<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2840</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210923">September 23, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To permit civil actions against the United States for COVID–19 vaccination mandates.</official-title></form><legis-body><section id="id52439B89B5F24B8FA1ABEF70A2C72544" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Don't Jab Me Act</short-title></quote>.</text></section><section id="idee3f6660a287459798371e4b8df7f779"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id3C2FE6F868E84B1F98F668CFE7D59F79"><enum>(1)</enum><header>Aggrieved individual</header><text display-inline="yes-display-inline">The term <term>aggrieved individual</term> includes—</text><subparagraph id="id8758710780fe47a0b942c9173a0180e0"><enum>(A)</enum><text>an individual who received a COVID–19 vaccine as a result of Executive Order 14043 to prevent the termination, or any other adverse consequence, of the employment of the individual with the Federal agency;</text></subparagraph><subparagraph id="idd9f7a950fe45448c9763e296977fc359"><enum>(B)</enum><text>an individual who is required to receive a COVID–19 vaccine as a result of Executive Order 14043 to prevent the termination, or any other adverse consequence, of the employment of the individual with the Federal agency;</text></subparagraph><subparagraph id="id7745086c66734e64b0f45d0c308d42cd"><enum>(C)</enum><text>an individual who received a COVID–19 vaccine as a result of a Federal agency requirement (or required by their employer who is acting pursuant to a Federal requirement) as a condition of new or continued employment; and</text></subparagraph><subparagraph id="idc8c36c35d2714ac09904634e63b6a047"><enum>(D)</enum><text>an individual who is required by a Federal agency (or required by their employer who is acting pursuant to a Federal requirement) to receive a COVID–19 vaccine, or be faced with an adverse consequence, as a condition of new or continued employment.</text></subparagraph></paragraph><paragraph id="idBBD6BCFFF5C8462F9B2DE2D813D589A9"><enum>(2)</enum><header>Executive Order 14043</header><text>The term <term>Executive Order 14043</term> means Executive Order 14043 (86 Fed. Reg. 50989; relating to requiring co­ro­na­vi­rus disease 2019 vaccination for Federal employees).</text></paragraph></section><section id="idfd3e751224d3440f800b4560ff3c04e4"><enum>3.</enum><header>Civil actions against the United States for COVID–19 vaccination mandates</header><text display-inline="no-display-inline">Any aggrieved individual may commence an action in an appropriate district court of the United States against the United States seeking declaratory or injunctive relief and to recover compensatory damages for injuries sustained as a result of a COVID–19 vaccination mandate.</text></section><section id="id64fcdd0a355c4557b7db00b98b200dac"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to permit or otherwise authorize a COVID–19 vaccine mandate under Federal law (including regulations).</text></section></legis-body></bill>
