<congress display="yes">117th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 2796</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to provide for the eligibility of rural community response pilot programs for funding under the Comprehensive Opioid Abuse Grant Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="HDEEF25D69A1D43FF8C8389E9BBBF66F4" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Opioid Abuse Prevention Act </short-title></quote>.</text></section><section id="H30EBB29FB80F47FDBEC8193D95D53DD9" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Eligibility of rural community response pilot programs for funding under the Comprehensive Opioid Abuse Grant Program</header><text display-inline="no-display-inline">Section 3021 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10701">34 U.S.C. 10701</external-xref>) is amended—</text><paragraph id="H61E96F6DD2814C4DA2A89FD7BCD90D2C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text><subparagraph id="H789D6FE6AB3D486DBC8680DC17111261" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (F), by striking <quote>and</quote>; </text></subparagraph><subparagraph id="H7BE23D18D0B44986A11BAC4C5E5A4092" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph><subparagraph id="H7AEBF79580624E3CB51792091CA29AD9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H64C8B3DEADF04B1C812D43DD561FDD3C"><subparagraph id="H7D83A542214F4A5A8D9F49FE3E2011CC" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">a pilot program for rural areas to implement community response programs that focus on reducing opioid overdose deaths, which may include presenting alternatives to incarceration, as described in subsection (f).</text></subparagraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB985A9065BD84AB1AFBD4B5C11E82620" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8E53C2D2CEE64325B34743C4B81DDA91"><subsection id="HE414D9BE89B24172A0496E40E9C4BB7D" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Rural pilot program</header><paragraph id="id50BDFA37F9E54A9E999F56FB5F5CAD3F" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The pilot program described under this subsection shall make grants to rural areas to implement community response programs to reduce opioid overdose deaths. Grants issued under this subsection shall be jointly operated by units of local government, in collaboration with public safety and public health agencies or public safety, public health and behavioral health collaborations. A community response program under this subsection shall identify gaps in community prevention, treatment, and recovery services for individuals who encounter the criminal justice system and shall establish treatment protocols to address identified shortcomings. The Attorney General, through the Office of Justice Programs, shall increase the amount provided as a grant under this section for a pilot program by no more than five percent for each of the two years following certification by the Attorney General of the submission of data by the rural area on the prescribing of schedules II, III, and IV controlled substances to a prescription drug monitoring program, or any other centralized database administered by an authorized State agency, which includes tracking the dispensation of such substances, and providing for interoperability and data sharing with each other such program (including an electronic health records system) in each other State, and with any interstate entity that shares information between such programs.</text></paragraph><paragraph id="id5CB523130E0547E28FA9318925A7239C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Rules of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to—</text><subparagraph id="id067913E0B28E4C3787CD9A3ABFA19F21" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">direct or encourage a State to use a specific interstate data sharing program; or</text></subparagraph><subparagraph id="id9344B74C32A94108BE9F42102CEAB912" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">limit or prohibit the discretion of a prescription drug monitoring program for interoperability connections to other programs (including electronic health records systems, hospital systems, pharmacy dispensing systems, or health information exchanges).</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20211208" chamber="Senate">Passed the Senate December 8, 2021.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
