<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2843</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210923">September 23, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the imposition of a fine, fee, or taxation on any person for violation of a COVID–19 vaccine mandate issued by the Occupational Safety and Health Administration or any other executive agency, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Taxation Without Congressional Consent Act</short-title></quote>.</text></section><section id="idF85A54BB64B9476D9B77B03558C7D225"><enum>2.</enum><header>Prohibition on OSHA and other executive agencies imposing fines, fees, or taxes with respect to COVID–19 vaccine mandates</header><subsection id="id24F562E4D98343AC816D0481A4832C4D"><enum>(a)</enum><header>In general</header><text>No fine, fee, or taxation shall be imposed on any person for violating a COVID–19 vaccine mandate issued by the Occupational Safety and Health Administration or any other executive agency.</text></subsection><subsection id="idF8D0322ABC584F4EBA72528562E71DA0"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id6559C78AF8E447AF83F7A8CDC832B03F"><enum>(1)</enum><header>COVID–19 vaccine mandate</header><text>The term <term>COVID–19 vaccine mandate</term> means any requirement that an individual receive a COVID–19 vaccine, including any requirement that an employer require an employee or independent contractor to receive such a vaccine.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id6CDC2FB9246C4050BB4AB2489C95E599"><enum>(2)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given such term in section 105 of title 5, United States Code. </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id36F217A19BAF4150B0184C7551CBDFC1"><enum>(3)</enum><header>Person</header><text>The term <term>person</term> has the meaning given such term in section 2510 of title 18, United States Code.</text></paragraph></subsection><subsection id="id83C983634F5B4650A0A880D4F3B6E80C"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to allow for or otherwise authorize a COVID–19 vaccine mandate issued by an Act of Congress or by an executive agency. </text></subsection></section></legis-body></bill>
