Extension of highway-related taxes.</toc-entry></toc></subsection></section><section id="HABA4677056E44E44974219B771DA551E"><enum>2.</enum><header>Findings and purposes</header><subsection id="HCF2F49F03FCC46DBBBEFF5D31059D9AB"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="HD0FE2491F9204B019EFDB550EC202FE7"><enum>(1)</enum><text>the objective of the Federal highway program has been to facilitate the construction of a modern freeway system that promotes efficient interstate commerce by connecting all States;</text></paragraph><paragraph id="HD72BF42D56F84521B483AD803CB55E77"><enum>(2)</enum><text>the objective described in paragraph (1) has been attained, and the Interstate System connecting all States is near completion;</text></paragraph><paragraph id="H3AE1359DF8D5458F83FEF000CEEE1EAE"><enum>(3)</enum><text>each State has the responsibility of providing an efficient transportation network for the residents of the State;</text></paragraph><paragraph id="H72E3396570AE4F7D9371E69D85835BED"><enum>(4)</enum><text>each State has the means to build and operate a network of transportation systems, including highways, that best serves the needs of the State;</text></paragraph><paragraph id="H4CB24C6192ED4CAB9AAF3CA76D58A3FB"><enum>(5)</enum><text>each State is best capable of determining the needs of the State and acting on those needs;</text></paragraph><paragraph id="HE53141C5EE464139A48D52731C86924E"><enum>(6)</enum><text>the Federal role in highway transportation has, over time, usurped the role of the States by taxing motor fuels used in the States and then distributing the proceeds to the States based on the perceptions of the Federal Government on what is best for the States;</text></paragraph><paragraph id="HE338FBEA6213448889792C079DB23A4C"><enum>(7)</enum><text>the Federal Government has used the Federal motor fuels tax revenues to force all States to take actions that are not necessarily appropriate for individual States;</text></paragraph><paragraph id="H5030CD12C8104A98BD79EA98F4E02FE1"><enum>(8)</enum><text>the Federal distribution, review, and enforcement process wastes billions of dollars on unproductive activities;</text></paragraph><paragraph id="H14989F2FF5D14D6A8AF4F685A7B7C223"><enum>(9)</enum><text>Federal mandates that apply uniformly to all 50 States, regardless of the different circumstances of the States, cause the States to waste billions of hard-earned tax dollars on projects, programs, and activities that the States would not otherwise undertake; and</text></paragraph><paragraph id="H500B33BC8F5A4168AF396C389931AA94"><enum>(10)</enum><text>Congress has expressed a strong interest in reducing the role of the Federal Government by allowing each State to manage its own affairs.</text></paragraph></subsection><subsection id="HAB21AF33A3E94DED8853CEEAE444F52A"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="id0EDB533CCB384331842EF8BA8AFAF622"><enum>(1)</enum><text>to provide a new policy blueprint to govern the Federal role in transportation once existing and prior financial obligations are met;</text></paragraph><paragraph id="H8358ABAF91CC477B92272EAF096FCBA9"><enum>(2)</enum><text>to return to the individual States maximum discretionary authority and fiscal responsibility for all elements of the national surface transportation systems that are not within the direct purview of the Federal Government;</text></paragraph><paragraph id="H06F91612A7D04A79850CC248C5853A28"><enum>(3)</enum><text>to preserve Federal responsibility for the Dwight D. Eisenhower National System of Interstate and Defense Highways;</text></paragraph><paragraph id="HFD0E051DF99744C08E06C597784AEDC3"><enum>(4)</enum><text>to preserve the responsibility of the Department of Transportation for—</text><subparagraph id="HFC449CFF9BD24D7A8E87EA17871CF83A"><enum>(A)</enum><text>design, construction, and preservation of transportation facilities on Federal public land;</text></subparagraph><subparagraph id="HDE3C24190E014A84B923698D4C25C75B"><enum>(B)</enum><text>national programs of transportation research and development and transportation safety; and</text></subparagraph><subparagraph id="H34811A2A881340B1A719E0EAF1DAF159"><enum>(C)</enum><text>emergency assistance to the States in response to natural disasters;</text></subparagraph></paragraph><paragraph id="H54006F7885B6455AB97C08FA40853401"><enum>(5)</enum><text>to eliminate to the maximum extent practicable Federal obstacles to the ability of each State to apply innovative solutions to the financing, design, construction, operation, and preservation of Federal and State transportation facilities; and</text></paragraph><paragraph id="H4DBB333AFA9042E2815F64F023491A31"><enum>(6)</enum><text>with respect to transportation activities carried out by States, local governments, and the private sector, to encourage—</text><subparagraph id="H9B67BF47DB80477B8E49BBFB878CFE44"><enum>(A)</enum><text>competition among States, local governments, and the private sector; and</text></subparagraph><subparagraph id="H12C2853743E54EABBD27ABE8FC1495A7"><enum>(B)</enum><text>innovation, energy efficiency, private sector participation, and productivity. </text></subparagraph></paragraph></subsection></section><title id="id91742E022EEA493F89E1A61B04989C22" style="OLC"><enum>I</enum><header>Highway funding</header><section commented="no" id="id9F69B28B13514938872B8AB5D483A69F"><enum>101.</enum><header>Authorization of appropriations</header><subsection id="H1992AB59C45B44C887F3C57BFF0F2A08"><enum>(a)</enum><header>In general</header><paragraph id="H0701E49CDF994227AEC2080EA206497E"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">The following sums are authorized to be appropriated out of the Highway Trust Fund:</text><subparagraph id="HD4A0116967E0479087D24A7B36B72EE5"><enum>(A)</enum><header>Federal-aid highway program</header><text>For the national highway performance program under section 119 of title 23, United States Code, the surface transportation block grant program under section 133 of that title, the highway safety improvement program under section 148 of that title, and the national highway freight program under section 167 of that title $18,450,000,000 for each of fiscal years 2022 through 2026.</text></subparagraph><subparagraph id="H709AE8B42B7144D886CC1FBC972F6A30"><enum>(B)</enum><header>Emergency relief</header><text>For emergency relief under section 125 of title 23, United States Code, $100,000,000 for each of fiscal years 2022 through 2026.</text></subparagraph><subparagraph id="H9B5ABACE48514A33AB581CB3080F0EB7"><enum>(C)</enum><header>Federal lands programs</header><clause id="H57572159DE204D84B4C30C19D39F0D68"><enum>(i)</enum><header>Federal lands transportation program</header><text>For the Federal lands transportation program under section 203 of title 23, United States Code, $300,000,000 for each of fiscal years 2022 through 2026, of which—</text><subclause id="idDB901F7D2BE34F97B6104BA57DAD9634"><enum>(I)</enum><text>$240,000,000 of the amount made available for each fiscal year shall be the amount for the National Park Service; and </text></subclause><subclause id="id27EB0398C18E479FA93D0EFA9FF010C3"><enum>(II)</enum><text>$30,000,000 of the amount made available for each fiscal year shall be the amount for the United States Fish and Wildlife Service.</text></subclause></clause><clause id="HEAD6955AF19F4E768684B5A9DE7801F7"><enum>(ii)</enum><header>Federal lands access program</header><text>For the Federal lands access program under section 204 of title 23, United States Code, $250,000,000 for each of fiscal years 2022 through 2026.</text></clause></subparagraph></paragraph></subsection><subsection id="H60A34BF0DEC9424DA8950E4138ECE52D"><enum>(b)</enum><header>Funding for highway research and development program</header><paragraph id="H2FB447A9B6A24D228BEF9B332C4F30DA"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated out of the Highway Trust Fund to carry out section 503(b) of title 23, United States Code, $115,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="HFBEBF620E40F4AC79724B5231714FCF3"><enum>(2)</enum><header>Applicability of title 23, United States Code</header><text display-inline="yes-display-inline">Funds authorized to be appropriated by paragraph (1) shall—</text><subparagraph id="H5036D04F2B3B4722BB0FD542E4752DF3"><enum>(A)</enum><text>be available for obligation in the same manner as if those funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, except that the Federal share of the cost of a project or activity carried out using those funds shall be 80 percent, unless otherwise expressly provided by this Act (including the amendments by this Act); and</text></subparagraph><subparagraph id="H2AD5C22D102D40D49426C61D1A385A29"><enum>(B)</enum><text>remain available until expended and not be transferable. </text></subparagraph></paragraph></subsection></section><section id="H548522BC7F164507AA3114B196EDD6A8"><enum>102.</enum><header>Federalization and defederalization of projects</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, beginning on October 1, 2021—</text><paragraph id="H37F2B950382A4893BD5CC908EA9FC35F"><enum>(1)</enum><text>a highway construction or improvement project shall not be considered to be a Federal highway construction or improvement project unless and until a State expends Federal funds for the construction portion of the project;</text></paragraph><paragraph id="H6FAB3530D1EE4CCD9A8F1346BB566CFE"><enum>(2)</enum><text>a highway construction or improvement project shall not be considered to be a Federal highway construction or improvement project solely by reason of the expenditure of Federal funds by a State before the construction phase of the project to pay expenses relating to the project, including for any environmental document or design work required for the project; and</text></paragraph><paragraph id="H02F36DA21E43442DB663EBDD0B32E9D8"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H25C51E9694854360A3E3FB4BED4E8616"><enum>(A)</enum><text>a State may, after having used Federal funds to pay all or a portion of the costs of a highway construction or improvement project, reimburse the Federal Government in an amount equal to the amount of Federal funds so expended; and</text></subparagraph><subparagraph id="H1166DC90D3E7403EB6607A54ACC45465" indent="up1"><enum>(B)</enum><text>after completion of a reimbursement described in subparagraph (A), a highway construction or improvement project described in that subparagraph shall no longer be considered to be a Federal highway construction or improvement project.</text></subparagraph></paragraph></section><section commented="no" id="H41EAE150F987402A9148F061D5B75AA3"><enum>103.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">No reporting requirement, other than a reporting requirement in effect as of the date of enactment of this Act, shall apply on or after October 1, 2021, to the use of Federal funds for highway projects by a public-private partnership.</text></section><section commented="no" id="id42E719959ACE4A5FA2905D242F490976"><enum>104.</enum><header>Funding limitation</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, if the Secretary of Transportation determines for any of fiscal years 2022 through 2026 that the aggregate amount required to carry out transportation programs and projects under this Act and the amendments made by this Act exceeds the estimated aggregate amount in the Highway Trust Fund available for those programs and projects for the fiscal year, each amount made available for that program or project shall be reduced by the pro rata percentage required to reduce the aggregate amount required to carry out those programs and projects to an amount equal to the amount available for those programs and projects in the Highway Trust Fund for the fiscal year. </text></section><section commented="no" id="id478EBBCE40D240AFACEEFBE2CC7EA834"><enum>105.</enum><header>Reports; certification</header><subsection commented="no" id="id3FF9EBF823C8456186D1FC6355D61A60"><enum>(a)</enum><header>Report on existing obligations</header><paragraph commented="no" id="id11CE7EB2A8B8492FB6D0CC38B158FCCB"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Management and Budget (referred to in this section as the <quote>Director</quote>), in consultation with the Secretary of Transportation, shall develop and submit to Congress a 5-year plan for the use of revenue deposited in the Highway Trust Fund to pay for unpaid obligations under Federal-aid highway programs (as in effect before the date of enactment of this Act) incurred before the date of enactment of this Act. </text></paragraph><paragraph commented="no" id="idE75313A816AC4470AC313DE9CAEF2CC4"><enum>(2)</enum><header>Requirement</header><text>In developing the plan under paragraph (1), the Director shall, to the maximum extent practicable, balance payments for new Federal-aid highway projects with continued payment of unpaid obligations described in paragraph (1). </text></paragraph></subsection><subsection commented="no" id="idA1AEA78C77A64063A7BEA5E6427CF85A"><enum>(b)</enum><header>Annual reports</header><text>Not less frequently than annually, the Director shall submit to Congress a report that includes—</text><paragraph commented="no" id="idD7B069AC2F224C659F4D5F5D0C6E6A7A"><enum>(1)</enum><text>a description of the remaining balance of unpaid obligations under Federal-aid highway programs (as in effect before the date of enactment of this Act) incurred before the date of enactment of this Act; funds under paragraph (1) to a purpose that is not a surface transportation purpose as described in paragraph (1), the amount of the improperly transferred funds shall be deducted from any amount the State would otherwise receive from the Highway Trust Fund for the fiscal year that begins after the date of the determination.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idEE5B1A6C0A8B4467A4F70C972DB2C963"><enum>(7)</enum><text>by striking subsection (i) and inserting the following:</text><quoted-block and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0532A86DAD2945ECA11F995BB6D55104"><subsection id="id465f446d8a2049b697d471bd5d3e999b"><enum>(d)</enum><header>Eligible projects</header><text>Except as provided in subsection (e), the Secretary may make a grant under this section only for a project that—</text><paragraph id="id1B98D78A193B43AA9C3A7B14FAF49C77"><enum>(1)</enum><text>is—</text><subparagraph id="idb777b84c8d6b403a957f35a09d9a02b5"><enum>(A)</enum><text>a highway freight project carried out on the National Highway Freight Network established under section 167;</text></subparagraph><subparagraph id="id3fe111639165436881c436cd3243ced1"><enum>(B)</enum><text>a highway or bridge project carried out on the Interstate System, including a project to add capacity to the Interstate System to improve mobility; or</text></subparagraph><subparagraph commented="no" id="id1ad8c427ad5b4080ad90b35b5830eebc"><enum>(C)</enum><text>a railway-highway grade crossing or grade separation project on the Interstate System; and</text></subparagraph></paragraph><paragraph id="id4ddd628698cb4345be78c4fc5e218bb1"><enum>(2)</enum><text>has eligible project costs that are reasonably anticipated to equal or exceed the lesser of—</text><subparagraph id="idbc1bf665ed2b4359abdb51b724483d5f"><enum>(A)</enum><text>$100,000,000; and</text></subparagraph><subparagraph id="idd0cd3782b1ed410d80b29f82418be8d4"><enum>(B)</enum><text>in the case of a project—</text><clause id="id7c6bbf335ef248269ed95d01002910ea"><enum>(i)</enum><text>located in 1 State, 30 percent of the amount apportioned under this chapter to the State in the most recently completed fiscal year; or</text></clause><clause id="id1aceafbe316c4088a42c644f3471ccb1"><enum>(ii)</enum><text>located in more than 1 State, 50 percent of the amount apportioned under this chapter to the participating State with the largest apportionment under this chapter in the most recently completed fiscal year.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id83031925C4904DDBB52AAED308D9DCB1"><enum>(2)</enum><text>in subsection (e)(1), by striking <quote>described in subsection (d)(1)(A) that do not satisfy the minimum threshold under subsection stock refunds</header><paragraph id="H2CF7C236F7A245ED9E9E9C52E1F0D4CC"><enum>(1)</enum><header>In general</header><text>If—</text><subparagraph id="HEC561FCCE3B64013A4F361C0DA26AD7B"><enum>(A)</enum><text>before the applicable date, tax has been imposed under <external-xref legal-doc="usc" parsable-cite="usc/26/4081">section 4081</external-xref> of the Internal Revenue Code of 1986 on any liquid, and</text></subparagraph><subparagraph id="H77DC10C573174F28AD4291B9F8831784"><enum>(B)</enum><text>on such date such liquid is held by a dealer and has not been used and is intended for sale,</text></subparagraph><continuation-text continuation-text-level="paragraph">there shall be credited or refunded (without interest) to the person who paid such tax (in this subsection referred to as the <term>taxpayer</term>) an amount equal to the excess of the tax paid by the taxpayer over the amount of such tax which would be imposed on such liquid had the taxable event occurred on such date.</continuation-text></paragraph><paragraph id="HD7AC34EAA25B411E8B7104C838EB15DA"><enum>(2)</enum><header>Time for filing claims</header><text>No credit or refund shall be allowed or made under this subsection unless—</text><subparagraph id="HD36ECEE4E466422BBF648EFE688498DF" commented="no"><enum>(A)</enum><text>claim therefor is filed with the Secretary of the Treasury before the date that is 6 months after the applicable date, and</text></subparagraph><subparagraph id="H92A2DB26BA4E458FB5A3571DD330582F" commented="no"><enum>(B)</enum><text>in any case where liquid is held by a dealer (other than the taxpayer) on the applicable date—</text><clause id="H39A25433DC10458F9C87CD38421CB49F" commented="no"><enum>(i)</enum><text>the dealer submits a request for refund or credit to the taxpayer before the date that is 3 months after the applicable date, and</text></clause><clause id="HDA3A1C718EF741B89324D463BEDA2EB9" commented="no"><enum>(ii)</enum><text>the taxpayer has repaid or agreed to repay the amount so claimed to such dealer or has obtained the written consent of such dealer to the allowance of the credit or the making of the refund.</text></clause></subparagraph></paragraph><paragraph id="HE78C0736F6834709A292CED4A13AA462"><enum>(3)</enum><header>Exception for fuel held in retail stocks</header><text>No credit or refund shall be allowed under this subsection with respect to any liquid in retail stocks held at the place where intended to be sold at retail.</text></paragraph><paragraph id="H2A4D0C1E9315451798BE8266224151AA"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection—</text><subparagraph id="idB3E0DD96FDAF48D58169420BC6A4CA79"><enum>(A)</enum><header>Applicable date</header><text>The term <term>applicable date</term> means the first day of the first calendar quarter beginning after the date of the enactment of this Act.</text></subparagraph><subparagraph id="idCCD980351A4A425E8CC3C1954070AC31"><enum>(B)</enum><header>Other terms</header><text>The terms <term>dealer</term> and <term>held by a dealer</term> have the respective meanings given to such terms by section 6412 of such Code; except that the term <term>dealer</term> includes a producer.</text></subparagraph></paragraph><paragraph id="HE08DE50B67DB489ABBC41B45D1253DBF"><enum>(5)</enum><header>Certain rules to apply</header><text>Rules similar to the rules of subsections (b) and (c) of section 6412 and sections 6206 and 6675 of such Code shall apply for purposes of this subsection.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4CFBBEB32293455E9246ADEB8B09A05C"><enum>(d)</enum><header>Effective dates</header><paragraph commented="no" display-inline="no-display-inline" id="H3D7E037EE5E84E17AD9A7B093C8EB449"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2), the amendments made by this section shall apply to fuel removed on or after the first day of the first calendar quarter beginning after the date of the enactment of this Act.</text></paragraph><paragraph id="H387168EBE50045B5ABF09E4A24E37C8B" commented="no"
