which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Radiation Exposure Compensation Act to revise the definition of <quote>affected area</quote> and extend the period in which compensation may be provided, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Downwinders Act</short-title></quote>.</text></section><section id="id326124D3F40D42E99D0450F3AEE251FA"><enum>2.</enum><header>Amendments to the Radiation Exposure Compensation Act</header><subsection id="id9B82614384CD495981A261C3059ADC92"><enum>(a)</enum><header>Affected areas</header><text>Section 4 of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended—</text><paragraph id="id2B9CABEE3DC345489573D42498132260"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idA2EEF4C0E4924DBC8D188775BF058C28"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id8433367DB4D34497B95B867F90E1E2EF"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="idEB0C6FDAFAE041668C15117A7B5CBD7C"><enum>(I)</enum><text>in clause (i)—</text><item id="idC44838DCC05B4822AF98AED2118AF2EB"><enum>(aa)</enum><text>in subclause (II), by striking <quote>; or</quote> and inserting a semicolon;</text></item><item id="id6B1C1C55D2DF430897C0F305F535B33E"><enum>(bb)</enum><text>by redesignating subclause (III) as subclause (IV); and</text></item><item id="id88642DB88F0945AA8C2159799623E547"><enum>(cc)</enum><text>by inserting after subclause (II) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCE5D525E24C140DAB81F1A81ED4F5E89"><subclause id="id30DD04DF18FD41089C939BB09957591D"><enum>(III)</enum><text>was physically present in the affected area described in subsection (b)(1)(D) for the period beginning on July 16, 1945, and ending on August 16, 1945; or</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></item></subclause><subclause id="idC20E8BACD54F47E1BCC0854C429FD880"><enum>(II)</enum><text>in clause (ii)(I), by striking <quote>physical presence described in subclause (I) or (II) of clause (i) or onsite participation described in clause (i)(III)</quote> and inserting <quote>physical presence described in subclause (I), (II), or (III) of clause (i) or onsite participation described in clause (i)(IV)</quote>; and</text></subclause></clause><clause id="id4767C59BD87E4159AB705FF59E233529"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="id1684E7C6DAE042DAAFD3926346D1D5F6" commented="no"><enum>(I)</enum><text> in clause (i), by striking <quote>subclause (I) or (II) of subparagraph (A)(i)</quote> and inserting <quote>subclause (I), (II), or (III) of subparagraph (A)(i)</quote>; and</text></subclause><subclause id="id6BE4DDCAFA8C45548449E28D5407AB19" commented="no"><enum>(II)</enum><text>in clause (ii), by striking <quote>subclause (III)</quote> and inserting <quote>subclause (IV)</quote>; and</text></subclause></clause></subparagraph><subparagraph id="id72A6B8562F7442939F36E72E359B7B40"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id3D8FE2B742DC487D84F123C06295141C"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>, or</quote> and inserting a comma;</text></clause><clause id="id28ED155BDD1D4645A01E0B7A0BF57B13"><enum>(ii)</enum><text>by redesignating subparagraph (C) as subparagraph (D); </text></clause><clause id="id4A45D969B88B487287BB6536E5871899"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96FE0A55C011473DAD072BD8F0884ED9"><subparagraph id="id51F390B0DA174E1A9799DF630119054C"><enum>(C)</enum><text>was physically present in the affected area described in subsection (b)(1)(D) for the period beginning on July 16, 1945, and ending on August 16, 1945, or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id8022AFEC84D34572AFFFA5202CEC8605"><enum>(iv)</enum><text>in the matter following subparagraph (D), as so redesignated, by striking <quote>subparagraph (A) or (B)</quote> and all that follows through <quote>subparagraph (C)</quote> and inserting <quote>subparagraph (A), (B), or (C)) or $75,000 (in the case of an individual described in subparagraph (D)</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id4077B22EF7AC43AA9F67C030756C655C"><enum>(2)</enum><text>in subsection (b)(1)—</text><subparagraph id="idE42544CD76A943E7B2854C3BAE44CBDA"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>in the State</quote> and all that follows through <quote>Piute</quote> and inserting <quote>the State of Utah</quote>;</text></subparagraph><subparagraph id="id1CDDD5FF6215465EB5BAF9BAA96B6047"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="id45460C28E8924F8B9AC9292BFAB62C84"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEE966518A7BA4B3C90A10EFE86F7F73B"><subparagraph id="idAD9A77DA66824A3E92228A9DFCBC941D"><enum>(D)</enum><text>with respect to a claim by an individual under subsection (a)(1)(A)(i)(III) or subsection (a)(2)(C), only the counties of Bernalillo, Chaves, Guadalupe, Lincoln, Sandoval, San Miguel, Santa Fe, Socorro, Torrance, and Valencia in the State of New Mexico; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id7055AFE71420442F92DB28AF094A2731"><enum>(b)</enum><header>Extension of period of compensation</header><paragraph id="id1D154FE0E33D46CE8B65C0B06556A4F8"><enum>(1)</enum><header>Termination of fund</header><text>Section 3(d) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended—</text><subparagraph id="id2272469392C64047B2A802ABF29DF91F"><enum>(A)</enum><text>in the first sentence, by striking <quote>22</quote> and all that follows through <quote>2000</quote> and inserting <quote>on the date that is 10 years after the date of enactment of the <short-title>Downwinders Act</short-title></quote>; and</text></subparagraph><subparagraph id="idAF54CFD5393D422CAA2C9CFD945761ED"><enum>(B)</enum><text>in the second sentence, by striking <quote>by the end of that 22-year period</quote> and inserting <quote>by such date of termination</quote>. </text></subparagraph></paragraph><paragraph id="id1DE8CA1F1F5D43E2B66545208DB379DF"><enum>(2)</enum><header>Eligibility</header><text>Section 8(a) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended by striking <quote>22</quote> and all that follows through <quote>2000</quote> and inserting <quote>10 years after the date of enactment of the <short-title>Downwinders Act</short-title></quote>.</text></paragraph></subsection><subsection id="id607B83A85AB84B5997E3240CBCA55666"><enum>(c)</enum><header>Conforming amendments</header><text>Section 6 of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended—</text><paragraph id="id236653A6FA57407B8AC19BB3A96749AC"><enum>(1)</enum><text>in subsection (b)(2)(C), by striking <quote>section 4(a)(2)(C)</quote> and inserting <quote>section 4(a)(2)(D)</quote>;</text></paragraph><paragraph id="idB191AF5BBBAF4739BD494C71A9393B42"><enum>(2)</enum><text>in subsection (c)(2)—</text><subparagraph id="idBD9C83CD9B1D44A88E1E59B03732516B"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="idCFEE79D3DBA145409D960969B87F08CA" commented="no"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), or (a)(2)(C) of section 4</quote>; and</text></clause><clause id="idE24FFE68EDF942D287682D02F62A2243" commented="no"><enum>(ii)</enum><text>in clause (i), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), or (a)(2)(C) of section 4</quote>; and</text></clause></subparagraph><subparagraph id="idB1320F4C19E04C84830915B784B414D1"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>section 4(a)(2)(C)</quote> and inserting <quote>section 4(a)(2)(D)</quote>; and</text></subparagraph></paragraph><paragraph id="idD61451F55D5D41BEA121C4BEDF097F2C" commented="no"><enum>(3)</enum><text>in subsection (e), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), or (a)(2)(C) of section 4</quote>.</text></paragraph></subsection></section><section id="id5305F1E3817E4B6295C73A97C7C23EE4"><enum>3.</enum><header>Study on counties affected by radiation fall-out due to open air nuclear testing conducted in Nevada and New Mexico</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall conduct a research study and report to Congress on which counties were affected by radiation fall-out due to open air nuclear testing conducted in Nevada and New Mexico, as identified using evidence-based analysis.</text></section><section id="id7916CE58403C4AC9997504C479F76E13"><enum>4.</enum><header>Spectrum auction</header><subsection id="idD5D3A6808A4D4FD1ABF4A54159FF8FCB"><enum>(a)</enum><header>Identification of spectrum To be auctioned</header><text>Not later than 1 year after the date of enactment of this Act, the Assistant Secretary of Commerce for Communications and Information, in consultation with the Federal Communications Commission and the Director of the Office of Science and Technology Policy, shall identify 100 megahertz of electromagnetic spectrum that is assigned or allocated to the Federal Government to be made available for non-Federal commercial licensed use through an auction under subsection (b).</text></subsection><subsection id="idEF5FA7D849BC4FEB88C0BB7F51C1125F"><enum>(b)</enum><header>Auction</header><text>Not later than 18 months after the date of enactment of this Act, the Federal Communications Commission shall conduct a system of competitive bidding under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) to grant new licenses for the spectrum identified under subsection (a).</text></subsection><subsection id="id1a1d7d192ecf4e8db0c627a09cc2bdc6"><enum>(c)</enum><header>Auction proceeds To cover 110 percent of Federal relocation or sharing costs</header><text>Nothing in this section shall be construed to relieve the Federal Communications Commission from the requirements under section 309(j)(16)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(16)(B)</external-xref>).</text></subsection><subsection id="idDDFD0BADF8204571A4B865AD9DB5981B"><enum>(d)</enum><header>Deposit of auction proceeds in Radiation Exposure Compensation Trust Fund</header><text>Section 309(j)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)</external-xref>) is amended—</text><paragraph id="idf12a595b35664f0faba95a299c3900d9"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and (G)</quote> and inserting <quote>(G), and (H)</quote>;</text></paragraph><paragraph id="idc9b6f86269fa4f3988b0caa669c835d6"><enum>(2)</enum><text>in subparagraph (C)(i), by striking <quote>and (G)</quote> and inserting <quote>(G), and (H)</quote>; and</text></paragraph><paragraph id="ide434ae272cff4c0ab58771500100062d"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idea8016f01f27448d81d8efabf8bfdc4a"><subparagraph id="idc6d7c457609e48568a607581ca865a0c"><enum>(H)</enum><header>Use of auction proceeds for radiation exposure compensation</header><text>Notwithstanding subparagraph (A), and except as provided in subparagraph (B), of the proceeds (including deposits and upfront payments from successful bidders) from the use of a system of competitive bidding under this subsection pursuant to section 4 of the <short-title>Downwinders Act</short-title>, the Commission shall deposit not less than $2,500,000,000 and not more than $5,000,000,000 in the Radiation Exposure Compensation Trust Fund established under section 3(a) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>), to be used for disbursement by the Attorney General under section 6 of such Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
