which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To impose sanctions with respect to Chinese and Russian companies that sign contracts or otherwise do business with the Taliban in strategic resource sectors, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restricting Taliban Critical Mineral Trade Act</short-title></quote>.</text></section><section id="id2BE21BB1B36C4AD8AD9137D991C3AB2A"><enum>2.</enum><header>Imposition of sanctions with respect to Chinese and Russian companies that sign contracts or otherwise do business with the Taliban in strategic resource sectors</header><subsection id="idCE3C82048E76413EA61958D8D7F022A3"><enum>(a)</enum><header>In general</header><text>The President shall impose the sanctions described in subsection (b) with respect to any covered foreign entity that, on or after the date of the enactment of this Act—</text><paragraph id="id5C58DEF309D74050AA22A72331BCA99C"><enum>(1)</enum><text>signs a contract with the Taliban with respect to a strategic resource sector; or</text></paragraph><paragraph id="id7994C4B5CAA640A3A5FABBF11C31E319"><enum>(2)</enum><text>otherwise agrees to do business with the Taliban in a strategic resource sector.</text></paragraph></subsection><subsection id="id997964FB17274B2C9C135323181C44CC"><enum>(b)</enum><header>Sanctions</header><paragraph id="id5A545EBF9550422485DBA32D2BD90A37"><enum>(1)</enum><header>Blocking of property</header><subparagraph id="id14B5AAE5668441C0885893F9DF8D0BE9"><enum>(A)</enum><header>In general</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of a covered foreign entity described in subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></subparagraph><subparagraph id="idDDE063ACEC72415D98116D887F5566F7"><enum>(B)</enum><header>Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a person that violates, attempts to violate, conspires to violate, or causes a violation of any regulation, license, or order issued to carry out subparagraph (A) to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of that section. </text></subparagraph><subparagraph id="id85C235050F9A43618137E0644612943E"><enum>(C)</enum><header>Implementation</header><text>The President may exercise all authorities under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this paragraph.</text></subparagraph></paragraph><paragraph id="idBA94587545ED47A5B87F6684F1DC563F"><enum>(2)</enum><header>Inclusion on entity list</header><text>The President shall include any covered foreign entity described in subsection (a) on the entity list maintained by the Bureau of Industry and Security and set forth in Supplement No. 4 to part 744 of title 15, Code of Federal Regulations.</text></paragraph></subsection><subsection id="idF3AD10CC209F44359D3275F71356C492"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idF6C3143246274CE5AE8055CEE0C1328E"><enum>(1)</enum><header>Covered foreign entity</header><text>The term <term>covered foreign entity</term> means—</text><subparagraph id="idD5E8A2A8E4CC411A820A6B5255C24C39"><enum>(A)</enum><text>an entity organized under the laws of the People's Republic of China or the Russian Federation, including any jurisdiction within either such country; or</text></subparagraph><subparagraph id="id9C4AA044CEA341C1A15A1B606D5FBEE1"><enum>(B)</enum><text>a significant subsidiary (as defined in section 210.1–02(w) of title 17, Code of Federal Regulations, or successor regulations) of an entity described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id6B1510B880314F95A7261B03476F2A02"><enum>(2)</enum><header>Critical mineral</header><text>The term <term>critical mineral</term> means a critical mineral—</text><subparagraph id="id927723042B404C769445FCAE1CF089E5"><enum>(A)</enum><text>included in the final list of critical minerals published by the Secretary of the Interior in the Federal Register on May 18, 2018 (83 Fed. Reg. 23295); or</text></subparagraph><subparagraph id="idE7937DCBAE7243C9B2AEBD1C8CF657FB"><enum>(B)</enum><text>as defined in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>).</text></subparagraph></paragraph><paragraph id="idA68794B9A1F444EFB4FC0ED50EC7FEB3"><enum>(3)</enum><header>Strategic resource sector</header><text>The term <term>strategic resource sector</term> means a sector of the economy relating to trade or investment in any critical mineral.</text></paragraph><paragraph id="HD1A658D4A8AA4961B8466D34ED9464A9"><enum>(4)</enum><header>United States person</header><text>the term <term>United States person</term> means—</text><subparagraph id="H7493960C5B69408B834938B8EB65BD1A"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted to the United States for permanent residence; and</text></subparagraph><subparagraph id="id828C787F41424B409AF4BE56A4EF2F21" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States (including any foreign branch of such an entity).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
