<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 2776</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210921">September 21, 2021</action-date><action-desc><sponsor name-id="S366">Ms. Warren</sponsor> (for herself, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, and <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that the Secretary of Health and Human Services has authority to implement a residential eviction moratorium under the quarantine authority vested by the Public Health Service Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H32DB8B5E700349DCAF3379FAA7189F67"><section section-type="section-one" id="HB094F082315D4BC8B207C073C5FE7ED5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Renters Safe Act</short-title></quote>.</text></section><section id="H7DB8FC4AB0104B199B9BC02FCAA5FCA7"><enum>2.</enum><header>Clarification HHS has authority for residential eviction moratoria</header><text display-inline="no-display-inline">Section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>) is amended—</text><paragraph id="HD5D99E35C8ED4D49A54E6B798152653D"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="H850AB5C134224E04A202990E40EFD35C"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1237061779814615953BCBDA819E7054"><subsection id="H9A929872C2CE410DA1016D5B5AC3980E"><enum>(e)</enum><text display-inline="yes-display-inline">Consistent with the standard described in subsection (a), regulations under this section may implement, maintain, or extend a residential eviction moratorium.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HFD5977EF35B74B21ABF97D282BF08E88"><enum>3.</enum><header>COVID–19 eviction moratorium</header><subsection id="HC8DE974A7E3743D2A98F197E6483884A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall implement a national residential eviction moratorium under section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>) to reduce the introduction, transmission, and spread of COVID–19 and otherwise address the public health emergency declared under section 319 of the such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) with respect to COVID–19.</text></subsection><subsection id="H2E02B5AB8EFF458DB2756E0A38B77981"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The moratorium under subsection (a) shall—</text><paragraph id="H77B1CFD151914B558068C39AEF90C81D"><enum>(1)</enum><text>be automatic, without requiring individuals to apply for coverage; and</text></paragraph><paragraph id="H7973666E4A9E4766B89CBC7D11C95C30"><enum>(2)</enum><text display-inline="yes-display-inline">apply to all residential eviction filings, hearings, judgments, and execution of judgments, except that the Secretary of Health and Human Services may establish moratorium exceptions necessary to protect the health and safety of others.</text></paragraph></subsection><subsection id="H242D2584A3BA45B4821CAAC285D06075"><enum>(c)</enum><header>Period following public health emergency</header><text>The moratorium under subsection (a) shall remain in effect at least 60 days after the conclusion of the public health emergency described in such subsection, including any extensions thereof.</text></subsection></section></legis-body></bill>
