following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit certain practices relating to certain commodity promotion programs, to require greater transparency by those programs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCD049396FDCD4C46B9B488BBE7701E80"><section section-type="section-one" id="H479748A5F57A499EB293237EDC542D11"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Opportunities for Fairness in Farming Act of 2021</short-title></quote>.</text></section><section id="H5B80EC856EF74633B5CED829AC2CA5E4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HD183E54DF7754ED7AD4D1170185131B2"><enum>(1)</enum><text>the generic programs to promote and provide research and information for an agricultural commodity (commonly known as <quote>checkoff programs</quote>) are intended to increase demand for all of that agricultural commodity and benefit all assessed producers of that agricultural commodity;</text></paragraph><paragraph id="H7EE6AE97EFD144AA93A023E90BE5B935"><enum>(2)</enum><text>although the laws establishing checkoff programs broadly prohibit the use of funds in any manner for the purpose of influencing legislation or government action, checkoff programs have repeatedly been shown to use funds to influence policy directly or by partnering with organizations that lobby;</text></paragraph><paragraph id="H247B7559BD614B008694AAF0406848EA"><enum>(3)</enum><text>the unlawful use of checkoff programs funds benefits some agricultural producers while harming many others;</text></paragraph><paragraph id="H639B6C90F34948218BB27A3D8BCE44DC"><enum>(4)</enum><text>to more effectively prevent Boards from using funds for unlawful purposes, strict separation of engagement between the Boards and policy entities is necessary;</text></paragraph><paragraph id="H3B8A97FFF3DA4C6F903F9B0C2AC804E7"><enum>(5)</enum><text>conflicts of interest in the checkoff programs allow special interests to use checkoff program funds for the benefit of some assessed agricultural producers at the expense of many others;</text></paragraph><paragraph id="H9C86BA56AEE9465A8069BF399F86F98B"><enum>(6)</enum><text>prohibiting conflicts of interest in checkoff programs is necessary to ensure the proper and lawful operation of the checkoff programs;</text></paragraph><paragraph id="H7CCC8A2976064F838E03DFD5492A865F"><enum>(7)</enum><text>checkoff programs are designed to promote agricultural commodities, not to damage other types of agricultural commodities through anticompetitive conduct or otherwise;</text></paragraph><paragraph id="H8FF3AD58679847C9B093774A6A2567D0"><enum>(8)</enum><text>prohibiting anticompetitive and similar conduct is necessary to ensure proper and lawful operation of checkoff programs;</text></paragraph><paragraph id="H9AE6F6F4C2FA4443ABCFE9D4860F3880"><enum>(9)</enum><text>lack of transparency in checkoff programs enables abuses to occur and conceals abuses from being discovered; and</text></paragraph><paragraph id="H2B24476A7B124EC0A5AB7993A286080E"><enum>(10)</enum><text>requiring transparency in the expenditure of checkoff program funds is necessary to prevent and uncover abuses in checkoff programs.</text></paragraph></section><section id="H841FEF35D04C437BAACB9007EDAC787A"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H1EFCCE07B3524ACFB4C210723624C837"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means a board, committee, or similar entity established to carry out a checkoff program or an order issued by the Secretary under a checkoff program.</text></paragraph><paragraph id="H7409F70B94D049C3A9B1BD34FD790B27"><enum>(2)</enum><header>Checkoff program</header><text display-inline="yes-display-inline">The term <term>checkoff program</term> means a program to promote and provide research and information for a particular agricultural commodity without reference to specific producers or brands, including a program carried out under any of the following:</text><subparagraph id="H78E94363A48F4CF99C298C60AEBCA2CD"><enum>(A)</enum><text display-inline="yes-display-inline">The Cotton Research and Promotion Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2101">7 U.S.C. 2101 et seq.</external-xref>).</text></subparagraph><subparagraph id="HFEB76E1B5D194319B46790AB8AF4E0DE"><enum>(B)</enum><text display-inline="yes-display-inline">The Potato Research and Promotion Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2611">7 U.S.C. 2611 et seq.</external-xref>).</text></subparagraph><subparagraph id="HAD6939C4F10C4E798E7B506A5834DDF5"><enum>(C)</enum><text display-inline="yes-display-inline">The Egg Research and Consumer Information Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2701">7 U.S.C. 2701 et seq.</external-xref>).</text></subparagraph><subparagraph id="HE378EB7727BE45DE8FD5B267F735E1AE"><enum>(D)</enum><text display-inline="yes-display-inline">The Beef Research and Information Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2901">7 U.S.C. 2901 et seq.</external-xref>).</text></subparagraph><subparagraph id="HCB4D964136704338B69623883EC066AC"><enum>(E)</enum><text Research, and Consumer Information Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7481">7 U.S.C. 7481 et seq.</external-xref>).</text></subparagraph><subparagraph id="H41FCBD7F54F044FE895C3562EB29B09C"><enum>(W)</enum><text display-inline="yes-display-inline">The Hass Avocado Promotion, Research, and Information Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/7/7801">7 U.S.C. 7801 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC4FF5E8785C84723AA6071775BAF7A17"><enum>(3)</enum><header>Conflict of interest</header><text>The term <term>conflict of interest</term> means a direct or indirect financial interest in a person or entity that performs a service for, or enters into a contract or agreement with, a Board for anything of economic value.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F163B80BE21475F905FC7AA6060262B"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section><section id="HA1C5ED15F16D4B0FB7A34839320A0598"><enum>4.</enum><header>Requirements of checkoff programs</header><subsection id="H8067B821008F427DA3400CA86A6C0CA9"><enum>(a)</enum><header>Prohibitions</header><paragraph id="HFAEC790E2A2E40F1A253E6BBEC4605B4"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (4), a Board shall not enter into any contract or agreement to carry out checkoff program activities with a party that engages in activities for the purpose of influencing any government policy or action that relates to agriculture.</text></paragraph><paragraph id="HDF5B880DC2CB4FB18CF643BE881903EF"><enum>(2)</enum><header>Conflict of interest</header><text>A Board shall not engage in, and shall prohibit the employees and agents of the Board, acting in their official capacity, from engaging in, any act that may involve a conflict of interest.</text></paragraph><paragraph id="H7B07E8627E244BE2B6A5449164A9E3E8"><enum>(3)</enum><header>Other prohibitions</header><text>A Board shall not engage in, and shall prohibit the employees and agents of the Board, acting in their official capacity, from engaging in—</text><subparagraph id="HD26C5A1DBD114A29B6BDADD0828EDE9F"><enum>(A)</enum><text>any anticompetitive activity;</text></subparagraph><subparagraph id="HCB2DF6F53EB541458A98345584FCC949"><enum>(B)</enum><text>any unfair or deceptive act or practice; or</text></subparagraph><subparagraph id="H6A895BD76F2C4C39B8E7DD385BB02BE5"><enum>(C)</enum><text>any act that may be disparaging to, or in any way negatively portray, another agricultural commodity or product.</text></subparagraph></paragraph><paragraph id="H85DAD6BD2A39417A993DCE922AAA264E"><enum>(4)</enum><header>Exception for certain contracts with institutions of higher education</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to a contract or agreement entered into between a Board and an institution of higher education for the purpose of research, extension, and education.</text></paragraph></subsection><subsection id="HD1A5F635BF9D49B59D3ABA62930E7BCC"><enum>(b)</enum><header>Authority To enter into contracts</header><text>Notwithstanding any other provision of law, on approval of the Secretary, a Board may enter directly into contracts and agreements to carry out generic promotion, research, or other activities authorized by law.</text></subsection><subsection id="HF48A51AE0523419CBC98D3F35A22579D"><enum>(c)</enum><header>Production of records</header><paragraph id="H82CE8F1F4AC246BD9D91F03B244A9A82"><enum>(1)</enum><header>In general</header><text>Each contract or agreement of a checkoff program shall provide that the entity that enters into the contract or agreement shall produce to the Board accurate records that account for all funds received under the contract or agreement, including any goods or services provided or costs incurred in connection with the contract or agreement.</text></paragraph><paragraph id="H9C196F7F260F4028868DD619FD1B9111"><enum>(2)</enum><header>Maintenance of records</header><text>A Board shall maintain any records received under paragraph (1).</text></paragraph></subsection><subsection id="HA7AE25C8DFC946DBAA9E03E91E5EF49D"><enum>(d)</enum><header>Publication of budgets and disbursements</header><paragraph id="H0B18F3BD326944018B589EFBF2300BF9"><enum>(1)</enum><header>In general</header><text>The Board shall publish and make available for public inspection all budgets and disbursements of funds entrusted to the Board that are approved by the Secretary, immediately on approval by the Secretary.</text></paragraph><paragraph id="HDFBEA9EE974F477885D4AE2E6154463E"><enum>(2)</enum><header>Required disclosures</header><text>In carrying out paragraph (1), the Board shall disclose—</text><subparagraph id="HA13D42EC35B7474CB245FF259B07793F"><enum>(A)</enum><text>the amount of the disbursement;</text></subparagraph><subparagraph id="H6CCA6513E3214F33AB0D60A4EDD4DB6F"><enum>(B)</enum><text>the purpose of the disbursement, including the activities to be funded by the disbursement;</text></subparagraph><subparagraph id="H779A45ED99A149F58D6748106C79E89A"><enum>(C)</enum><text>the identity of the recipient of the disbursement; and</text></subparagraph><subparagraph id="H7C58FAAD48964EB2B542D57AD7EB9961"><enum>(D)</enum><text>the identity of any other parties that may receive the disbursed funds, including any contracts or subcontractors of the recipient of the disbursement.</text></subparagraph></paragraph></subsection><subsection id="HF6CFE73BD2164345B96367398174C476"><enum>(e)</enum><header>Audits</header><paragraph id="H86C55D5712CD440CBEE23AF3B42F3B7D"><enum>(1)</enum><header>Periodic audits by Inspector General of USDA</header><subparagraph id="HC13328D9FF654EBF960DEBEB18A6FEB2"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and not less frequently than every 5 years thereafter, the Inspector General of the Department of Agriculture shall conduct an audit to determine the compliance of each checkoff program with this section during the period of time covered by the audit.</text></subparagraph><subparagraph id="H7FECC24B29684DCCA1D9375AA23FE6FC"><enum>(B)</enum><header>Review of records</header><text>An audit conducted under subparagraph (A) shall include a review of any records produced to the Board under subsection (c)(1).</text></subparagraph><subparagraph id="HC9C526F8EB6045C9AF3BC8CDBC2A721A"><enum>(C)</enum><header>Submission of reports</header><text>On completion of each audit under subparagraph (A), the Inspector General of the Department of Agriculture shall—</text><clause id="H0B5E286F90404ABC95406FA9DB031D5E"><enum>(i)</enum><text>prepare a report describing the audit; and</text></clause><clause id="H4DE219D745764E249B750CC7C741FB8F"><enum>(ii)</enum><text>submit the report described in clause (i) to—</text><subclause id="HA88BC4696C924D6DA04C292A49752A81"><enum>(I)</enum><text>the appropriate committees of Congress, including the Subcommittee on Antitrust, Competition Policy and Consumer Rights of the Committee on the Judiciary of the Senate; and</text></subclause><subclause id="HACD44E867CE6474A8D91A22E0325AD7A"><enum>(II)</enum><text>the Comptroller General of the United States.</text></subclause></clause></subparagraph></paragraph><paragraph id="H78A2BDBC781A4AC881E5999EA899BCD2"><enum>(2)</enum><header>Audit by Comptroller General</header><subparagraph id="HF5903612A3CA4ED4929C540E3FCF810E"><enum>(A)</enum><header>In general</header><text>Not earlier than 3 years, and not later than 5 years, after the date of enactment of this Act, the Comptroller General of the United States shall—</text><clause id="HFC43594E91624651834770E3C6C6A145"><enum>(i)</enum><text>conduct an audit to assess—</text><subclause id="HE271007E4DA948CA84DF10A01704590C"><enum>(I)</enum><text>the status of actions taken for each checkoff program to ensure compliance with this section; and</text></subclause><subclause id="HCC38531F2A6D4940AB23E98AD81DBE78"><enum>(II)</enum><text>the extent to which actions described in subclause (I) have improved the integrity of a checkoff program; and</text></subclause></clause><clause id="HDE2E2DD11B5A47DD9C1EEAB5C2549650"><enum>(ii)</enum><text>prepare a report describing the audit conducted under clause (i), including any recommendations for—</text><subclause id="H34E73A5F303443F995247811A8235DF9"><enum>(I)</enum><text>strengthening the effect of actions described in clause (i)(I); and</text></subclause><subclause id="HFB3745A6751E47B4BA2BA16138866D28"><enum>(II)</enum><text>improving Federal legislation relating to checkoff programs.</text></subclause></clause></subparagraph><subparagraph id="H5F3031159EC84BDDA45554AC7C8D8893"><enum>(B)</enum><header>Consideration of Inspector General reports</header><text>The Comptroller General of the United States shall consider reports described in paragraph (1)(C) in preparing any recommendations in the report under subparagraph (A)(ii).</text></subparagraph></paragraph></subsection></section><section id="H21C628AC4B7A4AC5A8AB60F501586865"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of such provision to any person or circumstance is held to be unconstitutional, the remainder of this Act, and the application of the provision to any other person or circumstance, shall not be affected.</text></section></legis-body></bill>
