<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2842</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210923">September 23, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to prohibit the Secretary of Defense from requiring that members of the Armed Forces receive a COVID–19 vaccine, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respecting Our Ser­vice­mem­bers Act</short-title></quote>.</text></section><section id="id71E53C7AEAE74A22BDE17BC6BA8D91A0"><enum>2.</enum><header>Prohibition on COVID–19 vaccination requirements for members of the Armed Forces</header><subsection id="id96BAF9DF43644A5A80D423CC3FD63A00"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">Chapter 55</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1110b">section 1110b</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id3C08C13D07DE41589288B0FCFBC702E1"><section id="id6864A9DACA2F4CA192DAC57786818D46"><enum>1110c.</enum><header>Prohibition on COVID–19 vaccination requirement</header><subsection id="id52A3FCE9C9C4472B855ACD954BC30FE2"><enum>(a)</enum><header>In general</header><text>The Secretary of Defense may not require any member of an Armed Force to receive a vaccine with respect to the Coronavirus Disease 2019 (COVID–19).</text></subsection><subsection id="idB642B56E903C4CD28512F86EB6912874"><enum>(b)</enum><header>Member of an Armed Force defined</header><text>In this section the term <term>member of an Armed Force</term> means a member of the Army, Navy, Air Force, Marine Corps, Coast Guard, or Space Force, including any member of a reserve component thereof on active service or active status.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6D68A44FC4314975A0104C7E0F8FB062"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 55 of such title is amended by inserting after the item relating to section 1110b the following new item:</text><quoted-block style="USC" id="id58ccea6c-5a34-4b98-804b-37bfcb54b6c2"><toc><toc-entry level="section" idref="id6864A9DACA2F4CA192DAC57786818D46">1110c.
