<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2796</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210922" legis-day="20210921">September 22 (legislative day, September 21), 2021</action-date><action-desc><sponsor name-id="S414">Mr. Ossoff</sponsor> (for himself and <cosponsor name-id="S153">Mr. Grassley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to provide for the eligibility of rural community response pilot programs for funding under the Comprehensive Opioid Abuse Grant Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H63FBA62CD1024405ABD914FE3A2AE6C4"><section section-type="section-one" id="HDEEF25D69A1D43FF8C8389E9BBBF66F4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Opioid Abuse Prevention Act </short-title></quote>.</text></section><section id="H30EBB29FB80F47FDBEC8193D95D53DD9"><enum>2.</enum><header>Eligibility of rural community response pilot programs for funding under the Comprehensive Opioid Abuse Grant Program</header><text display-inline="no-display-inline">Section 3021 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10701">34 U.S.C. 10701</external-xref>) is amended—</text><paragraph id="H61E96F6DD2814C4DA2A89FD7BCD90D2C"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="H789D6FE6AB3D486DBC8680DC17111261"><enum>(A)</enum><text>in subparagraph (F), by striking <quote>and</quote>; </text></subparagraph><subparagraph id="H7BE23D18D0B44986A11BAC4C5E5A4092"><enum>(B)</enum><text>in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph><subparagraph id="H7AEBF79580624E3CB51792091CA29AD9"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H64C8B3DEADF04B1C812D43DD561FDD3C"><subparagraph id="H7D83A542214F4A5A8D9F49FE3E2011CC"><enum>(H)</enum><text display-inline="yes-display-inline">a pilot program for rural areas to implement community response programs that focus on presenting alternatives to incarceration and reducing opioid overdose deaths, as described in subsection (f).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB985A9065BD84AB1AFBD4B5C11E82620"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8E53C2D2CEE64325B34743C4B81DDA91"><subsection id="HE414D9BE89B24172A0496E40E9C4BB7D"><enum>(f)</enum><header>Rural pilot program</header><text display-inline="yes-display-inline">The pilot program described under this subsection shall make grants to rural areas to implement community response programs to reduce opioid overdose deaths. Grants issued under this subsection shall be jointly operated by units of local government, in collaboration with public safety and public health agencies or public safety, public health and behavioral health collaborations. A community response program under this subsection shall identify gaps in community prevention, treatment, and recovery services for individuals who encounter the criminal justice system and shall establish treatment protocols to address identified shortcomings. The Attorney General, through the Office of Justice Programs, shall increase the amount provided as a grant under this section for a pilot program by no more than five percent for each of the two years following certification by the Attorney General of the submission of data by the rural area on the prescribing of schedules II, III, and IV controlled substances to a prescription drug monitoring program, or any other centralized database administered by an authorized State agency, which includes tracking the dispensation of such substances, and providing for interoperability and data sharing with each other such program (including an electronic health records system) in each other State, and with any interstate entity that shares information between such programs.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8EF2BB3C0223405381F0CD7847CE3A65"><enum>3.</enum><header>Provision regarding certain funding level for rural communities</header><text display-inline="no-display-inline">Section 3024 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10704">34 U.S.C. 10704</external-xref>) is amended—</text><paragraph id="HEE757D117E4F495EA6C349F67BEA29F4"><enum>(1)</enum><text>in paragraph (1) by striking <quote>and</quote> at the end; </text></paragraph><paragraph id="H11850E2302314E7F88A42D237FD1BFDD"><enum>(2)</enum><text>in paragraph (2)(C) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H507070A1E9AE4508B24F007335C6DD84"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H5D451F77400C4A989057F6535AB3BA84"><paragraph id="H9F900DB0C1BE4A37AD3B76CFA9F524BE"><enum>(3)</enum><text display-inline="yes-display-inline">provides that not less than 10 percent of grants issued pursuant to this part shall be awarded to rural areas.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0C2A09905B6248369CF51439642CAAC6"><enum>4.</enum><header>Definition</header><text display-inline="no-display-inline">Section 3025 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10705">34 U.S.C. 10705</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7C5681A9E6AA41FC887144FC22EA8C3E"><paragraph id="HF76ECD342B4B46EA8BB448BB0EB7B41B"><enum>(9)</enum><text display-inline="yes-display-inline">The term <quote>rural area</quote> has the meaning given such term in section 343(a)(13)(A) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)(A)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
