which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 35, United States Code, to address patent ownership, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pride in Patent Ownership Act</short-title></quote>.</text></section><section id="id4F5F21794244435FAE561A12294E14D6"><enum>2.</enum><header>Patents</header><subsection id="id951F599991994860AC698B4DEE7C30EE"><enum>(a)</enum><header>Amendments to title 35</header><paragraph id="id37EF5EF31CAF40B78C76DF4D54919931"><enum>(1)</enum><header>In general</header><text>Title 35, United States Code, is amended—</text><subparagraph id="id43D4C57CA7DA43ADACB56BFB1306153D"><enum>(A)</enum><text>in chapter 11, by adding at the end the following:</text><quoted-block id="idE8198C9613E54FBBAF53619BA12F4244" style="USC" act-name=""><section id="idCC150B29829C44FC957378A57F6BDF33" section-type="subsequent-section"><enum>124.</enum><header>Government funding of patent applications and maintenance fees</header><subsection id="id90E653E6F0D046E8950A18390069DD76"><enum>(a)</enum><header>Government funding of patent applications</header><text>For any application for patent, if any governmental entity, including a foreign governmental entity, provides funding specifically for the purpose of paying fees to the Office under section 41, or specifically for the purpose of paying an attorney or patent agent for prosecution of the application, the application shall include, or be amended to include, a statement describing the amount and source of the funding provided by the entity.</text></subsection><subsection id="idC8E854A0811743198358F055C142B135"><enum>(b)</enum><header>Government funding of maintenance fees</header><text>For any patent, if any governmental entity, including a foreign governmental entity, provides funding specifically for the purpose of paying maintenance fees to the Office under section 41, or specifically for the purpose of paying an attorney or patent agent for submitting those maintenance fees, the patentee shall file a separate statement describing the amount and source of the funding provided by the entity.</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id7635AE53D5B24F9897FF9CDA1A71BD78"><enum>(B)</enum><text>in section 261—</text><clause id="id05E86D4442B04A1F8E932F4658711C30"><enum>(i)</enum><text>by striking the first undesignated paragraph and inserting the following:</text><quoted-block style="OLC" id="id0DEC2A6CE07744FAB7CC90865872FAD9" act-name=""><subsection id="id0CD302C3EE94431FBCCD416AAD677E1D"><enum>(a)</enum><header>In general</header><paragraph id="idAC4D78BA246A4B0FABB003574D3ADB09"><enum>(1)</enum><header>Attributes of personal property</header><text>Subject to the provisions of this title, patents shall have the attributes of personal property.</text></paragraph><paragraph id="id57B4FDEA0DAA49A0932CA5AC1A81BAAF"><enum>(2)</enum><header>Register of interests</header><subparagraph id="id6A8E7600EC7E46CDA490F50FA4D3D19E"><enum>(A)</enum><header>In general</header><text>The Patent and Trademark Office shall maintain a register of interests in patents and applications for patents and shall record any document related thereto upon request, and may require a fee therefor.</text></subparagraph><subparagraph id="idBA651BF3D3ED4D92B5E1113580785FF1"><enum>(B)</enum><header>Public availability</header><text>The Office shall make the information described in subparagraph (A) publicly accessible, to the extent permitted by law.</text></subparagraph></paragraph><paragraph id="id51EA965584814B82AAD49E6C75E95D47"><enum>(3)</enum><header>Requirement to record certain assignments and other interests</header><subparagraph id="id720659E7AA0248DB9C46E07BE85CD3FF"><enum>(A)</enum><header>In general</header><text>Whenever a patent issues, or certain rights or interests in a patent (as defined by the Director) are assigned, granted, or conveyed to any person, including a governmental or legal entity, including a parent corporation—</text><clause id="idC6AB829C754D4C88BEEDF7885880DBB8"><enum>(i)</enum><text>the patentee shall, not later than 90 days after the effective date of the issuance, assignment, grant, or conveyance, as applicable, submit, or cause to be submitted, a request described in paragraph (2), unless such a request was submitted before the issuance of the patent; and</text></clause><clause id="idA5ACB51A1FFC4B2B8882DED4E54BC4B3"><enum>(ii)</enum><text>the Office shall, not later than 60 days after the date on which the Office receives a request submitted under clause (i)—</text><subclause id="idBA1A989AF66246F4970AFA334A41E6FA"><enum>(I)</enum><text>notify the patentee regarding any error in the request; or</text></subclause><subclause id="idC5BFF7C3B4374C9E896105412B62E6E6"><enum>(II)</enum><text>record the interest in the register described in paragraph (2).</text></subclause></clause></subparagraph><subparagraph id="id00A6B83DD91C4D1488DDD74E2FF2AD35"><enum>(B)</enum><header>Effect of failure to comply</header><text>If a patentee fails to comply with subparagraph (A)(i), no party may recover, for infringement of the applicable patent in any action, increased monetary damages under section 284 during the period beginning on the date that is 91 days after the effective date of the issuance, assignment, grant, or conveyance with respect to the patent, as applicable, and ending on the date on which that issuance, assignment, grant, or conveyance is properly requested to be recorded under paragraph (2).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id91F2444A7DF3454C948B26C021800965"><enum>(ii)</enum><text>in the first undesignated paragraph following subsection (a), as so designated by clause (i) of this subparagraph, by striking <quote>Applications</quote> and inserting the following:</text><quoted-block style="OLC" id="id8077FA4E76C24C5AA0F145F69BA5CFCA" act-name=""><subsection id="id700BC2937A4944F389307851697359A1"><enum>(b)</enum><header>Applications and patents assignable</header><text>Applications</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idCFC06F7CFD654D23B0CE7C3D04204553"><enum>(iii)</enum><text>in the first undesignated paragraph following subsection (b), as so designated by clause (ii) of this subparagraph, by striking <quote>A certificate</quote> and inserting the following:</text><quoted-block style="OLC" id="id4221050A93804BBB95D19350602A9F08" act-name=""><subsection id="id69A53AC8AC4447D18A75073125C68E9D"><enum>(c)</enum><header>Certificate of acknowledgment</header><text>A certificate</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idFDA1BA6763DD4FF9BF46D5B847491649"><enum>(iv)</enum><text>in the undesignated paragraph following subsection (c), as so designated by clause (iii) of this subparagraph, by striking <quote>An interest</quote> and inserting the following:</text><quoted-block style="OLC" id="id026DD658702F4C6BA8F7A7E5E8B32392" act-name=""><subsection id="id3AFA928599ED47B98A096E4654E65C34"><enum>(d)</enum><header>Effect of assignment</header><text>An interest</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idA3BD18F3902248CFB5875068EF73DF13"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/11">chapter 11</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4114C4C866B04763927916032DFC8470"><toc><toc-entry level="section" bold="off">124. Government funding of patent applications and maintenance fees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id15F916C269E14343962D3C86394AEC3C"><enum>(3)</enum><header>Effective dates; applicability</header><subparagraph id="idF2DE37082FAC4CFF9F4A548DBAAEB7CA"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the amendments made by this subsection shall take effect on the date that is 1 year after the date of enactment of this Act.</text></subparagraph><subparagraph id="id370703D0E836404AA1E4C5D67CE2F303"><enum>(B)</enum><header>Amendments regarding ownership and assignment</header><clause id="id671CF7B19DD541968A4A68F234D4BF4D"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the amendments made by paragraph (1)(B) shall take effect on the date of enactment of this Act.</text></clause><clause id="idB7585A0BDB26417F9F74A682547CBD0A"><enum>(ii)</enum><header>Requirement to record assignments and certain other interests</header><text>Paragraph (3) of subsection (a) of section 261 of title 35, United States Code, as so designated by paragraph (1)(B)(i) of this subsection, shall—</text><subclause id="id8164B8327EE748BFA1839394E5094078"><enum>(I)</enum><text>take effect on the effective date described in subparagraph (A); and</text></subclause><subclause id="id1AB76071071D4BE7BED7246E09C34D24"><enum>(II)</enum><text>apply with respect to any patent issuance, assignment, grant, or conveyance that occurs on or after the effective date described in subclause (I). </text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id7D9EB2FFAD8347B0BC2A151B2B9D366B"><enum>(b)</enum><header>Rules</header><text>Not later than 1 year after the date of enactment of this Act, the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office (referred to in this section as the <quote>Director</quote>) shall issue rules that accomplish the following:</text><paragraph id="id9D4D0687A740465A8E2F73824D4B4C39"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id462D4493402C45F9930F46B4D8ABC539"><enum>(A)</enum><text>Define the term <term>certain rights or interests in a patent</term> for the purposes of subsection (a)(3) of section 261 of title 35, United States Code, as so designated by subsection (a)(1) of this section.</text></subparagraph><subparagraph indent="up1" id="id8D4D083E50704A49A2459CA6F29C71BE"><enum>(B)</enum><text>For the purposes of subparagraph (A), the Director may review rules defining the term <term>beneficial owner</term> issued by other Federal entities and agencies, including the Committee on Foreign Investment in the United States, the Department of the Treasury, and the Securities and Exchange Commission.</text></subparagraph></paragraph><paragraph id="idEA061B8DF1CB45DB80EEB903A5F323D0"><enum>(2)</enum><text>Establish procedures for the proper recording of interests in patents that— </text><subparagraph id="idB8FA332BA21A4EF39DF4884BDFA79FD2"><enum>(A)</enum><text>provide for— </text><clause id="idCB137402CF1347C3AC7EA01865F8E49A"><enum>(i)</enum><text>notice of any error in a request submitted under subsection (a)(2) of section 261 of title 35, United States Code, as so designated by subsection (a)(1) of this section; and </text></clause><clause id="idA0515028E22340028B4C713C6E3EC25E"><enum>(ii)</enum><text>an opportunity to correct an error described in clause (i) not later than 60 days after the date on which the Director notifies the submitting party regarding the error; and</text></clause></subparagraph><subparagraph id="id970B7F21BE2E44B9A7D2180F1BB2CF04"><enum>(B)</enum><text>describe— </text><clause id="idBD2793C56269429AB7DCDBCA875BA0C2"><enum>(i)</enum><text>which types of errors described in subparagraph (A)(i) are eligible for correction without having to change the date of submission of the original request; and</text></clause><clause id="id1FD8981FAB0645C99F2779ADCF5B2F3B"><enum>(ii)</enum><text>which types of errors described in subparagraph (A)(i) must result in a new request with a new submission date.</text></clause></subparagraph></paragraph><paragraph id="id1D62D6EDA3D6421EBC59B7807CF846E8"><enum>(3)</enum><text>Implement section 124 of title 35, United States Code, as added by subsection (a)(1) of this section, including by imposing a penalty for a failure to disclose funding provided by a governmental entity, as required under such section 124.</text></paragraph><paragraph id="idF662DA772ACA497AB92043E40C5AFB15"><enum>(4)</enum><text>Otherwise implement the amendments made by subsection (a)(1).</text></paragraph></subsection><subsection id="id63FFACDECE2D47789627693CE6B7AA06"><enum>(c)</enum><header>Register</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall, with respect to the register described in subsection (a)(2) of section 261 of title 35, United States Code, as so designated by subsection (a)(1) of this section, create a publicly accessible database that is digitally searchable with fields based on patent number, assignee, assignor, assignment date, and other criteria determined by the Director.</text></subsection></section></legis-body></bill>
