which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To impose sanctions and other measures with respect to the Taliban, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing the Recognition of Terrorist States Act of 2021</short-title></quote>.</text></section><section id="id7736cba2c1e34bdcb3cfcc2324045035" commented="no"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="id107c6b1bf663456d8975ed5362262222" commented="no"><enum>(1)</enum><text>to continue to recognize the democratically elected government of the Islamic Republic of Afghanistan as the legitimate Government of Afghanistan;</text></paragraph><paragraph commented="no" id="id0D1F33A84F4C4E639DEA2E03671433F5"><enum>(2)</enum><text>to not recognize the Islamic Emirate of Afghanistan, which is controlled by the Taliban, as the official Government of Afghanistan under any circumstances;</text></paragraph><paragraph id="id4357843e6bb74f3d8041e0612bd9912b" commented="no"><enum>(3)</enum><text>to view the Taliban’s takeover of Afghanistan as a coup d’état and therefore illegitimate;</text></paragraph><paragraph id="id9e98a459717e4e5898c5a9209bf43dd9" commented="no"><enum>(4)</enum><text>to recognize that individuals designated as terrorists by the United States, such as Sirajuddin Haqqani, will play a key role in the Taliban regime; and</text></paragraph><paragraph id="id9f9aeb280de74739995f1fc089e664a0" commented="no"><enum>(5)</enum><text>to continue to assist the people of Afghanistan, especially people at risk as a result of their activities, beliefs, religion, or political views.</text></paragraph></section><section id="id03f9c64ae7fe4a978aa4385edf5ef60a" commented="no"><enum>3.</enum><header>Prohibition on actions recognizing the Islamic Emirate of Afghanistan</header><subsection id="idb1d2b552c372468e874890b8770b762e" commented="no"><enum>(a)</enum><header>In general</header><text>In furtherance of the policy set forth in section 2, no Federal department or agency may take any action or extend any assistance that states or implies recognition of the Taliban’s claim of sovereignty over Afghanistan.</text></subsection><subsection id="id84c522d37fcf484abfa7a5d279baeb0f" commented="no"><enum>(b)</enum><header>Funding limitation</header><text>Notwithstanding any other provision of law, no Federal funds appropriated or otherwise made available for the Department of State, the United States Agency for International Development, or the Department of Defense on or after the date of the enactment of this Act may be obligated or expended to prepare or promulgate any policy, guidance, regulation, notice, or Executive order, or to otherwise implement, administer, or enforce any policy, that extends diplomatic recognition to the Islamic Emirate of Afghanistan.</text></subsection></section><section id="idd1de5adc6d924b29a564d84dbf77a34d"><enum>4.</enum><header>Designation of Islamic Emirate of Afghanistan as a state sponsor of terrorism</header><subsection id="id2100730A6FB94706A08E19531DB6B021"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State shall designate the Islamic Emirate of Afghanistan as a state sponsor of terrorism.</text></subsection><subsection id="id3056C9F3C2954531B516A64E4283664A"><enum>(b)</enum><header>State sponsor of terrorism defined</header><text>In this section, the term <term>state sponsor of terrorism</term> means a country the government of which the Secretary of State has determined has repeatedly provided support for acts of international terrorism, for purposes of—</text><paragraph id="id5f50ebbabf00458d9a2a1fcade39725f"><enum>(1)</enum><text>section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)(i)</external-xref>);</text></paragraph><paragraph id="idacc8dc561bea472a9c0ccebe6cb590d8"><enum>(2)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></paragraph><paragraph id="ide8ebb37aacec4d78b49282d5171e37ce"><enum>(3)</enum><text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>); or</text></paragraph><paragraph id="id5010181d6c604491a3e8de8f8a3712ba" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>any other provision of law. </text></paragraph></subsection></section><section id="id12767B891D2744AC97C67CD53CFA87EB"><enum>5.</enum><header>Designation of the Taliban as a foreign terrorist organization</header><text display-inline="no-display-inline">The Secretary of State shall designate the Taliban as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></section><section id="id867f72374da742fb9659e755d023b2a9"><enum>6.</enum><header>Determinations with respect to narcotics trafficking and money laundering by the Taliban</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of State shall submit to Congress a report that includes—</text><paragraph id="id14F273FE62C941E5A87F8E56E2904A76"><enum>(1)</enum><text display-inline="yes-display-inline">a determination of whether the Taliban should be designated as—</text><subparagraph id="id15712AEC49A4457C8B7956F09E009974"><enum>(A)</enum><text display-inline="yes-display-inline">a significant foreign narcotics trafficker (as defined in section 808 of the Foreign Narcotics Kingpin Designation Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1907">21 U.S.C. 1907</external-xref>)); or </text></subparagraph><subparagraph id="id659B6B0B1FEC4278AF8EF746FD86257F"><enum>(B)</enum><text display-inline="yes-display-inline">a significant transnational criminal organization under Executive Order 13581 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of transnational criminal organizations); and</text></subparagraph></paragraph><paragraph id="id739E1F39AAF840FF9EEF49671A31FF7F"><enum>(2)</enum><text>a determination of whether Afghanistan, while under the control of the Taliban, should be designated as a high-risk jurisdiction subject to a call for action (commonly referred to as the <quote>black list</quote>) under the criteria established for such designation by the Financial Action Task Force.</text></paragraph></section><section id="id82A8765D6DFE4538844EB205E2FCC483"><enum>7.</enum><header>Assessment of whether rare earth metals exported from Afghanistan violate prohibition on importation of goods made with forced labor</header><text display-inline="no-display-inline">The Commissioner of U.S. Customs and Border Protection shall—</text><paragraph id="id067F5194057147F8AF97B02A1BE5163F"><enum>(1)</enum><text display-inline="yes-display-inline">assess whether the importation of rare earth metals extracted in Afghanistan and goods produced from such metals violates the prohibition on importation of goods made with forced labor under section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); and</text></paragraph><paragraph id="id3BCB2DA8BABB4B40B48871373F632780"><enum>(2)</enum><text>consider issuing a withhold release order with respect to such metals and goods to prevent such metals and goods from entering the United States.</text></paragraph></section><section id="idF7A9EAA79A64469BB29C52CF9B332AD5"><enum>8.</enum><header>Report on diplomatic relations of the Taliban and supporters of the Taliban</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State shall submit to Congress a report that—</text><paragraph id="id09CA66F6D35A4E1CA1209785BA2F48AA"><enum>(1)</enum><text display-inline="yes-display-inline">describes the Taliban’s relations with Iran, the Russian Federation, Pakistan, Saudi Arabia, the United Arab Emirates, Tajikistan, Uzbekistan, and the People’s Republic of China;</text></paragraph><paragraph id="id3e8c6194f65749dd8290d837994a4abb"><enum>(2)</enum><text>identifies each foreign person that knowingly assists, provides significant support or services to, or is involved in a significant transaction with, a senior member of the Taliban or a supporter of the Taliban; and</text></paragraph><paragraph id="id9DDE99A3B5BD46868B969CE528640F7B"><enum>(3)</enum><text>assesses—</text><subparagraph id="id408CCC9C6C6742628BDD1F968B946ACD"><enum>(A)</enum><text>the likelihood that the countries referred to in paragraph (1) will seek to invest in Afghanistan’s key natural resources; and </text></subparagraph><subparagraph id="id6C966E12A95C4489A96030377B4DC114"><enum>(B)</enum><text>the impact of such investments on the national security of the United States.</text></subparagraph></paragraph></section><section id="id032CE89D114249A8A646E275A6A450D4"><enum>9.</enum><header>Report on safe harbor provided to terrorist organizations by Pakistan</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State shall submit to Congress and make available to the public a report that describes the actions taken by the Government of Pakistan to provide safe harbor to organizations—</text><paragraph id="ida2ae8e1098184f28b98cf0e19f4e919d"><enum>(1)</enum><text>designated by the Secretary of State as foreign terrorist organizations under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); and</text></paragraph><paragraph id="id4d3c7023064d46819f9948810f779e9f"><enum>(2)</enum><text>designated as a specially designated global terrorist organizations under Executive Order 13224 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism).</text></paragraph></section><section id="id74df88414105489caa980bbbb6134763"><enum>10.</enum><header>Imposition of sanctions with respect to supporters of the Taliban</header><subsection id="idbb9153da9e0d459a9247c47da23896a5"><enum>(a)</enum><header>In general</header><text>The President shall impose 2 or more of the sanctions described in subsection (b) with respect to each foreign person identified under paragraph (2) of section 8 in the most recent report submitted under that section.</text></subsection><subsection id="id048B90CB55934041A59BBCEBD402598E"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions that may be imposed with respect to a foreign person under subsection (a) are the following:</text><paragraph id="id8afa91992b0b4ed1a8f6b2f4b7ddc2db"><enum>(1)</enum><header>Export-import bank assistance for exports to sanctioned persons</header><text>The President may direct the Export-Import Bank of the United States not to give approval to the issuance of any guarantee, insurance, extension of credit, or participation in the extension of credit in connection with the export of any goods or services to the foreign person.</text></paragraph><paragraph id="id9a35b042e55747c7bafb57f399e4b2ff"><enum>(2)</enum><header>Export sanction</header><text>The President may order the United States Government not to issue any specific license and not to grant any other specific permission or authority to export any goods or technology to the foreign person under—</text><subparagraph id="id03ae674858c949a6849e8e3cbe8be87a"><enum>(A)</enum><text>the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>);</text></subparagraph><subparagraph id="id004a45de25cf415f88428d52cad321f2"><enum>(B)</enum><text>the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>);</text></subparagraph><subparagraph id="id36462b1c35a34545b1a886a116d26ed1"><enum>(C)</enum><text>the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>); or</text></subparagraph><subparagraph id="id1683ca4193ce45b8bab929453abc0871"><enum>(D)</enum><text>any other statute that requires the prior review and approval of the United States Government as a condition for the export or reexport of goods or services.</text></subparagraph></paragraph><paragraph id="id1266c2b6af6a41dbbd14f7e8a1e83f5e"><enum>(3)</enum><header>Loans from united states financial institutions</header><text>The President may prohibit any United States financial institution from making loans or providing credits to the foreign person totaling more than $10,000,000 in any 12-month period. </text></paragraph><paragraph id="id5ffd806b2e9d43d7a247f881fb5098d7"><enum>(4)</enum><header>Blocking of property of identified persons</header><text>The President may exercise all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph></subsection><subsection id="id48a119be412840d798dd256b536be9ca"><enum>(c)</enum><header>Implementation; penalties</header><paragraph id="idb7ac6f32e5f646a889ce1ad0047133c3"><enum>(1)</enum><header>Implementation</header><text>The President may exercise the authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to the extent necessary to carry out this section.</text></paragraph><paragraph id="idecf7ae7cfd714c16ac31b2c99c07d035"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></paragraph></subsection><subsection id="id4416bc3d80494723aa3ba9171042b9fc"><enum>(d)</enum><header>Exceptions</header><paragraph id="id831cada51fe543c488f9ae3a08bd2f4b"><enum>(1)</enum><header>Exception for intelligence activities</header><text>Sanctions under this section shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></paragraph><paragraph id="ide559d8b73f164d58aa24c4e30c18a42b"><enum>(2)</enum><header>Exception relating to importation of goods</header><subparagraph id="idd92c0e8ce2ea452e9ed8cd950a22c8d4"><enum>(A)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id32edca33d4a14724a8799263ef2eb965"><enum>(B)</enum><header>Good defined</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data. </text></subparagraph></paragraph></subsection><subsection id="id5B9E5B25D3A54D31930D40F908492BF0"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id4fb6c5afb6c044aba6aede26688365be"><enum>(1)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person.</text></paragraph><paragraph id="id4341711e73cc4e6ba5d9ff459546f457"><enum>(2)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="iddadda78ec7ca4aa0939cacea97c84e2c"><enum>(A)</enum><text>an individual who is a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="id187592d02a224bffa1d37999c2471e08"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="id0ee0edaece5d4069ae538d22ab6ad33d"><enum>(C)</enum><text>any person in the United States. </text></subparagraph></paragraph></subsection></section><section id="id11f0d9cfd8af477d91a82f5289a3e434"><enum>11.</enum><header>Repeal of exception to sanctions with respect to energy, shipping, and shipbuilding sectors of Iran relating to Afghanistan reconstruction</header><text display-inline="no-display-inline">Subsection (f) of section 1244 of the Iran Freedom and Counter-Proliferation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/22/8803">22 U.S.C. 8803</external-xref>) is repealed. </text></section><section id="id6115e9be4e0d49ccbe5a988995b13a8a" commented="no"><enum>12.</enum><header>Limitation on humanitarian assistance that could benefit foreign terrorist organizations</header><subsection commented="no" id="idA7D3431AD39C46F9A2E7D9055DE9CF15"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Before obligating funds described in subsection (b) for assistance in or for Afghanistan and Pakistan or any other country in which organizations designated by the Secretary of State as foreign terrorist organizations under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>) hold territory or wield substantial economic or political power, the Administrator of the United States Agency for International Development shall take all appropriate steps to ensure that such assistance is not provided to or through—</text><paragraph commented="no" id="id2D6440251F8D41819F6ADDB806A8EFBC"><enum>(1)</enum><text display-inline="yes-display-inline">any individual, private or government entity, or educational institution that the Secretary knows, or has reason to believe, advocates, plans, sponsors, engages in, or has engaged in, terrorist activity; or</text></paragraph><paragraph commented="no" id="id4132CDBDC25F45E0A09507CB7B64445B"><enum>(2)</enum><text display-inline="yes-display-inline">any private entity or educational institution that has, as a principal officer or member of the governing board or governing board of trustees of the entity or institution, any individual who has been determined to be—</text><subparagraph commented="no" id="id0DAD966D7F3B464D99DC36AE27830C44"><enum>(A)</enum><text display-inline="yes-display-inline">involved in or advocating terrorist activity; or </text></subparagraph><subparagraph commented="no" id="idFA6A66DA5908406FA12809FB9299143B"><enum>(B)</enum><text display-inline="yes-display-inline">a member of a foreign terrorist organization. </text></subparagraph></paragraph></subsection><subsection commented="no" id="id3572FAA1935B4F2B8E86919C87CE87E5"><enum>(b)</enum><header>Funds described</header><text>Funds described in this subsection are funds appropriated under the heading <quote>Economic Support Fund</quote>, <quote>Development Assistance</quote>, <quote>Global Health</quote>, <quote>Transition Initiatives</quote>, or <quote>International Humanitarian Assistance</quote> in an Act making appropriations for the Department of State, foreign operations, and related programs or making supplemental appropriations.</text></subsection><subsection commented="no" id="id9B343AE8A23A46F490550E62A7DAB1EA"><enum>(c)</enum><header>Implementation</header><paragraph commented="no" id="idFE20A56BDE76417281DEC0F3A17DB9DA"><enum>(1)</enum><header>In general</header><text>The Administrator of the United States Agency for International Development shall, as appropriate—</text><subparagraph commented="no" id="idC2B0F1EB43D94908BA3CC521C8BA44F0"><enum>(A)</enum><text>establish procedures to specify the steps to be taken in carrying out subsection (a); and </text></subparagraph><subparagraph commented="no" id="idCC1694062E5A45FBBC544F8E8A3AC147"><enum>(B)</enum><text>terminate assistance—</text><clause commented="no" id="id2B1CFCF7B6F0498AB0665D579B1E3A4E"><enum>(i)</enum><text>to any individual, entity, or educational institution that the Secretary has determined to be involved in or advocating terrorist activity; or </text></clause><clause commented="no" id="id10A12424831740D695D63A61925B2505"><enum>(ii)</enum><text>that could benefit such an individual, entity, or educational institution.</text></clause></subparagraph></paragraph><paragraph id="idC663BFE4DDA24C10A2EB5C2013A803A3" commented="no"><enum>(2)</enum><header>Inclusion of certain entities</header><text>In establishing procedures under paragraph (1)(A) with respect to steps to be taken to ensure that assistance is not provided to individuals, entities, or institutions described in subsection (a), the Administrator shall ensure that the recipients and subrecipients of assistance from the United States Agency for International Development and their contractors and subcontractors are included.</text></paragraph></subsection></section><section id="idF7DDB80C3B3A443687D1E478A7D70092" commented="no"><enum>13.</enum><header>Restriction on foreign assistance to countries in which coups d'état have occurred</header><subsection commented="no" id="id39CAE62C0FAE43C6AE222643066CCF26"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">None of the funds appropriated or otherwise made available pursuant to an Act making appropriations for the Department of State, foreign operations, and related programs or making supplemental appropriations may be obligated or expended to finance directly any assistance to the government of any country whose duly elected head of government is deposed by military coup d'état or decree or, after the date of the enactment of this Act, a coup d'état or decree in which the military plays a decisive role.</text></subsection><subsection commented="no" id="idDB747E0477984A348A077FB8B7ED8BA4"><enum>(b)</enum><header>Resumption of assistance</header><text display-inline="yes-display-inline">Assistance described in subsection (a) may be resumed to a government described in that subsection if the Secretary of State certifies and reports to Congress that, subsequent to the termination of such assistance, a democratically elected government has taken office.</text></subsection><subsection commented="no" id="id8612111B652C497C869239A3B7B82295"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">The prohibition under subsection (a) shall not apply to assistance to promote democratic elections or public participation in democratic processes.</text></subsection><subsection commented="no" id="id9CAC81448EA24AEBB3E985F572B76CEC"><enum>(d)</enum><header>Notification procedures</header><text display-inline="yes-display-inline">Funds made available pursuant to subsection (b) or (c) shall be subject to the regular notification procedures of the Committees on Appropriations of the Senate and the House of Representatives.</text></subsection></section></legis-body></bill>
