display-inline="no-display-inline">Congress finds that—</text><paragraph id="id3047cf0f2e9e423ba2d2e78e2062e090"><enum>(1)</enum><text>revegetation efforts can meet multiple goals, including guarding against climate change, improving conservation and habitats, securing public water supplies, and providing for economic and cultural benefits;</text></paragraph><paragraph id="id19914fd627384f2d8896af3cdf1a14ff"><enum>(2)</enum><text>a range of practical constraints, including cost, available infrastructure, and whether land has been converted to other uses that are unlikely to be abandoned, significantly limit the areas that are viable for revegetation projects, and hence revegetation projects must be targeted;</text></paragraph><paragraph id="idd8e05d3b31a2476581f02bd6b460ab9c"><enum>(3)</enum><text>reforestation projects should occur in areas that were historically forested but have become degraded or impacted from wildfire events, windstorms, or other events, rather than other natural habitats, such as grasslands;</text></paragraph><paragraph id="id50b9e94c132a48cf94d50e8dd256c321"><enum>(4)</enum><text>forests and rangelands are important for storing carbon;</text></paragraph><paragraph id="id40116e6307e044f5b667a339a17eadcc"><enum>(5)</enum><text>established forests and native rangelands, including actively managed forests and rangelands, are preferable to new forests and rangelands that are a result of revegetation efforts, because intact forests and vegetation communities are more effective at sequestration and are more resilient to fire, storm, and drought;</text></paragraph><paragraph id="iddf16d1a3d4824411b01d72dca4c6e157"><enum>(6)</enum><text>natural regrowth of forests and rangelands is cheaper and more efficient than revegetation projects, as long as nonnative invasive species are not adversely impacting the landscape;</text></paragraph><paragraph id="id5cc78bc1fc514527b15d1f0437f2264a"><enum>(7)</enum><text>native plant development and restoration generates sustainable private sector jobs in a wide variety of sectors;</text></paragraph><paragraph id="id7434e738adba42329ea9b9e221780558"><enum>(8)</enum><text>selecting the appropriate species of trees and of other vegetation and promoting biodiversity using a mixture of species naturally found in the local area, rare species, and species of economic importance are crucial to the success of revegetation efforts;</text></paragraph><paragraph id="ideb6575f1dcfe4450b0b71925ca2b498c"><enum>(9)</enum><text>species selected for revegetation efforts and the specified planting density and structure should be suitable for the local climate, taking into account future climate resilience and other considerations;</text></paragraph><paragraph id="idac47a6dae8114266841eb169dbabfe81"><enum>(10)</enum><text>scientific knowledge should be combined with local knowledge, and site conditions should be taken into account, in developing revegetation projects, and ideally small-scale planting trials should take place before planting large numbers of trees;</text></paragraph><paragraph id="idd9c9e7827a1f41d98eb3e767c1f06bf6"><enum>(11)</enum><text>partnerships with local communities are key to the success of tree and vegetation planting projects because local people often have the most to gain from those projects;</text></paragraph><paragraph id="id8af6f35298b949aab3630b725a648c03"><enum>(12)</enum><text>a successful planting project must include a plan on how to source seeds or seedlings that match desired species and genetics, and that plan should involve working with local stakeholders;</text></paragraph><paragraph id="iddc878b837b7943ce9ed1aa3bc8a6f12b"><enum>(13)</enum><text>the sustainability of revegetation projects is dependent on the economic impacts for all stakeholders; and</text></paragraph><paragraph id="id08129972f7da4bc48f7e295c23e00be7"><enum>(14)</enum><text>invasive grasses are a catalyst for wildfires in forests and rangelands.</text></paragraph></section><section id="id33A0775DC3524CCEB07AE2AF3A6B8675"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1221c799e552456d96ac6e95d6f1cb56"><enum>(1)</enum><header>Carbon sequestration</header><text>The term <term>carbon sequestration</term> means the capture and long-term storage of atmospheric carbon dioxide. </text></paragraph><paragraph id="idD31E8BD8C60E4B76A8F797D78F13C18C"><enum>(2)</enum><header>National Forest System</header><text display-inline="yes-display-inline">The term <term>National Forest System</term> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="idf19f8e94745a4c21a240882cfef96585"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of the Interior and the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="id809b5d12a41b45ebbb1dbd3ab7ce72a3"><enum>(4)</enum><header>Secretary</header><text>Except in sections 103, 105(b), 201, 202, and 302, the term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id5f58c213ffcb4295a14b92ebe270a7e0"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means the Secretary of the Interior or the Secretary of Agriculture, acting through the Chief of the Forest Service. </text></paragraph></section><title style="OLC" id="id8CBF67E55BD642F5951FFC016F3926E6"><enum>I</enum><header>Revegetation</header><section id="id005475382acc4c74aae441a864c22de2"><enum>101.</enum><header>Climate adaptation and resilient forests and rangeland measures</header><subsection id="idff11a30ca000443eaa22b7230cef95a1"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretaries shall each revise applicable regulations of the Secretary concerned to require the consideration and assessment of resiliency and adaptation factors in developing strategies and efforts for revegetation, including reforestation and rangeland planting, carried out by the Secretary concerned, including in selecting species for planting.</text></subsection><subsection id="idA6512985CC3947FE93AB5E041256F0EC"><enum>(b)</enum><header>Effect</header><text>Nothing in this section affects—</text><paragraph id="id1880E7818DA74327A44DCF9D6F260A7B"><enum>(1)</enum><text>the reforestation requirements under section 3 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1601">16 U.S.C. 1601</external-xref>); or</text></paragraph><paragraph id="idD1E23DA797444E839C2DDC5668E01FEA"><enum>(2)</enum><text>the use of the forest plan revision process to make changes to reforestation approaches in an individual unit of the National Forest System.</text></paragraph></subsection></section><section id="idF337E95C0A0B425C987DD66DD5331BC2"><enum>102.</enum><header>National revegetation effort</header><subsection id="id96820A6A016F4C1BB68DAF39625D8F0C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id4CE76112A5EC48A18A15C2A717E206D3"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="id5F2BBCBE2C104106AD7A46503A55454F"><enum>(A)</enum><text>National Forest System land, except—</text><clause id="idca177adc488a4181988903698092aaf4"><enum>(i)</enum><text>the national grasslands and land utilization projects administered under title III of the Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010 et seq.</external-xref>); and</text></clause><clause id="ida0c2bc79b2834ba5b29bbcd2facfc21c"><enum>(ii)</enum><text>National Forest System land east of the 100th meridian; and</text></clause></subparagraph><subparagraph id="id96E61E149EFE4C5BAD3815A9592CC3F0"><enum>(B)</enum><text>land under the jurisdiction of the Secretary.</text></subparagraph></paragraph><paragraph id="id17a3a811562747d9abe649ce84ea6441"><enum>(2)</enum><header>Task force</header><text>The term <term>task force</term> means an interagency revegetation task force established under subsection (d).</text></paragraph><paragraph id="id5050D9FB20514B3FBA89364237A8C299"><enum>(3)</enum><header>Zone</header><text>The term <term>zone</term> means a zone described in subsection (c).</text></paragraph></subsection><subsection id="idd263473fe3004eb4b49176ae1ce7fce8"><enum>(b)</enum><header>Assessment of revegetation needs</header><paragraph id="id10ec18c944744e278ae555165c6a3c0b"><enum>(1)</enum><header>Federal land assessment</header><subparagraph id="id61629d72fd4c4bfc86ad71a236354913"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretaries shall assess, using the revegetation assessment tool described in paragraph (2), the number of acres of Federal land in need of revegetation, including—</text><clause id="idedc7cf2d35db43789a1bae965bf5790b"><enum>(i)</enum><text>acres that have experienced a stand-replacing disturbance by a wildfire, windstorm, or other natural event; </text></clause><clause id="id7f9aae09e0d441c89142c93d84a967b6"><enum>(ii)</enum><text>acres on which a regeneration harvest has previously taken place; and</text></clause><clause id="id018fa07b09a0417cb2c7d8c3e9014ec6"><enum>(iii)</enum><text>acres that could benefit from appropriate revegetation, as determined by the Secretaries. </text></clause></subparagraph><subparagraph id="ide67f618c77694cdb9ce05a8b5d8563ed"><enum>(B)</enum><header>Ecological forestry</header><text>In conducting the assessment under subparagraph (A), the Secretaries shall consider the role of recovery periods between disturbances for the development of stand complexity.</text></subparagraph></paragraph><paragraph id="id4b55b27a31e44676afa271ae8256417c"><enum>(2)</enum><header>Revegetation assessment tool</header><text>Not later than 180 days after the date of enactment of this Act, the Secretaries shall jointly develop, or use or expand an existing, objective revegetation assessment tool for each zone that uses a point system or rating scale—</text><subparagraph id="id1ed1c1dd9d624b258193d0399f406af9"><enum>(A)</enum><text>to consistently assess in various geographic areas, site classes, and forest and rangeland types whether an acre of Federal land is adequately occupied by well-distributed, countable, ecologically appropriate trees or other desirable vegetation;</text></subparagraph><subparagraph id="id09008e105bf84d918d04e179fb3e233b"><enum>(B)</enum><text>to assist rapidly assessing revegetation needs on Federal land; and</text></subparagraph><subparagraph id="id4ab73ee98a3f4e2fb9dc8644aacd6d64"><enum>(C)</enum><text>to establish baseline conditions for Federal land.</text></subparagraph></paragraph><paragraph id="id962d73b806e744b3b3c0ed60d3bbfba1"><enum>(3)</enum><header>Forest and rangeland cover restoration on non-Federal land</header><subparagraph id="id7563c45925254326b2013d0e2ac389d9"><enum>(A)</enum><header>Partnership for forest and rangeland cover restoration</header><text>The Secretaries may enter into a partnership with a non-Federal entity, including Indian Tribes, with data or expertise in Federal reforestation—</text><clause id="idc62ce5b2eb0840bbbe14e9bd48e973b5"><enum>(i)</enum><text>to assess the opportunity to restore forest or rangeland cover across non-Federal land in the United States; or</text></clause><clause id="id50e43c19e09049cd8c55514cbf83fb9d"><enum>(ii)</enum><text>to share existing data gathered by the non-Federal entity.</text></clause></subparagraph><subparagraph id="id01fd980e68134cda8202255f157ddf02"><enum>(B)</enum><header>Savings clause</header><text>Nothing in this paragraph grants the Secretary concerned any additional authority over or additional access to non-Federal land.</text></subparagraph></paragraph><paragraph id="id0eb4139eaecd4980a2f06305d87b5217"><enum>(4)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Secretaries shall publish a report describing—</text><subparagraph id="id4b3c268ac34741febdb66b4bf8bca575"><enum>(A)</enum><text>the number of acres of—</text><clause id="id401da116bbf8443e9fb2a561613ad180"><enum>(i)</enum><text>Federal land in need of revegetation; and</text></clause><clause id="id7d7296a1b19741afadca0c4ba331cd60"><enum>(ii)</enum><text>non-Federal land in the United States on which forest or rangeland cover can be restored and the owner of which has requested to be included in a comprehensive revegetation strategy and implementation plan developed under subsection (e)(2)(A); and</text></clause></subparagraph><subparagraph id="id71a6c48916104d65b903139f5229e25c"><enum>(B)</enum><text>the approximate location of the land described under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id41808f0db2914dc684c4118b4b8a48f8"><enum>(c)</enum><header>Regional zones for revegetation efforts</header><text>The Secretaries shall use the regions of the National Forest System as the zones for revegetation efforts conducted by the task forces under this section.</text></subsection><subsection id="id7577ba60617644d28f72f1344b1bd7b3"><enum>(d)</enum><header>Interagency task forces</header><text>Not later than 18 months after the date of enactment of this Act, the Secretaries shall establish an interagency revegetation task force of Federal and non-Federal members, including Indian Tribes, for each zone—</text><paragraph id="idced7d96cded248c196142f72c6254538"><enum>(1)</enum><text>to coordinate and carry out the activities described in subsections (e), (f), and (g); and</text></paragraph><paragraph id="id5e22743c3b2a420192e7352872a07b69"><enum>(2)</enum><text>to maximize collaboration and shared science and mapping resources among Federal and non-Federal entities, including Indian Tribes, in revegetating land in each zone, including through the use of—</text><subparagraph id="id0EDB4D0F990D49488BCDDE0110DDA655"><enum>(A)</enum><text>Department of Agriculture climate hubs;</text></subparagraph><subparagraph id="id6FE4A1239EF643B7A0B8E79CDF77EFF5"><enum>(B)</enum><text>collaboratives formed pursuant to section 4003 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/7303">16 U.S.C. 7303</external-xref>); and </text></subparagraph><subparagraph id="idC92C936C867D468A9B6ED31B96BBCC9D"><enum>(C)</enum><text>partnerships with States developed under shared stewardship agreements.</text></subparagraph></paragraph></subsection><subsection id="idb85fac7b56ff44708688e8b0e2f4de1c"><enum>(e)</enum><header>Comprehensive revegetation strategy and implementation plans</header><paragraph id="idc03ea5ccd0d84075a4d8dc5bf60335c9"><enum>(1)</enum><header>Data review</header><text>Each task force—</text><subparagraph id="id8fc66f96c8044f129ae8d04f8b79315e"><enum>(A)</enum><text>shall review the report published under subsection (b)(4); and</text></subparagraph><subparagraph id="id5ce3a0ca552843f0a3257a6ef856457a"><enum>(B)</enum><text>may modify, for the applicable zone, the number of acres of land in need of revegetation and the approximate location of the land identified in the report, as necessary.</text></subparagraph></paragraph><paragraph id="idd6ca8ee81ebc40be94724aa95d988211"><enum>(2)</enum><header>Plan development</header><subparagraph id="id6b82b731081c418387354a2483d34ffa"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date on which a task force is established, the task force shall develop a 10-year comprehensive revegetation strategy and implementation plan—</text><clause id="id25f3907ba1524d9ba60f63b9174a7360"><enum>(i)</enum><text>to revegetate not less than 25 percent of the land identified in the report published under subsection (b)(4), as modified under paragraph (1)(B) (if applicable), for the applicable zone; and</text></clause><clause id="id5844b6b9ca9941fea01930dd61712e7f"><enum>(ii)</enum><text>to achieve any additional goals or targets established by the task force.</text></clause></subparagraph><subparagraph id="idaf4e532396be4cfeab51dccffc2a1032"><enum>(B)</enum><header>Requirements</header><text>A plan developed under subparagraph (A) shall—</text><clause id="id0ecee7b1c1554873a3353aa411c27580"><enum>(i)</enum><text>take into account the best available science, best practices, and available deployment tools, including climate science that can inform the design of revegetated areas to assure resilience;</text></clause><clause id="idd49c3cb1f8854da88b1ddee971a22859"><enum>(ii)</enum><text>be based on, to the maximum extent practicable, the report published under subsection (b)(4);</text></clause><clause id="id0ae5271840e4471f995e1207ddce8284"><enum>(iii)</enum><text>identify resources and efforts needed to conduct appropriate revegetation treatments in the applicable zone, including identifying areas in which capacity exists to plant vegetation or conduct seed dispersal;</text></clause><clause id="id2d6706449751491485a629fc121d33a1"><enum>(iv)</enum><text>identify the desired, locally or regionally adapted native species of vegetation and the types planting stock required in the specific areas in the zone in need of revegetation, including ecosystems that do not include trees, such as sagebrush ecosystems, grasslands, or rangelands;</text></clause><clause id="id857a7e5e4a264d2f94863b20cbd62fef"><enum>(v)</enum><text>identify under-represented species of trees and plants in each zone that can be acquired and should be planted under this section;</text></clause><clause id="id3ac48edec8384b62a21f421c910bcd78"><enum>(vi)</enum><text>prioritize geographic areas in the applicable zone in need of revegetation, including giving priority to—</text><subclause id="id58e6ae35d930454e985cddb2e92fc25a"><enum>(I)</enum><text>burned areas and any other destabilized land that pose heightened risks to homes, roads, and public water supplies if not revegetated;</text></subclause><subclause id="id14c8cfc483ea467ca327a3d91f2b8204"><enum>(II)</enum><text>areas at high risk of establishing invasive species;</text></subclause><subclause id="idd13c72a1b64248a5bd9fa18446dfc88f"><enum>(III)</enum><text>mined land;</text></subclause><subclause id="id555be6f986704811a454d5f5a86137d9"><enum>(IV)</enum><text>floodplains and riparian areas; and</text></subclause><subclause id="id016b5daf7f8744d29ebeff0e94dac033"><enum>(V)</enum><text>land with regionally significant carbon sequestration potential;</text></subclause></clause><clause id="id40f2d164e7c9481f831d9f4ec90ebde2"><enum>(vii)</enum><text>identify—</text><subclause id="ida73cb203d0684ed0a5004076340a61da"><enum>(I)</enum><text>targets or goals for the number of acres planted annually; and</text></subclause><subclause id="id48ca6e486c2c4e0b8a87e48182fe5852"><enum>(II)</enum><text>other implementation actions and opportunities;</text></subclause></clause><clause id="idaac3fac7d0414f28ad43b9ca8961f697"><enum>(viii)</enum><text>identify areas in which—</text><subclause id="idd1e179c2514d4228aed6a67ae2bab4b2"><enum>(I)</enum><text>vegetation restoration is needed; but</text></subclause><subclause id="id3828ab1f257c4a3088707b8f44827745"><enum>(II)</enum><text>natural regeneration is the most effective means of restoration;</text></subclause></clause><clause id="idca7df572ba954fb99ab786a03607129d"><enum>(ix)</enum><text>identify areas in which revegetation efforts—</text><subclause id="idad6691f928e44a4881244a6521b9fb14"><enum>(I)</enum><text>may cause an increased risk of a stand-replacing wildfire, disease, or insect infestation, if not properly managed; or</text></subclause><subclause id="id1401797b596b40708b9c4fdd8e34f098"><enum>(II)</enum><text>would be adverse to livestock grazing or use by wildlife;</text></subclause></clause><clause id="id41115a269d804a29aa436fbd4b2ecfd9"><enum>(x)</enum><text>consider treatments that increase the carbon sequestration capacity of forests, rangelands, and grasslands;</text></clause><clause id="idbaa80e5cbaaa4107b23110762f1f687e"><enum>(xi)</enum><text>provide for—</text><subclause id="idb96205cd276e4bf4a29480709235ae07"><enum>(I)</enum><text>consideration of palatability to support grazing by wildlife and livestock; and</text></subclause><subclause id="idb58d8c843901486f8bbd003815ef0b64"><enum>(II)</enum><text>coordination with State wildlife agencies, rangeland management professionals, and ranchers;</text></subclause></clause><clause id="id0aad5c3d800745d1baaf6827b08077a8"><enum>(xii)</enum><text>incorporate the data and strategy relating to nurseries and the availability of planting stock described in subsection (g);</text></clause><clause id="id39375ad9c1e34b84997e5c0155f5e0e1"><enum>(xiii)</enum><text>for activities recommended to be carried out on non-Federal land—</text><subclause id="id8721FBD111B041F3B98E7CD2089708EB"><enum>(I)</enum><text>identify ways to address revegetation needs voluntarily by working with States, landowners, Indian Tribes, and other interested persons; and</text></subclause><subclause id="id869cb4b00d0e409bbd5c16555af05850"><enum>(II)</enum><text>ensure that revegetation efforts will not adversely impact existing markets for timber and other forest materials produced from private working forests; </text></subclause></clause><clause id="ide016a32ea839462ab1c5592ed6f929f1"><enum>(xiv)</enum><text>provide an explanation for any land not included in the implementation portion of the plan that was identified in the report published under subsection (b)(4), as modified under paragraph (1)(B) (if applicable);</text></clause><clause id="idbac3c07631b24eb7abbceac5769643b6"><enum>(xv)</enum><text>utilize an experimental approach, where appropriate; and</text></clause><clause id="id85c7bd48b3dd48ffaa25aff40bd3e940"><enum>(xvi)</enum><text>be consistent with any applicable agency land management plans. </text></clause></subparagraph><subparagraph id="id975093e7d68e4bb5b593261375d5262e"><enum>(C)</enum><header>Exceptions</header><text>Notwithstanding subparagraph (B)(iv), a task force may determine that the selection and use of certain desirable, noninvasive, nonnative species is appropriate in certain limited circumstances, based on localized ecological conditions, as determined by the task force.</text></subparagraph></paragraph><paragraph id="id18e51969933f425c8aa4b6a407960088"><enum>(3)</enum><header>Plan modifications</header><text>A task force may modify a plan developed under paragraph (2) to address new circumstances or changing conditions.</text></paragraph></subsection><subsection id="idc48157a32b0e49af8a7d370fd090bbd5"><enum>(f)</enum><header>Implementation of plans</header><paragraph id="ide95fe3b3c6ee4deda01677ce8dd5f4e9"><enum>(1)</enum><header>In general</header><text>During the 10-year period beginning on the date on which a plan for a zone is completed under subsection (e)(2), the task force, in coordination with applicable Federal agencies, shall implement the plan.</text></paragraph><paragraph id="id5c96a598ffad418ba392e7af3c0c61d7"><enum>(2)</enum><header>Outside funding</header><text>To implement a plan developed under subsection (e)(2), the Secretary concerned may—</text><subparagraph id="iddc67a9dbff204f3a9b66949a99998c95"><enum>(A)</enum><text>accept non-Federal funds, including leveraging funding opportunities relating to voluntary carbon mitigation; and</text></subparagraph><subparagraph id="id482acd9465374c4185afae32261a6db1"><enum>(B)</enum><text>issue a certificate of donation, as appropriate.</text></subparagraph></paragraph><paragraph id="idbabc73f0f23e4335a7729b3de418bf04"><enum>(3)</enum><header>Voluntary participation</header><text>In implementing a plan under this subsection, any activities carried out on non-Federal land shall be carried out—</text><subparagraph id="idadc242653fd242549b8fa3a43a214594"><enum>(A)</enum><text>in cooperation with the owner of the non-Federal land; and</text></subparagraph><subparagraph id="id6d531a9cb72c482c8a07b3b3ea2c902f"><enum>(B)</enum><text>only on a voluntary basis.</text></subparagraph></paragraph><paragraph id="id2a05b1f40a4c483c8e538065fe353eb3"><enum>(4)</enum><header>Enterprise team</header><text>The Secretary concerned may employ a Forest Service enterprise team to facilitate the implementation of a plan developed under subsection (e)(2).</text></paragraph></subsection><subsection id="id17bb1697c73f4275a19d410a67bf8bda"><enum>(g)</enum><header>Challenges to the reforestation pipeline in the united states</header><paragraph id="id11807d1248304c8682c7808d27ac3ac6"><enum>(1)</enum><header>In general</header><text>A task force shall—</text><subparagraph id="ide7ace7e5be874c1bb402abf8d9bcc844"><enum>(A)</enum><text>not later than 60 days after the date on which the task force is established, conduct an inventory of nurseries, an assessment of nursery capacity, and a tally of available planting stock in the applicable zone; and</text></subparagraph><subparagraph id="id9f5ad3a2bf2e41eba898b48354af2dc0"><enum>(B)</enum><text>based on the report published under subsection (b)(4), as modified under subsection (e)(1)(B) (if applicable)—</text><clause id="id5762cca752e642a8a972fc80d25916e1"><enum>(i)</enum><text>estimate the capacity of nurseries that would be necessary to fulfill revegetation needs, including identifying the species and types of planting stock needed for revegetation; and</text></clause><clause id="ide6d86c1711c2452889c4b27eff8a1585"><enum>(ii)</enum><text>develop a plan for increasing the number and capacity of nurseries, in accordance with the estimates under clause (i).</text></clause></subparagraph></paragraph><paragraph id="id2ef3ae95dcfd41aeb68ff5f0bcfa9535"><enum>(2)</enum><header>Seed collecting</header><text>A task force shall—</text><subparagraph id="ida896ebd9e8c944cba58b254eb78fe129"><enum>(A)</enum><text>assess the current capacity to locally collect and store seed; and</text></subparagraph><subparagraph id="id49a3b57d70c44978b526c8f90a0a96e0"><enum>(B)</enum><text>develop a plan for increasing capacity described in subparagraph (A), if necessary.</text></subparagraph></paragraph><paragraph id="id7efad388872c4cc6b53112f501f36d35"><enum>(3)</enum><header>Partnerships</header><text>The Secretaries may enter into a partnership with a non-Federal entity to assist a task force in meeting the requirements of this subsection.</text></paragraph></subsection><subsection id="idae3b9290a7914fefaccff210d6b0cce4"><enum>(h)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter until the date on which each plan developed under subsection (e)(2) is fully implemented, the Secretaries shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives, and publish on the website of the Department of the Interior, a report that describes, with respect to the preceding year—</text><paragraph id="id4e80288b4e5a4e458ab584af2c9a40a5"><enum>(1)</enum><text>whether the Secretaries have achieved compliance with the requirements of this section;</text></paragraph><paragraph id="id357c756722d24fe6bafecb7d0d30d786"><enum>(2)</enum><text>the total number of acres of land, reported by surface ownership in each zone, in need of revegetation treatments;</text></paragraph><paragraph id="id5a25cf9a7eca42aaaec48fd4d8bda294"><enum>(3)</enum><text>the total number of acres of land, reported by surface ownership in each zone, in which revegetation treatments have been carried out;</text></paragraph><paragraph id="id7d8eb6ceb7754bef9eadb26819a33ea6"><enum>(4)</enum><text>any other accomplishments and improvements to carbon sequestration capacity or other co-benefits as a result of implementing a plan under subsection (e)(2); and</text></paragraph><paragraph id="id11134397d1f04bfba83effe160f93057"><enum>(5)</enum><text>any barriers to implementation of a plan developed under subsection (e)(2), including as a result of legal issues, logistical issues, seed or sapling shortages, or lack of funding.</text></paragraph></subsection><subsection id="id788f6c18084e44b0a344d6311f920db1"><enum>(i)</enum><header>Partnerships</header><text>The Secretaries may enter into a memorandum of agreement with any member of a task force to carry out any activity described in subsection (e), (f), (g), or (h).</text></subsection><subsection id="idd199dfac509e4976ae6af2b4ee742149"><enum>(j)</enum><header>Effect</header><text>Nothing in this section establishes new, extends existing, or otherwise affects post-fire rehabilitation no-grazing requirements.</text></subsection><subsection id="id1240a04f36d8456583036f64d6181da4"><enum>(k)</enum><header>Avoidance of duplication</header><text>In carrying out this section, the Secretaries shall—</text><paragraph id="ida11e867e9e0f4ef5ad88ed27e3c0c91b"><enum>(1)</enum><text>avoid duplicative efforts and, to the maximum extent practicable, utilize existing efforts and personnel to develop and implement an activity described in subsection (e), (f), (g), or (h);</text></paragraph><paragraph id="id2d2913cf1f594fe388fd8d9a924a335d"><enum>(2)</enum><text>maximize non-Federal involvement; and</text></paragraph><paragraph id="id2f64ec8fed9641c383dbbd32262ea7d8"><enum>(3)</enum><text>avoid using personnel who would otherwise be engaged in forest management or wildfire mitigation efforts. </text></paragraph></subsection></section><section id="ida8ca7ee4120e4fdc9d7247955da4d962"><enum>103.</enum><header>Experimental forests</header><subsection id="id6c7c158f208f46dd85e99d22abf677a5"><enum>(a)</enum><header>Purposes of this section</header><text>The purposes of this section are—</text><paragraph id="id5A1BCA22A70D4E30881EC514A9BCF2C6"><enum>(1)</enum><text>to formally authorize the experimental forests and rangelands on National Forest System land existing on the date of enactment of this Act; and</text></paragraph><paragraph id="id4DDF240747CF4894B61FD838AEE95762"><enum>(2)</enum><text>to require that—</text><subparagraph id="idECE5163B69B54442BEF8DBBDEC9335A4"><enum>(A)</enum><text>the network of those experimental forests and rangelands be maintained in perpetuity; and </text></subparagraph><subparagraph id="idE54DF8128B7F4E57A10ECF1134894FF3"><enum>(B)</enum><text>climate resiliency research is continuously conducted within the network.</text></subparagraph></paragraph></subsection><subsection id="id24732e8e0b6a42bd91f1d449f0d8fe5c"><enum>(b)</enum><header>Establishment of network</header><text>The Secretary of Agriculture, acting through the Chief of the Forest Service (referred to in this section as the <quote>Secretary</quote>), shall establish and manage a network of experimental forests and ranges on National Forest System land (referred to in this section as the <quote>network</quote>).</text></subsection><subsection id="ida0c34bf86cbb407abec385a134833643"><enum>(c)</enum><header>Management purposes</header><text>The Secretary shall manage the network for the purposes of—</text><paragraph id="id61978c2e807c4e929f147cd64f9fafed"><enum>(1)</enum><text>research;</text></paragraph><paragraph id="idea2320ca655347dbba7d308296262999"><enum>(2)</enum><text>technology transfer; and</text></paragraph><paragraph id="id2694af0e4fde4aadbecedccf2b5e89cd"><enum>(3)</enum><text>education.</text></paragraph></subsection><subsection id="id8c976cb8d7f842f9806b5d56b0acab73"><enum>(d)</enum><header>Criteria</header><text>The network shall include—</text><paragraph id="id6faf1c5d051d495c92399aebcce6283e"><enum>(1)</enum><text>each of the forest cover types that occur in the United States, as defined by the Forest Cover Types of the United States and Canada published by the Society of American Forests;</text></paragraph><paragraph id="id9355454cbea444c9a7876e1479088d22"><enum>(2)</enum><text>an experimental forest that contains forest cover types found in the State of Hawaii; and</text></paragraph><paragraph id="id25887bc577594bffbc9a3d8755bdc2a2"><enum>(3)</enum><text>an experimental forest that contains forest cover types found in the territories of the United States.</text></paragraph></subsection><subsection id="id8b64655f3b2545f2a9394303afab4865"><enum>(e)</enum><header>Climate resiliency research</header><text>Within the network, the Secretary shall conduct research, including research on—</text><paragraph id="id2e990517b54242539683638dcd91d574"><enum>(1)</enum><text>seedling establishment, site suitability, and tree planting designs to inform and assist efforts undertaken in the United States to establish stands of trees that are resilient in future climate conditions; and</text></paragraph><paragraph id="id53afc515222c4994bdca6a3f9f8d64ec"><enum>(2)</enum><text>the sources and fates of carbon to construct and improve models of carbon responses to land management practices.</text></paragraph></subsection><subsection id="idad28c31a85ad4d17a13eee035342b5e7"><enum>(f)</enum><header>Public access</header><text>All data collected and research findings developed from projects undertaken on the network shall be made readily accessible to the public.</text></subsection><subsection id="idf9537991f6c44385859fc16ef84af435"><enum>(g)</enum><header>Partners</header><text>The Secretary may enter into an agreement with a State (including a State forestry agency), an educational institution, or a third party to fund or conduct research on the network.</text></subsection><subsection id="id9a422177e55d4c2bb0bb8dde01b33750"><enum>(h)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing, with respect to the network—</text><paragraph id="id51167c2dc8b9491eb4898769ccb9143d"><enum>(1)</enum><text>the location of the network on National Forest System land;</text></paragraph><paragraph id="id26cb207e7a1f4e18aaaad7db9bebcc32"><enum>(2)</enum><text>the forest cover types included in the network; and</text></paragraph><paragraph id="ide998f174a11e4311b1d36315c3c3ab5b"><enum>(3)</enum><text>any additional resources needed—</text><subparagraph id="id5418b31813214fef857b48d6226e8da1"><enum>(A)</enum><text>to establish or maintain infrastructure in an established experimental forest; or</text></subparagraph><subparagraph id="idb21a2b331c0b4c879e6034d8022ceddb"><enum>(B)</enum><text>to conduct the research described in subsection (d).</text></subparagraph></paragraph></subsection><subsection id="id01e94018311242ad878f809b95d14b83"><enum>(i)</enum><header>Savings clause</header><text>Nothing in this section—</text><paragraph id="idD57DDB975D834C2593CAAAD209E113FC"><enum>(1)</enum><text>modifies, limits, or repeals the applicability of any provision of law (including regulations) to National Forest System land; or</text></paragraph><paragraph id="idDE0A35BCA08C4BF29FEA4BF8625EEEB7"><enum>(2)</enum><text>precludes the Secretary from authorizing multiple-use activities, including livestock grazing and other authorized uses on land included within the network.</text></paragraph></subsection></section><section id="idcf557ba0b32f4409926c1ed7b67bfd36"><enum>104.</enum><header>Long-term contracts for tree and seed planting</header><subsection id="ida9624af0435b46ac90332685e944e4c9"><enum>(a)</enum><header>In general</header><text>Notwithstanding the Federal Acquisition Regulation, the Secretary concerned may enter into a contract or cooperative agreement for re-establishing vegetation on Federal land described in subsection (b).</text></subsection><subsection id="idd052b78c73fd41b29c945894d3d3c617"><enum>(b)</enum><header>Federal land</header><text>Federal land referred to in subsection (a) is—</text><paragraph id="idf13f9f5fd13346d498fd934d5e9f72a3"><enum>(1)</enum><text>National Forest System land, other than—</text><subparagraph id="id1f48810ca3f94a649d395af8a2977838"><enum>(A)</enum><text>the national grasslands and land utilization projects administered under title III of the Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id90559820be6c47c488dab77d9dc096f3"><enum>(B)</enum><text>National Forest System land east of the 100th meridian;</text></subparagraph></paragraph><paragraph id="idab433695657d464f8fc129b21cdfcecc"><enum>(2)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>));</text></paragraph><paragraph id="id9b6c202f97d145eb90d52afa61377409"><enum>(3)</enum><text>land that the Secretary holds in trust for an Indian Tribe; </text></paragraph><paragraph id="ide7ca3db0127449b5936bf4743b45cbc9" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>a unit of the National Wildlife Refuge System;</text></paragraph><paragraph id="id69c8baa6fae0480fb22456502603f82c"><enum>(5)</enum><text>land administered by the Bureau of Reclamation; and</text></paragraph><paragraph id="id1aa14b0d3b6c4fbe97647ccc9580e05a"><enum>(6)</enum><text>a unit of the National Park System. </text></paragraph></subsection><subsection id="id5d55e412dea4405ea9a05497bc5e33f2" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Term</header><text>A contract or cooperative agreement described in subsection (a) shall be for a term of not more than 10 years. </text></subsection></section><section id="id0788767659444c5099b32664bd763f65"><enum>105.</enum><header>Tree planting for communities</header><subsection id="idbdc6c8893ee544348c4701a295f42cff"><enum>(a)</enum><header>Job corps program</header><text>The Secretary of Labor shall—</text><paragraph id="id867df98e6dd7494c9e66245e93c650b3"><enum>(1)</enum><text>develop a career and technical education and training program focused on tree planting or tree maintenance; and</text></paragraph><paragraph id="id64ede8299cde45bd926f9a4f6600843b"><enum>(2)</enum><text>offer the program as part of the Job Corps program.</text></paragraph></subsection><subsection id="id118635af485b4eaca5f0c9e2aafa43ce"><enum>(b)</enum><header>Retail power provider tree planting grant program</header><paragraph id="idc832f15a5c3a4457a11ca887677c0737"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Energy (referred to in this subsection as the <quote>Secretary</quote>), in consultation with the Secretaries, shall establish a program under which the Secretary shall award grants to States, Indian Tribes, local governments, nonprofit organizations, and retail power providers to conduct tree planting projects in accordance with this subsection (referred to in this subsection as the <quote>program</quote>).</text></paragraph><paragraph id="idf9111e7022f847a593c4d47f49f116cc"><enum>(2)</enum><header>Applications</header><text>An entity seeking to receive a grant under the program shall submit to the Secretary an application at such time, in such form, and containing such information as the Secretary may require, including a description of how the project to be carried out using the grant funds will reduce residential energy consumption.</text></paragraph><paragraph id="id1a20bd805c3448cb83f7970ab458c213"><enum>(3)</enum><header>Priority</header><text>In awarding grants under the program, the Secretary shall—</text><subparagraph id="id04EC6A368ED34D778440C64267A5BAA2"><enum>(A)</enum><text>give priority to tree planting projects that would provide the largest potential reduction in residential energy consumption for households; and</text></subparagraph><subparagraph id="id47c687467ee9459dbf83d9bad678de18"><enum>(B)</enum><text>for projects to be carried out in an urbanized area of the United States, analyze tree equity scores to prioritize socioeconomically disadvantaged neighborhoods with the greatest need.</text></subparagraph></paragraph><paragraph id="id64CEB9E4CA6A4147981B788E7098359B"><enum>(4)</enum><header>Variety of geographic locations</header><text>In awarding grants under the program, the Secretary shall ensure diverse and equitable geographic representation among the grant recipients.</text></paragraph><paragraph id="id8671b9a3a25a410fab354c28f23a0143"><enum>(5)</enum><header>Cost-share</header><subparagraph id="id82c09b8423da458381820738a6f61310"><enum>(A)</enum><header>Federal share</header><text>Subject to subparagraph (C), the Federal share of the cost of a tree planting project carried out using a grant under the program shall be not more than 50 percent.</text></subparagraph><subparagraph id="idcd75380900004486a329b44b23aead47"><enum>(B)</enum><header>Non-federal share</header><text>The non-Federal share of the cost of a tree planting project carried out using a grant under the program may be in the form of—</text><clause id="id4d07416dabac4a4884d7c1071ac7289b"><enum>(i)</enum><text>cash or donations received directly from non-Federal sources; or</text></clause><clause id="id0f2617d778224ae7a0ce857cc4b90067"><enum>(ii)</enum><text>in-kind contributions.</text></clause></subparagraph><subparagraph id="id8581be94ec254f06857eab4ed757cd15"><enum>(C)</enum><header>Waiver</header><text>The Secretary may, on a case-by-case basis, increase the Federal share described in subparagraph (A) if a tree planting project carried out using a grant under the program is located wholly in an economically distressed community.</text></subparagraph></paragraph></subsection></section><section id="idadeb9afb9efa4e529c552b1d09f254b2"><enum>106.</enum><header>Revegetation on abandoned mine land</header><subsection id="id66568d128f9a411691ef66ad26dcb3e1"><enum>(a)</enum><header>Pilot program</header><paragraph id="idfeb7f83e4d97495bbaf5d6307636f518"><enum>(1)</enum><header>Establishment</header><text>Using funding available to the Secretary, the Secretary shall establish a pilot program to establish native trees, shrubs, or grasses (referred to in this section as <quote>vegetation</quote>) on eligible mined land described in paragraph (6).</text></paragraph><paragraph id="id08d4d89c55334eefbdf27b89f4b1d7d0"><enum>(2)</enum><header>Financial assistance</header><text>In carrying out the pilot program established under paragraph (1), the Secretary shall—</text><subparagraph id="id10cd846998ef4629acc1d6c8c0cbcb4f"><enum>(A)</enum><text>in coordination with the Secretary of Agriculture, establish vegetation on eligible mined land located on Federal land;</text></subparagraph><subparagraph id="id176c2442f76d44baab6d51fbf3322037"><enum>(B)</enum><text>offer financial assistance to States to establish native vegetation on eligible mined land located on State land;</text></subparagraph><subparagraph id="id42190d5757bc48baacd9a62975bca870"><enum>(C)</enum><text>offer financial assistance to Indian Tribes to establish native vegetation on eligible mined land located on Tribal land or land held in Trust for an Indian Tribe; and</text></subparagraph><subparagraph id="ide3210f2198334e0a92ebb2a9e66887cc"><enum>(D)</enum><text>establish vegetation or offer financial assistance to States or other entities to establish native vegetation on eligible mined land located on private land.</text></subparagraph></paragraph><paragraph id="ide9c78b8ff38f4157bd055957897e6db2"><enum>(3)</enum><header>Compatibility with existing operations</header><subparagraph id="idfc5b092218a94fd5bd30f7dfda6a27b8"><enum>(A)</enum><header>Consultation</header><text>Prior to selecting a project for funding under the pilot program established under paragraph (1), the Secretary shall consult with, as applicable, the relevant Office of Surface Mining Reclamation and Enforcement abandoned mine land program office to confirm that the proposed project is compatible with any current mining, exploration, or reclamation activities.</text></subparagraph><subparagraph id="ida04faf5c4af6417aa2b2db2865fe9ea8"><enum>(B)</enum><header>Restriction</header><text>The Secretary shall not provide financial assistance under paragraph (2) to a person or entity with an ongoing legal obligation to revegetate the land in a project area.</text></subparagraph></paragraph><paragraph id="id446176feccb7424281d6a58bb3f2e062"><enum>(4)</enum><header>Activities</header><text>The following activities associated with a project to establish vegetation on eligible mined land shall be eligible for financial assistance under paragraph (2):</text><subparagraph id="id73fd8eb8a29540b7a7da4851f9dd1510"><enum>(A)</enum><text>Site preparation, including ripping compacted soils and incorporating soil amendments.</text></subparagraph><subparagraph id="idd4dcc0b163914ecd88cee99df6ef84b1"><enum>(B)</enum><text>Vegetation planting.</text></subparagraph><subparagraph id="id1eadc79330e44859882f43681e7be802"><enum>(C)</enum><text>Maintenance, including watering, to the extent necessary to establish vegetation under this section.</text></subparagraph><subparagraph id="id190f3d14fad840da8eb19b29d936d434"><enum>(D)</enum><text>Managing competing vegetation.</text></subparagraph></paragraph><paragraph id="id90f69346b4fa48b8995a1e0e6da198b7"><enum>(5)</enum><header>Preference</header><text>Under the pilot program established under paragraph (1), the Secretary shall, to the maximum extent practicable, seek to establish vegetation that—</text><subparagraph id="id31721edb9de34f03a08ff986e613df45"><enum>(A)</enum><text>is ecologically appropriate; and</text></subparagraph><subparagraph id="idbc43eadddd8a4cfca9dc83159539cd69"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8F92ABBA10C74EFE839791795F14EBCD"><enum>(i)</enum><text>has a high capacity to sequester and store carbon; </text></clause><clause id="id80C20C53A44548B4800925E84BD2EE5C" indent="up1"><enum>(ii)</enum><text>serves to reconnect established landscapes or enhance habitat connectivity; or</text></clause><clause id="id6f6161695a2c405eae6e41463435e88e" indent="up1"><enum>(iii)</enum><text>would establish wildlife habitat that is underrepresented in the State in which the project is located.</text></clause></subparagraph></paragraph><paragraph id="idb08e2ed6c1734ef5a72ba84232f6627c"><enum>(6)</enum><header>Eligible mined land</header><text>To be eligible for financial assistance under paragraph (2), a tree planting project shall be located on—</text><subparagraph id="ida1203bf3f7a14325b634dc8ba66abc7c"><enum>(A)</enum><text>land that was mined prior to the date of enactment of this Act;</text></subparagraph><subparagraph id="idebc7bbb080d34ee4aeeb7f521146e7c5"><enum>(B)</enum><text>in the case of State land or private land, land that is accessible to the public for not less than 1 day per year; and</text></subparagraph><subparagraph id="id81d05c643e644bc2961a268b8923079b"><enum>(C)</enum><text>in the case of private land, land owned by a person, or a nongovernmental organization, that has submitted to the Secretary or the State in which the land is located a request seeking to participate in the pilot program under this section.</text></subparagraph></paragraph><paragraph id="idd9e95e9458154e739e92e75a00e671eb"><enum>(7)</enum><header>Termination</header><text>The pilot program established under paragraph (1) shall be in effect for the 8-year period beginning on the date of enactment of this Act.</text></paragraph></subsection><subsection id="ide103d8aea7b9480db0190b7bcd42b41d"><enum>(b)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the accomplishments of the pilot program established under subsection (a)(1), including—</text><paragraph id="ide50a91d26ecf45f983bc498d34214ea7"><enum>(1)</enum><text>jobs created or supported in rural areas;</text></paragraph><paragraph id="id4d075b9c62374b55a69d7d4b9712cd83"><enum>(2)</enum><text>increases in the abundance of wildlife species, including game species and song birds;</text></paragraph><paragraph id="id4b8d5124be2d4ba89056d9375324bdaf"><enum>(3)</enum><text>opportunities for hunting and other compatible outdoor recreation; and</text></paragraph><paragraph id="idd3b51b81736a449caf417c52e79225f1"><enum>(4)</enum><text>an estimate of—</text><subparagraph id="id1F64DC06BF8443F6A32E6635D6734099"><enum>(A)</enum><text>carbon sequestered during the 5-year period beginning on the date on which the pilot program is established; and</text></subparagraph><subparagraph id="id59AEF18A8644413091CB24C0CF6640AA"><enum>(B)</enum><text>projected additional carbon sequestration and storage during the 15-year period beginning on the last day of the period described in subparagraph (A).</text></subparagraph></paragraph></subsection></section><section id="idc61440b69f93475b9fd78edd0eec5bec"><enum>107.</enum><header>International reforestation</header><text display-inline="no-display-inline">The Secretary of Agriculture, acting through the Chief of the Forest Service, may—</text><paragraph id="id1a9922bc12db4743a806ae62ca0a7e18"><enum>(1)</enum><text>evaluate a request from another country for technical assistance for tree planting activities;</text></paragraph><paragraph id="id6f83dc0db4e641dc9e984efa6bd8accc"><enum>(2)</enum><text>subject to the evaluation under paragraph (1) and the availability of Forest Service personnel and funding, provide to another country technical assistance for tree planting activities, including sharing—</text><subparagraph id="idfa79aae34321471a8446d93ddf14c4a0"><enum>(A)</enum><text>personnel; and</text></subparagraph><subparagraph id="id5723823a62944ff88634c905878e5a9f"><enum>(B)</enum><text>knowledge through communications and technical on-site instruction; and</text></subparagraph></paragraph><paragraph id="idba799ef898694682a54861ca6a9c3bab"><enum>(3)</enum><text>enter into a partnership with a nongovernmental entity that is located outside the United States or that is located in the United States and operates internationally—</text><subparagraph id="id9195b0aea01c42c8a4f7d4799ad89b6f"><enum>(A)</enum><text>to engage in activities that restore vegetation; and</text></subparagraph><subparagraph id="id52de936d086445dd8215c5d417b2d70e"><enum>(B)</enum><text>to promote and improve global carbon sequestration through revegetation activities.</text></subparagraph></paragraph></section></title><title id="idAFD0EADB22AA4E4BB5EC4E98D439AE45" style="OLC"><enum>II</enum><header>Carbon sequestration through forest management and innovation</header><section id="id3F7DCDB254E64A18AF9FB393566EB79C"><enum>201.</enum><header>Forest management from carbon credits</header><subsection id="idE4F38008B3AB4883B7950BFE1C8E63F0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ide0af6b459c1343aabd5763e443dbcd71"><enum>(1)</enum><header>Carbon credit</header><text>The term <term>carbon credit</term> means a carbon or greenhouse gas credit, offset, or other defined unit—</text><subparagraph id="id1a2798f8661c459bbc00c3160ec5d60a"><enum>(A)</enum><text>approved by a credible, third-party entity; and</text></subparagraph><subparagraph id="id17d9b9f57fcc43feaf9fe57d88c18c42"><enum>(B)</enum><text>as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id9c3c254092034a74a05b975aea0f28af"><enum>(2)</enum><header>Carbon credit program</header><text>The term <term>carbon credit program</term> means a voluntary program or market that issues, assigns, trades, or sells carbon credits.</text></paragraph><paragraph id="id05e414b4d22f4cd081c7b3be73fdbfc6"><enum>(3)</enum><header>Covered activity</header><text>The term <term>covered activity</term> means an improved forest management activity, including a hazardous fuel treatment, mechanical thinning, or timber harvesting project, that is—</text><subparagraph id="idf931920fcfd0492081bae8a423319198"><enum>(A)</enum><text>ecologically appropriate;</text></subparagraph><subparagraph id="idf309752bb6e444a780c706bd2778ece0"><enum>(B)</enum><text>carried out on National Forest System land;</text></subparagraph><subparagraph id="id1fbf55a7ed924e008d95023b45dfe1b5"><enum>(C)</enum><text>designed—</text><clause id="id2001fb89b5f140b9b56bf2fc20506dd0"><enum>(i)</enum><text>to increase rates of carbon sequestration;</text></clause><clause id="id21c4cf6e09d74184ba72c4f5c8f5a73f"><enum>(ii)</enum><text>to increase long-term carbon storage in durable wood products; or</text></clause><clause id="id057beed2dae14b7b887684ca130df9f2"><enum>(iii)</enum><text>to mitigate or avoid carbon emissions;</text></clause></subparagraph><subparagraph id="idea6bd7f2df224e5eaaf95e21cf1180f0"><enum>(D)</enum><text>carried out by—</text><clause id="id145f15f4288a42aeb9dc75b47e1c4ea0"><enum>(i)</enum><text>the Secretary; or</text></clause><clause id="id82eeee7502234665a4fac63f9d6dbd5e"><enum>(ii)</enum><text>a non-Federal entity under any existing authority available to the Secretary; and</text></clause></subparagraph><subparagraph id="id65790318e7644fe88f7167d60b296078"><enum>(E)</enum><text>not in competition with or adverse to the issuance, assignment, trading, or selling of forest carbon in the private sector. </text></subparagraph></paragraph><paragraph id="id2b1b21ddb7cd4cbdaeb55c471c51e402"><enum>(4)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> does not include—</text><subparagraph id="id2ae0b5e414ef46c5aa159bddb5dd32c3"><enum>(A)</enum><text>the national grasslands and land utilization projects administered under title III of the Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010 et seq.</external-xref>); or</text></subparagraph><subparagraph id="id5a7f4b54f8bf42aea1e25ef99042d43a"><enum>(B)</enum><text>National Forest System land east of the 100th meridian.</text></subparagraph></paragraph><paragraph id="id765ce272113f4a98bb54598275f6dd24"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph></subsection><subsection id="id5b25a67594f94d518c043bcadb856f65"><enum>(b)</enum><header>Funds associated with carbon credits for forest management</header><paragraph id="id639c8c90a3f34138b07f337963db597b"><enum>(1)</enum><header>In general</header><text>The Secretary may use to support the implementation of covered activities, without further appropriation or fiscal year limitation, funds received from a non-Federal entity—</text><subparagraph id="id7ec7184b144d4e29b7cc173c84e975f3"><enum>(A)</enum><text>through a carbon credit program; or</text></subparagraph><subparagraph id="id297747031f8c4809842f82ce6ee7051f"><enum>(B)</enum><text>for a carbon credit generated from National Forest System land.</text></subparagraph></paragraph><paragraph id="idd544f9ea866b4d1983af047cd2db4ca7"><enum>(2)</enum><header>Supplement, not supplant</header><text>Amounts made available under paragraph (1) shall supplement, and not supplant, any other amounts made available for covered activities.</text></paragraph></subsection><subsection id="id233edb370cb3458e9052639939076adb"><enum>(c)</enum><header>Management of carbon credit transactions by national forest foundation</header><paragraph id="idcd8eae975ee04a678cafa33043aba381"><enum>(1)</enum><header>In general</header><text>The National Forest Foundation shall receive and distribute any funds received under subsection (b)(1).</text></paragraph><paragraph id="id6e9030840d974a74a0d105d1421dd7a2"><enum>(2)</enum><header>Other partners</header><text>The National Forest Foundation may work with other entities that use funds received through a carbon credit program or for a carbon credit generated from National Forest System land to design, manage, account for, or implement a covered activity.</text></paragraph><paragraph id="id22a3fdd16b104fec85920400411e5f18"><enum>(3)</enum><header>Methodology</header><text>For the management of transactions described in this section, the National Forest Foundation, in collaboration with the Secretary, shall develop and use a methodology that calculates the predicted increase in carbon sequestration or in the longevity of long-term carbon storage for a project or the avoided release of carbon due to reduction of the risk of high-severity fire and other disturbances, by considering—</text><subparagraph id="ida29e8fcf225d4bf9b064372255cbb7ba"><enum>(A)</enum><text>retention of forest cover;</text></subparagraph><subparagraph id="idf38a2d00f34148aeb55a70e000bfbbbc"><enum>(B)</enum><text>carbon sequestration rates before and after the implementation of a covered activity;</text></subparagraph><subparagraph id="id7cab84af272b45d0a1a0d53e790b26ec"><enum>(C)</enum><text>reduction in the risk of tree mortality;</text></subparagraph><subparagraph id="id788e5d7781484443a9a2081afd05f7cb"><enum>(D)</enum><text>restoration of historic fire regimes; and</text></subparagraph><subparagraph id="id91eede648a314b15b6c1b7e7fc9cbd08"><enum>(E)</enum><text>the long-term storage of carbon in long-lasting wood products.</text></subparagraph></paragraph></subsection><subsection id="id6da1f15d730144319066350514c2df52"><enum>(d)</enum><header>Reports to congress</header><text>The Secretary, in collaboration with the National Forest Foundation, shall annually submit to Congress a report describing the status of the program under this section, including—</text><paragraph id="idefd28c2b16a84e708f86124a87e7ed1d"><enum>(1)</enum><text>the extent to which additional covered activities that were implemented with funding received under subsection (b)(1) have been carried out; and</text></paragraph><paragraph id="id3bbe69c374e543e5b33f3c900568074a"><enum>(2)</enum><text>any recommendations to improve or expand the program, including expansion of the authorities under this section to land managed by the Secretary of the Interior.</text></paragraph></subsection><subsection id="id52330d0edba8410da155a3f8e42cecfa"><enum>(e)</enum><header>Effect</header><text>Nothing in this section authorizes any activity that is inconsistent with—</text><paragraph id="id712f0021f6d14e0a94c590e5b168708e"><enum>(1)</enum><text>any applicable forest plan; or</text></paragraph><paragraph id="id5e18b7c29da149d4bc1298e5ebe94371"><enum>(2)</enum><text>any other provision of law (including regulations).</text></paragraph></subsection></section><section id="idc74bf82f2c6f44e6b06d542d8b511af2"><enum>202.</enum><header>Recovery and restoration treatments following stand-replacing disturbances</header><subsection id="id67f7893af552447594087d478c61b8ff"><enum>(a)</enum><header>Definition of stand-Replacing disturbance</header><text>In this section, the term <term>stand-replacing disturbance</term> means a natural disturbance event, including a wildland fire or other event, that kills all or most of the living overstory trees in a stand and initiates forest succession or regrowth on a unit of the National Forest System.</text></subsection><subsection id="ide2189ab127454e1db4598b24f03c6820"><enum>(b)</enum><header>Pilot national forests</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture, acting through the Chief of the Forest Service (referred to in this section as the <term>Secretary</term>), shall identify units of the National Forest System that the Secretary determines to be at high or very high risk of experiencing a stand-replacing disturbance during the 10-year period following the date of enactment of this Act.</text></subsection><subsection id="id043e84b1bb3347e7992f470e759fadda"><enum>(c)</enum><header>Interdisciplinary teams</header><paragraph id="id67ed337a5a4743a7a3fd10a48255ab26"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall establish an interdisciplinary post-disturbance planning team (referred to in this section as the <term>team</term>) to assist in carrying out the requirements of this section.</text></paragraph><paragraph id="idf18175c40ea54482a1274ec639adb0b6"><enum>(2)</enum><header>TEAMS Enterprise</header><text>The Secretary may employ a Forest Service enterprise team or a regional planning center to meet the requirement of this subsection.</text></paragraph></subsection><subsection id="ida812f40a57484ccc8296a38ba8faf4cb"><enum>(d)</enum><header>Model Land and Resource Management Plan Amendment</header><paragraph id="id5fd8b07bc9dc4e98af432c132cd3105b"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary, in cooperation with the team, shall develop a model land and resource management plan amendment establishing plan content for future site-specific project-level decisions if a stand-replacing disturbance occurs on units of the National Forest System identified under subsection (b).</text></paragraph><paragraph id="id829fef66d2f546959834fe820d3c6770"><enum>(2)</enum><header>Content</header><text>The model amendment required under paragraph (1) shall include direction regarding post-disturbance management, including salvage logging and reforestation activities, to achieve desired conditions, objectives, standards, guidelines, suitability of lands, and other plan content, including goals and monitoring provisions, of the existing land and resource management plan on the applicable unit of the National Forest System, if a stand-replacing disturbance occurs.</text></paragraph><paragraph id="iddec0e9af48e845cd940f992253d96c54"><enum>(3)</enum><header>Use of Model Land and Resource Management Plan Amendment</header><text>The Secretary shall utilize the Model Land and Resource Management Plan Amendment, as adapted to the unique ecological and socioeconomic setting for each unit of the National Forest System identified under subsection (b), in carrying out subsection (e).</text></paragraph></subsection><subsection id="id8eba330a80094681b693aaa222f072f8"><enum>(e)</enum><header>Land and Resource Management Plan Amendments</header><paragraph id="idccd8a49ad9294c6d90426cc44f74f3f8"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 10 years, after the date of enactment of this Act, the Secretary, assisted by the team, shall amend the applicable land and resource management plan of each unit of the National Forest System identified under subsection (b).</text></paragraph><paragraph id="idf0628f46c9d3480b8ee59ea919bf5bc8"><enum>(2)</enum><header>Process</header><text>The Secretary shall comply with all relevant laws in carrying out this section.</text></paragraph><paragraph id="idee0c7c5071194a26aef09be8761b1868"><enum>(3)</enum><header>Election</header><text>The Secretary may comply with the provisions of this section by incorporating the requirements of this section into an ongoing land and resource management plan revision or amendment process.</text></paragraph></subsection></section><section id="id7ec99c8185a64494841b8b1378107175"><enum>203.</enum><header>Biochar and wood waste</header><subsection id="id09fca84c338a4ac8b84bab28e52416a6"><enum>(a)</enum><header>Food and Drug Administration biochar pilot program</header><paragraph id="id78b7ea09508942f78c125a577b60a429"><enum>(1)</enum><header>In general</header><text>The Commissioner of Food and Drugs (referred to in this subsection as the <quote>Commissioner</quote>), in consultation with the Secretary of Agriculture and in coordination with States, shall establish a pilot program to grant a nationwide food use authorization of biochar as a feed additive for cattle.</text></paragraph><paragraph id="id9073ae45a0544356a682c1ade2f47d88"><enum>(2)</enum><header>Terms</header><text>The pilot program described in this subsection shall be—</text><subparagraph id="id49c81571f81a4ec8a47eec240ed634f6"><enum>(A)</enum><text>for a period of not more than 5 years; and</text></subparagraph><subparagraph id="idc1e55cd0678d4a53b8d79ea55ec642d0"><enum>(B)</enum><text>subject to any conditions that the Commissioner determines appropriate.</text></subparagraph></paragraph><paragraph id="id0e77baa0b0204506817fe21b2ad2c147"><enum>(3)</enum><header>Savings clause</header><text>The Commissioner shall ensure that participation in the pilot program under this subsection is voluntary.</text></paragraph></subsection><subsection id="id6cda5f0fc6084c1e90acde56d2ae5d5d"><enum>(b)</enum><header>USGS commercialization plan</header><paragraph id="idCB8389EC32084FD28843305B78AB2494"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, acting through the Director of the United States Geological Survey, in coordination with any relevant non-Federal entities, shall develop and publish a national commercialization plan for the production, sale, and use of biochar as a soil amendment for plant growth improvement, including for commercial, agricultural, and residential use.</text></paragraph><paragraph id="idD812ACADE7BD4DA0BA0F22B7959F3985"><enum>(2)</enum><header>Requirement</header><text>The commercialization plan required under paragraph (1) shall, at a minimum— </text><subparagraph id="id4afda37b903949a9b22e8c8a54e1135c"><enum>(A)</enum><text>identify—</text><clause id="id09E94A7AD0E047ADB8B89B30B2CA69B0"><enum>(i)</enum><text>impediments to producing large quantities of biochar for agricultural, forestry, or other commercial uses; and</text></clause><clause id="id75AF9F7E0F1B43A0A42197F17F3B6EE4"><enum>(ii)</enum><text>solutions for those impediments; and</text></clause></subparagraph><subparagraph id="id8752bd5612c24dbc93ad291aac8e87ef" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>propose a framework for demonstration efforts to increase consumer demand for biochar.</text></subparagraph></paragraph></subsection></section><section id="id337b0101d7bc4823947a4b32e4bbe6de"><enum>204.</enum><header>Eradication of invasive grasses</header><subsection id="idfc3633b3bf2d47548224444444b5a577"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida5832a5053bb446dac0bc92f578a169c"><enum>(1)</enum><header>Action plan</header><text>The term <term>action plan</term> means the action plan developed under subsection (b).</text></paragraph><paragraph id="id59a6626ac445429b92bf281d31f6ea4b"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="id58344d423f0249b3b30a37bbcdc3ae5d"><enum>(A)</enum><text>National Forest System land, except—</text><clause id="ide4bfa84a82a24e0ca72ae19b914c0c56"><enum>(i)</enum><text>the national grasslands and land utilization projects administered under title III of the Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010 et seq.</external-xref>); and</text></clause><clause id="id870b775e2fbe4affb36c1c69067ebe7c"><enum>(ii)</enum><text>National Forest System land east of the 100th meridian; and</text></clause></subparagraph><subparagraph id="id7068c6ab540a4cd7ad691bd7ce053735"><enum>(B)</enum><text>land under the jurisdiction of the Secretary.</text></subparagraph></paragraph><paragraph id="id92535d98a96c449484beeb2dfa97f153"><enum>(3)</enum><header>Invasive grass</header><text>The term <term>invasive grass</term> means—</text><subparagraph id="id6535e034d0bb4aa2a2074c0b2005e25c"><enum>(A)</enum><text>cheatgrass;</text></subparagraph><subparagraph id="idbcbbce9246e3400abd76744c68d47066"><enum>(B)</enum><text>ventenata;</text></subparagraph><subparagraph id="id90d8b56ce367467c8bd03a0b624b2e59"><enum>(C)</enum><text>medusahead; and</text></subparagraph><subparagraph id="idef4445cb97784017a656d3405adc76b3"><enum>(D)</enum><text>any additional invasive, nonnative annual grass species that the Secretaries determine pose a risk by—</text><clause id="id07de0f8a8fd24bda91408847226d8722"><enum>(i)</enum><text>increasing fire vulnerability and fire spread; and</text></clause><clause id="ide78d52ef25434539a227a1e060d219be"><enum>(ii)</enum><text>altering fire regimes.</text></clause></subparagraph></paragraph><paragraph id="id9AE3C3F6B9484117A91C2DFDC162F9A2"><enum>(4)</enum><header>Target treatment area</header><text>The term <term>target treatment area</term> means a target treatment area described in subsection (b)(2)(D).</text></paragraph></subsection><subsection id="id5317771d77d74239bf7415d1804b2922"><enum>(b)</enum><header>Action plan</header><paragraph id="id0a722604e4704f6e811fd4f7581893a5"><enum>(1)</enum><header>In general</header><text>The Secretaries shall jointly develop and implement an action plan to map, treat, and control invasive grass—</text><subparagraph id="id64584778a8564f468811694acccb08db"><enum>(A)</enum><text>to promote the resiliency, biodiversity, and carbon sequestration capacity of forests, rangelands, and grasslands;</text></subparagraph><subparagraph id="id2c0fe23820ff4f129842f3dac910ca5a"><enum>(B)</enum><text>to minimize risks from wildfire; and</text></subparagraph><subparagraph id="id98070b7af0ef40afaaafba9515642cd1"><enum>(C)</enum><text>to enhance the quality of forage for wildlife and livestock. </text></subparagraph></paragraph><paragraph id="idf67c78c881b644b39bd5f47636bbb94f"><enum>(2)</enum><header>Requirements</header><text>The action plan shall—</text><subparagraph id="idc6427aa5d7b940d7bc7ee3ddd5badabe"><enum>(A)</enum><text>consider or incorporate existing efforts;</text></subparagraph><subparagraph id="id7728b1a99d1343ac849a033775e613d9"><enum>(B)</enum><text>take into account—</text><clause id="id5730109ea6e14ee1aec070c45a23b959"><enum>(i)</enum><text>the latest science;</text></clause><clause id="ida1c54bdc0c744e2da003b533ca040c03"><enum>(ii)</enum><text>best practices; and</text></clause><clause id="id999f04f5be96457684344fe73e5984ec"><enum>(iii)</enum><text>available deployment tools;</text></clause></subparagraph><subparagraph id="idb104368eae8e4cdf8032de4e8c954123"><enum>(C)</enum><text>be prepared in coordination with State and local governmental entities and the heads of other Federal agencies, including the Chief of the Natural Resources Conservation Service, that are engaged in activities to control invasive grass to leverage and maximize funding and resources;</text></subparagraph><subparagraph id="idbe67d9bb5f7a44949e9e76445a9ea4f1"><enum>(D)</enum><text>identify and depict on a map target treatment areas that focus on—</text><clause id="id9e310e9ae4ac43c3809332ed5391c618"><enum>(i)</enum><text>areas with a large quantity of invasive grass where revegetation with native species is most likely to succeed;</text></clause><clause id="idda07d29dc09e4e09a8869cbcc553ead3"><enum>(ii)</enum><text>areas at high risk of wildfire;</text></clause><clause id="id72cfc02670634ac1949586c400902867"><enum>(iii)</enum><text>areas in which invasive grass negatively impacts livestock grazing or other uses;</text></clause><clause id="id371593e0dc014a4087343a3b899f7f20"><enum>(iv)</enum><text>wildlife habitat and forage needs, particularly sagebrush habitat; </text></clause><clause id="id90baa203556a4612bffc9057f4d74016"><enum>(v)</enum><text>areas prone to infestations; or</text></clause><clause id="id5c8c6d8086e74e3d905b4c08a367d78b"><enum>(vi)</enum><text>areas deemed important by the Secretaries; </text></clause></subparagraph><subparagraph id="idca5afd44d59f4aafa29fb0382e47df20"><enum>(E)</enum><text>establish—</text><clause id="id569D6E0F9473419FB0B8C06357B8003A"><enum>(i)</enum><text>specific goals;</text></clause><clause id="id7DD791A86103460F9683D552F5A6DDB8"><enum>(ii)</enum><text>specific implementation actions that the Secretaries and partners of the Secretaries will conduct over a 5-year period; and</text></clause><clause id="id7470054D4CEC48ED91015C08F427AE37"><enum>(iii)</enum><text>targets, including acres to be treated annually in the target treatment areas;</text></clause></subparagraph><subparagraph id="id28816fdbb0d4433ab2369a804db5756f"><enum>(F)</enum><text>provide for a combination of treatment methods for the most effective control of an invasive grass, including—</text><clause id="id4a42149d075447dba4095e90de1fa91f"><enum>(i)</enum><text>mechanical treatment methods;</text></clause><clause id="id3a3835a364c34fd1b10bd8f71c2fe57a"><enum>(ii)</enum><text>cultural treatment methods;</text></clause><clause id="id2906fa51027c443dbe0a49c0ae634fbd"><enum>(iii)</enum><text>biological treatment methods, which may include livestock grazing;</text></clause><clause id="idacf7bc1ee4204d139b6359f0d1b3a520"><enum>(iv)</enum><text>prescribed fire; and</text></clause><clause id="id033b5ad30a2341978978410e5473b750"><enum>(v)</enum><text>chemical treatment methods;</text></clause></subparagraph><subparagraph id="idb5903a999fa5478c86ac584b54f0675f"><enum>(G)</enum><text>identify and implement, to the extent practicable, best practices, such as the use of spray washing stations, to reduce the spreading of invasive grass seed adjacent to infested areas or into noninfested areas;</text></subparagraph><subparagraph id="ide54156d3f5bf434dbf24f6d0e92096f6"><enum>(H)</enum><text>identify methods and tools for the post-treatment monitoring of target treatment areas to determine the effectiveness of a treatment and control efforts;</text></subparagraph><subparagraph id="id26252e70237d4e81bfa52e2b3777bcdd"><enum>(I)</enum><text>initiate and expedite environmental reviews for treatments, as required by applicable law, including identifying—</text><clause id="id36adb63628d54487b6f1ca834bdd9974"><enum>(i)</enum><text>methods for achieving timely decisions and implementation for treatments, monitoring, and follow-up treatments based on monitoring; and</text></clause><clause id="idbc124f7ec32a43758c5a084fd0562f8a"><enum>(ii)</enum><text>maximizing opportunities to cooperate with other Federal and State agencies in analysis, assessments, and studies; and</text></clause></subparagraph><subparagraph id="id838a6cd43ddd4f7194c3d5dc59ccec57"><enum>(J)</enum><text>establish guidelines that—</text><clause id="id26b859e509cb432d8151763a4b9c9d0b"><enum>(i)</enum><text>if native, intact grasses are absent within a target treatment area and the target treatment area is prone to high-risk vectors or pathways—</text><subclause id="idf362219c7d9645738935be0fa54caece"><enum>(I)</enum><text>identify geographically based desirable, native seed mix and seed reserves;</text></subclause><subclause id="idd1f9f98995ea418181bf00c5e27163e6"><enum>(II)</enum><text>prioritize reseeding the area in the target treatment area; and</text></subclause><subclause id="id25b3d112fb384a108e0ab9d7928b1e3d"><enum>(III)</enum><text>monitor for the presence of new invasive grass and promptly treat any invasive grass present; and</text></subclause></clause><clause id="id2eb5890a5be14a95845c7e306bd87ea2"><enum>(ii)</enum><text>if, after conducting a treatment, desirable native grasses are established and dominant in a target treatment area, provide for the natural restoration of native grasses.</text></clause></subparagraph></paragraph><paragraph id="idd216d6c15e1e4d6ca0653e9296ff7b4d"><enum>(3)</enum><header>Deadline to finalize action plan</header><text>Not later than 270 days after the date of enactment of this Act, the Secretaries shall finalize the action plan.</text></paragraph><paragraph id="id5e35bd865830492bbbe651367deb89aa"><enum>(4)</enum><header>Implementation of action plan</header><subparagraph id="idc6d7c022fbf742b5a5481b660588bea8"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date on which the action plan is finalized under paragraph (3), the Secretaries shall begin implementing the action plan.</text></subparagraph><subparagraph id="id61a56ef2f6b44bf88eeaab2ab9555319"><enum>(B)</enum><header>Memoranda of understanding and agreements</header><text>In implementing the action plan, the Secretary concerned may enter into a memorandum of understanding or an agreement with non-Federal entities, as appropriate, to carry out activities under the action plan to control the spread of an invasive grass on Federal land or land adjacent to Federal land.</text></subparagraph><subparagraph id="id508d15ffa2a24962b47d10b3a762eccb"><enum>(C)</enum><header>Cooperating agency coordination</header><text>The Secretary concerned shall, to the extent practicable, offer to assist in the preparation of environmental reviews that may be necessary in implementing treatment and control activities on non-Federal land.</text></subparagraph></paragraph></subsection><subsection id="idbb6bd07b645b4eba9e0aa7dbfa87a775"><enum>(c)</enum><header>Reports to Congress</header><text>Not later than 18 months after the date of enactment of this Act, and annually thereafter during the period in which the action plan is being implemented, the Secretaries shall submit to Congress a report assessing the effectiveness of the action plan that includes a description of—</text><paragraph id="idc78196c20dca4f3bbb1119bbdb5237af"><enum>(1)</enum><text>the location of the target treatment areas;</text></paragraph><paragraph id="id25d4046490d24472bec6b7beb8d9fce5"><enum>(2)</enum><text>the number of acres within target treatment areas on which treatments were conducted;</text></paragraph><paragraph id="ida387b1127dfb48e5afd3ef36af749bfb"><enum>(3)</enum><text>the agreements or partnerships entered into under subsection (b)(4)(B) to advance the implementation of the action plan; </text></paragraph><paragraph id="idacff4f44eeb24c74888f28a07a19d4c3"><enum>(4)</enum><text>monitoring information described in subsection (b)(2)(H); and</text></paragraph><paragraph id="id8bf065d9037e4976aef13b04b8866115"><enum>(5)</enum><text>recommendations for studies to explore innovative methods and practices to treat and control invasive grass.</text></paragraph></subsection><subsection id="id8b5c50d6d4914e6a8d84405f5e750488"><enum>(d)</enum><header>Funding</header><paragraph id="id0958a524fd864afaacd39b98c8d41cdd"><enum>(1)</enum><header>Outside funding</header><text>The Secretary concerned may accept non-Federal funds to implement any provision of this section.</text></paragraph><paragraph id="idccc77089798d49a5905fdfe0c7bf808f"><enum>(2)</enum><header>Other funding</header><text>In addition to any funding received under paragraph (1), the Secretaries may expend to carry out this section up to $30,000,000 of any funding made available to the Secretary concerned for invasive species control.</text></paragraph><paragraph id="id6fd2d7cd61d84891b87d65a81ebe5fab"><enum>(3)</enum><header>Limitations</header><text>Of the amounts made available to carry out this section, not more than 10 percent shall be used for development of the action plan. </text></paragraph></subsection></section></title><title id="id09E5F0C896144F908CE0591FA26C5C16" style="OLC"><enum>III</enum><header>Mass timber</header><section id="id003ed44d0b7b4af099da5478c4980b5f"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="ida8381ba24d6d43138c6d7e66641d68e9"><enum>(1)</enum><header>Local approving agency</header><text>The term <term>local approving agency</term> means an agency or unit of a local government that is responsible for the issuance of permits for building construction.</text></paragraph><paragraph id="ide998b2ab39ab4d7db6f84c1e84da417d"><enum>(2)</enum><header>Mass timber</header><text>The term <term>mass timber</term> includes— </text><subparagraph id="id223B4DC3F6E2413EA8E3CDEBEDAD9A4C"><enum>(A)</enum><text>cross-laminated timber; </text></subparagraph><subparagraph id="idEE8CC65391DD4B098A697AC30447DE36"><enum>(B)</enum><text>nail laminated timber;</text></subparagraph><subparagraph id="idD7743D1323514BFB8BA9BB4F51C79976"><enum>(C)</enum><text>glue laminated timber; </text></subparagraph><subparagraph id="ide77a96d640214ba795cfd8fc6bddf1e3"><enum>(D)</enum><text>dowel laminated timber;</text></subparagraph><subparagraph id="idf2d9d9088c0a4281a7c2068f1f750c72"><enum>(E)</enum><text>laminated strand lumber; and</text></subparagraph><subparagraph id="id2dcaa48488ae43289143108939ca245d"><enum>(F)</enum><text>laminated veneer lumber.</text></subparagraph></paragraph><paragraph id="id859c0bec475e4afb88488ec95ac18aee"><enum>(3)</enum><header>Procuring agency</header><text>The term <term>procuring agency</term> means the Department of the Interior, the Forest Service, or a person that is a party to a contract with the Department of the Interior or the Forest Service, with respect to work performed under such a contract.</text></paragraph><paragraph id="id3e78126b976d42ccac825c6c2ad1af04"><enum>(4)</enum><header>Tall wood building</header><text>The term <term>tall wood building</term> means a building designed to be—</text><subparagraph id="id53eab97aaa6b4b2691b6f45684c48e3a"><enum>(A)</enum><text>constructed with mass timber; and</text></subparagraph><subparagraph id="id0a9302f436024f7fbfb7ec112581b7c8"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id30CF39FA0447426EBFAF0653D71DB3F6"><enum>(i)</enum><text>if a residential building, more than 4 stories in height; and</text></clause><clause id="id3e77faa3ce2947668df7e8ecd892cc5b" indent="up1"><enum>(ii)</enum><text>if a commercial building, more than 5 stories in height.</text></clause></subparagraph></paragraph></section><section id="id3353f72cb5f144bd8281ab8f46ad98dd"><enum>302.</enum><header>Joint mass timber science and education program</header><subsection id="id9f980363343745559df932c0c39c71db"><enum>(a)</enum><header>Mass timber science and education program with the forest products laboratory</header><text>The Secretary of Agriculture, acting through the Director of the Forest Products Laboratory of the Forest Service (referred to in this section as the <term>Secretary</term>), shall establish a mass timber science and education program to respond to the emerging research needs of architects, developers, and the forest products industry.</text></subsection><subsection id="id1b8a049dfd6f4eb0a938e9c0678f01b0"><enum>(b)</enum><header>Coordination</header><text>The Secretary shall work closely with research programs at colleges and universities in administering the mass timber science and education program established under subsection (a) to supplement the current research and educational efforts of colleges and universities.</text></subsection><subsection id="id87391745ca80458a85ff71d685f2a93b"><enum>(c)</enum><header>Purposes</header><text>The mass timber science and education program established under subsection (a) shall have the following principal purposes:</text><paragraph id="idd55c4ac17f7543d79bf697b496d1ef5c"><enum>(1)</enum><text>To provide practical research responsive to the needs of architects, developers, and the forest products industry, including assessments of carbon impacts in the originating forests and the end use of mass timber in the built environment.</text></paragraph><paragraph id="id5b873998c32b4afeb7b1355c326902ca"><enum>(2)</enum><text>To engage and listen to clients and then develop focused, strategic lines of new research responsive to those needs, which may include research relating to flammability and performance during a fire, structural characteristics, energy use and savings, acoustics, and slab construction composed of hybrid materials.</text></paragraph><paragraph id="id19dd26b1e6bb43f5be32ed55a4320400"><enum>(3)</enum><text>To solicit proposals from scientists who compete for funding through a rigorous peer-review process designed to ensure the best projects are funded.</text></paragraph><paragraph id="id4a10adc309804e6085bf96c28c7ee731"><enum>(4)</enum><text>To disseminate research findings using a suite of communication tools to ensure that architects, developers, and the forest products industry are aware of, understand, and can use the information to make sound decisions and implement projects.</text></paragraph><paragraph id="ida241a3c0a9e549d6b3d60b12afafde59"><enum>(5)</enum><text>To develop and facilitate the adoption, on a voluntary basis, of a curriculum for building structures using mass timber for use in schools of engineering and architecture that includes—</text><subparagraph id="ide822a4334cd546f7a58eb8e06191b216"><enum>(A)</enum><text>structural design; and</text></subparagraph><subparagraph id="ide1d142ae51f14696b54fa54a471ab78b"><enum>(B)</enum><text>the possibilities, benefits, and limitations of using mass timber in construction.</text></subparagraph></paragraph></subsection><subsection id="ide7433c4d89bc46adbffbfb9a62de967d"><enum>(d)</enum><header>Mass timber plan</header><text>Not later than September 30, 2022, the Secretary shall submit to the relevant committees of Congress a mass timber plan that includes—</text><paragraph id="id3b95c34bf59a4f57a3e056f15e70e461"><enum>(1)</enum><text>an assessment of the current state of knowledge about mass timber and tall wood buildings;</text></paragraph><paragraph id="id76d7929367d047c8beceb2ef0b869e32"><enum>(2)</enum><text>an integrated approach to improve knowledge sharing;</text></paragraph><paragraph id="idb3809907333d486a81418b577dbd83c1"><enum>(3)</enum><text>an approach for project monitoring and evaluation; and</text></paragraph><paragraph id="idc347e9f42beb464695daa8952d564032"><enum>(4)</enum><text>an approach for setting research priorities.</text></paragraph></subsection><subsection id="id28eedc2b28cf4e2585ee77aee07b2e77"><enum>(e)</enum><header>Stakeholder advisory group</header><paragraph id="id5a51b0dc17fe46b39e5d4410ab9bc2a8"><enum>(1)</enum><header>Membership</header><text>The Secretary shall appoint a stakeholder advisory group of technical experts that consists, at a minimum, of—</text><subparagraph id="ida424df9bdf32403299762069fb467f4f"><enum>(A)</enum><text>a Forest Service scientist;</text></subparagraph><subparagraph id="ide95a01d5704a4a10a4df385264721674"><enum>(B)</enum><text>a researcher from a college or university;</text></subparagraph><subparagraph id="id3b6a6f3f8aac47a58298114609d5442e"><enum>(C)</enum><text>a representative of a trade association;</text></subparagraph><subparagraph id="ided8ef441c93e4e07be3dd7257ae0b39a"><enum>(D)</enum><text>an architect or developer;</text></subparagraph><subparagraph id="id8d4968a5781a43679eadf1afd628e621"><enum>(E)</enum><text>a representative of a local approving agency;</text></subparagraph><subparagraph id="id94794b09da0c4d2089cbacef2ba55c89"><enum>(F)</enum><text>a representative of a forest products company; and</text></subparagraph><subparagraph id="ida103a5bb87e847019d06e503f1ad34c2"><enum>(G)</enum><text>a representative of a nongovernmental organization with experience—</text><clause id="idea75488bda3241f9b22b48af5a4c778f"><enum>(i)</enum><text>designing or constructing tall wood buildings; or</text></clause><clause id="id918ca6d8f8f64e26b08417c28fcfe84a"><enum>(ii)</enum><text>complying with or revising related building codes.</text></clause></subparagraph></paragraph><paragraph id="id1eb4cbfbdd0648e5a12ae36938eff981"><enum>(2)</enum><header>Duties</header><text>The stakeholder advisory group shall meet at least annually—</text><subparagraph id="idbe31fe91f8f34362ad0594ad9fddba4f"><enum>(A)</enum><text>to consider immediate and long-term science needs;</text></subparagraph><subparagraph id="idd7eff01518cd45ee828ae68deae5316d"><enum>(B)</enum><text>to suggest to the Secretary appropriate topic areas, specific issues within those topic areas, and information transfer needs for which the Secretary shall solicit proposals described in subsection (c)(3); and</text></subparagraph><subparagraph id="id25804a788e0d4fd9885d6d251c0218a5"><enum>(C)</enum><text>to assist the Secretary in drafting the mass timber plan required under subsection (d).</text></subparagraph></paragraph></subsection><subsection id="id7d15764c72764babb835dbbe205ad24c"><enum>(f)</enum><header>Assistance</header><text>The Secretary may provide to the Secretary of Transportation and to States technical assistance relating to the use of wood in bridges when undergoing revisions to a State bridge design manual.</text></subsection><subsection id="id3e0d196f3d3a4c409f4ebe05660f75f9"><enum>(g)</enum><header>Availability of appropriations</header><text>From amounts appropriated for Forest Service research, excluding funding made available for the Forest Inventory and Analysis program, the Secretary may use $4,000,000 to carry out the activities described in this section.</text></subsection></section><section id="id1caeeab967844946b7b3cccef85ffd66"><enum>303.</enum><header>Storing carbon in Federal buildings</header><subsection id="id12ac549321da4da28611866766afffbc"><enum>(a)</enum><header>Mass timber buildings database and plan</header><paragraph id="id4ce2e983473e450db380bcfe4a39ea37"><enum>(1)</enum><header>Database</header><text>The Secretaries, in coordination with any other relevant agencies, shall develop and maintain a running database of mass timber buildings that are owned or leased by the Federal Government and are occupied primarily by employees of the Secretaries (referred to in this subsection as the <quote>database</quote>).</text></paragraph><paragraph id="id92d37eb5de07410ab885f2720943a454"><enum>(2)</enum><header>Assessment</header><text>The Secretary of Agriculture, acting through the Director of the Forest Products Laboratory of the Forest Service, shall conduct an assessment of each mass timber building included in the database, which shall include collecting data on the embodied carbon of the materials used in the construction of the mass timber buildings included in the database.</text></paragraph><paragraph id="id7c0da770288b43b999712e09f9e784a0"><enum>(3)</enum><header>Plan</header><subparagraph id="ide2fcc71bb69340ec94e9c95618dd9bed"><enum>(A)</enum><header>In general</header><text>The Secretaries shall prepare a plan to increase the quantity of carbon stored in buildings that are owned or leased by the Federal Government and are occupied primarily by employees of Secretaries.</text></subparagraph><subparagraph id="id397fb2846c414ea9b324151a68aaf7ff"><enum>(B)</enum><header>Plan submission</header><text>Not later than 1 year after the date of enactment of this Act, the Secretaries shall submit the plan under subparagraph (A) to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources of the Senate</committee-name> and the <committee-name committee-id="">Committee on Natural Resources of the House of Representatives</committee-name>.</text></subparagraph><subparagraph id="id9700e7d62e0b48ec97b313d7fc19868c"><enum>(C)</enum><header>Material neutrality</header><text>The plan submitted by the Secretaries shall be, to the maximum extent practicable, material neutral, and may include using mass timber, carbon concrete, and any other materials.</text></subparagraph></paragraph></subsection><subsection id="id0b3b04186e0a44318340e63d5bd4cda1"><enum>(b)</enum><header>Minimum purchases</header><paragraph id="idf6ce0398ad364503ac00fdeaaf4ad889"><enum>(1)</enum><header>In general</header><text>Not later than September 30, 2025, subject to the exceptions listed in paragraph (2), the Secretaries shall procure facilities, buildings, or structures, including not fewer than 100 single-occupancy restrooms, using domestic mass timber.</text></paragraph><paragraph id="id72ceb8e4d4854b86813f9806cfcd2eaa"><enum>(2)</enum><header>Exceptions</header><text>The Secretaries may decide not to procure facilities, buildings, or structures using domestic mass timber if the Secretaries determine that the items—</text><subparagraph id="id10557e8afc214fafaada0dfc1983e33a"><enum>(A)</enum><text>are not reasonably available within a reasonable period of time;</text></subparagraph><subparagraph id="idba27eb5c963e4e42ae8dab6029de55eb"><enum>(B)</enum><text>fail to meet the reasonable performance standards of the procuring agencies;</text></subparagraph><subparagraph id="ide3856c45ec8b44489735965427302e71"><enum>(C)</enum><text>are not necessary to support the mission of the applicable agency; or</text></subparagraph><subparagraph id="id564afc9c81264bf7a5ada950dc6abe8e"><enum>(D)</enum><text>are available only at an unreasonable price.</text></subparagraph></paragraph></subsection><subsection id="ide92514e311d94388987de9e909726db5"><enum>(c)</enum><header>Coordination and technical assistance</header><text>The Secretary of Agriculture, acting through the Director of the Forest Products Laboratory of the Forest Service, may coordinate with other Federal agencies and non-Federal partners for the purpose of improving the management and efficiency of constructing mass timber buildings and infrastructure. </text></subsection></section></title><title id="ide0eb1838c7ae47e4b31f7f08ddf0f7ed"><enum>IV</enum><header>Research</header><section id="id31035bb077c14c6cab8fe94c70ecf3ac"><enum>401.</enum><header>Longevity of forest products</header><text display-inline="no-display-inline">The Secretary of Energy, in coordination with the Secretary of Agriculture, shall—</text><paragraph id="id3d0808e72812454785ab8e80a273e4eb"><enum>(1)</enum><text>develop more accurate and efficient methods and technologies to measure and monitor the amount and average lifespan of carbon stored in woody biomass energy feedstocks and building materials;</text></paragraph><paragraph id="id974be9e328f84fe88fbf1b51c44fb3a8"><enum>(2)</enum><text>by not later than 2 years after the date of enactment of this Act, publish estimates of the amount and average lifespan of carbon stored in different woody biomass energy feedstocks and building materials, including in short-lived forest products and long-lived wood products; and</text></paragraph><paragraph id="id191e8dcba4894b44a76a20c8aa7e21a6"><enum>(3)</enum><text>by not later than 3 years after the date of enactment of this Act, publish an estimate of the total amount of carbon stored in—</text><subparagraph id="ide518802b81294bf5807a658f8604a540"><enum>(A)</enum><text>short-lived forest products;</text></subparagraph><subparagraph id="idbd130b7f3da041b5b53ea4b58dcb8268"><enum>(B)</enum><text>building materials; and</text></subparagraph><subparagraph id="id8c45741d30804355a73a202ade0896bc"><enum>(C)</enum><text>other long-lived wood products.</text></subparagraph></paragraph></section><section id="id748315ce34fc4c9d968096d7912a78c0"><enum>402.</enum><header>Forest inventory and analysis</header><subsection id="id9a0f335339ad4553b41659c221d5aefc"><enum>(a)</enum><header>In general</header><text>To bring more innovation and efficiency to climate-resilient forestry actions in the United States, the Secretary of Agriculture, acting through the Chief of the Forest Service—</text><paragraph id="id74947cb774ad47c59a2201b9e57075ba"><enum>(1)</enum><text>shall publish a report, or expand on a report being published pursuant to another provision of law, that demonstrates the efforts of the Forest Service—</text><subparagraph id="ida7b785de5fe74ce8b023e142093751f0"><enum>(A)</enum><text>to measure a consistent historical series of field plots while using advanced technology, including remote sensing, to improve data and information; and</text></subparagraph><subparagraph id="id833daee0c9c5433689ba21c9e0ae2b28"><enum>(B)</enum><text>to use advanced geospatial technologies to improve area and volume estimates, especially for sub-State regions and smaller area estimates;</text></subparagraph></paragraph><paragraph id="idf970634c591f46e086a0a3fce399c5b6"><enum>(2)</enum><text>may use remote sensing technologies and other technologies to develop more accurate and efficient methods and to reduce costs to facilitate the measuring and monitoring of forest carbon in the United States, in a manner that can—</text><subparagraph id="idd615f2f2e83542f78cbf88732f572f66"><enum>(A)</enum><text>assess landscape-scale or regional-scale carbon stocking;</text></subparagraph><subparagraph id="id4098f0a0824c4dde8dde13c964d8a829"><enum>(B)</enum><text>improve the quantity and quality of the information available to policy makers and forest managers, including with regard to forest inventories and verification activities;</text></subparagraph><subparagraph id="id1b8b8cd11ec047c4a82aca6d0bf3e700"><enum>(C)</enum><text>empower private forest owners to participate in voluntary carbon crediting opportunities; and</text></subparagraph><subparagraph id="idb222f08c493844a785075b5cc88dd1c5"><enum>(D)</enum><text>enable—</text><clause id="id9b1c8c5a7ac447869c4ac405576d41f8"><enum>(i)</enum><text>a policy maker to compare the consequences of policy options to increase climate benefits from forests; and</text></clause><clause id="id5faa3212a448492984979721ebf3f648"><enum>(ii)</enum><text>an assessment of the effectiveness of a policy implemented to increase the climate benefits from forests; and</text></clause></subparagraph></paragraph><paragraph id="id295ba90f84ff4055851fa704f7cd1d0a"><enum>(3)</enum><text>may accelerate, or increase the frequency of, current inventories and data collection activities across all forest types to ensure consistent nationwide estimates of forest carbon pools that can reflect short-term changes from disturbances, such as wildfires, and management activities.</text></paragraph></subsection><subsection id="idb3c688558c5a40b6a3c007e92a85dd55"><enum>(b)</enum><header>Funding</header><text>The Secretary of Agriculture, acting through the Chief of the Forest Service, may annually use to carry out this section not more than $10,000,000 of any amount made available to the Forest Service for research.</text></subsection></section><section id="id2768b2b8963a4657982bfa5253048570"><enum>403.</enum><header>Bioeconomy research</header><text display-inline="no-display-inline">The Secretary of Agriculture, acting through the Director of the Forest Products Laboratory of the Forest Service, shall expand research relating to the use of wood—</text><paragraph id="id0B535BD7F6294B058C466E597346F0B4"><enum>(1)</enum><text display-inline="yes-display-inline">to facilitate the establishment of new markets, including nontraditional markets, for material produced from forest management projects that typically has little or no commercial value; </text></paragraph><paragraph id="idD94D3A4D6310401F8B4B6552A3621184"><enum>(2)</enum><text display-inline="yes-display-inline">to increase the economic viability of manufacturing products using material described in paragraph (1); and</text></paragraph><paragraph id="id31c2748e17ad4807a578b4dc4d6f31c1"><enum>(3)</enum><text>including structural testing of hardwood species for use in mass timber. </text></paragraph></section><section id="ide4904f64f2c248488cd61e6251fe8beb"><enum>404.</enum><header>Insurance product to replace buffers</header><text display-inline="no-display-inline">The Secretary of Agriculture, acting through the Chief of the Forest Service, may—</text><paragraph id="idac98dafadf20492dbbd9a4c53989eea4"><enum>(1)</enum><text>establish an intragovernmental revolving fund to maintain adequate buffer reserves for a project implementing a covered activity (as defined in subsection (a) of section 201) under that section to cover unforeseen losses in carbon stocks to address nonpermanence; and</text></paragraph><paragraph id="idd901e8a1ae054c1d8bce11be1686a65e"><enum>(2)</enum><text>transfer amounts into and out of the intragovernmental revolving fund established under paragraph (1) to serve as a buffer pool for covered activities referred to in paragraph (1).</text></paragraph></section><section id="idc407c295a58f431fa4cc891364f54a2d"><enum>405.</enum><header>Forest health threat centers</header><text display-inline="no-display-inline">The Secretary of Agriculture, acting through the Chief of the Forest Service, shall—</text><paragraph id="id32c5c5b497a34406a9878d52ecc40fc7"><enum>(1)</enum><text>seek to expand the services provided by the Western Wildland Environmental Threat Assessment Center and the Eastern Forest Environmental Threat Assessment Center such that those Centers become centers of excellence to inform large-scale climate-resilient forest management; and</text></paragraph><paragraph id="idd579e6b55ee1467293c90d4bcbca9dbf"><enum>(2)</enum><text>share the syntheses, models, and application tools developed by the Western Wildland Environmental Threat Assessment Center and the Eastern Forest Environmental Threat Assessment Center with—</text><subparagraph id="id2aaad1f0abe84e5396bfc6f419dcafc5"><enum>(A)</enum><text>the Department of Agriculture climate hubs; and</text></subparagraph><subparagraph id="id457cbf800f944f838fea3bd0b70fcd03"><enum>(B)</enum><text>the Climate Adaptation Science Centers managed by the Secretary, acting through the Director of the United States Geological Survey.</text></subparagraph></paragraph></section></title></legis-body></bill>
