which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Homeland Security to use alternatives to detention for certain vulnerable immigrant populations, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCC6441BCDCD8499FB99CE9A186346B84"><section section-type="section-one" id="HBAF0A1775E464B178289C9CB630C69C8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alternatives to Detention Act of 2021</short-title></quote>.</text></section><section id="id018FA28523D94CD9B2DA0663F0B8977C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HB2B3BBB0B499408A8708EB5D77B076CF"><enum>(1)</enum><header>Dependent caregiver</header><text display-inline="yes-display-inline">The term <term>dependent caregiver</term> means an individual who lives with, and provides more than ½ of the financial support required by, a family member who is—</text><subparagraph id="HE33A43A64549444590CF557FE71FEC5E"><enum>(A)</enum><text>younger than 18 years of age; or</text></subparagraph><subparagraph id="HEC2C023C804B44FA887A6D48DDC13D38"><enum>(B)</enum><text>unable to engage in substantial employment due to a physical or mental health condition or disability.</text></subparagraph></paragraph><paragraph id="id3BAB2F17E7A54DB1BC6C7A07D6DF3A40"><enum>(2)</enum><header>Executive departments</header><text>The term <term>executive departments</term> means the Federal Departments listed under section 101 of title 5, United States Code.</text></paragraph><paragraph id="H646C01791F5240418E0DE7F0274A012C"><enum>(3)</enum><header>Family caregiver</header><text display-inline="yes-display-inline">The term <term>family caregiver</term> means an individual who lives with, and provides more than ½ of the personal care required by, a family member who is—</text><subparagraph id="HEC9D7DB45A85484297AA31005D1778FF"><enum>(A)</enum><text>younger than 18 years of age; or</text></subparagraph><subparagraph id="H65F0932EC4A546E18654D809D90DB090"><enum>(B)</enum><text>unable to engage in substantial employment due to a physical or mental health condition or disability.</text></subparagraph></paragraph><paragraph id="H1CAE99CE9BC0414C9D5810C592312559"><enum>(4)</enum><header>Family member</header><text>The term <term>family member</term>, with respect to an individual receiving personal care services or financial support, means an individual who is—</text><subparagraph id="H4C9A3BB8C60B4A279F8BC9A629BDD499"><enum>(A)</enum><text>a parent or legal guardian;</text></subparagraph><subparagraph id="HBDCA93F492E941AB9BD48E49B0255DF3"><enum>(B)</enum><text>a spouse;</text></subparagraph><subparagraph id="HABB3F87D5EC14FEBB415F3F616277365"><enum>(C)</enum><text>a child;</text></subparagraph><subparagraph id="HD8F4FB81D930466D9D5BE5AD5510D64C"><enum>(D)</enum><text>a step-family member; or</text></subparagraph><subparagraph id="HA4EC3471A74D44739FD9E01B2FF815E3"><enum>(E)</enum><text>an extended family member.</text></subparagraph></paragraph><paragraph id="idAA7EA0BD484A4C47B9FF719663C779E6"><enum>(5)</enum><header>Immigration laws</header><text>The term <term>immigration laws</term> has the meaning given such term in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>).</text></paragraph><paragraph id="id5920987E1AB14B9582D45CE1F1C9E533"><enum>(6)</enum><header>Legal guardian</header><text>The term <term>legal guardian</term> means a legal guardian, as defined under State law or under the law of a foreign country.</text></paragraph><paragraph id="H96EC02D9E42E42869399AB62702CA4D3"><enum>(7)</enum><header>Member of a vulnerable population</header><text display-inline="yes-display-inline">The term <term>member of a vulnerable population</term> means an individual who—</text><subparagraph id="HF1A350B9225D445C98777C389884368F"><enum>(A)</enum><text>is an asylum seeker or is otherwise seeking lawful status;</text></subparagraph><subparagraph id="idEF2A64524144477892B3E33CBEAF5551"><enum>(B)</enum><text>is a victim of torture or trafficking;</text></subparagraph><subparagraph id="H172146CCA48B4E0BBC9F5D64EE093101"><enum>(C)</enum><text>has special religious, cultural, or spiritual considerations;</text></subparagraph><subparagraph id="HF7239D432BAC4847991175D600CCD116"><enum>(D)</enum><text>is pregnant or nursing;</text></subparagraph><subparagraph id="H0D41A55F02F94B468ADB3FBD0ADBF443"><enum>(E)</enum><text>is younger than 21 years of age;</text></subparagraph><subparagraph id="id928AB9B630744CFEB1449E1378C543DF"><enum>(F)</enum><text>is older than 60 years of age;</text></subparagraph><subparagraph id="HE02CD38E0CA1488A8BE9A51C26464BC0"><enum>(G)</enum><text>identifies as gay, lesbian, bisexual, transgender, or intersex;</text></subparagraph><subparagraph id="HC47771E9F5E24A959481D2AE37D88A94"><enum>(H)</enum><text>is a victim or a witness of a crime;</text></subparagraph><subparagraph id="HF183AA987BC8470D993BF1B35E293A4F"><enum>(I)</enum><text>has a mental disorder or physical disability; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD9FB0B39E8A41A398612A8D14245DC4"><enum>(J)</enum><text>is experiencing severe trauma or is a survivor of torture or gender-based violence, as determined by an immigration judge or the Secretary based on information obtained—</text><clause commented="no" display-inline="no-display-inline" id="id60FB5EC176AE4FFA93C3FC42CD269F33"><enum>(i)</enum><text>by the attorney or legal services provider of the individual during the intake process; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idE6EA3D8809684B53B19DC07214E8961E"><enum>(ii)</enum><text>through credible reporting by the individual.</text></clause></subparagraph></paragraph><paragraph id="HD6309015D7634E46912F0F7BC5AEA1E8"><enum>(8)</enum><header>Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> means a biological or adoptive parent of a child, whose parental rights have not been relinquished or terminated under State law or the law of a foreign country.</text></paragraph><paragraph id="idAA571F126B77490EB488AE45C2E68F90" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security. </text></paragraph></section><section id="HED5D57F60E2642D8911530AD7F603B89"><enum>3.</enum><header>Alternatives to detention under the immigration laws</header><subsection id="HACFE67EFB24F46FB9093E628AE1B3007"><enum>(a)</enum><header>Establishment</header><paragraph id="idA816A566B9254A269C0610359458797A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish programs to provide alternatives to detention under the immigration laws.</text></paragraph><paragraph commented="no" id="id19D8579689854A48A861118D3C315B71"><enum>(2)</enum><header>Availability</header><text>The programs required under paragraph (1) shall be available to an alien regardless of whether—</text><subparagraph id="id3F29DFB715EE4019A7DDD1BE8268393D"><enum>(A)</enum><text display-inline="yes-display-inline">a decision on a charge of removability with respect to the alien is pending; or</text></subparagraph><subparagraph id="id7DE8FFAAE3D942BD8AA40A3286E13D68"><enum>(B)</enum><text display-inline="yes-display-inline">the alien is subject to an order of removal.</text></subparagraph></paragraph><paragraph id="id7C0BC0046EE04C6E9B36A6860F63E2F6"><enum>(3)</enum><header>Continuum of supervision</header><text display-inline="yes-display-inline">The programs required under paragraph (1) shall provide for a continuum of supervision mechanisms and options, including community-based supervision and community support.</text></paragraph><paragraph commented="no" id="id52E0476888214A28A66E02DD83C61E69"><enum>(4)</enum><header>Contracts with nongovernmental organizations</header><text display-inline="yes-display-inline">The Secretary may contract with one or more nongovernmental organizations to provide services under this subsection and subsection (b).</text></paragraph></subsection><subsection id="id9da863672c234da3aa4019d5f0b075ce"><enum>(b)</enum><header>Restoration of the Family Case Management Program</header><text>Not later than 7 days after the date of the enactment of this Act, the Secretary shall fully restore the U.S. Immigration and Customs Enforcement Family Case Management Program, as constituted on January 21, 2016, which shall—</text><paragraph id="idFDDF021649C04EF9895CBADA4B888D83"><enum>(1)</enum><text>provide community supervision and community support services, including case management services, appearance services, and screening of aliens who have been detained; and</text></paragraph><paragraph id="id3BA371C717D446688F9B97B9C83EAED9"><enum>(2)</enum><text>be carried out through a contract with a nongovernmental organization that has demonstrated expertise in providing such supervision and support services.</text></paragraph></subsection><subsection id="H024D6A5FD3FA4E199BC0084A61746E9B"><enum>(c)</enum><header>Determination of vulnerable population or caregiver status required</header><paragraph id="H4A0C6FB7CD644B4CB4974A0AC4B01DB3"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), not later than 72 hours after taking an individual into custody under the immigration laws, the Secretary, the Commissioner of U.S. Customs and Border Protection, an immigration officer, or an immigration judge shall make an individualized determination with respect to—</text><subparagraph id="idA6B74281ADD342DE940C407016ED1CC5"><enum>(A)</enum><text>whether the individual may participate in an alternatives to detention program, including the Family Case Management Program described in subsection (b); and</text></subparagraph><subparagraph id="id77A6AC4292CB49BB8E617410CC1E3F5D"><enum>(B)</enum><text>the appropriate level of supervision for such individual.</text></subparagraph></paragraph><paragraph commented="no" id="H84903FABCB124FC78CEC65B9026B2881"><enum>(2)</enum><header>Presumption for placement in alternatives to detention program</header><subparagraph commented="no" id="id51BEACCC6BEB4DD190766223E40B7FD8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be a presumption for placement in an alternatives to detention program that is a community-based supervision program for any alien who is—</text><clause commented="no" id="id88E431C1BF0B4B7C8D25040DDCFCB29D"><enum>(i)</enum><text display-inline="yes-display-inline">taken into the physical custody of the Department of Homeland Security; and</text></clause><clause commented="no" id="id53C9F970818D4662B4C7FCCEE0ABD42C"><enum>(ii)</enum><text display-inline="yes-display-inline">a member of a vulnerable population, a parent of a child who is younger than 18 years of age, a dependent caregiver, or a family caregiver.</text></clause></subparagraph><subparagraph commented="no" id="id155460A800574907A30B3D7A193F567D"><enum>(B)</enum><header>Exception</header><text>The presumption described in subparagraph (A) shall not apply if the Secretary, the Commissioner of U.S. Customs and Border Protection, an immigration officer, or an immigration judge specifically determines that the alien is a threat to himself or herself or to the public.</text></subparagraph></paragraph><paragraph commented="no" id="H5031734ED047439AA63F483A23350A2E"><enum>(3)</enum><header>Exceptions</header><text>Alternatives to detention programs shall not be available to any individual—</text><subparagraph id="HCCFC3175D79146D29070345CE33CA794"><enum>(A)</enum><text>who is detained pursuant to section 236A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226a">8 U.S.C. 1226a</external-xref>); or</text></subparagraph><subparagraph id="H91B9BCF677F3401BB313D833E3598D5E"><enum>(B)</enum><text>for whom release on bond or recognizance is determined to be a sufficient measure to ensure appearances at immigration proceedings and public safety.</text></subparagraph></paragraph></subsection><subsection id="H890DBF774DC64599B6FF6A88FAF4C330"><enum>(d)</enum><header>Coordinator of Alternatives to Detention</header><paragraph id="H88B0A6A27D494B13B1A334783DD1AAF5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary shall—</text><subparagraph id="id5D9C342316FE404BAF6DB01F84DA970A"><enum>(A)</enum><text display-inline="yes-display-inline">establish within the Department of Homeland Security the position of Coordinator of Alternatives to Detention (referred to in this subsection as the <quote>Coordinator</quote>), who shall report directly to the Secretary; and</text></subparagraph><subparagraph id="id7264F5D5AD404DC9A4FEB50FA0AE971F"><enum>(B)</enum><text display-inline="yes-display-inline">appoint the Coordinator.</text></subparagraph></paragraph><paragraph id="idA02DFF965B534322AF6D99641A79B08B"><enum>(2)</enum><header>Resources</header><text display-inline="yes-display-inline">The Secretary shall make available to the Coordinator such personnel, funds, and other resources as may be appropriate to enable the Coordinator to carry out the mission described in paragraph (3)(A).</text></paragraph><paragraph id="HBB8124D20A3C43069ADA782A11F8DB23"><enum>(3)</enum><header>Mission and duties</header><subparagraph id="H6DBB1ADD337D4E38BB76AEA74831A8EE"><enum>(A)</enum><header>Mission</header><text display-inline="yes-display-inline">The mission of the Coordinator shall be to coordinate, in collaboration with the executive departments, the use of alternatives to detention programs.</text></subparagraph><subparagraph id="H2B50F09BF0794A3894048EBA363F4AB3"><enum>(B)</enum><header>Duties of coordinator</header><clause id="H3613FEF510CE45B2B08C8A74DC477AE0"><enum>(i)</enum><header>In general</header><text>The Coordinator shall—</text><subclause id="idDB2E4DCB1261421E926A841057EAA547"><enum>(I)</enum><text>serve as the primary point of contact within the executive branch for Congress, State and local governments, the private sector, and community leaders with respect to the alternatives to detention programs; and</text></subclause><subclause id="id28C204E92891437BBA247567C9B42945"><enum>(II)</enum><text>in coordination with the executive departments, with respect to Congress, State and local governments, the private sector, and community leaders, manage information flow about, requests for actions relating to, and discussions on, such programs.</text></subclause></clause><clause id="H8637A1D060DB4A149162A7737BFE89A2"><enum>(ii)</enum><header>Reports required</header><subclause id="idE1800712A1C5452D8344AB91C2C5840E"><enum>(I)</enum><header>Monthly reports</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Coordinator is appointed, and every 30 days thereafter, the Coordinator shall submit a report to Congress that includes, for the reporting period—</text><item id="HEC3ABD5717F54A8D9B4A8ECFCEA2E870"><enum>(aa)</enum><text display-inline="yes-display-inline">the number of individuals detained under the immigration laws—</text><subitem id="idC9AD5975E06B402EAAD742D8424C1765"><enum>(AA)</enum><text display-inline="yes-display-inline">pending a decision on whether the individual is to be removed; and</text></subitem><subitem id="id876021A60B8C42A88898E9BA24B7A1F9"><enum>(BB)</enum><text display-inline="yes-display-inline">after the issuance of a removal order;</text></subitem></item><item id="id7EC6CF24135B476CBBDCCA1C0B08FA23"><enum>(bb)</enum><text display-inline="yes-display-inline">an assessment whether any individual described in item (aa) is subject to the special rule under subsection (c)(2)(B); and</text></item><item id="idB1D901E8DEB741B6BFBD12994F83A012"><enum>(cc)</enum><text>the number of individuals participating in an alternatives to detention program established under subsection (a), disaggregated by the level of supervision of such individuals.</text></item></subclause><subclause id="idE4A45039129B421C84DD873C013F1F87"><enum>(II)</enum><header>Annual reports</header><text>Not later than 1 year after the date on which the Coordinator is appointed, and annually thereafter, the Coordinator shall submit a report to Congress that includes—</text><item id="id56DDF5D3F9B442CC9A4FFFB763C94A3A"><enum>(aa)</enum><text>guidance and requirements for referral and placement decisions in alternatives to detention programs;</text></item><item id="idEEACD8EBC4D840509F05A891322D50F1"><enum>(bb)</enum><text>information on enrollment in alternatives to detention programs, disaggregated by field office;</text></item><item id="idBC064AD6AA334167BF7487EAD94664F5"><enum>(cc)</enum><text>information on the length of enrollment in alternatives to detention programs, disaggregated by type of alternative to detention program; and</text></item><item id="idDF5E93E7CF084378A6F3A8B1845D761D"><enum>(dd)</enum><text>information on the population enrolled in alternatives to detention programs, disaggregated by type of alternative to detention program and point of apprehension.</text></item></subclause></clause></subparagraph><subparagraph id="H353DBAD01E134943A9D801910DBB8EF5"><enum>(C)</enum><header>Duties of executive departments</header><text display-inline="yes-display-inline">The heads of the executive departments shall—</text><clause id="H7C9183DDA87F4A7D88D82ED05B18DC60"><enum>(i)</enum><text>respond promptly to any request by the Coordinator;</text></clause><clause id="HC7CDF4EC475547CEB1EE78ADCA076096"><enum>(ii)</enum><text>consistent with applicable law, provide such information as the Coordinator considers necessary to carry out the mission of the Coordinator; and</text></clause><clause id="H48A6C2F5E94848319B23D44EB2EEF9BA"><enum>(iii)</enum><text>otherwise cooperate with the Coordinator to the maximum extent practicable to facilitate the performance of the mission described in subparagraph (A).</text></clause></subparagraph></paragraph></subsection><subsection id="H3A95156F137B41C09E183782A6BE37D5"><enum>(e)</enum><header>GAO study and report</header><text>The Comptroller General of the United States shall—</text><paragraph id="id6A74E464A7C04258B84C8E0051D00AB1"><enum>(1)</enum><text>conduct a study on the use and effectiveness of the alternatives to detention programs established pursuant to subsection (a); and</text></paragraph><paragraph id="id49159499569D44F5AB70163657F87F0E"><enum>(2)</enum><text>not later than 2 years after the date of the enactment of this Act, submit a report to Congress that contains the results of the study conducted pursuant to paragraph (1).</text></paragraph></subsection></section><section id="id643D9B097EEE49AAA239FBD177BBD23E"><enum>4.</enum><header>Savings provisions</header><subsection id="idD65C44F716534C2CA8552877239D5D97"><enum>(a)</enum><header>Federal law</header><text>Nothing in this Act may be construed to supersede or modify—</text><paragraph id="id8ad7261778ac481a8c15158ccf28cc2d"><enum>(1)</enum><text>the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232 et seq.</external-xref>);</text></paragraph><paragraph id="id444819d5348e4b57b2989d0ae0f231c2"><enum>(2)</enum><text>the Stipulated Settlement Agreement filed in the United States District Court for the Central District of California on January 17, 1997 (CV 85–4544–RJK) (commonly known as the <quote>Flores Settlement Agreement</quote>);</text></paragraph><paragraph id="ide647361620e94255a1332cd124c87012"><enum>(3)</enum><text>the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>); or</text></paragraph><paragraph id="ida2869480c4fe4146a2e44e88e0e60cb6"><enum>(4)</enum><text>any applicable Federal child welfare law, including the Adoption and Safe Families Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/89">Public Law 105–89</external-xref>).</text></paragraph></subsection><subsection id="id208F0C8BAEC34636A4D59D59D4463066"><enum>(b)</enum><header>State law</header><text>Nothing in this Act may be construed to supersede or modify any applicable State child welfare law.</text></subsection></section></legis-body></bill>
