which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To create a mandatory safety standard to require portable generators to meet certain standards relating to carbon monoxide, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H00B344360B5E4F1DBE0B6AEDEFBF7CAE"><section section-type="section-one" id="H7CC872EB6B514171BAD53ED996093C2C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Generators Save Lives Act</short-title></quote>. </text></section><section id="HCE7268CE41A742D193C58E8D84610103"><enum>2.</enum><header>Mandatory product safety standard for portable generators</header><subsection id="HDF427DBFB03145D590B7F0D8956F4F07"><enum>(a)</enum><header>Final standard for portable generators</header><paragraph id="HE4722742F2964C47AA2B60044C7B2F3B"><enum>(1)</enum><header>Mandatory standard</header><text>Not later than 1 year after the date of the enactment of this Act, the Consumer Product Safety Commission shall promulgate, in accordance with section 553 of title 5, United States Code, a final consumer product safety standard for portable generators to protect consumers from death or injury relating to the use of such generators.</text></paragraph><paragraph id="H01BBE89141E1407FB177982E1B538626"><enum>(2)</enum><header>Requirements</header><text>The final standard promulgated under paragraph (1) shall incorporate requirements that are substantially the same as each of the following:</text><subparagraph id="H907929F2AF0A4134BB6D69E278186150"><enum>(A)</enum><text display-inline="yes-display-inline">The requirements of the—</text><clause id="idB3B6DD87254548B79A7CBF3A062AAC9E"><enum>(i)</enum><text display-inline="yes-display-inline">American National Standard for Carbon Monoxide Emission Rate of Portable Generators (ANSI/UL 2201), or any related successor standard, that relate to carbon monoxide concentration limits; or</text></clause><clause commented="no" id="H524FBE4B1EF44D3E85C3E02FCA910A2F"><enum>(ii)</enum><text display-inline="yes-display-inline">American National Standard for Safety and Performance of Portable Generators (ANSI/PGMA G300–2018), or any related successor standard, except where such requirements conflict with any other requirement under this paragraph. </text></clause></subparagraph><subparagraph id="H26E38992E11D4DE68930BB2D0F46A826"><enum>(B)</enum><text display-inline="yes-display-inline">A requirement that a portable generator shall include clear and conspicuous labeling marking the direction of exhaust, and a label indicating that portable generators should not be used inside. </text></subparagraph><subparagraph id="HA55A41ABC72A4FB8A9939DD8B909D043"><enum>(C)</enum><text>A requirement that the cord of a portable generator may not be shorter than 30 feet in length.</text></subparagraph><subparagraph id="H9D014EA4ACAA4B35A344D814AE01302D"><enum>(D)</enum><text display-inline="yes-display-inline">A requirement relating to the shutoff capability of a portable generator in an elevated carbon monoxide environment.</text></subparagraph><subparagraph id="H434E781A2E7B44F5B63C309E6166DB7F"><enum>(E)</enum><text display-inline="yes-display-inline">Other shutoff requirements and test specifications the Commission determines necessary to protect consumers from the risk of injury relating to the use of portable generators.</text></subparagraph></paragraph><paragraph commented="no" id="H5FE6C8C28B0C48B395BD7270AAD27B57"><enum>(3)</enum><header>Compliance dates</header><text>The Commission shall include in the final standard promulgated under paragraph (1) a compliance date that is not later than 1 year after the date of such promulgation, by which portable generators shall comply with the final standard.</text></paragraph><paragraph id="H683033D0BEC44B018B3F1B3F8F2B8259"><enum>(4)</enum><header>Review and revision of standard</header><text display-inline="yes-display-inline">Beginning 1 year after the date of the promulgation of the final standard under paragraph (1) and not less frequently than every 5 years thereafter, the Commission shall review and revise such standard to ensure the highest level of safety feasible with respect to portable generators.</text></paragraph><paragraph id="HE2C39C4B34D4473E8A97508B99F9F2B2"><enum>(5)</enum><header>Treatment of standard</header><text display-inline="yes-display-inline">The final standard promulgated under paragraph (1), including any revision of such standard made pursuant to paragraph (4), shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>).</text></paragraph></subsection><subsection id="HB79E65A81EF14F259B06FB49D211855E" commented="no"><enum>(b)</enum><header>Violation</header><text display-inline="yes-display-inline">Failure to comply with subsection (a) shall be treated as a violation of section 19 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2068">15 U.S.C. 2068</external-xref>).</text></subsection></section></legis-body></bill>
