which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture to provide assistance for socially disadvantaged farmers and ranchers and socially disadvantaged groups, and for other purposes.</official-title></form><legis-body><section id="idC450CCF3B66E4040AE0E44BBDE3EB163" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Relief for Farmers of Color Act of 2021</short-title></quote>.</text></section><section id="id24c7181737a7490e99d3f8a702af63ac"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idec11215ac6654308965bb82ed16fa0b3"><enum>(1)</enum><text>various factors have contributed to the loss of Black farmers, Indigenous farmers, and farmers of color in the United States, including—</text><subparagraph id="idB8C7E9A4C6C64554A35C4CCEE3B5BF1A"><enum>(A)</enum><text>mass and systemic loss of farmland owned and operated by minority farmers;</text></subparagraph><subparagraph id="id02CFF73C0FEA46578A444153854BC1FE"><enum>(B)</enum><text>institutional civil rights violations by the Federal Government; </text></subparagraph><subparagraph id="id19A2CC48F3B94146A510B6D5D6D59D43"><enum>(C)</enum><text>difficulties accessing debt and credit capital; and </text></subparagraph><subparagraph id="idF9A7ED6D6929492BA3A97B23FB661DA0"><enum>(D)</enum><text>other legal challenges that make it difficult for minority farmers and farmworkers to participate in the United States farm economy;</text></subparagraph></paragraph><paragraph id="idfd0b612f746c4a2ab8f445f358af685a"><enum>(2)</enum><text>a 2019 Government Accountability Office report found that socially disadvantaged farmers and ranchers have more difficulty getting loans and credit from the Department of Agriculture, which can help beginning farmers break into the business and help existing farmers continue running their operations; </text></paragraph><paragraph id="id750AD585E8714C19A50355E9EDB00175"><enum>(3)</enum><text>the finding described in paragraph (2) highlights the systemic racism that has hindered farmers of color for generations and continues as of the date of enactment of this Act;</text></paragraph><paragraph id="id89271c7ac5474bb4b1a2f80c23fca9d9"><enum>(4)</enum><text>beginning in 1830, Native American removal was a federally sanctioned practice, the impact of which still detrimentally impacts Native American farmers today, including— </text><subparagraph id="id83C801D6ECBE48C0A7861C973338F177"><enum>(A)</enum><text>the moving of tens of thousands of original inhabitants from traditional land;</text></subparagraph><subparagraph id="idC2F8EABF664A47E1841216527B294538"><enum>(B)</enum><text>the disruption of land ownership and tenure; and </text></subparagraph><subparagraph id="idE3D23FBE9901472E866F619E4255A2C1"><enum>(C)</enum><text>the reorientation of traditional farm production techniques;</text></subparagraph></paragraph><paragraph id="idfebe6eab1e294f8a80dd5bdbfc090db4"><enum>(5)</enum><text>according to the Census of Agriculture—</text><subparagraph id="id2EC2DB6D25F944AF893DBD5218ECC52A"><enum>(A)</enum><text>approximately 80 percent of land was lost by Black farmers from 1910 to 2007; </text></subparagraph><subparagraph id="id9D4088038A1B45D19C4BC3A7B8348E79"><enum>(B)</enum><text>in 1910, 14 percent of United States farmers were Black; and </text></subparagraph><subparagraph id="id93DE70CA9B254A5A96CD3418BADD2B56"><enum>(C)</enum><text>in 2012, less than 2 percent of United States farmers were Black;</text></subparagraph></paragraph><paragraph id="id43f54e1dfa5f4d4bb798a4b381fe5eb4"><enum>(6)</enum><text>heirs’ property refers to land that is informally passed down from generation to generation without a legally designated owner;</text></paragraph><paragraph id="idEEE905CDF8404F8392C56201316ACB63"><enum>(7)</enum><text>due to lack of access to the legal system during Reconstruction and distrust of the legal system during the Jim Crow era, many Black families have relied on heirs’ property to keep land in their families, which has resulted in title issues now hindering many Black families from obtaining credit; </text></paragraph><paragraph id="id22aa678334834af98ca4537daf6b9276"><enum>(8)</enum><text>Hispanic farmers were unlawfully discriminated against by the Department of Agriculture with respect to credit and loan transaction and farm disaster benefits;</text></paragraph><paragraph id="id47807e52c1384eb6ab0adca34875937b"><enum>(9)</enum><text>there are various laws, regulations, and questionable practices that have led to and are associated with land owned by Black farmers, Indigenous farmers, and farmers of color being acquired by developers, contrary to the will of the farmers and land workers;</text></paragraph><paragraph id="idbab748a24b5d40698a743ed9d42233dc"><enum>(10)</enum><text>numerous reports over 60 years have shown a consistent pattern of discrimination at the Department of Agriculture against Black farmers, Indigenous farmers, and farmers of color;</text></paragraph><paragraph id="idc21729e9a705478f9951a3e7ef1d82b8"><enum>(11)</enum><text>in 1965, the United States Commission on Civil Rights found evidence of discrimination in program delivery and the treatment of employees of color at the Department of Agriculture;</text></paragraph><paragraph id="id0e7479f888a84e88aea5b0bb11a76e45"><enum>(12)</enum><text>in the 1970s, the Department of Agriculture deliberately forced Black farmers, Indigenous farmers, and farmers of color off their land through corrupt loan and financing practices;</text></paragraph><paragraph id="id2385d1df703a4fb899471ae0e33c33ff"><enum>(13)</enum><text>a 1982 report of the United States Commission on Civil Rights concluded that racial discrimination was continuing within the Department of Agriculture, and, despite lawsuits and court orders, the discrimination continued in carrying out the farm loan programs in the headquarters and the network of field offices of the Department of Agriculture; and</text></paragraph><paragraph id="id18a481b1be814a82803da62f2e0862c8" commented="no" display-inline="no-display-inline"><enum>(14)</enum><text>a 2008 Government Accountability Office report stated there were <quote>significant deficiencies</quote> in addressing civil rights issues by the Department of Agriculture and recommended new measures to address the backlog of civil rights issues at the Department of Agriculture. </text></paragraph></section><section id="id28f734093cb0474c8251ddf5039418d6"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb03ae9c697d648ab93f8987288d5dc20"><enum>(1)</enum><header>Farm loan</header><text>The term <term>farm loan</term> means a loan administered by the Farm Service Agency under subtitle A, B, or C of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922</external-xref> et seq.).</text></paragraph><paragraph id="id2657c2779f264bf796217dcbea4d4c61"><enum>(2)</enum><header>Qualified nonprofit organization</header><text>The term <term>qualified nonprofit organization</term> means an organization—</text><subparagraph id="id4f88315005ec4a738b2f7095aebabf92"><enum>(A)</enum><text>that is a nonprofit;</text></subparagraph><subparagraph id="id43209ba6ba764f43b1ebc0501226e048"><enum>(B)</enum><text>that has not less than 3 years of experience providing meaningful agricultural, business assistance, legal assistance, or advocacy services to socially disadvantaged farmers or ranchers; and</text></subparagraph><subparagraph id="idec2bf1fa386544ecaed394f7f2dbdf74"><enum>(C)</enum><text>at least 50 percent of the members of the board of directors of which are members of a socially disadvantaged group. </text></subparagraph></paragraph><paragraph id="id0f7c3aed2226440f90f64ffc0504e153"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="ida044ea83704341dabd68e78b23cab488"><enum>(4)</enum><header>Socially disadvantaged farmer or rancher</header><text>The term <term>socially disadvantaged farmer or rancher</term> has the meaning given the term in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>).</text></paragraph><paragraph id="id28d116d9ce144f54959c9491cf9cc458"><enum>(5)</enum><header>Socially disadvantaged group</header><text>The term <term>socially disadvantaged group</term> has the meaning given the term in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>).</text></paragraph></section><section id="id29e442fe3573477a9534ef5a8ab38d76"><enum>4.</enum><header>Debt forgiveness on farm service agency loans</header><subsection id="idaefb664506854acbaf484b5bf151abdd"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to address the historical discrimination against socially disadvantaged farmers and ranchers and address issues relating to the Coronavirus Disease 2019 (COVID–19)—</text><paragraph id="id7e929ec604364e07a555e85c96d88cc5"><enum>(1)</enum><text>in farm loan programs; and</text></paragraph><paragraph id="id9d2a4179926b4c83af866b8c91f43c7c"><enum>(2)</enum><text>across the Department of Agriculture.</text></paragraph></subsection><subsection id="id807b578e0ec34748a0f8dd1ea689c1b1"><enum>(b)</enum><header>Debt forgiveness</header><paragraph id="id828596b12d614adabfb07b9b640c0239"><enum>(1)</enum><header>Direct loans</header><text>The Secretary shall forgive the obligation of each socially disadvantaged farmer or rancher who is a borrower of a farm loan made by the Secretary to repay the principal and interest outstanding as of the date of enactment of this Act on the farm loan.</text></paragraph><paragraph id="id39f492bcf3ea4ce68c64ce148b017e86"><enum>(2)</enum><header>Guaranteed loans</header><text>The Secretary shall pay to each lender of farm loans guaranteed by the Secretary an amount equal to the principal and interest outstanding as of the date of enactment of this Act on all farm loans held by the lender, the borrowers of which are socially disadvantaged farmers and ranchers, such that the borrowers shall be relieved of the obligation to repay the principal and interest due on those guaranteed farm loans.</text></paragraph><paragraph id="idc4b2078498f14b9fb84ce5f70e4d1986"><enum>(3)</enum><header>Applications</header><subparagraph id="id589a56b955214c0caca3f74220c55f67"><enum>(A)</enum><header>Circumstances when not required</header><text>The Secretary shall not require a borrower of a farm loan for which debt forgiveness may be provided under paragraph (1) or (2) who has self-identified as a socially disadvantaged farmer or rancher under a farm loan existing as of the date of enactment of this Act to submit an application for debt forgiveness under paragraph (1) or (2).</text></subparagraph><subparagraph id="idc518bffeae8e4fdfaa7ff1b755bcb7a2"><enum>(B)</enum><header>Opportunity to submit</header><text>The Secretary shall provide to each socially disadvantaged farmer or rancher who is a borrower of a farm loan for which debt forgiveness may be provided under paragraph (1) or (2) and who has not self-identified as a socially disadvantaged farmer or rancher under a farm loan existing as of the date of enactment of this Act an opportunity to submit to the Secretary an application for debt forgiveness under paragraph (1) or (2).</text></subparagraph></paragraph><paragraph id="id2f86bc00c00d4b8ca6b978453cbacd97"><enum>(4)</enum><header>Prohibition on future eligibility restriction</header><text>The Secretary shall not restrict the eligibility of a borrower for a future farm loan based on the receipt of loan forgiveness under this section. </text></paragraph></subsection><subsection id="idbbf42cd04f8d433a91fde34ebfac4362"><enum>(c)</enum><header>Funding</header><text>There is appropriated to the Secretary, out of amounts in the Treasury not otherwise appropriated, to carry out this section $4,000,000,000 for the period of fiscal years 2021 through 2025.</text></subsection></section><section id="id7594bb5017844282828c1ec2c41d2535"><enum>5.</enum><header>Additional assistance for socially disadvantaged farmers and ranchers and socially disadvantaged groups</header><subsection id="id8b4a6750be9d417aaa7ea37ae8afc05e"><enum>(a)</enum><header>Equity commission</header><paragraph id="idB61DDF7332174443BD9EB40A51779333"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an equity commission composed of—</text><subparagraph id="id6ad06d999faa4ebd8cec80075e4b05a6"><enum>(A)</enum><text>officers of the Department of Agriculture; </text></subparagraph><subparagraph id="id0C9B8F008FF44CC0B4EF67A17AB67458"><enum>(B)</enum><text>individuals with an interest in the activities of the Department of Agriculture;</text></subparagraph><subparagraph id="id25ddcce045d74e3288b4e4852df72c78"><enum>(C)</enum><text>socially disadvantaged farmers or ranchers with not less than 10 years of experience in farming or ranching;</text></subparagraph><subparagraph id="id13eedf9449844867a0d0c1156492b7b6"><enum>(D)</enum><text>individuals with expertise in civil rights; and</text></subparagraph><subparagraph id="idF31A46DF587F41E093AA78371C005834"><enum>(E)</enum><text>employees or board members of qualified nonprofit organizations.</text></subparagraph></paragraph><paragraph id="idc9ce5cd1cb4c4a339c2fb0cbd9a4ae49"><enum>(2)</enum><header>Duties</header><text>The equity commission established under paragraph (1) shall—</text><subparagraph id="idde4123d82b0b4d80b238f38a5b69bc01"><enum>(A)</enum><text>examine past discrimination by the Department of Agriculture;</text></subparagraph><subparagraph id="id3d298f38daef490f9eb6a05adbe95884"><enum>(B)</enum><text>examine and evaluate discrimination occurring in programs administered by the Department of Agriculture; and</text></subparagraph><subparagraph id="idb5916d1dfa5442c1bfca708ad26aa326"><enum>(C)</enum><text>provide recommendations to the Secretary to address and mitigate future discrimination by the Department of Agriculture, including—</text><clause id="id055146CD4E6646528892DD2591C19C2F"><enum>(i)</enum><text>budgetary recommendations; and</text></clause><clause id="id674bb1a3afee4666899ebd96770b8141"><enum>(ii)</enum><text>recommendations for improving the structure of Farm Service Agency county committees to better serve socially disadvantaged farmers and ranchers. </text></clause></subparagraph></paragraph></subsection><subsection id="iddb07b13d8e5e411481b815458346604f"><enum>(b)</enum><header>National Center for Minority Farmer Agricultural Law Research and Information</header><paragraph id="id554869e3e2c34294b2613292e8d425f8"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall make a competitive grant to a school of law, or a legal research entity, in the United States to establish the National Center for Minority Farmer Agricultural Law Research and Information (referred to in this subsection as the <term>Center</term>).</text></paragraph><paragraph id="id46a08088a99648788e45340a2d1f6e95"><enum>(2)</enum><header>Activities</header><text>The Center shall—</text><subparagraph id="idfb7d06874e48405e8b34728c6fac56c5"><enum>(A)</enum><text>conduct international, Federal, State, and local legal research on the legal issues of minority farmers and farmworkers relating to farmland, credit, land ownership, and related food and agricultural issues;</text></subparagraph><subparagraph id="idd52a5c048f9f4e19845311f3b00add2f"><enum>(B)</enum><text>provide information, community legal education, policy research, and guidance on legal issues relating to minority farmers and farmworkers to—</text><clause id="idce90a568505b45ad9d817b60d5a883aa"><enum>(i)</enum><text>practicing attorneys, including attorneys providing pro bono assistance, representing minority farmers and farmworkers, including advice and brief services;</text></clause><clause id="idaa89bcfab38645d2a4607ed9da3b3c48"><enum>(ii)</enum><text>minority farmers and individuals assisting minority farmers on legal issues;</text></clause><clause id="id9a73a66e0a43413c870cd49f5c2e8e20"><enum>(iii)</enum><text>food, agriculture, farmworker, and farm organizations;</text></clause><clause id="id106db289cdcd440bb375910f2063b45f"><enum>(iv)</enum><text>local, State, and Federal agencies;</text></clause><clause id="ide21d50beabe74a2f802b279e366b5870"><enum>(v)</enum><text>members of Congress; and</text></clause><clause id="id11b390e839d84c53a2dd8d30881d20d4"><enum>(vi)</enum><text>other persons who are assisting minority farmers and farmworkers in addressing the legal issues described in subparagraph (A); and</text></clause></subparagraph><subparagraph id="id5db21be396c24c6495dfd5d1d059124c"><enum>(C)</enum><text>coordinate a national network of attorneys—</text><clause id="id858B1BDA82944CB58E7985166F3D410A"><enum>(i)</enum><text>providing legal assistance to minority farmers and farmworkers; or</text></clause><clause id="id7B69C35FC3CE47C6A914EE1887BFC273"><enum>(ii)</enum><text>working on issues relevant to minority farmers and farmworkers.</text></clause></subparagraph></paragraph><paragraph id="idc844384163b94f8c9a2df90f4ed91478"><enum>(3)</enum><header>Availability</header><subparagraph id="id79B19BC8788D4C7CBD27B0F45A4D5360"><enum>(A)</enum><header>Center</header><text>The Center shall make available to the National Agricultural Library the research, community legal education, policy research, guidance, advice, and information of the Center.</text></subparagraph><subparagraph id="idC78B43B9E0974F8EBFFC110BBC8B8480"><enum>(B)</enum><header>National Agricultural Library</header><text>The National Agricultural Library shall make available to the public the research, community legal education, policy research, guidance, advice, and information provided by the Center under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id60d263758be8462ebb06c8ee3fe3ba58"><enum>(4)</enum><header>Collaboration</header><text>The Center shall collaborate with—</text><subparagraph id="id9200F53B9E454E11AB4DCFA01C90EA2C"><enum>(A)</enum><text>the National Agricultural Library; and </text></subparagraph><subparagraph id="id51AEC5B71478404A82C264F8798DE2C7"><enum>(B)</enum><text>the National Center for Agricultural Law Research and Information.</text></subparagraph></paragraph></subsection><subsection id="id70360dab2f1f4d0ba919445a7f20539d"><enum>(c)</enum><header>Grants and loans To resolve ownership and succession on farmland</header><text>The Secretary shall make—</text><paragraph id="id97a8ed5f04d04345b9b9d3bbf44825ae"><enum>(1)</enum><text>grants to resolve property issues relating to ownership and succession on farmland; and</text></paragraph><paragraph id="id34979b1a710f41979be449e266901af6"><enum>(2)</enum><text>loans under section 310I of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1936c">7 U.S.C. 1936c</external-xref>).</text></paragraph></subsection><subsection id="idb1f4d18f2ac44ceb8fa7ba74342e8df5"><enum>(d)</enum><header>Cooperatives serving socially disadvantaged groups</header><text>The Secretary shall provide financial assistance to cooperative development centers, individual cooperatives, or groups of cooperatives—</text><paragraph id="idd01a21b26bc74165a9970287aa2c7346"><enum>(1)</enum><text>that serve socially disadvantaged groups; and</text></paragraph><paragraph id="id18fbe646beba4fe3a5848b922f7e0846"><enum>(2)</enum><text>a majority of the boards of directors or other governing boards of which are composed of individuals who are members of socially disadvantaged groups.</text></paragraph></subsection><subsection id="iddf917600d71f4fea97f0d92bbf491bd5"><enum>(e)</enum><header>Pilot projects</header><text>The Secretary may establish pilot projects to provide technical and financial assistance to socially disadvantaged farmers and ranchers, including projects that focus on land acquisition, financial planning, technical assistance, and credit.</text></subsection><subsection id="idf2445319319b46ccad2d755fda9df59e"><enum>(f)</enum><header>Historical discrimination</header><text>The Secretary may provide financial assistance to socially disadvantaged farmers or ranchers that—</text><paragraph id="id101F01EDEA3A4F54BB56C78898F466F8"><enum>(1)</enum><text>are former farm loan borrowers of the Department of Agriculture; and</text></paragraph><paragraph id="id94B9DC52A16247D5832B9B2B52DDACB7"><enum>(2)</enum><text>have suffered adverse actions or past discrimination or bias relating to the farm loan, as determined by the Secretary.</text></paragraph></subsection><subsection id="idbc61e012b8564a5a9f59f0a0aa427f15"><enum>(g)</enum><header>Financial institutions</header><text>The Secretary may support the development of agricultural credit financial institutions that are designed to serve and finance socially disadvantaged groups, including Farm Credit System institutions chartered under the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2001">12 U.S.C. 2001</external-xref> et seq.).</text></subsection><subsection id="id645130c821db48a4a74e964cfcb20373"><enum>(h)</enum><header>Financial and technical assistance</header><text>The Secretary shall provide financial assistance, outreach, mediation, financial training, capacity building training, cooperative development training and support, and other technical assistance to qualified nonprofit organizations that provide services to socially disadvantaged farmers and ranchers.</text></subsection><subsection id="id2eb60c60007547579e341ee420bc01a9"><enum>(i)</enum><header>1890 land-Grant institutions and certain other institutions</header><text>The Secretary shall support and supplement research, education, and extension activities at—</text><paragraph id="id97e7e21928d74471a1564041644bab86"><enum>(1)</enum><text>colleges or universities eligible to receive funds under the Act of August 30, 1890 (commonly known as the <quote>Second Morrill Act</quote>) (26 Stat. 417, chapter 841; <external-xref legal-doc="usc" parsable-cite="usc/7/321">7 U.S.C. 321</external-xref> et seq.), including Tuskegee University;</text></paragraph><paragraph id="id374ab118a6cf471f89d66a4f8615183f"><enum>(2)</enum><text>1994 Institutions (as defined in section 532 of the Equity in Education Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>));</text></paragraph><paragraph id="ide3d58f1acd5f4bab99c60fbb6e823862"><enum>(3)</enum><text>Alaska Native serving institutions and Native Hawaiian serving institutions eligible to receive grants under subsections (a) and (b), respectively, of section 1419B of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3156">7 U.S.C. 3156</external-xref>);</text></paragraph><paragraph id="id4eb38ef8e04746d284e52a8ff73aab8c"><enum>(4)</enum><text>Hispanic-serving institutions eligible to receive grants under section 1455 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3241">7 U.S.C. 3241</external-xref>); and</text></paragraph><paragraph id="id86cc2cd65e324b45967de195d714153d"><enum>(5)</enum><text>eligible institutions (as defined in section 1489 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3361">7 U.S.C. 3361</external-xref>)).</text></paragraph></subsection><subsection id="id0735ce47b32e49e880ab9ee4b932a9ef"><enum>(j)</enum><header>Grants for scholarships</header><text>The Secretary shall provide grants to—</text><paragraph id="ideb151dc0acb2453fbacb8f43d48fd3d2"><enum>(1)</enum><text>colleges or universities eligible to receive funds under the Act of August 30, 1890 (commonly known as the <quote>Second Morrill Act</quote>) (26 Stat. 417, chapter 841; <external-xref legal-doc="usc" parsable-cite="usc/7/321">7 U.S.C. 321</external-xref> et seq.), including Tuskegee University, for student scholarships; and</text></paragraph><paragraph id="idaf20a6a4911b4a4d800f56a0aa99a250"><enum>(2)</enum><text>land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)) for scholarships for students or prospective students who are—</text><subparagraph id="id92f298648c6d455ba349ec1bdc0cddf7"><enum>(A)</enum><text>members of Indian Tribes; and</text></subparagraph><subparagraph id="id6995ab376f0749e8912ea0d3246df2b5"><enum>(B)</enum><text>pursuing an agricultural field of study.</text></subparagraph></paragraph></subsection><subsection id="id090fb6a605214e60aa4356e8f15c8c67"><enum>(k)</enum><header>Funding</header><text>There is appropriated to the Secretary, out of amounts in the Treasury not otherwise appropriated, to carry out this section $1,000,000,000 for fiscal year 2021, to remain available until expended.</text></subsection></section></legis-body></bill>
