which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Religious Freedom Restoration Act of 1993 to protect civil rights and otherwise prevent meaningful harm to third parties, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE3596BE961334FC58E6D2E546029479A"><section section-type="section-one" id="HC10E18D69B594EF4B8C626C27C884890"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Do No Harm Act</short-title></quote>.</text></section><section id="H3BF5B86E2E7A4132B5123ACA6B917D33"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H906F683D3E6A42BDB93A03CC2EB33566"><enum>(1)</enum><text>the Religious Freedom Restoration Act of 1993 should not be interpreted to authorize an exemption from generally applicable law if the exemption would impose the religious views, habits, or practices of one party upon another; </text></paragraph><paragraph id="H7607CCF90E9249789619E15814499C92"><enum>(2)</enum><text>the Religious Freedom Restoration Act of 1993 should not be interpreted to authorize an exemption from generally applicable law if the exemption would impose meaningful harm, including dignitary harm, on a third party; and </text></paragraph><paragraph id="HDC1CC2C1CB23447F9F779994875AAEDC" commented="no"><enum>(3)</enum><text>the Religious Freedom Restoration Act of 1993 should not be interpreted to authorize an exemption for one party from generally applicable law if the exemption would permit discrimination against others, including persons who do not belong to the religion or adhere to the beliefs of that party.</text></paragraph></section><section id="H60713917C6CD4862AC334DE5294F5276"><enum>3.</enum><header>Exception from application of Act where Federal law prevents harm to others</header><text display-inline="no-display-inline">Section 3 of the Religious Freedom Restoration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000bb-1">42 U.S.C. 2000bb–1</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF6FED7CC457B47CDAB6072E2A9AFAFA4"><subsection id="H2C9491BE9BDD499D82838B10D3ADB3AD"><enum>(d)</enum><header>Additional exception from application of Act where Federal law prevents harm to others</header><text display-inline="yes-display-inline">Subsection (a) shall not apply—</text><paragraph id="H2550F32DC559419DAE583D361DCFD83E"><enum>(1)</enum><text display-inline="yes-display-inline">to any provision of law or its implementation that provides for or requires—</text><subparagraph commented="no" id="HBFAD906C68274CF28F406F13FC61FB49"><enum>(A)</enum><text display-inline="yes-display-inline">a protection against discrimination or the promotion of equal opportunity, including the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000a">42 U.S.C. 2000a et seq.</external-xref>), the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>), the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2601">29 U.S.C. 2601 et seq.</external-xref>), Executive Order 11246 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e</external-xref> note; relating to equal opportunity in Federal employment), the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925 et seq.</external-xref>), the final rule, including any amendment made by such rule, of the Department of Housing and Urban Development entitled <quote>Equal Access to Housing in HUD Programs Regardless of Sexual Orientation or Gender Identity</quote> (77 Fed. Reg. 5662 (February 3, 2012)) (or any corresponding similar regulation or ruling), or section 5.106 of title 24, Code of Federal Regulations (or any corresponding similar regulation or ruling);</text></subparagraph><subparagraph id="HFACB7580E9AC41038F93F61D60B86E9F"><enum>(B)</enum><text display-inline="yes-display-inline">an employer to provide a wage, other compensation, or a benefit including leave, or a standard protecting collective activity in the workplace;</text></subparagraph><subparagraph id="HF997B3C3CDF24A4B994F5DC4CBCCC6FE"><enum>(C)</enum><text display-inline="yes-display-inline">protection against child labor, child abuse, or child exploitation; or</text></subparagraph><subparagraph id="H561215BDE4F44A4F9F751BDDB924004D"><enum>(D)</enum><text display-inline="yes-display-inline">access to, information about, a referral for, provision of, or coverage for, any health care item or service;</text></subparagraph></paragraph><paragraph id="H175FF47FC1234BDE8906FD51476761E3" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">to any term of a government contract, grant, cooperative agreement, or other instrument for an award, that requires a good, service, function, or activity to be performed for or provided to a beneficiary of or participant in a program or activity funded by such a government contract, grant, cooperative agreement, or other instrument for an award; or</text></paragraph><paragraph id="H6B50B48B17F846C699D5360C5097A85D"><enum>(3)</enum><text>to the extent that application would result in denying a person the full and equal enjoyment of a good, service, benefit, facility, privilege, advantage, or accommodation provided by the government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H4CAD68E30A26402E96E5F067599AF0C1"><enum>4.</enum><header>Clarification of preclusion of litigation between private parties</header><subsection commented="no" display-inline="no-display-inline" id="H45C2A7F009C84DF98D334A14AEB3B86F"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the amendment made by subsection (b) is to clarify the applicability of the Religious Freedom Restoration Act of 1993, as enacted.</text></subsection><subsection id="H18C9F854F035442FA06E4E4787410DCC"><enum>(b)</enum><header>Preclusion</header><text>Section 3(c) of the Religious Freedom Restoration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000bb-1">42 U.S.C. 2000bb–1(c)</external-xref>) is amended, in the first sentence, by striking <quote>judicial proceeding</quote> and all that follows and inserting <quote>judicial proceeding to which the government is a party and obtain appropriate relief against that government.</quote>.</text></subsection></section></legis-body></bill>
