<congress>One Hundred Seventeenth Congress of the United States of America</congress><session display="yes">2d Session</session><enrolled-dateline display="yes">Begun and held at the City of Washington on Monday, the third day of January, two thousand and twenty two</enrolled-dateline><legis-num display="yes">S. 2834</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to preserve access to rehabilitation innovation centers under the Medicare program.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dr. Joanne Smith Memorial Rehabilitation Innovation Centers Act of 2022</short-title></quote>.</text></section><section id="ida06f4697840b4e2dadf3b3a1fd750e97" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Preserving access to rehabilitation innovation centers under Medicare</header><subsection id="idC99ABBE3B69E4661901370CCFC921DB7" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1886(j)(7)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(j)(7)(E)</external-xref>) is amended—</text><paragraph id="idcf9e536fa9654b14a704ccbe98f782f1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="subparagraph" style="OLC">Public availability of data submitted</header-in-text>.—The</quote> and inserting “<header-in-text level="subparagraph" style="OLC">Public availability of data submitted</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf9bd946bda8a49ed9e4c3754f0d53d1d"><clause id="id040c4256276f4ed5b5e51856a56c0aa4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The</text></clause><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="id79996fa505804c8290657567e5ee7884" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after clause (i), as redesignated by paragraph (1), the following new clauses:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida819c9395d45439eb62eca1e68e87aee"><clause id="id82f062db7b894475ae43be34e753de6a" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Public recognition of rehabilitation innovation centers</header><text display-inline="yes-display-inline">Beginning not later than 18 months after the date of the enactment of this clause, the Secretary shall make publicly available on such Internet website, in addition to the information required to be reported on such website under clause (i), a list of all rehabilitation innovation centers, and shall update such list on such website not less frequently than biennially.</text></clause><clause id="id48892f618f51437999325cf2409c7c58" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Rehabilitation innovation centers defined</header><text display-inline="yes-display-inline">For purposes of clause (ii), the term <term>rehabilitation innovation centers</term> means a rehabilitation facility that, as of the applicable date (as defined in clause (v)), is a rehabilitation facility described in clause (iv).</text></clause><clause id="idb7f862d8c60c4b95826e655931054573" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Rehabilitation facility described</header><subclause id="id209B353BEED84795A68780A5BF837151" commented="no" display-inline="no-display-inline"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subclause (II), a rehabilitation facility described in this clause is a rehabilitation facility that—</text><item id="id2d36ee2be70d4265aa0b11f6e132eab6" commented="no" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline">is classified as a rehabilitation facility under the IRF Rate Setting File for the Inpatient Rehabilitation Facility Prospective Payment System for Federal Fiscal Year 2019 (83 Fed. Reg. 38514), or any successor regulations that contain such information;</text></item><item id="id503f83a7efcf4cf292ace8a077e82e7c" commented="no" display-inline="no-display-inline"><enum>(bb)</enum><text display-inline="yes-display-inline">holds at least one Federal rehabilitation research and training designation for research projects on traumatic brain injury or spinal cord injury from the National Institute on Disability, Independent Living, and Rehabilitation Research at the Department of Health and Human Services, based on such data submitted to the Secretary by a facility, in a form, manner, and time frame specified by the Secretary;</text></item><item id="idB4C834219A664BB582638FAE0E1C4C07" commented="no" display-inline="no-display-inline"><enum>(cc)</enum><text display-inline="yes-display-inline">submits to the Secretary a description of the clinical research enterprise of the facility and a summary of research activities of the facility that are supported by Federal agencies;</text></item><item id="id7d2a8e9495a54288ba1fb0e572f379ad" commented="no" display-inline="no-display-inline"><enum>(dd)</enum><text display-inline="yes-display-inline">has a minimum Medicare estimated average weight per discharge of 1.20 for the most recent fiscal year for which such information is available according to the IRF Rate Setting File described in item (aa), or any successor regulations that contain such information; and</text></item><item id="ida1466a1384484a7382a812a54b2b0301" commented="no" display-inline="no-display-inline"><enum>(ee)</enum><text display-inline="yes-display-inline">has a minimum teaching status of 0.075 for the most recent fiscal year for which such information is available according to the IRF Rate Setting File described in item (aa), or any successor regulations that contain such information.</text></item></subclause><subclause id="id1D55A0A62A7A460A8B54742253EF186A" commented="no" display-inline="no-display-inline"><enum>(II)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The Secretary may, as determined appropriate, waive any of the requirements under items (aa) through (ee) of subclause (I).</text></subclause></clause><clause id="iddcbe385db9e8494a938709afefbbfd74" commented="no" display-inline="no-display-inline"><enum>(v)</enum><header display-inline="yes-display-inline">Applicable date defined</header><text display-inline="yes-display-inline">For purposes of clauses (iii) and (iv), the term <term>applicable date</term> means—</text><subclause id="idd4019f64c30047e59e4c216008859102" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to the initial publication of a list under clause (ii), the date of the enactment of such clause; and</text></subclause><subclause id="id82065d08e7ac4c01bd6daae76b531c89" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to the publication of an updated list under clause (ii), a date specified by the Secretary that is not more than one year prior to the date of such publication.</text></subclause></clause><clause id="id6024def11bb84e0b83cb3cce3ded9c73" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law the Secretary may implement clauses (ii) through (v) by program instruction or otherwise.</text></clause><clause id="idc8773e2922014e70ab05220e46220315" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><header display-inline="yes-display-inline">Nonapplication of Paperwork Reduction Act</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, shall not apply to data collected under clauses (ii) through (v).</text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id3A4A17E556F545AAA87CAAAEC9356220" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary of Health and Human Services—</text><paragraph commented="no" display-inline="no-display-inline" id="id345D328A01E4485DB49CEA1D46F077E2"><enum>(1)</enum><text display-inline="yes-display-inline">shall submit to Congress a report containing any recommendations on action as the Secretary determines appropriate to preserve access to rehabilitation innovation centers (as defined in section 1886(j)(7)(E)(iii) of the Social Security Act, as added by subsection (a)); and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id0783C2C4E086457B92A911FAE958EBBF"><enum>(2)</enum><text display-inline="yes-display-inline">may, in the report described in paragraph (1), as permitted by law, disseminate research, best practices, and other clinical information identified or developed by such rehabilitation innovation centers, as determined appropriate by the Secretary.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
