<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2833</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210923">September 23, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself and <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the National Flood Insurance Act of 1968 to address the premium rates for certain properties under the National Flood Insurance Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NFIP Underwater Properties Act</short-title></quote>.</text></section><section id="idA26797D3058B4A93A3B543D03B3228FE"><enum>2.</enum><header>Extreme repetitive loss structures</header><subsection id="idE4458E1ADFFA4DDCA1D9CC67317D2114"><enum/><text>Chapter I of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4011">42 U.S.C. 4011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id75A188AD0BFB42DAB66E4312B1AC9E4A" style="OLC" act-name=""><section id="id67913D4D5A984623AB10435FBFD6D2CF" section-type="subsequent-section"><enum>1326.</enum><header>Extreme repetitive loss structures</header><subsection id="id130E28405E4042F7815D97085B9F63C8"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>extreme repetitive loss structure</term> means a structure that—</text><paragraph id="id42C12A010D9D4C01A972F17543FCCD72"><enum>(1)</enum><text>is covered under a contract for flood insurance made available under this title; and</text></paragraph><paragraph id="id73CF289D43A24A2E87866015F58A8AC3"><enum>(2)</enum><text>has incurred flood-related damage for which, during a 10-year period, not fewer than 2 separate claims payments have been made under flood insurance coverage under this title, with the cumulative amount of such claims exceeding 120 percent of the assessed value of the structure, as of the date on which the first such claim payment is made.</text></paragraph></subsection><subsection id="idB558AE2EE0DE4AE380244F5DD9B28AE7"><enum>(b)</enum><header>Treatment of structures</header><text>Notwithstanding any other provision of this title, if, after the date on which a structure qualifies as an extreme repetitive loss structure, the structure incurs flood-related damage for which a claim under flood insurance coverage under this title is filed with the Administrator—</text><paragraph id="id74CBAE1C34E04AB2B3DC76987C393A4E"><enum>(1)</enum><text>the Administrator shall assess the claim in accordance with the requirements of this title and any other applicable provision of law or regulation; and</text></paragraph><paragraph id="idF1A49CCE0A274A26882E46F348DDE8BF"><enum>(2)</enum><text>after resolution of the claim— </text><subparagraph id="id6749F174134740158784CA2CBFAC6353"><enum>(A)</enum><text>the Administrator shall prescribe a chargeable risk premium rate with respect to the structure that represents an actuarially sound rate; and </text></subparagraph><subparagraph id="id1E06F817A9F54115A8866AAA93D5FAE3"><enum>(B)</enum><text>the rate described in subparagraph (A) shall not be subject to the limitation under section 1308(e)(1), unless— </text><clause id="id7A8C67C14E044AC7818538B2700B43F2"><enum>(i)</enum><text>the Administrator— </text><subclause id="id6D1CC88EFEDF47EA8F1BD97C207D62AD"><enum>(I)</enum><text>performs an examination of the structure; and</text></subclause><subclause id="id635DB0AF562C40EC894CB9EB5B110338"><enum>(II)</enum><text>determines that the structure is not located in an area having special flood hazards; or</text></subclause></clause><clause id="id4A2607D1E7E147E1A527C6BFBE0FF933"><enum>(ii)</enum><text>the most recent flood insurance rate map published by the Administrator does not indicate that the structure is located in an area having special flood hazards.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
