Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Veterans Affairs to address the inappropriate or unlawful denial by the Department of Veterans Affairs of benefits and services for former members of the Armed Forces who were discharged or released from the active military, naval, or air service under conditions characterized as neither dishonorable nor honorable, and for other purposes.</official-title></form><legis-body><section id="id36DBBA986818489C8A0635E4A4E6CFCE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unlawful Turn-Aways Act of 2021</short-title></quote>.</text></section><section id="id3306CE94386B4BF4BEE9572744E2DBAC" section-type="subsequent-section"><enum>2.</enum><header>Addressing Department of Veterans Affairs turn-away problem</header><subsection id="idF2D4D2B8B74F40F3A890E424A768E10F"><enum>(a)</enum><header>Improving training, guidance, and oversight of Department of Veterans Affairs staff</header><paragraph id="id1042571F5F8F495D97ED33A2CD465C9F"><enum>(1)</enum><header>Training</header><subparagraph id="id76598A46CD2D4FDCB7B538DE64161F84"><enum>(A)</enum><header>For all employees</header><text>The Secretary of Veterans Affairs shall require all employees of the Department of Veterans Affairs to participate in uniform, national training on character of discharge eligibility standards for benefits and services provided under laws administered by the Secretary.</text></subparagraph><subparagraph id="id97C30DD5276E486B9B19F879E074BA07"><enum>(B)</enum><header>For front-line staff</header><text>The Secretary shall require all employees of the Department who the Secretary considers front-line staff, including employees of the Department that the Secretary considers Department facility enrollment and eligibility staff, to participate, as soon as practicable after the date of the enactment of this Act and periodically thereafter, in training described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="id39E39BEFA4684DAF9C40F60006A5199D"><enum>(2)</enum><header>Requirement that any contact with Department of Veterans Affairs seeking health care from Department be recorded in electronic health management system</header><text display-inline="yes-display-inline">The Secretary shall ensure that any contact made by an individual seeking health care from the Department is recorded in the electronic health management system of the Department. </text></paragraph><paragraph id="id124F6DD600ED42EA8B0EE82C9E91DDE1"><enum>(3)</enum><header>Designation of positions</header><subparagraph id="id887D19AE7D404DFC9EFD70A9A92ADEDD"><enum>(A)</enum><header>In general</header><text>The Secretary shall designate a national-level position and establish senior positions within each regional office of the Department to focus on issues affecting individuals who served in the active military, naval, or air service and who were discharged or released therefrom under conditions characterized as neither honorable nor dishonorable.</text></subparagraph><subparagraph id="idBF01BB538A294B07A2D874BB66CAA824"><enum>(B)</enum><header>Congressional updates</header><text>The official designated to a national-level position under subparagraph (A) shall provide Congress with updates, on a regular basis, on progress made by the Department in providing benefits and services to individuals described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id654CEA7038AC41368CECC9849BEABFF4"><enum>(b)</enum><header>Remedy past unlawful turn-Aways</header><paragraph id="id4DF6B6555E384FE59A3CA479DA2E39EA"><enum>(1)</enum><header>Assessment, identification, recommendations, and report</header><text>Not later than one year after the date of the enactment of this Act, the Inspector General of the Department of Veterans affairs shall—</text><subparagraph id="id0F4E5724D8D54452B579F907E2D900AB"><enum>(A)</enum><text>conduct an assessment of the practices of the Department involving denying benefits and services to individuals seeking such benefits and services from the Department based on a discharge or release from service in the active military, naval, or air service under conditions that were characterized as neither honorable nor dishonorable;</text></subparagraph><subparagraph id="idE261691D973540508BAC5EA161105C8A"><enum>(B)</enum><text>identify whether any denials described in subparagraph (A) were unlawful and the scope of such unlawful denials by the Department;</text></subparagraph><subparagraph id="id43D0504FFE3B470C964DDEED603BACC2"><enum>(C)</enum><text>develop recommendations for legislative or administrative action to limit the occurrence of unlawful denials described in subparagraph (B); and</text></subparagraph><subparagraph id="id34332E9E8FF847FD90F35EC157C2FA91"><enum>(D)</enum><text>submit to Congress a report on the findings of the Inspector General under subparagraphs (A) through (C).</text></subparagraph></paragraph><paragraph id="id50E74395146447CEB3135542D7F5EEA5"><enum>(2)</enum><header>Notice</header><subparagraph id="id020A2E836F204774B19A792B84046E15"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text><clause id="id3361eef9a7bc4858ae9536879192bd3d"><enum>(i)</enum><text>notify all individuals who were discharged or released from service in the active military, naval, or air service under conditions that were characterized as neither honorable nor dishonorable about their right to apply for health care and benefits from the Department; and</text></clause><clause id="id920D91C84BF74C5AB9B8F980FF17585F"><enum>(ii)</enum><text>encourage individuals described in clause (i) to apply for health care and benefits described in such clause, even if they have previously been denied or turned away from the Department.</text></clause></subparagraph><subparagraph id="id869C42B0588848AAB2A4AC56688657F9"><enum>(B)</enum><header>Manner</header><text>The Secretary shall carry out subparagraph (A) by sending individuals described in such subparagraph a letter to last known address on file with Social Security Administration.</text></subparagraph></paragraph><paragraph id="id70B034BD8949418D847B8C45D9E7982B"><enum>(3)</enum><header>Outreach</header><subparagraph id="idCAC73683C2F642D18408D33978F8027B"><enum>(A)</enum><header>Program required</header><text>The Secretary shall carry out a program of public outreach, including via the internet and through mailed notices, to covered individuals described in subparagraph (B) who may have been unlawfully denied a benefit or service from the Department based on the characterization of their discharge or release from service in the active military, naval, or air service.</text></subparagraph><subparagraph id="idDA24F3EB487340379FE1D8B0FD0D2F8C"><enum>(B)</enum><header>Covered individuals</header><text>For purposes of this paragraph, a covered individual is an individual who was discharged or released from service in the active military, naval, or air service under conditions that were characterized as neither honorable nor dishonorable.</text></subparagraph><subparagraph id="idA00AC9827B3C43C1B71331D7B08DD1F6"><enum>(C)</enum><header>Contents</header><text>Outreach carried out pursuant to the program required by subparagraph (A) shall include distribution of information about what benefits and services covered individuals may be eligible for under laws administered by the Secretary of Veterans Affairs. </text></subparagraph><subparagraph id="idF8B302A9DCC84DC8AFDB79ED4C8C87E5"><enum>(D)</enum><header>Manner</header><text>Outreach under the program required by subparagraph (A) shall include the following methods of contact:</text><clause id="id69DB2115CC72415FB3057A43B0BFDB51"><enum>(i)</enum><text>Traditional and social media.</text></clause><clause id="idE3C250377C0C4BA9AD91C221CCCD24BE"><enum>(ii)</enum><text>Websites and blogs of the Department.</text></clause><clause id="id19CA3BC924854A42AA7DE131C0973116"><enum>(iii)</enum><text>Informational brochures and fact sheets.</text></clause><clause id="idFB3EC7013FFF486B966D7B8305041B56"><enum>(iv)</enum><text>Community events.</text></clause></subparagraph></paragraph></subsection><subsection id="idC5C27A7A88D04999A029810D8C2C6E98"><enum>(c)</enum><header>Simplifying eligibility standards and processes</header><paragraph id="idC80B1DAE89D14A9399E59E6B65104DF3"><enum>(1)</enum><header>Modification of definition of veteran</header><text>Section 101(2) of title 38, United States Code, is amended by striking <quote>under conditions other than dishonorable</quote> and inserting <quote>, other than a person whose rights are barred by section 5303(a) of this title</quote>.</text></paragraph><paragraph id="id45903A1690874EDEB4B3FE001FDA9BDD"><enum>(2)</enum><header>Veterans Justice Outreach Program services</header><subparagraph id="id823F3054ADEF402D86ED1301C8BFD3C5"><enum>(A)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall ensure that services provided by the Veterans Justice Outreach Program are available to all individuals who served in the active military, naval, or air service, regardless of the nature of their discharge or release from such service.</text></subparagraph><subparagraph id="id91bde3328a7a4239be630017d6df0e69"><enum>(B)</enum><header>Veterans Justice Outreach Program defined</header><text>In this paragraph:</text><clause id="id9edb4fe7efa842ef898fd55eabc19ace"><enum>(i)</enum><header>Justice-involved veteran</header><text>The term <term>justice-involved veteran</term> means a veteran with active, ongoing, or recent contact with some component of a local criminal justice system.</text></clause><clause id="idd54ce5c00a024ba1a2e3cbe333081615"><enum>(ii)</enum><header>Local criminal justice system</header><text>The term <term>local criminal justice system</term> means law enforcement, jails, prisons, and Federal, State, and local courts.</text></clause><clause id="idEB53AFFEFD5D4BBFBC02AA7194F9FC3A"><enum>(iii)</enum><header>Veterans Justice Outreach Program</header><text>The term <term>Veterans Justice Outreach Program</term> means the program through which the Department of Veterans Affairs identifies justice-involved veterans and provides such veterans with access to Department services.</text></clause></subparagraph></paragraph></subsection><subsection id="id4C80D38B39D1469D85CECE1632712982"><enum>(d)</enum><header>Definitions</header><text>In this section, the terms <term>active military, naval, or air service</term> and <term>veteran</term> have the meanings given such terms in section 101 of title 38, United States Code. </text></subsection></section><section id="id5F44BE80E5DF4ACC9667638C09B0D2CE"><enum>3.</enum><header>Modification of requirements relating to eligibility for certain counseling services from Department of Veterans Affairs</header><subsection id="id37FA7668692F4D809BB1DDE7CC8411CC"><enum>(a)</enum><header>Counseling for military sexual trauma</header><text display-inline="yes-display-inline">Section 1720I(b) of title 38, United States Code, is amended—</text><paragraph id="id33FFFC4FE6E94415B12B059837A2EBF2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text><subparagraph id="id5289879C051645E4B7ACBB87D53B2D9A"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subparagraph (B); and</text></subparagraph><subparagraph id="id26AE00B142C640078A6434E77F170D1A"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>(A)(i) served</quote> and inserting <quote>(i) served</quote>; and</text></subparagraph></paragraph><paragraph id="idFA22E4CAB5F44946A5E3B4D173FEFB21"><enum>(2)</enum><text>in paragraph (2), by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></paragraph><paragraph id="id72D5E0D798D0434D83B9D20A1FA76780"><enum>(3)</enum><text>in paragraph (1), by striking <quote>is a former member</quote> and inserting <quote>(A) is a former member</quote>;</text></paragraph><paragraph id="id4B1BEA5D4B6B49239A4A7DA549F08B59"><enum>(4)</enum><text>by redesignating paragraphs (2) through (4) as subparagraphs (B) through (D), respectively; and</text></paragraph><paragraph id="id679AF5E134AB4511AA58F38173728322"><enum>(5)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1E8E096CAA684DFABF8B925A7BCF8D0C"><paragraph id="idE451E36EBC3740968F1CB1CFB1A4A1F8" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id899D8582313E4E24A612B812B730E741"><enum>(A)</enum><text>is a former member of the Armed Forces, including the reserve components;</text></subparagraph><subparagraph indent="up1" id="id4E5E565BD0D44E5BA691C3A4DA7DFCAE"><enum>(B)</enum><text>is not enrolled in the health care system established by section 1705 of this title; and</text></subparagraph><subparagraph indent="up1" id="idFF6DAA8BF944469BB0C16F31009D38A2"><enum>(C)</enum><text>while serving in the Armed Forces, was the victim of a physical assault of a sexual nature, a battery of a sexual nature, or sexual harassment (as defined in section 1720D(f) of this title).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1C64A0085FDD4E568789831E6EAEF3EF"><enum>(b)</enum><header>Counseling in Vet Centers</header><paragraph id="id80714CB0A88548B9AF8651BA38C2FA33"><enum>(1)</enum><header>In general</header><text>Section 1712A(a)(1)(C) of such title is amended—</text><subparagraph id="id9FACD99A9A4B4E85A3122CFC0959DDF1"><enum>(A)</enum><text>by striking <quote>individual who is a veteran or</quote> each place it appears;</text></subparagraph><subparagraph id="idF16B67E740704E31BF2A5ACD417C1228"><enum>(B)</enum><text>in clause (ii), by striking <quote>causalities</quote> and inserting <quote>casualties</quote>;</text></subparagraph><subparagraph id="id78553AA4F96F4DC397A3403FD8A1F174"><enum>(C)</enum><text>in clause (iii), by striking <quote>such veteran or member</quote> and inserting <quote>such member</quote>;</text></subparagraph><subparagraph id="id20B486C70065474CA8E37A4F590A0210"><enum>(D)</enum><text>in clause (vii)—</text><clause id="id123D2A7D93ED4FE29BDFD8A134BA1600"><enum>(i)</enum><text>in subclause (I), by striking <quote>; or</quote> and inserting a semicolon; and</text></clause><clause id="idA0F30CCF8FFF4AE7B306177A0BDE08DD"><enum>(ii)</enum><text>in subclause (II), by striking <quote>veteran or member of the Armed Forces</quote> and inserting</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id0F8D38B35C7C49DE8E61BCF1B04FCF21"><text>veteran; or</text><subclause id="id091589BAD4B74D239A6F86D9BC74CCE1" indent="up2"><enum>(III)</enum><text>member of the Armed Forces</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idC7CC62184B37474CB7B76959F008429C"><enum>(E)</enum><text>by redesignating clauses (i) through (vii) as clauses (ii) through (viii), respectively; and</text></subparagraph><subparagraph id="id5B821EFEA433424AA2AFF8EFF146553D"><enum>(F)</enum><text>by inserting before clause (ii), as redesignated by subparagraph (E), the following new clause (i):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF9578A8619CF44D98B0FDCEE48532B3C"><clause id="id6B76B0F0072B42E598DC617C3D08C10A" indent="up2"><enum>(i)</enum><text>Any veteran.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idCAA7FADFAE144C709043045E0BBA1C64"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="idC720F4EBC4DF44A192901F212327C1BD"><enum>(A)</enum><header>In general</header><text>Section 1712A of such title is amended—</text><clause id="id3CCDDCA80B25486AB64056A0461B0907"><enum>(i)</enum><text>in subsection (a)(1)—</text><subclause id="id99B5379CE8344631A037CDF643AFDD89"><enum>(I)</enum><text>by striking <quote>clauses (i) through (vi)</quote> each place it appears and inserting <quote>clauses (i) through (vii)</quote>;</text></subclause><subclause id="idCCC2738BE6084991963A26D61D7FE48B"><enum>(II)</enum><text>by striking <quote>clause (vii)</quote> each place it appears and inserting <quote>clause (viii)</quote>; and</text></subclause><subclause id="id4A3362320A8E411D8415A2C7B228E27F"><enum>(III)</enum><text>in subparagraph (B)(ii)(II), by striking <quote>veteran or member described in subclause (II)</quote> and inserting <quote>veteran or a member described in subclause (III)</quote>; and</text></subclause></clause><clause id="id522B3EEB92B74621A4180CF28677A92F"><enum>(ii)</enum><text>in subsection (g)(1), by striking <quote>described in subsection (a)(1)(C)</quote>.</text></clause></subparagraph><subparagraph id="id72043C9318AB40ACBC09D2B663AFF879"><enum>(B)</enum><header>Suicide prevention assistance</header><text>Section 201(q)(4)(C) of the Commander John Scott Hannon Veterans Mental Health Care Improvement Act of 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/116/171">Public Law 116–171</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1720F">38 U.S.C. 1720F</external-xref> note) is amended by striking <quote>clauses (i) through (iv)</quote> and inserting <quote>clauses (ii) through (v)</quote>. </text></subparagraph></paragraph></subsection></section><section id="ide99195155e3e439b9fd59a10c65d2712"><enum>4.</enum><header>Outreach to and study on treatment of members of the Armed Forces discharged under conditions other than honorable for no other reason than sexual orientation or gender identity</header><subsection id="idB0ED1F7996C14C5EB813B1624669B774"><enum>(a)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall conduct outreach to former members of the Armed Forces who were discharged from the Armed Forces under other than honorable conditions for no other reason than the sexual orientation or gender identity of the member pursuant to the Don't Ask, Don't Tell policy of the Department of Defense.</text></subsection><subsection id="id421360f071464ddaae3872ed519147db"><enum>(b)</enum><header>Study</header><text>The Secretary shall conduct a study to assess the scope and cost of providing health care under the laws administered by the Secretary to former members of the Armed Forces with other than honorable discharges who were discharged from the Armed Forces after serving on active duty in the Armed Forces for less than two years for no other reason than the sexual orientation or gender identity of the member, whether pursuant to the Don't Ask, Don't Tell policy of the Department or not. </text></subsection></section></legis-body></bill>
