal Board issues a final written decision under subsection (a), the Board or the Director shall finally decide any request for reconsideration, rehearing, or review that is submitted with respect to the decision, except that the Director may, for good cause shown, extend that 120-day period by not more than 60 days.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id30017CDBCA0A46E0983B340670158B13"><enum>(F)</enum><text>in section 319—</text><clause id="idBD0E5ECFE98E4A12BECBB9153E1B384B"><enum>(i)</enum><text>in the first sentence, by striking <quote>A party</quote> and inserting the following:</text><quoted-block id="id3FAD071FF27D490F9252C29B126E5D7E" style="OLC" act-name=""><subsection id="id694A13DE6A3248DAB7F473F529C02F43"><enum>(a)</enum><header>In general</header><text>A party</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id916B9EE137964C6AA7458A0F89BD7071"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block id="idDDB34A0741CE411692677F0750C2F0FA" style="OLC" act-name=""><subsection id="idF374FA18634342219B6DD55ABAAE431E"><enum>(b)</enum><header>Standing</header><paragraph id="id1274C1516C6345859506B305842C7760"><enum>(1)</enum><header>Injury in fact</header><text>For the purposes of an appeal described in subsection (a), injury in fact shall be presumed if the party appealing the decision—</text><subparagraph id="idE506D2DA63C24693BA19E039C9DCF8AB"><enum>(A)</enum><text>reasonably expects that another person will assert estoppel against the party under section 315(e) as a result of the final written decision that is the subject of the appeal; or</text></subparagraph><subparagraph id="id0CDCFE9A4957431FA6B777E8BD519FD9"><enum>(B)</enum><text>suffers any other concrete and particularized injury that— </text><clause id="idADF210CA950A41D0B30DC0C739DB0B12"><enum>(i)</enum><text>is fairly traceable to the final written decision that is the subject of the appeal; and</text></clause><clause id="idC46112EE71994A2B8FE6497311A68A86"><enum>(ii)</enum><text>could be redressed through appellate review.</text></clause></subparagraph></paragraph><paragraph id="id09656C811B1E4079BCE364778F5C5AB0"><enum>(2)</enum><header>Estoppel</header><text>If a court finds that a party lacks standing to bring an appeal described in subsection (a) under article III of the Constitution of the United States, that party shall not be estopped under section 315(e) with respect to the underlying inter partes review.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idE68DF9300CF2486FBA3BF76E7F611C1F"><enum>(4)</enum><text>in chapter 32—</text><subparagraph id="id7A904250365E4E109F55F3C1A58631F1"><enum>(A)</enum><text>in section 321(a), by inserting <quote>, including a governmental entity,</quote> after <quote>a person</quote>;</text></subparagraph><subparagraph id="id20FDD14950DF437B97221F4E23CED2E2"><enum>(B)</enum><text>in section 324—</text><clause id="idC3CC904FA17A4321B64B657C748DEF50"><enum>(i)</enum><text>in subsection (a), by striking <quote>The Director may not authorize a post-grant review to be instituted unless</quote> and inserting the following: <quote>Subject only to the discretion of the Director under section 325(d)(4), a petition filed under section 321 that meets the requirements of this chapter shall be instituted if</quote>; and</text></clause><clause id="idF06FA957B22E4861802F606A5471206F"><enum>(ii)</enum><text>in subsection (e)—</text><subclause id="id8F84A19DD0764354A26FD7F2054F835F"><enum>(I)</enum><text>by inserting <quote>or maintain</quote> after <quote>to institute</quote>; and</text></subclause><subclause id="id707EB5134C6C44D681D15E765AD7D639" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>by striking <quote>section</quote> and inserting <quote>chapter</quote>; </text></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id3A7DF5533CC74B029A116038A9ED97E0"><enum>(C)</enum><text>in section 325—</text><clause id="idED41BEE347F7402FA4F7FA3D1F51430A"><enum>(i)</enum><text>in subsection (a)— </text><subclause id="idE3A52D01A7CA444894920CB0A307336D"><enum>(I)</enum><text>in the subsection heading, by striking <quote><header-in-text style="USC" level="subsection">Infringer’s Civil Action</header-in-text></quote> and inserting <quote><header-in-text style="USC" level="subsection">Civil action</header-in-text></quote>; and</text></subclause><subclause id="id3EB4CD1450DE442A8C16E64DE7191B9E"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0CC040C8EA04403BBA8F815C6268BF57"><paragraph id="id27C231C3D8EF4F008E117EAC72C7C3D3"><enum>(4)</enum><header>Request for stay</header><subparagraph id="id6B631460D79940FBA277F8296C0F3FB4"><enum>(A)</enum><header>In general</header><text>If a party seeks a stay of a civil action brought under section 281 alleging infringement of a patent that is also subject to a post-grant review, the court shall decide whether to stay the civil action based on whether—</text><clause id="idB1651AE59AA74231A10D13808B269ADA"><enum>(i)</enum><text>the outcome of the post-grant review will likely simplify the issues in question in the civil action and streamline the proceedings in the civil action;</text></clause><clause id="id0C1F38BC7DC24B65AEB4D3D8982477C0"><enum>(ii)</enum><text>as of the date on which the stay is requested, discovery in the civil action is complete;</text></clause><clause id="id2F57D081F99C41E0802974E5C18C6C8C"><enum>(iii)</enum><text>a stay, or the denial thereof, would— </text><subclause id="idD6B883C697554C82BAC5149D0ED2B604"><enum>(I)</enum><text>unduly prejudice the nonmoving party; or </text></subclause><subclause id="idE953943D83724A2BA47B52982F621460"><enum>(II)</enum><text>present a clear tactical advantage for the moving party; and</text></subclause></clause><clause id="idE90840E544CC4FD7900A444F4B547A42"><enum>(iv)</enum><text>a stay, or the denial thereof, will reduce the burden of litigation on the parties to the civil action and the court.</text></clause></subparagraph><subparagraph id="id7812A35FF5FC484998FC188FD873C187"><enum>(B)</enum><header>Review</header><text>A party may take an immediate interlocutory appeal from the decision of a district court of the United States under subparagraph (A). The United States Court of Appeals for the Federal Circuit shall review the district court’s decision to ensure consistent application of established precedent, and such review shall be de novo.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="idCD83C85EC2B644D486D0374F4B7416EF"><enum>(ii)</enum><text>in subsection (c)—</text><subclause id="id684D4A7D00C6474EB21B30F82DCA6AD6"><enum>(I)</enum><text>by striking <quote>If more</quote> and inserting the following:</text><quoted-block id="id1A797E2D1D3D459A98EAE1BD51D227F2" style="OLC" act-name=""><paragraph id="idA3773534822A44E6A919A7E768794A36"><enum>(1)</enum><header>In general</header><text>If more</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="id3B62C740C6674983A86737C7C63EF0F6"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block id="id5A4C9ED79CD34230A4B7A1DE50AA8F87" style="OLC" act-name=""><paragraph id="id3ACD458E555C427FA83ED4C797A4516D"><enum>(2)</enum><header>Estoppel</header><text>Any person joined as a party to a post-grant review, and any real party in interest or privy of such person, shall be estopped under subsection (e) to the same extent as if that person, real party in interest, or privy had been the first petitioner in that post-grant review.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="idC6AFD2F2272640B9A5B61FFD681C9D05"><enum>(iii)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block id="id71F2A9E535F44A7BB5B9F7829CA1AB79" style="OLC" act-name=""><subsection id="id63904DA9AA3847B7956A68D2A923171E"><enum>(d)</enum><header>Multiple proceedings</header><paragraph id="idE14B25345ACE424295F4230AAD54F150"><enum>(1)</enum><header>In general</header><text>Notwithstanding sections 135(a), 251, and 252, and chapter 30, during the pendency of any post-grant review under this chapter, if another proceeding or matter involving the patent is before the Office, or if there is a pending application claiming the benefit of a common filing date to the patent under section 120 or 121—</text><subparagraph id="id51012514ED3F4867B35E9C9D5D23018A"><enum>(A)</enum><text>the parties shall notify the Director; and </text></subparagraph><subparagraph id="id3F8F55D8EBC94E1DBD6FE69B071A1D67"><enum>(B)</enum><text>the Director shall issue a decision determining the manner in which the other proceeding or matter may proceed, including providing for stay, transfer, consolidation, or termination of any such proceeding or matter. </text></subparagraph></paragraph><paragraph id="id53EDC9047E9F4BC0B15F2802DD21B70C"><enum>(2)</enum><header>No extension</header><text>A decision of the Director under paragraph (1)(B) may not— </text><subparagraph id="id6F5D7788DAE8490A896C5059B840071F"><enum>(A)</enum><text>extend any statutory deadline under this chapter; or</text></subparagraph><subparagraph id="id0769FD9BF8EB44A1ADB3FA991EC8BB55"><enum>(B)</enum><text>terminate an inter partes proceeding in favor of an ex parte proceeding.</text></subparagraph></paragraph><paragraph id="idE411CBC2D23E42A38CEC994691094FD9"><enum>(3)</enum><header>Presumption</header><text>For the purposes of this subsection, if the multiple proceedings described in paragraph (1) are of like type and are filed reasonably close in time, there shall be a rebuttable presumption that the Director shall consolidate the proceedings under that paragraph.</text></paragraph><paragraph id="id5432A9962CC2426BAE444F95637A3BC1"><enum>(4)</enum><header>Considerations</header><text>In determining whether to institute or order a proceeding under this chapter, chapter 30, or chapter 31, the Director may take into account whether, and reject the petition or request because, the same or substantially the same prior art or arguments previously were presented to the Office.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idAAD78BFC1929411AA0DA0C66D6A77BA9"><enum>(iv)</enum><text>in subsection (e)—</text><subclause id="idD0292275F81A492EBCC5F409367D5966"><enum>(I)</enum><text>in paragraph (1)—</text><item id="idA64B1F7CC6D344CBA9C9F2B356A3254D"><enum>(aa)</enum><text>by striking <quote>The petitioner in</quote> and inserting the following:</text><quoted-block id="id58A152F4D77845B89A635258686F4314" style="OLC" act-name=""><subparagraph id="id792BD3BB2BA348E9AFEE259919406303"><enum>(A)</enum><header>Estoppel against petitioner</header><text>The petitioner in</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></item><item id="id47E95B40AE8B434AAA7822FFD71CDC53"><enum>(bb)</enum><text>in subparagraph (A), as so designated, by inserting <quote>, after the time for appeal of the decision has expired or any such appeal has terminated,</quote> after <quote>may not</quote>; and</text></item><item id="id9EF8DC68E8174D13A3A6A176ABC0B322"><enum>(cc)</enum><text>by adding at the end the following:</text><quoted-block id="idEEC85DB1A5524940B8C45FD4B4FA15A7" style="OLC" act-name=""><subparagraph id="idF687FC19A19C43D991DC7C07140C90AA"><enum>(B)</enum><header>Estoppel against patent owner</header><text>The Office may not issue to a patent owner any claim that is not patentably distinct from a claim that was issued and was subsequently— </text><clause id="id1E7C10D4B2754A7AA6C71EA410A1C8A7"><enum>(i)</enum><text>found to be unpatentable; or </text></clause><clause id="idE2EA0CF6AA2844DDA352DB6DA998BA61"><enum>(ii)</enum><text>canceled in any proceeding before the Office, including under section 135, 251, 253, 301, 311, or 321.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></item></subclause><subclause id="idC955D27D5600445C93EAE4A16ACE0477"><enum>(II)</enum><text>in paragraph (2)—</text><item id="id173B8EB8ECB6480FB4AF0A4DDC64C6F1"><enum>(aa)</enum><text>by inserting <quote>that the claim is not unpatentable</quote> after <quote>section 328(a)</quote>; </text></item><item id="id988754699AE341E4BB055DF9E49554E1"><enum>(bb)</enum><text>by inserting <quote>, after the time for appeal of the decision has expired or any such appeal has terminated,</quote> after <quote>may not</quote>; and</text></item><item id="id115C8BF1981F46309844D3CDEC93E2F7" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text>by inserting <quote>or 1498</quote> after <quote>section 1338</quote>; </text></item></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idE5BFAB7F23F64F1BB06FDEBECBE49351"><enum>(D)</enum><text>in section 326—</text><clause id="id3063069DA5FE42DC8D26AEEE29A44C6C"><enum>(i)</enum><text>in subsection (a)(11), by inserting <quote>or consolidation under section 325(d)</quote> after <quote>under section 325(c)</quote>;</text></clause><clause id="idB19848DD30224C56BDD8C61319879149"><enum>(ii)</enum><text>in subsection (c)—</text><subclause id="id72BCBD19E4014F31A862491DCD4DEF0E"><enum>(I)</enum><text>by striking <quote>The Patent</quote> and inserting the following:</text><quoted-block id="idE3EE1BED9CB84160A25F1AF0C463DA45" style="OLC" act-name=""><paragraph id="idCA7FF933E1DA4FE7BEDA3A57E4E06875"><enum>(1)</enum><header>In general</header><text>The Patent</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="idA45CF3CDD7604C7B94520473D4CB7E68"><enum>(II)</enum><text>by adding at the end the following:</text><quoted-block id="id121F118A15F745C08DBCE22C0BC0E3C8" style="OLC" act-name=""><paragraph id="id0F69B647EB9D456B8CE27A688A017BAB"><enum>(2)</enum><header>Ex parte communication</header><text>An officer who has review authority, supervisory authority, or disciplinary authority with respect to an administrative patent judge of the Patent Trial and Appeal Board (or a delegate of such an officer), and who is not a member of a panel described in section 6(c), shall refrain from ex parte communication with such a judge who is a member of that panel concerning any pending matter before that panel, except as allowed under the Code of Conduct for United States Judges.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="idAE61D6F0CE4C4AAD8FFDB37A3C9A5190"><enum>(iii)</enum><text>in subsection (e)—</text><subclause id="id4356E30545214920AA886FDC2F336AE7"><enum>(I)</enum><text>by striking <quote>In a</quote> and inserting the following:</text><quoted-block id="idD168823F2B1144379BBE4AD9D77D5315" style="OLC" act-name=""><paragraph id="id0E97365E37524C4789E268A528C02EBD"><enum>(1)</enum><header>In general</header><text>In a</text></paragraph><after-quoted-block>; </text></subparagraph><subparagraph id="id636B8D652B65421FABAFEC95A2115913"><enum>(B)</enum><text>the Patent Trial and Appeal Board shall— </text><clause id="id6D132D6F072C4807912E69E7409390FE"><enum>(i)</enum><text>examine the substitute claim; or </text></clause><clause id="id07FAFDF5C06743F8B5B30A423DCF47E4"><enum>(ii)</enum><text>notwithstanding subsection (c)(2), refer the substitute claim to the Director, who shall cause an examination of the substitute claim to be made within the time limits for the applicable inter partes review; and</text></clause></subparagraph><subparagraph id="idAD0B7116C2D9499FB4995EAEE1DB8436"><enum>(C)</enum><text>the Director may establish, by regulation, fees for examination of the substitute claim in such amounts as the Director determines to be reasonable, taking into consideration the aggregate costs of examination.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="idDEB0BF8E526D43F1B80C2455DCD02CDF"><enum>(E)</enum><text>in section 328—</text><clause id="id34594F02FCCF415C808E6A8CA74BB3D2"><enum>(i)</enum><text>in subsection (b), by inserting <quote>not later than 60 days after the date on which the parties to the post-grant review have informed the Director that the time for appeal has expired or any appeal has terminated,</quote> after <quote>the Director shall</quote>; or</text></subparagraph><subparagraph id="id8BC1FB551A3F4D68ADD71849B16A39FD"><enum>(B)</enum><text>suffers any other concrete and particularized injury that— </text><clause id="id1A9BA91C5C3A4FEA942C9A76FA338DAB"><enum>(i)</enum><text>is fairly traceable to the final written decision that is the subject of the appeal; and</text></clause><clause id="id5CA94E9846844BD2ABCDB6A5068EADE8"><enum>(ii)</enum><text>could be redressed through appellate review.</text></clause></subparagraph></paragraph><paragraph id="id7C759056143643E7B00CB080D205CAD5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Estoppel</header><text>If a court finds that a party lacks standing to bring an appeal described in subsection (a) under article III of the Constitution of the United States, that party shall not be estopped under section 325(e) with respect to the underlying post-grant review.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section></legis-body></bill>
