<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2857</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210927">September 27, 2021</action-date><action-desc><sponsor name-id="S412">Mr. Tuberville</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit any Federal agency from requiring financial institutions to report on the financial transactions of their customers.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Financial Privacy Act of 2021</short-title></quote>.</text></section><section id="id7F7B0F44F0D14DB4BE4B339B6374298E"><enum>2.</enum><header>Prohibiting Federal agencies from requiring financial institutions to report on financial transactions of customers</header><subsection id="idA1FCBD40E1454881B6C3B4FBE40BD1EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the Bank Secrecy Act or any regulations promulgated under such Act (as in effect on September 1, 2021), no Federal agency (including the Department of the Treasury) shall be permitted to create, implement, or administer any financial account information reporting program that would require financial institutions or individuals to report data on financial accounts in an information return listing balances, transactions, transfers, or inflows or outflows of any kind.</text></subsection><subsection id="id32F213DE04CA46D4BDD39F4847A6FFA5"><enum>(b)</enum><header>Bank Secrecy Act</header><text>The term <term>Bank Secrecy Act</term> means—</text><paragraph id="id5E5D127DD3A543BA9101A3411E47E5F2"><enum>(1)</enum><text>section 21 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1829b">12 U.S.C. 1829b</external-xref>),</text></paragraph><paragraph id="id9A421AB402084187832C9C3A129D9992"><enum>(2)</enum><text>chapter 2 of title I of <external-xref legal-doc="public-law" parsable-cite="pl/91/508">Public Law 91–508</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/12/1951">12 U.S.C. 1951 et seq.</external-xref>), and</text></paragraph><paragraph id="idE3D1FB817AAF4E8CA1C5D42FE5B3552D"><enum>(3)</enum><text>subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code.</text></paragraph></subsection></section></legis-body></bill>
