<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2780</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210921">September 21, 2021</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself, <cosponsor name-id="S412">Mr. Tuberville</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, and <cosponsor name-id="S355">Mr. Cruz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to prohibit certain adverse personnel actions taken against members of the Armed Forces based on declining the COVID–19 vaccine.</official-title></form><legis-body><section id="id8536F01410764C86891C85D41788F0AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Vaccine Dishonorable Discharge Prevention Act</short-title></quote>.</text></section><section id="idbbe39acb9cae43c49a08197ae9cc97a8"><enum>2.</enum><header>Prohibition on adverse personnel actions taken against members of the Armed Forces based on declining COVID–19 vaccine</header><subsection id="idffaa54861e8049a19988f0171fce9709"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="id8b4e72b6d56e4fbab37b29f286c0fbc0"><enum>(1)</enum><text>The Secretary of Defense has announced a COVID–19 vaccine mandate will take effect for the Department of Defense. </text></paragraph><paragraph id="id7dbb060d6dda45b7a17f6ae0fd7e61f1"><enum>(2)</enum><text>Reports of adverse actions being taken, or threatened, by military leadership at all levels are antithetical to our fundamental American values. </text></paragraph><paragraph id="idf4001ef8025e42a98c1a1fdb659391b8"><enum>(3)</enum><text>Any discharge other than honorable denotes a dereliction of duty or a failure to serve the United States and its people to the best of the ability of an individual. </text></paragraph></subsection><subsection id="id22773eafe4254e6397a86fd31bade3a6"><enum>(b)</enum><header>Prohibition</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">Chapter 55</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1107a">section 1107a</external-xref> the following new section: </text><quoted-block style="USC" display-inline="no-display-inline" id="id49375C2756C14D36B11ABA143A6515E0"><section id="id7a041ab09bf84cc390d44661fc63508e"><enum>1107b.</enum><header>Prohibition on certain adverse personnel actions related to COVID–19 vaccine requirement</header><subsection id="id64c04537e3a140c795719bf7fdd67d2b"><enum/><text>Notwithstanding any other provision of law, a member of the armed forces subject to discharge on the basis of the member choosing not to receive the COVID–19 vaccine may only receive an honorable discharge.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idd009c37e2a9a432e8a7a0b7247a08679"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1107a the following new item: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idBEF4C3DB6F174FF28A7B55DFC3BC37D8"><toc><toc-entry level="section" bold="off">1107b.
