<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2834</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210923">September 23, 2021</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> (for himself, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, and <cosponsor name-id="S386">Ms. Duckworth</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to preserve access to rehabilitation innovation centers under the Medicare program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dr. Joanne Smith Memorial Rehabilitation Innovation Centers Act of 2021</short-title></quote>.</text></section><section id="ida06f4697840b4e2dadf3b3a1fd750e97"><enum>2.</enum><header>Preserving access to rehabilitation innovation centers under Medicare</header><subsection id="idC99ABBE3B69E4661901370CCFC921DB7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1886(j)(7)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(j)(7)(E)</external-xref>) is amended—</text><paragraph id="idcf9e536fa9654b14a704ccbe98f782f1"><enum>(1)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">Public availability of data submitted</header-in-text>.—The</quote> and inserting “<header-in-text level="subparagraph" style="OLC">Public availability of data submitted</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf9bd946bda8a49ed9e4c3754f0d53d1d"><clause id="id040c4256276f4ed5b5e51856a56c0aa4"><enum>(i)</enum><header>In general</header><text>The</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id79996fa505804c8290657567e5ee7884"><enum>(2)</enum><text>by inserting after clause (i), as redesignated by paragraph (1), the following new clauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida819c9395d45439eb62eca1e68e87aee"><clause id="id82f062db7b894475ae43be34e753de6a"><enum>(ii)</enum><header>Public recognition of rehabilitation innovation centers</header><text>Beginning not later than one year after the date of the enactment of this clause, the Secretary shall make publicly available on such Internet website, in addition to the information required to be reported on such website under clause (i), a list of all rehabilitation innovation centers, and shall update such list on such website not less frequently than biennially. In carrying out the activities under this clause, the Secretary shall disseminate research, best practices, and other clinical information identified or developed by such rehabilitation innovation centers to, as appropriate, Federal agencies, hospitals, health professional organizations, and national and State accreditation bodies.</text></clause><clause id="id48892f618f51437999325cf2409c7c58"><enum>(iii)</enum><header>Rehabilitation innovation centers defined</header><text>For purposes of clause (ii), the term <term>rehabilitation innovation centers</term> means a rehabilitation facility that, as of the applicable date (as defined in clause (v)), is a rehabilitation facility described in clause (iv).</text></clause><clause id="idb7f862d8c60c4b95826e655931054573"><enum>(iv)</enum><header>Rehabilitation facility described</header><text>A rehabilitation facility described in this clause is a rehabilitation facility that—</text><subclause id="id2d36ee2be70d4265aa0b11f6e132eab6"><enum>(I)</enum><text>is classified as a rehabilitation facility under the IRF Rate Setting File for the Inpatient Rehabilitation Facility Prospective Payment System for Federal Fiscal Year 2019 (83 Fed. Reg. 38514), or any successor regulations that contain such information;</text></subclause><subclause id="id503f83a7efcf4cf292ace8a077e82e7c"><enum>(II)</enum><text>holds, as of the applicable date at least one Federal rehabilitation research and training designation for research projects on traumatic brain injury or spinal cord injury from the National Institute on Disability, Independent Living, and Rehabilitation Research at the Department of Health and Human Services, based on such data submitted to the Secretary by a facility, in a form, manner, and time frame specified by the Secretary;</text></subclause><subclause id="idB4C834219A664BB582638FAE0E1C4C07"><enum>(III)</enum><text>submits to the Secretary a description of the clinical research enterprise of the facility and a summary of research activities of the facility that are supported by Federal agencies;</text></subclause><subclause id="id7d2a8e9495a54288ba1fb0e572f379ad"><enum>(IV)</enum><text>has a minimum Medicare estimated weight per discharge of 1.20 for the most recent fiscal year for which such information is available according to the IRF Rate Setting File described in subclause (I), or any successor regulations that contain such information; and</text></subclause><subclause id="ida1466a1384484a7382a812a54b2b0301"><enum>(V)</enum><text>has a minimum teaching status of 0.075 for the most recent fiscal year for which such information is available according to the IRF Rate Setting File described in subclause (I), or any successor regulations that contain such information.</text></subclause></clause><clause id="iddcbe385db9e8494a938709afefbbfd74"><enum>(v)</enum><header>Applicable date defined</header><text>For purposes of clauses (iii) and (iv), the term <term>applicable date</term> means—</text><subclause id="idd4019f64c30047e59e4c216008859102"><enum>(I)</enum><text>with respect to the initial publication of a list under clause (ii), the date of the enactment of such clause; and</text></subclause><subclause id="id82065d08e7ac4c01bd6daae76b531c89"><enum>(II)</enum><text>with respect to the publication of an updated list under clause (ii), a date specified by the Secretary that is not more than one year prior to the date of such publication.</text></subclause></clause><clause id="id6024def11bb84e0b83cb3cce3ded9c73"><enum>(vi)</enum><header>Implementation</header><text>Notwithstanding any other provision of law the Secretary may implement clauses (ii) through (v) by program instruction or otherwise.</text></clause><clause id="idc8773e2922014e70ab05220e46220315"><enum>(vii)</enum><header>Nonapplication of Paperwork Reduction Act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, shall not apply to data collected under clauses (ii) through (v).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id3A4A17E556F545AAA87CAAAEC9356220"><enum>(b)</enum><header>Report</header><text>Not later than March 15, 2022, the Secretary of Health and Human Services shall submit to Congress a report containing any recommendations for such legislation or administrative action as the Secretary determines appropriate to preserve access to rehabilitation innovation centers (as defined in section 1886(j)(7)(E)(iii) of the Social Security Act, as added by subsection (a)).</text></subsection></section></legis-body></bill>
