following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to allow States to provide coverage under the Medicaid program for vaccines and treatment for COVID–19 for uninsured individuals without the imposition of cost sharing requirements, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD5E0B06691C947D1A5AE0EB71642B177"><section section-type="section-one" id="HDFD27BF1010543818304F99A205EF87A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stronger Medicaid Response to the COVID–19 Pandemic Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H9D016A8577764302B5ED3F5C32945DA9"><enum>2.</enum><header>Optional coverage at no cost sharing of COVID–19 treatment and vaccines under Medicaid for uninsured individuals</header><subsection id="H54BA53AD6FD34BF0BE622B2F6D6B2F02"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a)(10) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)</external-xref> is amended, in the matter following subparagraph (G), by striking <quote>and any visit described in section 1916(a)(2)(G)</quote> and inserting the following: <quote>, any COVID–19 vaccine that is administered during any such portion (and the administration of such vaccine), any item or service, including drugs approved or authorized under section 505 or 564 of the Federal Food, Drug, and Cosmetic Act, that is furnished during any such portion for the treatment or prevention of COVID–19 (which shall include, in the case of an individual who is diagnosed with or presumed to have COVID–19, during the period such individual is infected (or presumed infected) with COVID–19, the treatment or prevention of a condition that may complicate the treatment of COVID–19) or the treatment or prevention of a COVID–19-related condition that follows a COVID–19 infection, and any services described in section 1916(a)(2)(G)</quote>.</text></subsection><subsection commented="no" id="H3451C1B44007466CBA938FAEA1FBF30D"><enum>(b)</enum><header>Definition of uninsured individual</header><paragraph id="HACC95809D1F841A7BC70AED26E8C5D62"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (ss) of section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC751496A0ADC4A97B982D9BF1052905C"><subsection id="H9EE2903E8BCA4323A32426219F8051FD"><enum>(ss)</enum><header>Uninsured individual defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>uninsured individual</term> means, notwithstanding any other provision of this title, any individual who is not covered by minimum essential coverage (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/5000A">section 5000A(f)(1)</external-xref> of the Internal Revenue Code of 1986).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HB673713EF22E4DF892503FA74DC5437A"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect and apply as if included in the enactment of the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>).</text></paragraph></subsection><subsection id="idefb222cc8fb04345a79f38b43ae389b8"><enum>(c)</enum><header>Clarification regarding emergency services for certain individuals</header><text>For purposes of applying section 1903(v)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)(2)(A)</external-xref>), the care and services described in such section shall include the following:</text><paragraph id="id2F8440304032441988CD8AE7A2B873AB"><enum>(1)</enum><text display-inline="yes-display-inline">In vitro diagnostic products (as defined in section 809.3(a) of title 21, Code of Federal Regulations), and the administration of such products.</text></paragraph><paragraph id="idFB1B122272F5407C96D9AB18FF468EBB"><enum>(2)</enum><text>A COVID–19 vaccine (and the administration of such vaccine).</text></paragraph><paragraph id="idE1FFCF0C95D2420790E05B487156F79A"><enum>(3)</enum><text>Any item or service that is furnished for the treatment or prevention of COVID–19 or a condition that may complicate the treatment of COVID–19, the treatment or prevention of a COVID–19-related condition that follows a COVID–19 infection, and any service described in section 1916(a)(2)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o(a)(2)(G)</external-xref>).</text></paragraph></subsection><subsection id="ida59802f4b960442892740c8eb604f917"><enum>(d)</enum><header>Emergency Medicaid for individuals with suspected COVID–19 infections</header><text>For purposes of applying section 1903(v)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)(3)</external-xref>), the term <term>emergency medical condition</term> (as defined in such section) shall include, with respect to an individual, any concern that the individual may have contracted COVID–19.</text></subsection><subsection id="id62c11cb3477a429ab36bfa246f03cd09"><enum>(e)</enum><header>Treatment of assistance and services provided</header><text>Beginning on the date of enactment of this Act—</text><paragraph id="id3B02DEB77B3A44C5BE37CB2AA1634FD8"><enum>(1)</enum><text>the value of assistance or services provided to any person under a program with respect to which a coronavirus response law establishes or expands eligibility or benefits shall not be considered income or resources; and</text></paragraph><paragraph id="id64941AD58323457CAB59AF197EA0FD24"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id480CAFDBD6844BD99853097CD4E4B3E7"><enum>(A)</enum><text>any medical coverage or services provided to an individual under subsection (v) of section 1903 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>) shall be considered treatment for an emergency medical condition (as defined in subsection (v)(3) of such section) for any purpose under any Federal, State, or local law, including law relating to taxation, welfare, and public assistance programs; and</text></subparagraph><subparagraph id="id451BF66D8082483CA9A93DE8218CA6FF" indent="up1"><enum>(B)</enum><text>a participating State or political subdivision of a State shall not decrease any assistance otherwise provided to an individual because of the receipt of benefits under the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/301">42 U.S.C. 301</external-xref> et seq.).</text></subparagraph></paragraph></subsection><subsection id="id84AF77458FBA4F20B3186AED2AD77CD2"><enum>(f)</enum><header>Other definitions</header><text>In this section:</text><paragraph id="idd18a468ed6064cdab485f687219036f3"><enum>(1)</enum><header>Coronavirus public health emergency</header><text>The term <term>coronavirus public health emergency</term> means—</text><subparagraph id="idea10f3a9fdb24bbea1db5187b8834564"><enum>(A)</enum><text>an emergency involving Federal primary responsibility determined to exist by the President under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>) with respect to COVID–19 or any other coronavirus with pandemic potential;</text></subparagraph><subparagraph id="id78c52118e0bd4951a93568729a2d919c"><enum>(B)</enum><text>an emergency declared by a Federal official with respect to coronavirus (as defined in section 506 of the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>));</text></subparagraph><subparagraph id="id92eb9766f6564f99ba40fe1409752675"><enum>(C)</enum><text>a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to COVID–19 or any other coronavirus with pandemic potential; and</text></subparagraph><subparagraph id="id68dccbdd2e6b47eb8adb7c73cb7dd71d"><enum>(D)</enum><text>a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247">42 U.S.C. 247(d)</external-xref>) with respect to COVID–19 or any other coronavirus with pandemic potential.</text></subparagraph></paragraph><paragraph id="id436079aa57534c318f70803a29fcf0c4"><enum>(2)</enum><header>Coronavirus response law</header><text>The term <term>coronavirus response law</term> means—</text><subparagraph id="ida5b95cc321124bee9d12dc054f730fb3"><enum>(A)</enum><text>the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>);</text></subparagraph><subparagraph id="idbdbc66c80e2f4706bf9c2a1a2c458023"><enum>(B)</enum><text>the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>); </text></subparagraph><subparagraph id="id6394E3B3374E4335964E1147A6892E6E"><enum>(C)</enum><text>the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>); </text></subparagraph><subparagraph id="idB448CE585EE94FE1B7EC11039C095D66" commented="no"><enum>(D)</enum><text>the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef1ac095cf9d4a168bab5240f58a8dbc"><enum>(E)</enum><text>the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21474AFD5C7D4763B9380A363800AE10"><enum>(F)</enum><text>any other law that appropriates or otherwise makes available funds, establishes, amends, or expands a program, or authorizes activities or assistance for a purpose that is expressly related to responding to, or mitigating the effects of, a coronavirus public health emergency. </text></subparagraph></paragraph></subsection><subsection id="idBE8E9CC88F4943DB8273D497ECA2EBFD"><enum>(g)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit—</text><paragraph id="id7E937917F954445D9A008000E94960A9"><enum>(1)</enum><text>the types of care and services that are necessary for the treatment of an emergency condition for purposes of section 1903(v) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8C3431C4181434FBF10EDB54B933F54"><enum>(2)</enum><text>the types of medical conditions that are <term>emergency medical conditions</term> for purposes of such section.</text></paragraph></subsection></section></legis-body></bill>
